Hillsborough County City-County Planning Commission 601 E Kennedy Blvd., 18 th floor, Tampa, Florida theplanningcommission.org EXECUTIVE SUMMARY Meeting Date: December 14, Briefing Agenda Item: CPA CIE Text Amendment Presenter: T. Gonzalez, Ext. 320 Action Necessary: No SUMMARY: Planning Commission staff is requesting a text amendment to the Capital Improvements Element (CIE) of the Comprehensive Plan. Pursuant to Section (3)(a)4. and 5. of the Florida Statutes, the CIE schedule of capital improvement projects must be updated on an annual basis and include all federal, state and local projects that affect levels of service. To date, the County has complied with state law by incorporating each relevant agency s list of projects in each annual update of the capital improvement schedule. Recent guidance by the Department of Economic Opportunity (DEO) now allows local jurisdictions to incorporate these project lists by reference in the Comprehensive Plan, thereby eliminating the need to include each project list for the relevant agencies. This staff-initiated text amendment would incorporate by reference the Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County School District s Public Schools Facilities Work Program. This amendment will ensure that projects listed in the TIP, TDP, and Public Schools Facilities Work Program remain consistent with the Comprehensive Plan, as required by law, while reducing the size and complexity of the Comprehensive Plan. RECOMMENDATION: This item is for your information only. No action is required. ATTACHMENTS: Amendment summary.
Capital Improvements Element Text Amendment Planning Commission Briefing: December 14, 2015 Application type Publicly initiated Proposed Text Amendment CIE Policy 3.D: The Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County Public Schools Facilities Work Program are incorporated by reference into the Capital Improvements Element of the Comprehensive Plan, except as expressly excluded during the annual adoption of the Schedule of Projects. The County is not financially responsible for those capital projects which are funded, maintained and/or under the control of other agencies or jurisdictions. Policy 8.3: The County adopts by reference the schedule of capacity improvements approved by the School Board annually, that includes school capacity sufficient to meet anticipated student demands projected by the County and municipalities, in consultation with the School Board s projections of student enrollment, based on the adopted level of service standards for public schools. The 5-year schedule of improvements ensures the level of service standards for public schools are achieved and maintained within the period covered by the 5-year schedule and are shown in Table 7 of this element. Policy 8.5: By December 1st of each year, the County shall amend Table 7 in the Capital Improvements Element to update the five year work program approved by the School Board to add planned facilities and funding sources that will ensure a financially feasible capital improvements program and to ensure level of service standards will be achieved by the end of the five year period. Purpose The staff of the Planning Commission is requesting an amendment to the Capital Improvements Element of the Comprehensive Plan to incorporate by reference the Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County Public Schools Facilities Work Program to obtain consistency between the plans, as required by law. Agency Review Comments Applicable Plan Sections The School Board recommended updates to Policy 8.3 and 8.5 for consistency with the proposed new Policy 3.D. Staff Planner Tatiana Gonzalez Capital Improvements Element (CIE)
Staff Recommendation TBD Practical Impacts The proposed amendment would ensure that capital projects listed in the TIP, TDP, and Public Schools Facilities Work Program remain consistent with the Comprehensive Plan, as required by law. 6 Tatiana Gonzalez From: Amber Wheeler Sent: Tuesday, November 17, :15 AM To: Tatiana Gonzalez Subject: Re: CPA Good Morning, Thank you for the staff report, it helps to clarify. I agree that adopting by reference is a better way to go. However, I was looking through the adopted CIE online, and I was wondering if the policies below should be update as well for consistency. Policy 8.3: The County adopts the schedule of capacity improvements approved by the School Board annually, that includes school capacity sufficient to meet anticipated student demands projected by the County and municipalities, in consultation with the School Board s projections of student enrollment, based on the adopted level of service standards for public schools. The 5 year schedule of improvements ensures the level of service standards for public schools are achieved and maintained within the period covered by the 5 year schedule and are shown in Table 7 of this element. Policy 8.5: By December 1st of each year, the County shall amend Table 7_ in the Capital Improvements Element to update the five year work program approved by the School Board to add planned facilities and funding sources that will ensure a financially feasible capital improvements program and to ensure level of service standards will be achieved by the end of the five year period. Yes, I'm looking forward to the tour too! I can't believe how many RSVP"s I received, so it better be good. :) Amber K. 7 Memorandum TO: FROM: Yeneka Mills, Community Planner Hillsborough County City-County Planning Commission Linda Walker, Planner II Hillsborough Area Regional Transit Authority (HART) DATE: November 24, 2015 RE: CPA Capital Improvement Element Text Amendment HART staff has reviewed the plan amendment request to the Capital Improvement Element to ensure that projects listed in the Metropolitan Planning Organization s (MPO) Transportation Improvement Plan, Hillsborough Area Regional Transit Authority s (HART) Transit Development Plan and the Hillsborough County Public Schools Facilities Work Program will remain consistent with the Comprehensive Plan as required by law. HART has no objection to the proposed change if the schedule of capacity improvements approved by the School Board will go through the formal review process prior to the County adoption by reference. This will ensure a more comprehensive assessment for road capacity, sidewalks and impacts of peak period commuting delays when determining the needs for new schools.
