1 AmBank Group Touch n Go Zing Card Terms and Conditions This Terms and Conditions shall be read together with the AmBank / AmBank Islamic - Mastercard / Visa Cardholder Agreement. Unless the context otherwise requires and save as expressly defined in this Terms and Conditions, all words and expressions defined in the AmBank / AmBank Islamic - Mastercard / Visa Cardholder Agreement shall have the same meaning when used herein. 1. Definitions & Construction 1.1 For purposes of this Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires:- Bank means AmBank (M) Berhad (Company No: 8515-D), AmBank Islamic Berhad (Company No: U) and includes its successors-in-title. Automatic Reload Facility means the facility offered by the Bank and accepted by the Cardholder for the automatic top-up of the stored monetary value in the Zing Card with the Auto- Reload Value when the stored monetary value falls below the Preset Threshold, using the credit line under the Cardholder s Card. Auto-Reload Value means the minimum fixed monetary value of RM (or any other monetary value(s) as agreed by the Bank and the Cardholder from time to time) added to the stored monetary value in the Zing Card through the Automatic Reload Facility when the stored monetary value falls below the Preset Threshold. AmBank Group means AMMB Holdings Berhad (Company No: V) and its group of companies and includes all direct and indirect subsidiaries and associate corporations of the Bank s holding company. Card means a Mastercard or Visa credit card issued by the Bank to a Cardholder at any time or to the Supplementary Cardholder under the AmBank / AmBank Islamic - Mastercard / Visa Cardholder Agreement. Cardholder means the person to whom and in whose name a valid Card is issued and where relevant, also means the Supplementary Cardholder. GST means any tax payable on the supply of goods, services or other things in accordance with the provisions of GST Law. GST Law means the Goods and Services Tax Act 2014, subsidiary legislation, statutory orders and regulations governing the application of GST, as amended from time to time. Preset Threshold means RM50.00 stored monetary value in the Zing Card. Principal Card means the Card issued by the Bank to the Principal Cardholder. Principal Cardholder means the person who applied as principal applicant and has been approved to hold a Principal Card. TNGSB means Touch n Go Sdn Bhd (Company No: X), the issuer of the Zing Card and includes its successors-in-title. Service Provider means a party which had entered into an agreement with TNGSB to accept payment through the use of the Zing Card for goods sold and/or services provided. Supplementary Card means the Card issued by the Bank to the Supplementary Cardholder. Supplementary Cardholder means any other person(s) as nominated by the Principal Cardholder to hold an additional card or Supplementary Card under the Card account. Unutilized Value means the unutilized stored monetary value in the Zing Card. Zing Card means the stored value card issued by TNGSB bearing the name and mark / logo of AmBank Group, with Automatic Reload Facility. 1.2 The term Associate Corporation shall have the meaning assigned to it under Section 2(1) of the Financial Services Act 2013 and Islamic Financial Services Act The term Related Corporations shall have the meaning assigned to it under Section 6 of the Companies Act Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words implying singular number shall also imply plural number and vice versa. Words implying the masculine gender shall include the feminine and neuter gender.

