BACKGROUND: At the September 14, 2011 Council meeting, based on a presentation and discussion of the Comprehensive General Plan Update related to the public outreach program and issues for future works sessions, as reflected in the approved meeting minutes, City Council appointed Council Members Barth and Gaspar to the subcommittee to finalize and refine the proposed structure of the planning process schedule and to also define the composition of the stakeholders group and return to a future City Council meeting with an amended time line. The primary purpose of the stakeholder group is to gamer additional input. Based on Council direction the Subcommittee met on four occasions (10/10, 10/19, 1117 and 11128/11) to discuss a variety of available options for expanding the draft General Plan public outreach and planning process schedule. The meetings were attended by Kristin Gaspar, Teresa Barth, the City Manager and Planning staff; after the first meeting, Peder Norby, Highway 101 Corridor Coordinator, also attended. ANALYSIS: The goal of the outreach process, outlined below, is to gamer maximum review and comment on the draft document in order provide additional feedback to Council for consideration. The -Subcommittee agreed that the guiding light in the expanded outreach process shall be that all work, review and comments strive to achieve a final document that is consistent with and adheres to state and regional requirements and other legislative mandates. As part of the Commission review, GP AC outreach, ERAC review and the informational open houses, adherence to state law is necessary for a successful update. Last printed 12/ :40:00 PM

2 Last printed 12/ :40:00 PM 12/14/11 ITEM #07 2 Milestone dates/deadlines were identified in order to meet the state requirement of having an approved Housing Element by April The milestones are set fol1h in the Draft GP Update Strategic Plan Timeline (Attachment "CC-B") and include: 1) The start of the expanded public outreach and review in January 2012 with confirmation on density, land use and housing by the Council in April to June 2012; 2) The submittal of the draft Housing Element to the State Depat1ment of Housing and Community Development (HCD) by June 2012 to accommodate a 60 day review period by HCD with a number of submittals/iterations; 3) EIR preparation to begin in June 2012 upon Council direction with a draft complete in October 2012 followed by a 60 day public review period; and 4) The start of Planning Commission Public Hearings in late 2012 and City Council Public Hearings in late February The refined structure of the Comprehensive General Plan Update planning process schedule for the outreach program, as recommended by the Subcommittee, is depicted in Attachment "CC-C". The public outreach is to i'un from January to June 2012 and is comprised of four components, including Commissions review, GPAC outreach, Element Review Advisory Committee review and Informational Open Houses. The outreach program would culminate with a check-in with Council on density, land use, and housing on April 18,2012 and final confirmation on the land use approach by Council in June Commission Review - The Subcommittee, consistent with Council direction, recommends that the City'S various commissions review and comment on the draft General Plan Update document. As specified in Attachment "CC-D" regarding Commission Review, the Commissions would review the draft document and provide comments to the Planning Commission. The Planning Commission would then review the comments from the various commissions and provide additional comments for consideration by the City Council. All meetings are open to the public to provide comments. City Council will ultimately provide direction to staff to consider patticular issues that would modify the draft General Plan. As specified in the Commission Review Summary (Attachment "CC-D"), general topic areas, goal sections, or elements are suggested for review by each commission in relation to the purview of the commission, however, the commissions are able to weigh in on other topic areas if they so desire. General Plan Advisory Committee (GPAC) - The GPAC would be utilized for public outreach through the implementation of tool kit meetings. The tool kit format would be revised to reflect the draft General Plan document and the status of the CGPU process; those members wanting to participate in the tool kit effort would attend a training session and then the results of the tool kit effort would be presented to City Council for consideration Element Review AdvisOlY Committee ferac) - The Subcommittee recommends the establishment of the ERAC as the new stakeholder group involved in the expanded public review of the draft General Plan Update. The by-laws of the ERAC are included in Resolution No. 20 II-57 which

As proposed by the Subcommittee, the ERAC would consist of 23 members who hold a variety of background interests. In order to allow for "more eyes" on the document, to be eligible to serve on the ERAC, the applicant can not be cuitently seated on a City commission or on the GPAC. In order to keep the process on track, an appointment process is suggested by the Subcommittee. The Subcommittee would review the applications and make recommendations to the full Council for review and approval. As proposed, the application process would start immediately following Council authorization to proceed, with the application deadline slated for January 11, The Subcommittee would review the applications on January 17, 2012 and forward their recommendation to Council for consideration and approval on January 25, This would enable the ERAC to initiate meetings in February. A description of the appointment process for the ERAC is included herein as Attachment "CC-E". The Subcommittee recommends that the ERAC review all elements of the draft General Plan and provide comments. In order to meet the milestone deadlines, the ERAC will