RICK SCOTT GOVERNOR Florida Department of Transportation N. McKinley Drive Tampa, Florida November 25, 2015 JIM BOXOLD SECRETARY Ms. Yeneka Mills, Community Planner II The Planning Commission 601 East Kennedy Boulevard, 18 th Floor Tampa, FL Re: Hillsborough County Proposed Amendment: October 2015 Submittal Cursory Review (CPA 15-12, -13, -14, -15) Dear Ms. Mills: We have reviewed the County initiated Comprehensive Plan (the Plan) Amendment October 2015 Submittal according to Chapter 163, Florida Statutes, and our review guidelines. The Department is providing the following cursory assessment. Background: With an estimated 2010 population of 832,340 (County estimate), unincorporated Hillsborough County is 909 square miles in size. Land uses with large amounts of acreage include residential, agricultural, public/quasi-public and commercial. The cities of Tampa, Temple Terrace and Plant City are located within Hillsborough County. Numerous federal and state facilities traverse the county, including I-4, I-75, I- 275, US 41, US 92, US 301, SR 60, SR 574, SR 580, and SR 589. Proposal: The County is proposing two land use plan amendments, both of them to greater intensities, and two text amendments. The table below summarizes all four as they relate to transportation facilities of state importance within three miles of the subject property. CPA Acres Comprehensive Plan Change N/A Updates Public Schools Facilities Section LI to RMU-35 on Hillsborough Avenue east of Race Track Road. Significant Change The primary substantive change to this Section is the revision of policies that deal with the annual School Board reporting and review process instituted by the ILA. Adds 35 units per acre residential development; adds regional scale retail commercial, business park and research park uses; increases allowable size from.5 FAR to 2.0 FAR. N/A Deficient Important State Roads 1 None
Ms. Yeneka Mills November 25, 2015 Page 2 CPA Acres Comprehensive Plan Change N/A Adds a new CIE Policy RES-4 to RES-9 at Tall Cedar Drive. Significant Change CIE Policy 1.E.2.J: The Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP), and the Hillsborough County Public Schools Facilities Work Program are incorporated by reference into the Capital Improvements Element of the Comprehensive Plan, except as expressly excluded during the annual adoption of the Schedule of Projects. The County is not financially responsible for those capital projects which are funded, maintained and/or under the control of other agencies or jurisdictions. Adds 5 units per acre residential development; increases scale to urban; increases FAR to.50. N/A Deficient Important State Roads 1 I-275, SR 678 (Bearss Ave. between Florida and Nebraska), SR 597, SR 579 (Fletcher Ave. between Florida and Nebraska) 1 Within three miles of subject parcel; based on 2013 Q/LOS Handbook Generalized Tables. Comments: Although as a matter of course, all amendments should be analyzed for transportation impacts on all significant roads, the Department strongly recommends such for CPA Such analyses should consider the highest and best uses as they relate to trip generation rates. Thank you for the opportunity to provide an initial review of this amendment. Should you have any questions please do not hesitate to contact me at or jeffery.dow@dot.state.fl.us. Please allow this memo to replace the original one dated November 25, 2015, as it makes a correction to the text. Development Services offers the following comments: The text amendment to the Capital Improvements Element (CIE) adopts by reference, in their entirety, the MPO Transportation Improvement Program (TIP), the Hillsborough Area Regional Transit Authority Transit Development Plan (TOP), and the Hillsborough County Public Schools Facilities Work Program. Section (3)(a) Florida Statutes requires that the 5 year schedule of capital improvements include "applicable'' transportation improvements listed in the MPO TIP "to the extent that such improvements are relied upon to ensure concurrency and financial feasibility." It should be noted that the statute neither requires such plans to be adopted in their entirety, nor does it require projects that are operational, maintenance, unfunded, or "vision" projects to be adopted in the Capital Improvements Element (CIE) or 5-year Capital Improvement Program (ClP). The LRTP TLP already includes HART~s funded priorities for the next 5 years. The Capital Improvement Element and 5 year CIP do not have to include the unfunded items identified in the 10 year "vision" section of the TOP, particularly when such projects are dependent on funding sources that have not been approved. Development Services statt recommends that the text be amended to only include capital projects that meet level of service standards, consistent with the intent of Section (3)(a) Florida Statutes, instead of incorporating the entire documents by reference. If you have any questions, please contact Matt Lewis, our Project Manager for comprehensive plan amendment reviews, by telephone at (813) or by at lewism@hillsboroughcounty.org. Thank you. www.