Activation of Automatic Reload Facility 2.1 To activate the Automatic Reload Facility, a Cardholder need only tap his Zing Card on a Touch n Go card reader placed at any highway toll booths in Malaysia. 3. Acceptance and Use of Zing Card 3.1 The activation of the Automatic Reload Facility affirms the Cardholder s acceptance of this Terms and Conditions. The Cardholder is solely and fully responsible for the use of the Zing Card. 3.2 A Zing Card can be used at all payment facilities that display the Touch n Go logo and to pay for goods sold and/or services provided by Service Providers. 4. Operation of Automatic Reload Facility 4.1 The Zing Card is automatically loaded / reloaded with the Auto-Reload Value when the Cardholder taps the Zing Card on a Touch n Go card reader placed at any highway toll booths once the stored monetary value in the Zing Card reaches the Preset Threshold, provided that:- (a) the Card which is linked to the Zing Card and/or the Automatic Reload Facility is not terminated and/or suspended in accordance with the Terms and Conditions of the AmBank / AmBank Islamic - Mastercard / Visa Cardholder Agreement; or (b) the Zing Card is not terminated and/or suspended in accordance with this Terms and Conditions. 4.2 The Bank is authorized by the Cardholder to debit the Cardholder s Card account which is linked to the Zing Card with an amount equal to the Auto-Reload Value for each automatic reload along with the auto reload fee of RM2 (GST inclusive) without prior notice to the Cardholder. 4.3 A Cardholder may terminate the Automatic Reload Facility by calling the Bank s (24-hour) Contact Centre. The Bank will cease the Automatic Reload Facility within forty-eight (48) hours of receiving the call from the Cardholder. 4.4 The Bank may, at its sole and absolute discretion, terminate the Automatic Reload Facility by giving the Cardholder at least twenty-one (21) calendar days prior notice. 4.5 Notwithstanding Clause 4.4, the Bank shall have the absolute right and discretion, to immediately suspend or terminate, as the Bank deems fit, the Automatic Reload Facility to a Cardholder at any time without prior notice:- (a) if the Cardholder breaches any term in the AmBank / AmBank Islamic - Mastercard / Visa Cardholder Agreement; (b) if the Bank has reasonable grounds to believe there is fraudulent use of the Zing Card or the Zing Card is used for a fraudulent purpose; (c) if the Zing Card is reported damaged to the Bank; (d) if the TNG electronic payment system of TNGSB fails, is changed or modified; or (e) if a Force Majeure event affecting the Bank s obligations herein continues for a period of more than six (6) months from the date it first arises. 4.6 A Cardholder may contact the Bank s (24-hour) Contact Centre at to request for the Automatic Reload Facility to be resumed, which the Bank may, in its sole and absolute discretion, oblige subject to compliance by the Cardholder of such conditions as the Bank may impose for the reactivation of the Automatic Reload Facility. 4.7 The Zing Card cannot be reloaded at any other establishment or by any other method other than through the Automatic Reload Facility. 4.8 Notwithstanding Clause 4.3, 4.4 and 4.5, the Zing Card and the Unutilized Value therein remain valid for use for a further ninety (90) days from the effective date of termination of the Automatic Reload Facility. Upon expiry of the said ninety (90) days period, the Zing Card shall be totally incapacitated and any Unutilized Value remaining therein can no longer be utilized and may be refunded to the Cardholder subject to Clause 10 herein. 5. Dispute on Automatic Reload Function 5.1 Any dispute by a Cardholder in connection with the Automatic Reload Facility must be reported to the Bank s (24 hour) Contact Centre at within fourteen (14) calendar days of receipt of the relevant Card statement. 6. Expiry of Zing Cards 6.1 All Zing Cards are issued subject to an expiry date of ten (10) years from the date of the Zing Card or upon cessation of the Automatic Reload Facility, whichever is earlier ( Expiry Date ). The Unutilized Value in any Zing Card will be valid for use for a further ninety (90) calendar days from the Expiry Date, during which period, the Cardholder can continue using the Zing Card until the Unutilized Value is fully utilized. 6.2 Subject to Clause 10 herein, a Cardholder may request the Bank to refund the Unutilized Value after the Expiry Date and prior to the ninety (90) calendar days period from the Expiry Date as stated in Clause 6.1 above.

