The selected corridor means the road section from Ja-Ela to Chilaw on National Highway A003 in Sri Lanka. Delay in signing the Financing Agreement - A meeting was held with the Prime Minister where direction was given to the Attorney General (AG) instructing him to resolve the issue with respect to the FA within 3 weeks from July 3, AG has raised objections on the belief that an "operation" as envisaged under an expressway cannot be carried out within the road section to be financed under TCAMP as it is a non-user fee highway which is contrary to the National Thoroughfares act no 40 of It has been repeatedly pointed out to the AG that an "operation" as carried out within an expressway is not envisaged under this project and therefore the contractor will not infringe upon the right and responsibilities of other institutions. Hence, no amendments to the National Thoroughfares act is necessary. The AG's comments received via letter dated June 22, 2017 had requested deletion of references to "OPRC". At a subsequent meeting with the AG's department the team together with the Country Director has explained that this project was proposed to address critical issues that the road sector is facing today and that the Bank will pilot the project with the use of output and performance based contracts as it would otherwise not benefit the country. The agreement was reached with the AG's department that they will revert back having reviewed the contract clauses in the actual bid document to understand that they are in conformity with the FA. Further to this agreement, the AG's department has had discussions with the RDA and External Resources Department and have indicated that they are in agreement of the proposed methodology. 2. Project Restructuring: The team is currently awaiting the confirmation from the AG's department on the suitability of the amendments to the FA and the request from the External Resources Department for the restructuring of the Project. Accordingly, the project will need to be made effective before September 9, Safeguards - The project was approved based on TCAMP being approved as a "specified project" under the 2013 regulations to the land acquisition act that allows the project to meet the Bank's safeguards requirements without any gaps. A legal review was also carried out in order to assess the options that can be pursued by the project in seeking the specified status. The review identified two short term options that included seeking specific cabinet approval for TCAMP for its own entitlement matrix or seeking specified status. At the time of seeking approval of the cabinet of Ministers again, there have been several objections to this status being granted to TCAMP as there were several other projects seeking same status. Finally, the Ministry of Land has been requested to review the process and propose a standardized process that could be adopted for several projects awaiting such clearance. The RDA however is in the process of revising the RAP where the entitlement matrix for this project would be based on the 2008 regulations with the gap between the 2008 regulation and the Banks safeguards policies will be addressed through an alternative mechanism. 4. Finalization of the Bid Documents - There have been several rounds of discussions in refining the bid documents which has also been issued by the ADB project. The team has sought RPM clearance to issue the bid documents for information with a view to refining the suitability of the contract conditions to the market as it is being carried out as a pilot and the market is unknown. 5. Overall Implementation - The implementation of other components such as the operationalization of the asset system, formulation of the road policy, user satisfaction survey etc. are being carried out and the key positions within the PMU has been filled.
