1 AmBank 1% Cash Back on Overseas Spend and Air Conversion Campaign Terms and Conditions The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad ( U) (collectively referred to as the Bank ) relevant credit card agreement(s) (collectively referred to as Cardholder Agreement ) which govern the use of the credit card/i issued by the Bank. In the event of any discrepancy or inconsistency between these Terms and Conditions and the Cardholder Agreement, these Terms and Conditions shall prevail in so far as it relates to the Campaign. Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardholder Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardholder Agreement. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and viceversa. Words importing the masculine gender shall include the feminine and neuter gender. Campaign 1. The Campaign means 1% Cash Back on Overseas Spend and Air Conversion Campaign organised by the Bank in accordance with the Terms and Conditions as herein stipulated. Campaign Duration 2. The Campaign is from 15 September 2017 to 15 March 2018, both dates inclusive ( Campaign Duration ) or such other Duration(s) as may be determined at the sole and absolute discretion of the Bank with prior notice of at least five (5) calendar days. Eligibility 3. Eligible Cardholders means customers of the Bank who receive an invitation via Short Message Service ( Invitation SMS ) or an ( Invitation ) from the Bank to participate in this Campaign and having a Principal Credit Card/i ( Card ) during the Campaign Duration as herein described but do not include:- (a) cardholders of debit card(s), prepaid card(s), corporate card(s), commercial card(s), or insurance card(s) issued by the Bank; and/or (b) cardholders whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during and up till twelve (12) weeks after expiry of the Campaign Duration. 4. For the avoidance of doubt, this Campaign does not require any registration for participation and that all related Cards of Eligible Cardholders including his/her supplementary Cards(s) shall be automatically tracked for purposes of tabulation of the Eligible Transactions and/or Eligible Conversions throughout the Campaign Duration. Eligible Transaction and 1% Cash Back 5. Subject to the Terms and Conditions hereinafter appearing, all Eligible Cardholders who use their Card to perform retail transaction(s) in foreign currency (aside from Ringgit Malaysia) and Page 1 of 5 AmBank 1% Cash Back on Overseas Spend and Air Conversion Campaign
2 overseas (outside of Malaysia) will be eligible for 1% Cash Back ( Cash Back ) as recorded in the Bank s system ( Eligible Overseas Transaction ). 6. In addition, for retail transactions in foreign currency but transacted in Malaysia ( Eligible Online Transaction ), only the following retail transactions by Merchant Category Code (MCC) are eligible for Cash Back: Retail Transaction Categories Airlines Hotel Travel Examples of Merchants Airlines / Air Carriers ie: Malaysia Airlines, AirAsia, Singapore Airlines, Cathay Pacific, THAI Airways Lodging includes Hotels, Motels, Resorts, Central Reservation Services ie: Sofitel, Tune Hotels Travel Agencies, Tour Operations, Online Travel Agencies, Travel Related Arrangements Services, ie: Holiday Tours, Trafalgar Tours, Agoda, Expedia MCC 3000 to 3299, to 3999, , The assignment of MCC for each merchant is subject to classification by the respective merchants acquiring banks ( Merchant Acquiring Bank ) and it is the responsibility of the relevant Merchant Acquiring Bank to assign the correct MCC. The Bank is not responsible for nor does the Bank have any control whatsoever on any incorrect and/or inconsistent assignment of MCC by the relevant Merchant Acquiring Bank that may result in the Eligible Cardholder being omitted from the Cash Back entitlement. 