Lost / Stolen Zing Cards 7.1 The Cardholder is solely and fully liable for any unauthorized use of the Zing Card if it is lost or stolen. 7.2 The Cardholder must report the loss or theft of the Zing Card to the Bank s (24-hour) Contact Centre at promptly to avoid incurring further fraudulent charges. 7.3 Notwithstanding prompt notification by the Cardholder, TNGSB and the Bank shall be allowed forty-eight (48) hours from the time of notification to de-activate the Zing Card and the Automatic Reload Facility. 7.4 Neither TNGSB nor the Bank shall bear responsibility for transactions occurring or incurred prior to the proper report having been made to the Bank s (24-hour) Contact Centre and within the said forty-eight (48) hours after the report is made. Cardholders shall remain fully liable for all transactions occurring or incurred on the Zing Card prior to the proper report having been made to the Bank s (24-hour) Contact Centre and during this forty-eight (48) hours notice period. 7.5 At the Cardholder s request, a replacement Zing Card will be forwarded by the Bank to the Cardholder within fourteen (14) calendar days from the date of the Cardholder s request, and a card replacement fee of RM10 (GST inclusive) will be debited to the Cardholder s Card account which is linked to the Zing Card. 7.6 Subject to Clause 10 herein, any remaining Unutilized Value of the lost or stolen Zing Card after forty-eight (48) hours from the time of report made pursuant to Clause 7.2, will be credited into the Cardholder s Card account which is linked to the Zing Card. 8. Termination / Suspension of Zing Card 8.1 A Cardholder may terminate a Zing Card by calling the Bank s (24-hour) Contact Centre at The Bank will cease the Automatic Reload Facility within forty-eight (48) hours of receiving the call from the Cardholder. 8.2 Notwithstanding Clause 8.1, the Zing Card and the Unutilized Value therein remain valid for use for a further ninety (90) days from the date of receipt of termination instructions from the Cardholder. Upon expiry of the said ninety (90) days period, the Zing Card shall be totally incapacitated and any Unutilized Value remaining therein can no longer be utilized and may be refunded to the Cardholder subject to Clause 10 herein. 8.3 The use of the Zing Card may be suspended or terminated without prior notice in the event:- (a) the Cardholder is in breach of any of the Terms and Conditions herein; (b) the Cardholder s Zing Card account is inactive, i.e the Zing Card is not used for more than one (1) year. 8.4 The termination of the Zing Card shall not prejudice any rights of the Bank and TNGSB accruing prior to termination. 8.5 Provided that the reasons for suspension or termination of the Zing Card has been resolved to TNGSB and/or the Bank s satisfaction, a Cardholder may reactivate the Zing Card within 6 months from the date of suspension or termination by contacting the Bank s (24-hour) Contact Centre at or visit the nearest TNGSB sales counter or hub. 9. Fee and Charges 9.1 TNGSB will charge the following fees where applicable:- Fees for Each auto reload Mode of Payment Debit to Cardholder s Card account 9.2 The Bank will charge the following fees where applicable:- Fees for Registration Replacement of a Zing Card Mode of Payment Debit to Cardholder s Card account Debit to Cardholder s Card account RM (GST inclusive) 2 RM (GST inclusive) Fee Waived Notwithstanding the aforesaid, TNGSB and/or the Bank reserves the right to vary all or any of the fees and charges above by giving the Cardholder at least twenty-one (21) calendar days prior notice in accordance with Clause 12 herein.