be asked to initially review the Land Use and Housing Elements followed by review of all the other remaining elements. The ERAC members are also expected to attend at least one General Plan Update informational open house, which are also proposed as part of the expanded outreach process. The findings from the ERAC meetings will be transmitted to the City Council for review and consideration. The ERAC will work on a consensus basis, with no voting members or formal chair. While remaining neutral, a facilitator would be utilized to manage the meeting, respond to inquiries or points raised, and keep the meeting on time. The Subcommittee recommends that Peder Norby, the Highway 10 1 Corridor Coordinator, be the facilitator for the ERAC meetings. Mr. Norby has served as the facilitator for a number of issues or plans previously under consideration by the City. A brief summary of his background is included in Attachment "CC-G". Informational Open Houses - The bulk of proposed changes under the CGPU draft relate to the New Encinitas area. Therefore, it is recommended that two open houses be held in the New Encinitas area; however, all are welcome and encouraged to attend the event. In order to maximize attendance oppoltunities, staff is looking into scheduling two week night events, one at Flora Vista and one at Park Dale Lane Elementary School, and is also considering a Saturday event at the San Diego County Credit Union. The purpose of these meetings is to provide additional outreach and input. FISCAL AND STAFF IMPACTS: The informational open houses will be staffed by Planning Department staff and will not require additional service costs from the project consultant as maps, exhibits and informational materials from previous workshops will be utilized. Upon approval, the ERAC meetings will be facilitated and staffed by Peder Norby and Planning Department staff, which will not require additional costs to the project budget. RECOMMENDATION: Direct staff to move forward with implementation of the refined structure of the Comprehensive General Plan Update outreach and planning process schedule, as recommended by the Subcommittee, and adopt Resolution No to form the Element Review Advisory Committee (ERAC) and establish the by-laws.

6 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS FORMING THE ELEMENT REVIEW ADVISORY COMMITTEE AS PART OF THE COMPREHENSIVE GENERAL PLAN UPDATE PROCESS AND ESTABLISHING THE BY LAWS OF THE COMMITTEE WHEREAS, after incorporation in October 1986, the City's first General Plan was adopted on March 29, 1986; WHEREAS, the City has never completed a comprehensive or major overhaul of the General Plan and the existing document requires a thorough review and comprehensive update; WHEREAS, on September 10, 2008, the City Council discussed the need to update the City of Encinitas General Plan and reviewed and discussed the preliminary scope related to the work program; WHEREAS, on December 14, 2011 the City Council discussed the refined structure of the CGPU outreach and planning process schedule related to the draft document General Plan document that was formally released for public review on September 1,20 11; WHEREAS, the expanded outreach program for the CGPU work program includes the formation of an Element Review Advisory Committee and the City Council has received and reviewed General Plan Council Subcommittee recommendations to initiate the process to form the committee; WHEREAS, the Element Review Advisory Committee is intended to review all elements of the draft General Plan document and provide comment and feedback to the City Council; and WHEREAS, procedures relating to the formation and operation of the Element Review Advisory Committee are defined by Section 15378(b) of Title 14 of the California Code of Regulations as administrative procedures not subject to the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the CityCouncil does hereby resolve as follows: 1. That the above recitations are true and correct. 2. That the City Council approves the formation of the Element Review Advisory Committee subject to the Committee by-laws and rules of procedure which are attached hereto as Exhibit "A" and incorporated by reference and are hereby approved. ERAC Objective or Mission Statement: The Ad Hoc ERAC is established to review all elements of the draft General Plan and provide comments consistent with adhering to state and regional requirements and other legislative mandates. The ERAC will be asked to initially review the Land Use and Housing Elements and followed by review of all the other remaining elements. Some of the state and regional requirements include: The findings from these ERAC meetings will be transmitted to the City Council for review and consideration. The added role of the committee members is also to serve as a conduit of information and help raise public awareness to keep community members fully engaged in the public review process. Where possible the ERAC members should be willing to talk to others and share information. 2. ERAC Primary Function: The Ad Hoc ERAC is created for the purpose of providing effecti ve feedback on draft General Plan policies. Initially, the ERAC will be asked to review the goals and policies of the Land Use and Community Development Element and the Housing Element. Then the ERAC will review all other elements of the draft General Plan (i.e. Circulation, Parks, Recreation and Public Facilities, Resource Management, Public Safety, Public Health, and Noise Elements). The ERAC has no legal identity as part of the city's organizational structure, nor do they possess any statutory powers. The committee will operate on a consensus basis. By serving on the ERAC, members agree to invest time beyond their attendance at ERAC meetings. Members also agree to construct and design effective, creative and innovative ways of raising public awareness AND facilitate its implementation to receive additional feedback.