8. Eligible Overseas Transaction and Eligible Online Transaction (both to be defined as Eligible Transaction ) affected by Eligible Cardholders shall enable him/her to receive 1% Cash Back on its respective transaction amount with a cap of RM200 per Eligible Cardholder throughout this Campaign Duration as recorded in the Bank s system date and time. All Eligible Transactions in foreign currency shall be converted to Ringgit Malaysia (RM) based on the prevailing foreign exchange rates as recorded in the Bank s system. 9. Eligible retail spend transactions are all local, overseas and/or online retail spend transactions as explained in Clause 5 and Clause 6 above that are charged to any Eligible Cardholder s Principal Card(s) during the Campaign Duration for purchase of goods or services incurred for personal consumption, and not for business purposes, excluding the following transactions:- (a) quasi cash transactions for betting and/or gaming; (b) on-going monthly instalments of AmFlexi-Pay Program / Easy Payment Plan; (c) corporate Bill Payments or Corporate GIRO transactions; (d) cash advance / deposit / withdrawal transactions; (e) any fees or charges imposed by the Bank; (f) trade financing transactions; (g) transactions which are under special corporate arrangement where rebate is applicable; (h) (i) retail spend transactions which are not defined in Clause 5 and Clause 6 above; and retail spend transactions which are subsequently cancelled, disputed, refunded, unauthorized, suspicious or fraudulent transactions of any nature. 3 10. Any determination by the Bank as to what constitutes Eligible Transactions is conclusive and cannot be challenged in any manner whatsoever. All transactions as recorded by the Bank shall also be final and conclusive. 11. All Eligible Transactions within the Campaign Duration must be based on Malaysian time as captured by the Bank s transaction records and posted to the Eligible Cardholder s Card account within five (5) calendar days from the date of the transactions. The Bank is not responsible in any manner whatsoever for any failure and/or delay in the transmission of evidence of sales transactions by Mastercard, Visa, merchant establishments or any other party. 12. The Cash Back shall be credited into the respective Eligible Cardholder s Card account which was used to perform the Eligible Transaction within twelve (12) weeks from the end the Campaign Duration and shall be displayed in his/her statement of Card account. 13. Notwithstanding the foregoing, the Bank reserves the right to use any other medium or method, including the Bank s website at as it deems fit in its sole and absolute discretion for the purpose of announcing the Eligible Cardholders entitled for the Cash Back. Air Conversion (only for Eligible Cardholders with AmBank/AmBank Islamic Mastercard Credit Card/i) 14. Subject to the Terms and Conditions hereinafter appearing, all Eligible Cardholders who use their AmBank/AmBank Islamic Mastercard Credit Card/i to convert his/her AmBonus points to AmBank Frequent Flyer Programme partners Air ( Air ) will be eligible for Additional 30% Air ( Additional Air ) as recorded in the Bank s system ( Eligible Conversion ). 15. For the avoidance of doubt, the existing conversion rates of AmBonus points to Air (in multiples of 1,000) according to the AmBank Frequent Flyer Programme are as below: AmBank Mastercard AmBonus Points Equivalent Air Credit Card World 5,000 1,000 Platinum 6,000 1,000 Gold 10,000 1, Eligible Cardholders are required to submit the AmBonus Rewards redemption form with all the required Card details, Frequent Flyer Membership details and the below Redemption Code to be eligible for the Additional Air : Redemption Code AmBank Mastercard Credit Card Enrich AirAsia BIG Points KrisFlyer Asia World OVS001 OVS004 OVS007 OVS009 Platinum OVS002 OVS005 OVS008 OVS010 Gold OVS003 OVS Page 3 of 5 AmBank 1% Cash Back on Overseas Spend and Air Conversion Campaign