Refund of Unutilized Value 10.1 The Unutilized Value will be refunded by the Bank to the Cardholder by crediting into the Cardholder s Card account which is linked to the Zing Card, subject to the following conditions:- (a) Requests for refund shall be entertained only in respect of expired, lost, stolen, forged, damaged or terminated Zing Cards, but not in any other circumstances; (b) A request received by the Bank from the Cardholder for refund by way of or telephone call to: AmBank / AmBank Islamic (24-hour) Contact Centre Tel : customercare@ambankgroup.com (c) Prior settlement of all and any applicable fees chargeable to the Cardholder as per Clause 9 from the Unutilized Value before the balance thereof is refunded to the Cardholder If the Unutilized Value cannot be credited into the Cardholder s Card account which is linked to the Zing Card pursuant to Clause 10.1, the Bank will credit the Unutilized Value into the Cardholder s deposit account as advised by the Cardholder to the Bank. 11. Amendment of This Terms and Conditions 11.1 The Bank is entitled to amend, add to or delete any of the Terms and Conditions from time to time by: (a) notifying the Cardholder at least twenty-one (21) calendar days in advance; and (b) informing or publishing the new Term(s) and Condition(s) before the effective date in any manner as the Bank considers appropriate. 12. Notice 12.1 Any notice from TNGSB or the Bank to a Cardholder pursuant to the Terms and Conditions herein shall be given by way of:- (a) mailing of notices to the Cardholder s last known address according to the Bank s records; or (b) display of notices at TNGSB or the Bank s branches, or at any of TNGSB s Touch n Go sales counters; or (c) posting in TNGSB s website, or the Bank s website, ambank.com.my; or (d) any other mode as TNGSB and/or the Bank deems necessary and shall be deemed to have been received by the Cardholder:- (a) if delivered by hand or courier, at the time of delivery; (b) if sent by post, on the 5th business day after posting; (c) if displayed at the Bank s branches or TNGSB s premises or any TNGSB s Touch n Go hubs, on the date the notification is first displayed; (d) if posted on or ambank.com.my, on the date of posting. 13. Force Majeure 13.1 To the extent permitted by law, neither the Bank nor TNGSB shall be liable to the Cardholder for any losses or costs caused by any delay or failure in performing its obligations hereunder if such delay or failure is due to any act of God, war (whether declared or undeclared), strike, riot, civil commotion, explosion, public disorder, terrorism, industrial dispute, labour unrest, lock-out, fire, accident, breakdown of machinery or computer system or transmission link or telecommunication system failure or electrical failure, any act or omission of other telecommunication operators or any other causes or circumstances beyond the Bank or TNGSB s control as the case may be. 14. Disclosures 14.1 The Cardholder hereby authorizes the Bank to disclose any information concerning the Cardholder to TNGSB to facilitate the use of the Zing Card The Cardholder confirms that the Cardholder has read, understood and agreed to be bound by the Privacy Notice of AmBank Group which is made available at AmBank / AmBank Islamic branches and website and give his consent for AmBank Group to process his personal data for the intended usage as stated under the Privacy Notice. 