The ERAC will establish additional meeting dates and an agenda schedule to review the remaining elements (i.e. Circulation, Parks, Recreation and Public Facilities, Resource Management, Public Safety, Public Health, and Noise Elements) with reports and recommendations to Council. Meeting dates will also occur on Saturdays and/or weekday evenings and could occur from April through July. 5, Ground Rules: A. The ERAC shall, at the first regular meeting, review and discuss ground rules about protocol and the manner in which members should conduct themselves. The committee is also expected to discuss member roles and responsibilities, as well as complete other organizational, schedule and introductory tasks. B. Background information on state law shall be provided. C. The ERAC meetings will be facilitated with no chair. However, a facilitator will be utilized to help the ERAC understand common objectives, to be responsible for regular

The facilitator is to remain neutral and is not to take a position on an issue of discussion. The facilitator will manage the meeting, maintain order, respond to inquiries or points raised, and keep the meeting on time in order to complete the agenda items. D. Facilitator will handle all communication with the City, and will be responsible for organizing meeting agendas and other ERAC tasks, research and activities. (See the liaison section below.) E. Each ERAC member is expected to participate in all ERAC meetings to conduct business and move work plan tasks forward. It is recognized that members may miss an occasional meeting which is acceptable. The emphasis is on active participation and contribution in some form. F. City Council will consider filling any vacancy occurring between the first and last day of a committee member's term based on the recommendations of the ERAC. G. The ERAC shall accept input from the individual members either in writing or verbally for review and discussion. The facilitator will document these communications and forward copies of all correspondences to the City for the administrative record and for distribution to the ERAe. H. ERAC members should be prepared to contribute to discussions and consensus building. From time to time, assignments may be given to members to become familiar with the issues surrounding the community. Members may also be asked to research issues and review documents in order to prepare for upcoming meetings and/or participation on subcommittees. l. ERAC members are expected to attend at least one General Plan Update informational open house to be scheduled in February J. In order to maintain a neutral role the facilitator will not meet individually with ERAC members. K. At their discretion, the City Council may expand the duties and responsibilities of the ERAe and any other ERAC ad hoc subcommittee. L. ERAC will report directly to Council. 6. Public Comment: 15 minutes shall be set aside at the beginning of each agenda for the public to comment and address the committee on any matter under its purview. If necessary, any time left at the end of the meeting may be utilized for additional public comment. It is important to note that the ERAC is solely an advisory committee to the City Council and is not a public hearing body. Significant public input and outreach for the General Plan Update will be provided through meetings with commissions, public hearings, and written correspondence.

11 7. Location: Unless otherwise stated, regular meetings of the committee shall be held in the Banquet Hall at the Community and Senior Center (1140 Oakcrest Park Drive, Encinitas, CA 92024). 8. Compensation: The members of the Element Review Advisory Committee shall serve without compensation. 9. Liaison: The Planning and Building Department shall serve as a resource to the ERAC. Staff will provide support to the facilitator to develop agendas and summary minutes based on ERAC direction/discussion. Staff will advise the committee on background information, state law, and the like. All documents will be distributed through the facilitator to ensure that all members have the same information. In the event that there is information that should be shared with other committee members, the information should be given to the facilitator for timely distribution to the entire committee. 10. Communications with the Media: ERAC members agree not to characterize their personal viewpoints as representative of the entire committee when contacted by the media. Members agree not to use the media to unilaterally influence the process. Should members speak to the media, members are encouraged to provide accurate, factual information to inform the public about the program, but are asked to refrain from speaking on behalf of the committee unless authorized by the committee to do so. City staff will be available to assist in any communications to the media, if desired. 11. Changes: The provisions of the By-laws may be changed, amended, or repealed by the City Council at any time, within the limitations imposed by the Brown Act 12. Expectations for ERAC Members Dul'ing Meetings: Members agree to make a good faith effort to attend each scheduled meeting of the ERAC as well as other General Plan Update public events/activities. If unable to attend, a member may send an alternate from their organization to serve as a proxy. The alternate is encouraged to actively participate in the meeting provided that he or she is adequately briefed as to the status of prior discussions and direction. During meetings, Element Review Advisory Committee members are expected to: A. Turn cell phones and other communication items off. B. Be courteous and listen while others are speaking. Treat others in the group the way that you would like to be treated. Make an effort to understand each other's position. C. Address the facilitator and members of the ERAC, rather than the public, in a manner that allows the group to hear your comments. Members shall speak one at a time. 12 spoken once during a round of discussion, allow others to contribute before providing additional input. D. Build on collaboration and provide constructive feedback to the facilitator and group. Keep an open mind and be interested in finding areas of understanding and/or agreement. E. Participate actively, review documents by agreed upon deadlines, and adhere to the Comprehensive General Plan Update work program schedule established for the committee. F. Use the various tools to share information with and, as appropriate, request feedback from your constituency group. A schedule of specific outreach activities will be developed for the Advisory Committee during the regular meetings and through communications with the facilitator. G. Maintain a positive outlook. This, along with providing constructive feedback, maintaining an open mind, and finding areas of understanding and agreement, will help the facilitator to run the meetings with positive results. 