Eligible Cardholders shall receive Additional Air for Eligible Conversions affected during the Campaign Duration on a first-come, first-served basis, subject to availability of the Additional Air allocation for all Frequent Flyer Programme partners as outlined below: Frequent Flyer Programme Partner Air Allocation Enrich (Malaysia Airlines) 1,000,000 AirAsia BIG (AirAsia) 1,000,000 KrisFlyer (Singapore Airlines) 1,000,000 Asia (Cathay Pacific) 1,000,000 TOTAL 4,000, Additional Air will be credited into the respective Frequent Flyer accounts of Eligible Cardholders within twelve (12) weeks from the end of Campaign Duration. 19. The following additional terms and conditions shall apply to the Additional Air : (a) Eligible Cardholders are responsible to ensure information provided (to include but not limited to name, contact numbers, addresses, mailing addresses and Frequent Flyer membership numbers) with respect to their Frequent Flyer accounts are accurate for Additional Air issuance purposes; (b) Additional Air are given on an as is basis and are not transferable, nor exchangeable for credit or kind whether in part or in full; (c) Additional Air issued under this Campaign are in the form of Air issued by the Bank s appointed merchants or suppliers or vendors, where the Air are subject to the terms and conditions applicable to using them. In that respect, each and every Eligible Cardholders understand that the terms and conditions specified in the terms of use of such Air are beyond the Bank s control and are determined by the merchants or suppliers or vendors or the Frequent Flyer Programme partners. Any dispute(s) arising out of the terms and conditions applicable to the Additional Air must be settled directly with the relevant party. The Bank is not responsible for investigating or resolving any disputes between any Eligible Cardholder and any party, and is not responsible for replacing or canceling any redemptions as a result of such dispute(s). 20. Any determination by the Bank as to what constitute Eligible Conversions is conclusive and cannot be challenged in any manner whatsoever. All transactions as recorded by the Bank shall also be final and conclusive. 21. Notwithstanding the foregoing, the Bank reserves the right to use any other medium or method, including the Bank s website at as it deems fit in its sole and absolute discretion for the purpose of announcing the Eligible Cardholder entitled for the Additional Air. Disqualification 22. The Bank reserves the absolute right to disqualify the participation of any Eligible Cardholders for the purpose of this Campaign without having to alert him/her in the event:- (a) the Eligible Cardholder s Card account is in default of facilities granted at any time during the Campaign Duration; or (b) the Eligible Cardholder s Card account is closed within twelve (12) weeks from the expiry of the Campaign Duration; or (c) the Eligible Cardholder has provided untrue information or acted fraudulently in any manner during the Campaign Duration; or (d) the Eligible Cardholder breaches any of these Terms and Conditions stipulated herein. 5 Liability 23. The Bank shall not be liable to any Eligible Cardholder for any damage of whatsoever nature or loss suffered (including but not limited to, loss of goodwill, income or profits or consequential, direct or indirect, exemplary, incidental, punitive or special damages) howsoever arising in relation to participation in the Campaign, or the Bank exercising its rights pursuant to any of the Terms and Conditions herein. General 24. The Bank s decision on all matters relating to the Campaign is binding and final and no further correspondence or appeal shall be entertained. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 25. All Eligible Cardholders have read and understood all the Terms and Conditions specified herein and the Bank shall have the absolute right to suspend, terminate or cancel the Campaign at any time without assigning any reason by giving prior notice of at least five (5) calendar days on the Bank s website at All Eligible Cardholders are deemed to have expressly agreed to be bounded by these Terms and Conditions (as varied or changed), the decisions of the Bank and, to the fullest extent permitted by law, to have consented to and authorized the Bank to disclose their particulars to the third party service providers engaged by the Bank for purposes of the Campaign. The Bank warrants that the disclosure of such particulars to any third party service providers shall be limited to the Eligible Cardholders names, addresses, Frequent Flyer membership number and telephone numbers and shall be used only in relation to and for purposes of the Campaign. The Bank s decision on all matters relating to the Campaign (including the interpretation of these Terms and Conditions) shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained. 27. For avoidance of doubt, cancellation, termination or suspension of this Campaign by the Bank shall not entitle the Eligible Cardholder(s) to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the Eligible Cardholder(s) as a direct or indirect result of the act of cancellation, termination or suspension. 28. To the extent permitted by law, the Bank shall not be liable to the Eligible Cardholder(s) for any losses or costs (including loss of business opportunities or profits) caused by abnormal and unforeseeable circumstances outside the Bank s reasonable control which is unavoidable, including but not limited to any accident, act of terrorist, breakdown of machinery, civil commotion, fire, industrial dispute, labour unrest, lock-out, natural disaster, riot, strike, war (whether declared or undeclared), or data processing system, electrical, telecommunication system or transmission link failure. 29. 6 Kempen Pulangan Tunai 1% atas Perbelanjaan Di Luar Negara dan Pertukaran Air AmBank Terma dan Syarat Terma-terma dan syarat-syarat di sini ( Terma dan Syarat ) adalah tambahan kepada dan untuk dibaca bersama dengan perjanjian kad kredit yang berkaitan ( Perjanjian Pemegang Kad ) AmBank (M) Berhad (8515-D) / AmBank Islamic Berhad ( U) (secara kolektif dirujuk sebagai pihak Bank ) yang masing-masing mentadbir ke atas penggunaan kad kredit/i yang dikeluarkan oleh pihak Bank. Sekiranya terdapat sebarang percanggahan atau ketidakseragaman antara Terma dan Syarat ini dan Perjanjian Pemegang Kad, Terma dan Syarat ini akan digunapakai setakat berkaitannya dengan Kempen ini. Kecuali di mana konteks memerlukan sebaliknya, atau melainkan jika Terma dan Syarat ini memperuntukkan selainnya, semua perkataan, nama dan ekspresi yang ditakrifkan di dalam Perjanjian Pemegang Kad, apabila digunakan atau dirujuk di dalam Terma dan Syarat ini, hendaklah mempunyai maksud yang sama seperti yang dinyatakan di dalam Perjanjian Pemegang Kad. Perkataan yang melambangkan orang termasuklah orang yang hidup dan, jika dan di mana berkenaan, badan atau orang yang diperbadankan atau tidak diperbadankan. Perkataan yang bererti tunggal juga hendaklah termasuk jamak dan sebaliknya. Perkataan yang bermaksud jantina lelaki hendaklah termasuk jantina perempuan dan neuter. Kempen 1. Kempen bermaksud Kempen Pulangan Tunai 1% atas Perbelanjaan Di Luar Negara dan Pertukaran Air yang dianjurkan oleh pihak Bank selaras dengan Terma dan Syarat yang ditetapkan di sini. Tempoh Kempen 2. Kempen ini adalah dari 15 September 2017 hingga 15 Mac 2018, termasuk kedua-dua tarikh ( Jangka Waktu Kempen ) atau mana-mana tempoh lain sebagaimana yang ditentukan mengikut budi bicara tunggal dan mutlak pihak Bank dengan notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu. Kelayakan 3. "Pemegang Kad Yang Layak" bermaksud pelanggan pihak Bank yang mempunyai Kad Kredit/i Utama ( Kad ) semasa Jangka Waktu Kempen seperti yang diterangkan di sini tetapi tidak termasuk:- (a) pemegang kad debit, kad prabayar, kad korporat, kad komersial atau kad insurans yang dikeluarkan oleh pihak Bank; dan/atau (b) pemegang kad dengan akaun Kad yang telah digantung, diberhentikan atau dibatalkan atas apa jua sebab semasa dan sehingga dua belas (12) minggu setelah Jangka Waktu Kempen tamat. 