5 Terma dan Syarat Kad Touch n Go Zing Kumpulan AmBank Terma dan Syarat ini hendaklah dibaca bersama dengan Perjanjian Pemegang Kad AmBank / AmBank Islamic - Mastercard / Visa. Melainkan mempunyai maksud lain mengikut konteks dan kecuali seperti yang ditakrifkan secara nyata di dalam Terma dan Syarat ini, semua perkataan dan ungkapan yang ditakrifkan dalam Perjanjian Pemegang Kad AmBank / AmBank Islamic - Mastercard / Visa hendaklah mempunyai maksud yang sama apabila digunakan di dalam ini. 1. Definisi & Susunan Kata 1.1 Untuk tujuan Terma dan Syarat ini, perkataan dan ungkapan berikut hendaklah mempunyai maksud yang diberikan kepadanya melainkan mempunyai maksud lain mengikut konteks:- Bank bermaksud AmBank (M) Berhad (No. Syarikat: 8515-D), AmBank Islamic Berhad (No. Syarikat: U) dan termasuk pengganti hak milik. Kemudahan Tambah Nilai Automatik bermaksud kemudahan yang ditawarkan oleh Bank dan diterima oleh Pemegang Kad untuk membuat tambah nilai automatik bagi nilai wang yang tersimpan di dalam Kad Zing, dengan Jumlah Tambah Nilai Automatik, apabila nilai wang yang tersimpan berada di bawah Had Yang Ditetapkan, menggunakan Kemudahan kredit bagi Kad Pemegang Kad. Jumlah Tambah Nilai Automatik bermaksud nilai wang tetap sekurang-kurangnya RM (atau nilai wang lain seperti yang dipersetujui oleh Bank dan Pemegang Kad dari semasa ke semasa) yang ditambah kepada nilai wang yang tersimpan di dalam Kad Zing melalui Kemudahan Tambah Nilai Automatik apabila nilai wang yang tersimpan jatuh di bawah Had Yang Ditetapkan. Kumpulan AmBank bermaksud AMMB Holdings Berhad (No. Syarikat: V) dan kumpulan syarikat-syarikat dan termasuk semua anak syarikat langsung dan tidak langsung dan syarikat sekutu di bawah syarikat pegangan Bank. Kad bermaksud kad kredit Mastercard atau Visa yang dikeluarkan oleh Bank kepada Pemegang Kad pada bila-bila masa atau kepada Pemegang Kad Tambahan di bawah Perjanjian Pemegang Kad AmBank / AmBank Islamic - Mastercard / Visa. Pemegang Kad bermaksud orang yang diberikan sekeping Kad yang sah di atas namanya dan di mana berkenaan, turut bermaksud Pemegang Kad Tambahan. CBP bermaksud apa-apa cukai yang perlu dibayar bagi bekalan barangan, perkhidmatan atau barang lain di bawah peruntukan undang-undang CBP. Undang-undang CBP bermaksud Akta Cukai Barangan dan Perkhidmatan 2014, perundangan subsidiari, perintah berkanun dan peraturan yang berkuat kuasa ke atas pelaksanaan CBP, seperti yang dipinda dari semasa ke semasa. Had Yang Ditetapkan bermaksud nilai wang tersimpan sebanyak RM50.00 dalam Kad Zing. Kad Utama bermaksud Kad yang dikeluarkan oleh Bank kepada Pemegang Kad Utama. Pemegang Kad Utama bermaksud orang yang memohon sebagai pemohon utama dan telah diluluskan untuk memegang Kad Utama. TNGSB bermaksud Touch n Go Sdn Bhd (No. Syarikat: X), pengeluar Kad Zing dan termasuk pengganti hak miliknya. Penyedia Perkhidmatan bermaksud pihak yang telah menandatangani perjanjian dengan TNGSB untuk menerima bayaran menggunakan Kad Zing untuk barangan yang dijual dan/atau perkhidmatan yang disediakan. Kad Tambahan bermaksud Kad yang dikeluarkan oleh Bank kepada Pemegang Kad Tambahan. Pemegang Kad Tambahan bermaksud mana-mana orang yang dinamakan oleh Pemegang Kad Utama untuk memegang satu lagi kad atau Kad Tambahan di bawah Akaun Kad. Nilai Belum Digunakan bermaksud nilai wang tersimpan yang belum digunakan dalam Kad Zing. Kad Zing bermaksud kad nilai tersimpan yang dikeluarkan oleh TNGSB dengan nama dan tanda / logo Kumpulan AmBank, yang menyediakan Kemudahan Tambah Nilai Automatik. 1.2 Istilah Syarikat Bersekutu hendaklah mempunyai maksud yang diberikan kepadanya di bawah Seksyen 2(1) Akta Perkhidmatan Kewangan 2013 dan Akta Perkhidmatan Kewangan Islam Istilah Syarikat Berkaitan hendaklah mempunyai maksud yang diberikan kepadanya di bawah Seksyen 6 Akta Syarikat 1965.