13. Planning Commission Function: During the draft General Plan update public review period, the Planning Commission will review issues and concerns from the other City commissions (Senior, Art, Youth, Parks and Recreation, Environmental, and Traffic), and provide additional comments. The Planning Commission will not filter or dismiss comments received during the public review period. Ultimately, the Planning Commission will hold a series of formal public hearings and have a chance to weigh in on the project by providing a recommendation to the City Council. This step will occur after the completion of the public review period for environmental documentation. 14. City Council Function: As the legislative body for the city, City Council has the ultimate approval in the General Plan Update process. The City Council specifically reserves its role as the primary policy making body and will ultimately conduct public hearings on the subject matter. During the public review period, the City Council will serve an important role in reviewing the comments of the ERAC, the various city commissions, Planning Commission and the GPAC and will provide direction to staff to consider particular issues in the update's planning and environmental documentation process. City Council will also review all public comments received on the project during this period. 18 Commission Review November 30, 2012 During the draft General Plan update public review period the City's various commissions will review and comment on the draft document. As specified below the Senior Commission, Art Commission, Youth Commission, Parks and Recreation Commission, Environmental Commission and Traffic Commission will review the document and provide comment to the Planning Commission for consideration. The Planning Commission will review issues and concerns from other city commissions and provide additional comments for consideration by the City Council. City Council will ultimately provide direction to staff to consider particular issues that would modify the draft General Plan. The goal is to obtain City Council confirmation on the plan approach on density, land use and housing issues by June The following list of goals (et. seq. policies) is intended to help facilitate commission review. General topic areas, goal sections, or elements are suggested for review by each commission in relation to their purview; however, commission members may also want to weigh in on other topic areas. The focus is initially on land use and housing policy review to meet the overall schedule. The first check in with City Council on land use and housing issues is tentatively scheduled on April 18,2012. 23 12/14/11 ITEM #07 23 Element Review Advisory Committee (ERAC) Appointment Process November 30, 2011 Due to the amount of initial feedback generated during the initial Draft General Plan public comment period, an Element Review Advisory Committee (ERAC) will be organized to review each element of the draft General Plan with a "fresh set of eyes" and focus members on their knowledge or interest areas. This committee is in addition to other methods of soliciting additional feedback on the draft General Plan Update. 1. Establishing the Method of Appointment of Members Initiate ERAC appointment process with notifications and advertisements in mid December. One month application period; deadline of January 11, 2012 by 6pm. Subcommittee review of applications in accordance with Council approved resolution/direction and make recommendations to the full Council for review and approval. Council meeting on January 25,2012 for final consideration and approval. 2. Advertising and Informing the Community about the Process and Opportunity E-alert and CGPU notification system. Maintain an ERAC section on the General Plan Update website that includes the application and the Council report/resolution. Send application information to local service groups, merchants and community organizations. Provide press releases to local media outlets. 27 12/14/11 ITEM #07 27 Background Summary Of Peder Norby Below is some basic information regarding the experience of Pedcr Norby, Highway 10 I Corridor Coordinator, in facilitation and the San Diego County General Plan work project. Mr. Norby has served the past three years as a San Diego County Planning Commissioner. During this time the County of San Diego processed and approved their General Plan. The San Diego Planning Commission played an important role in the completion of 26 community maps and adoption of the San Diego County General Plan. Mr. Norby is a SOl Certified Facilitator. SOl is a facilitation methodology and a suite of products that is used by SOl certified facilitators working with companies and government worldwide. The following link is a partial list of clients that use the SOl methodology 0 f facili tation. php/cl icnts/clientlist#gov Mr. Norby has facilitated over 20 diverse groups primarily in conflict resolution and preparation of strategic planning documents. In Encinitas, Mr. Norby has facilitated the Cardiff-by-the-Sea Specific Plan Area Review Committee (CSPARC), during a nine month long, weekly meeting schedule. This effort culminated in the council adoption of the "Cardiff-by-the-Sea Specific Plan". Additionally, Mr. Norby facilitated the Underground Utility workshop series. This effort resulted in changes and refinements to the City of Encinitas underground utilities policy.