4. Bagi mengelakkan keraguan, Kempen ini tidak memerlukan sebarang pendaftaran untuk penyertaan dan bahawa semua Kad Pemegang Kad Yang Layak yang berkaitan termasuk Kad tambahan beliau akan dijejaki secara automatik bagi tujuan penjadualan Transaksi Yang Layak dan/atau Pertukaran Yang Layak sepanjang Jangka Waktu Kempen. 7 Transaksi Yang Layak dan Pulangan Tunai 1% 5. Tertakluk kepada Terma dan Syarat yang akan dinyatakan selepas ini, semua Pemegang Kad Yang Layak yang menggunakan Kad mereka untuk melaksanakan transaksi perbelanjaan runcit dalam mata wang asing (selain daripada Ringgit Malaysia) dan di luar negara (di luar Malaysia) akan layak untuk 1% Pulangan Tunai ( Pulangan Tunai ) seperti yang direkodkan dalam sistem Bank ( Transaksi Luar Negara Yang Layak ). 6. Selain itu, untuk transaksi perbelanjaan runcit dalam mata wang asing tetapi dilaksanakan di Malaysia ( Transaksi Dalam Talian Yang Layak ), hanya transaksi perbelanjaan runcit yang berikut oleh Kod Kategori Saudagar (MCC) layak untuk Pulangan Tunai: Kategori Transaksi Perbelanjaan Runcit Syarikat Penerbangan Hotel Perjalanan Contoh-Contoh Saudagar Syarikat Penerbangan / Pengangkutan Udara iaitu: Malaysia Airlines, AirAsia, Singapore Airlines, Cathay Pacific, THAI Airways Penginapan termasuk Hotel, Motel, Resort, Perkhidmatan Tempahan Pusat iaitu: Sofitel, Tune Hotels Agensi Pelancongan, Operasi Pelancongan, Agensi Pelancongan Dalam Talian, Perkhimatan Pengaturan Berkaitan Perjalanan iaitu: Holiday Tours, Trafalgar Tours, Agoda, Expedia MCC 3000 hingga 3299, hingga 3999, , Penentuan MCC untuk setiap saudagar adalah tertakluk kepada pengelasan oleh bank pemeroleh saudagar ( Bank Pemeroleh Saudagar ) dan adalah menjadi tanggungjawab Bank Pemeroleh Saudagar yang berkaitan untuk memberikan MCC yang betul. Bank tidak bertanggungjawab ke atas dan juga tidak mempunyai apa-apa jua kawalan ke atas sebarang pemberian MCC yang tidak betul dan/atau tidak konsisten oleh Bank Pemeroleh Saudagar yang berkaitan yang boleh mengakibatkan Pemegang Kad Yang Layak disingkirkan daripada hak mendapat Wang Bank. 8. Transaksi Luar Negara Yang Layak dan Transaksi Dalam Talian Yang Layak (kedua-duanya akan ditakrifkan sebagai Transaksi Yang Layak ) yang dilaksanakan oleh Pemegang Kad Yang Layak akan membolehkan beliau untuk menerima Pulangan Tunai 1% di atas amaun transaksi masing-masing dengan had RM200 bagi setiap Pemegang Kad Yang Layak sepanjang Jangka Waktu Kempen ini seperti yang direkodkan dalam tarikh dan masa sistem Bank. Semua Transaksi Yang Layak dalam mata wang asing hendaklah ditukarkan kepada Ringgit Malaysia (RM) berdasarkan kadar pertukaran mata wang asing lazim seperti yang direkodkan dalam sistem Bank. 9. Transaksi perbelanjaan runcit yang layak semuanya adalah transaksi perbelanjaan runcit tempatan, luar negara dan/atau dalam talian seperti yang diterangkan dalam Klausa 5 dan Klausa 6 di atas yang dicajkan kepada mana-mana Kad Utama Pemegang Kad Yang Layak semasa Jangka Waktu Kempen untuk pembelian barangan atau perkhidmatan yang ditanggung untuk penggunaan peribadi dan bukan bagi tujuan perniagaan, tidak termasuk transaksi-transaksi yang berikut:- Page 2 of 6 Kempen Pulangan Tunai 1% atas Perbelanjaan Di Luar Negara dan Pertukaran Air AmBank