6 1.3 Perkataan yang merujuk kepada orang hendaklah termasuk orang yang masih hidup dan, sekiranya dan di mana berkenaan, pertubuhan atau kumpulan orang yang diperbadankan atau tidak diperbadankan. Perkataan yang berbentuk mufrad (satu) hendaklah juga merangkumi bentuk jamak dan sebaliknya. Perkataan yang mewakili jantina lelaki turut merujuk kepada jantina perempuan dan tanpa jantina. 2. Pengaktifan Kemudahan Tambah Nilai Automatik 2.1 Untuk mengaktifkan Kemudahan Tambah Nilai Automatik, Pemegang Kad hanya perlu menyentuh Kad Zing pada pembaca kad Touch n Go yang dipasang pada mana-mana pondok tol lebuh raya di Malaysia. 3. Penerimaan dan Penggunaan Kad Zing 3.1 Pengaktifkan Kemudahan Tambah Nilai Automatik mengesahkan bahawa Pemegang Kad menerima Terma dan Syarat ini. Pemegang Kad adalah bertanggungjawab sepenuhnya ke atas penggunaan Kad Zing. 3.2 Kad Zing boleh digunakan di semua kemudahan pembayaran yang memaparkan logo Touch n Go dan untuk membayar barangan yang dijual dan/atau perkhidmatan yang disediakan oleh Penyedia Perkhidmatan. 4. Operasi Kemudahan Tambah Nilai Automatik 4.1 Kad Zing dimuatkan / ditambah nilai secara automatik dengan Jumlah Tambah Nilai Automatik apabila Pemegang Kad menyentuh Kad Zing pada pembaca kad Touch n Go yang dipasang di mana-mana pondok tol lebuh raya apabila nilai wang tersimpan dalam Kad Zing mencecah Had Yang Ditetapkan, dengan syarat:- (a) Kad yang dihubungkan dengan Kad Zing, dan/atau Kemudahan Tambah Nilai Automatik tidak ditamatkan dan/atau digantung mengikut Terma dan Syarat Perjanjian Pemegang Kad AmBank / AmBank Islamic - Mastercard / Visa; atau (b) Kad Zing tidak ditamatkan dan/atau digantung mengikut Terma dan Syarat ini. 4.2 Bank diberi kuasa oleh Pemegang Kad untuk mendebitkan jumlah yang bersamaan dengan Jumlah Tambah Nilai Automatik bagi setiap tambah nilai automatik, di samping yuran tambah nilai automatik sebanyak RM2 (termasuk CBP) daripada akaun Kad Pemegang Kad yang dihubungkan dengan Kad Zing tanpa memberikan notis terlebih dahulu kepada Pemegang Kad. 4.3 Pemegang Kad boleh menamatkan Kemudahan Tambah Nilai Automatik dengan menghubungi Pusat Panggilan (24 jam) Bank. Bank akan menghentikan Kemudahan Tambah Nilai Automatik dalam masa empat puluh lapan (48) jam selepas menerima panggilan daripada Pemegang Kad. 4.4 Atas budi bicara mutlaknya, Bank boleh menamatkan Kemudahan Tambah Nilai Automatik dengan memberikan notis sekurang-kurangnya dua puluh satu (21) hari kalendar kepada Pemegang Kad terlebih dahulu. 4.5 Walau apa pun yang terkandung dalam Fasal 4.4, Bank mempunyai hak dan budi bicara mutlak untuk segera menggantung atau menamatkan, sebagaimana yang dianggap wajar oleh Bank, Kemudahan Tambah Nilai Automatik kepada Pemegang Kad pada bila-bila masa tanpa notis terlebih dahulu:- (a) jika Pemegang Kad melanggar mana-mana terma dalam Perjanjian Pemegang Kad AmBank / AmBank Islamic - Mastercard / Visa; (b) jika Bank mempunyai alasan yang munasabah untuk mempercayai wujudnya penipuan semasa menggunakan Kad Zing atau Kad Zing digunakan untuk tujuan penipuan; (c) jika Kad Zing dilaporkan rosak kepada Bank; (d) jika sistem pembayaran elektronik TNG yang dikendalikan oleh TNGSB gagal, ditukar atau (e) diubah suai; atau sekiranya peristiwa Force Majeure yang menjejaskan kewajipan Bank di dalam ini berterusan untuk tempoh lebih daripada enam (6) bulan dari tarikh ia mula terjadi. 