8 (a) (b) (c) (d) (e) (f) (g) (h) transaksi tunai separa untuk perjudian dan/atau permainan; ansuran bulanan Program AmFlexi-Pay / Pelan Bayaran Mudah yang sedang berjalan; transaksi Bayaran Bil Korporat atau GIRO Korporat; transaksi pendahuluan tunai / deposit / pengeluaran; sebarang yuran atau caj yang dikenakan oleh Bank; transaksi pembiayaan perdagangan; transaksi yang berada di bawah pengaturan korporat khas yang mana rebat boleh digunakan; transaksi perbelanjaan runcit yang tidak ditakrifkan dalam Klausa 5 dan Klausa 6 di atas; dan (i) transaksi perbelanjaan runcit yang kemudiannya dibatalkan, dipertikaikan, dikembalikan, tidak dibenarkan, mencurigakan atau transaksi palsu dalam apa-apa bentuk. 10. Sebarang penentuan oleh Bank mengenai apa yang dimaksudkan sebagai Transaksi Yang Layak adalah muktamad dan tidak boleh dicabar dalam apa jua cara. Semua transaksi seperti yang direkod oleh pihak Bank akan juga menjadi muktamad dan konklusif. 11. Semua Transaksi Yang Layak dalam Jangka Waktu Kempen mesti berdasarkan mesti berdasarkan waktu Malaysia seperti yang dirakamkan oleh rekod transaksi pihak Bank dan diposkan ke akaun Kad Peserta dalam tempoh lima (5) hari kalendar dari tarikh transaksitransaksi tersebut. Pihak Bank tidak bertanggungjawab dalam sebarang cara apa jua untuk sebarang kegagalan dan/atau kelewatan dalam transmisi bukti transaksi jualan oleh Mastercard, Visa, pertubuhan peniaga atau sebarang pihak lain. 12. Pulangan Tunai akan dikreditkan ke dalam akaun Kad Pemegang Kad Yang Layak yang telah digunakan untuk melaksanakan Transaksi Yang Layak dalam masa dua belas (12) minggu dari tarikh tamat Jangka Waktu Kempen dan akan dipaparkan dalam penyata akaun Kad beliau. 13. Walau apa pun yang dinyatakan di atas, Bank berhak untuk menggunakan sebarang medium atau kaedah lain, termasuk laman sesawang Bank di yang dianggap wajar menurut budi bicara mutlaknya bagi tujuan mengumumkan Pemegang Kad Yang Layak yang berhak mendapat Pulangan Tunai. Pertukaran Air (hanya untuk Pemegang Kad Yang Layak dengan Kad Kredit/i Mastercard AmBank/Ambank Islamic) 14. Tertakluk kepada Terma dan Syarat yang akan dinyatakan selepas ini, semua Pemegang Kad Yang Layak yang menggunakan Kad Kredit/i Mastercard AmBank/Ambank Islamic mereka untuk menukar mata AmBonus mereka kepada Air rakan kongsi Frequent Flyer Programme AmBank ( Air ) akan layak untuk 30% Air Tambahan ( Air Tambahan ) seperti yang direkodkan dalam sistem Bank ( Pertukaran Yang Layak ). 15. Terma dan syarat tambahan yang berikut akan terpakai kepada Air Tambahan: (a) Pemegang Kad Yang Layak bertanggungjawab untuk memastikan maklumat yang diberikan (termasuk tetapi tidak terhad kepada nama, nombor hubungan, alamat e- mel, alamat surat-menyurat dan nombor keahlian Penerbang Kerap) berkaitan dengan akaun Penerbang Kerap mereka adalah tepat bagi tujuan pengeluaran Air Tambahan; (b) Air Tambahan diberi berdasarkan seadanya dan tidak boleh dipindah milik atau ditukar untuk kredit atau yang serupa dengannya sama ada sebahagian atau sepenuhnya; (c) Air Tambahan yang dikeluarkan di bawah Kempen ini adalah dalam bentuk Air yang dikeluarkan oleh saudagar atau pembekal atau vendor yang dilantik oleh Bank, yang mana Air ini tertakluk kepada terma dan syarat yang terpakai dalam penggunaannya. Dalam hal ini, setiap Pemegang Kad Yang Layak memahami bahawa terma dan syarat yang telah ditetapkan dalam terma penggunaan Air yang sedemikian adalah di luar kawalan Bank dan ditentukan oleh saudagar atau pembekal atau vendor atau rakan-rakan kongsi Frequent Flyer Programme AmBank. Sebarang pertikaian yang timbul daripada terma dan syarat yang terpakai kepada Air Tambahan hendaklah diselesaikan secara langsung dengan pihak yang berkenaan. Bank tidak bertanggungjawab untuk menyiasat atau menyelesaikan sebarang pertikaian antara mana-mana Pemegang Kad Yang Layak dan mana-mana pihak, dan tidak bertanggungjawab untuk menggantikan atau membatalkan sebarang penebusan akibat daripada pertikaian yang sedemikian. 10 20. Sebarang penentuan oleh Bank mengenai apa yang dimaksudkan dengan Pertukaran Yang Layak adalah muktamad dan tidak boleh dicabar dalam apa cara jua pun. Semua transaksi seperti yang direkodkan oleh Bank adalah juga tetap dan muktamad. 21. Walau apa pun yang dinyatakan di atas, Bank berhak untuk menggunakan sebarang medium atau kaedah lain, termasuk laman sesawang Bank di yang dianggap wajar menurut budi bicara mutlaknya bagi tujuan mengumumkan Pemegang Kad Yang Layak yang berhak mendapat Air Tambahan. Penyingkiran 22. Pihak Bank berhak secara mutlak untuk menyingkirkan penyertaan sesiapa Pemegang Kad Yang Layak untuk tujuan Kempen ini tanpa keperluan untuk memaklumkan beliau sekiranya:- (a) akaun Kad Pemegang Kad Yang Layak tersebut mengingkari kemudahan-kemudahan yang diberi pada bila-bila masa semasa Jangka Waktu Kempen; atau (b) akaun Kad Pemegang Kad Yang Layak tersebut ditutup dalam dua belas (12) minggu setelah Jangka Waktu Kempen tamat; atau (c) Pemegang Kad Yang Layak telah memberikan maklumat yang tidak benar atau melakukan penipuan dalam sebarang cara ssemasa Jangka Waktu Kempen; atau (d) Pemegang Kad Yang Layak tersebut memungkiri sebarang Terma dan Syarat yang dinyatakan di sini. Liabiliti 23. Pihak Bank tidak akan bertanggungjawab kepada sesiapa Peserta untuk sebarang kerosakan dalam apa jua bentuk atau kerugian yang dialami (termasuk tetapi tidak terhad kepada, kehilangan nama baik, pendapatan atau keuntungan atau kerosakan berbangkit, secara langsung atau tidak langsung, teladan, sampingan, punitif atau khas) sebagaimana yang timbul berkaitan dengan penyertaan dalam Kempen ini, atau pihak Bank melaksanakan haknya menurut sebarang Terma dan Syarat di sini. Umum 24. Keputusan pihak Bank untuk semua perkara berkaitan dengan Kempen ini adalah terikat dan muktamad. Semua Terma dan Syarat yang ditetapkan di sini adalah ditadbir oleh dan ditafsirkan selaras dengan undang-undang Malaysia dan sebarang pertikaian undang-undang akan dimulakan dan dibicarakan di mahkamah di Kuala Lumpur. 25. Semua Peserta telah membaca dan memahami semua Terma dan Syarat yang dinyatakan di sini dan pihak Bank akan mempunyai hak mutlak untuk mengantung, memberhentikan atau membatalkan Kempen ini pada bila-bila masa tanpa memberi sebarang sebab dengan memberi notis sekurang-kurangnya lima (5) hari kalendar terlebih dahulu pada laman web pihak Bank di Semua Pemegang Kad Yang Layak dianggap sebagai telah menyatakan persetujuan untuk terikat dengan Terma dan Syarat ini (seperti yang diubah atau berubah), keputusan Bank dan, setakat yang benarkan oleh undang-undang, untuk membenarkan dan memberi kuasa kepada Bank untuk mendedahkan butiran peribadi mereka kepada penyedia perkhidmatan pihak ketiga yang digunakan oleh Bank bagi tujuan Kempen. Bank menjamin bahawa pendedahan butiran yang sedemikian kepada mana-mana penyedia perkhidmatan pihak ketiga akan terhad kepada nama, alamat, nombor keahlian Penerbang Kerap dan nombor telefon Pemegang Kad Yang Layak dan akan digunakan hanya dalam hal berkaitan dengan dan bagi tujuan Kempen. 11 Kempen (termasuk interpretasi Terma dan Syarat ini) adalah muktamad dan mengikat dan sebarang surat-menyurat selanjutnya atau percubaan untuk mempertikaikan keputusan yang sedemikian tidak akan dilayan. 27. Untuk mengelakkan keraguan, pembatalan, pemberhentian atau penggantungan Kempen ini oleh pihak Bank tidak akan memberi hak kepada para Peserta untuk sebarang tuntutan atau pampasan terhadap pihak Bank untuk sebarang dan kesemua kerugian atau kerosakan yang dialami atau ditanggung oleh para Peserta sebagai akibat langsung atau tidak langsung dari tindakan pembatalan, pemberhentian atau penggantungan tersebut. 28. Setakat yang dibenarkan oleh undang-undang, pihak Bank tidak akan bertanggungjawab kepada para Peserta untuk sebarang kerugian atau kos (termasuk kehilangan peluang perniagaan atau keuntungan) yang disebabkan oleh keadaan-keadaan yang luar biasa dan tidak dapta diduga di luar kawalan munasabah pihak Bank yang tidak dapat dielakkan, termasuk tetapi tidak terhad kepada sebarang kemalangan, tindakan pengganas, kerosakan mesin, kekacauan awam, kebakaran, pertikaian perindustrian, kekacauan buruh, sekatan masuk kerja, bencana alam, rusuhan, mogok, peperangan (sama ada diisytiharkan atau tidak diisytiharkan) atau kegagalan sistem pemprosesan data, elektrik, sistem telekomunikasi atau sambungan transmisi. 29.