4.6 Pemegang Kad boleh menghubungi Pusat Panggilan (24 jam) Bank di talian untuk meminta Kemudahan Tambah Nilai Automatik diaktifkan semula. Bank boleh atas budi bicara mutlaknya menerima permintaan tersebut, tertakluk kepada pematuhan syarat sedemikian yang ditetapkan oleh Bank terhadap Pemegang Kad untuk mengaktifkan semula Kemudahan Tambah Nilai Automatik. 4.7 Kad Zing tidak boleh ditambah nilai di mana-mana gedung lain atau dengan apa-apa cara lain kecuali menerusi Kemudahan Tambah Nilai Automatik. 4.8 Walau apa pun yang terkandung dalam Fasal 4.3, 4.4 dan 4.5, Kad Zing dan baki Nilai Belum Digunakan di dalamnya tetap sah digunakan untuk tempoh sembilan puluh (90) hari lagi dari tarikh kuat kuasa penamatan Kemudahan Tambah Nilai Automatik. Selepas tamat tempoh sembilan puluh (90) hari tersebut, Kad Zing tidak lagi berfungsi sama sekali dan sebarang baki Nilai Belum Digunakan di dalamnya tidak boleh digunakan dan boleh dibayar balik kepada Pemegang Kad tertakluk kepada Fasal 10 di dalam ini. 5. Pertikaian Mengenai Fungsi Tambah Nilai Automatik 5.1 Sebarang pertikaian oleh Pemegang Kad berkaitan dengan Kemudahan Tambah Nilai Automatik mesti dilaporkan kepada Pusat Panggilan (24 jam) Bank di talian dalam tempoh empat belas (14) hari kalendar dari tarikh penerimaan penyata Kad yang berkenaan.

Tarikh Luput Kad Zing 6.1 Semua Kad Zing yang dikeluarkan adalah tertakluk kepada tarikh luput sepuluh (10) tahun dari tarikh Kad Zing atau apabila Kemudahan Tambah Nilai Automatik dihentikan, yang mana lebih awal ( Tarikh Luput ). Nilai Belum Digunakan di dalam mana-mana Kad Zing adalah sah digunakan untuk tempoh sembilan puluh (90) hari kalendar lagi dari Tarikh Luput, di mana dalam tempoh tersebut Pemegang Kad boleh terus menggunakan Kad Zing sehingga Nilai Belum Digunakan telah digunakan sepenuhnya. 6.2 Tertakluk kepada Fasal 10 di dalam ini, Pemegang Kad boleh meminta Bank untuk membayar balik Nilai Belum Digunakan selepas Tarikh Luput dan sebelum tempoh sembilan puluh (90) hari kalendar dari Tarikh Luput seperti yang dinyatakan dalam Fasal 6.1 di atas. 7. Kehilangan / Kecurian Kad Zing 7.1 Pemegang Kad adalah bertanggungjawab sepenuhnya terhadap sebarang penggunaan Kad Zing yang tidak sah jika ia hilang atau dicuri. 7.2 Pemegang Kad mesti melaporkan kehilangan atau kecurian Kad Zing kepada Pusat Panggilan (24 jam) Bank di talian dengan segera untuk mengelakkan menanggung caj selanjutnya akibat penipuan. 7.3 Walau diberitahu dengan segera oleh Pemegang Kad, TNGSB dan Bank hendaklah diberi masa empat puluh lapan (48) jam dari masa pemberitahuan untuk menamatkan penggunaan Kad Zing dan Kemudahan Tambah Nilai Automatik. 7.4 TNGSB mahupun Bank tidak bertanggungjawab terhadap transaksi yang berlaku atau ditanggung sebelum laporan yang sewajarnya dibuat kepada Pusat Panggilan (24 jam) Bank dan dalam masa empat puluh lapan (48) jam selepas laporan dibuat. Pemegang Kad akan tetap bertanggungjawab sepenuhnya terhadap semua transaksi yang berlaku atau dikenakan ke atas Kad Zing sebelum laporan yang sewajarnya dibuat kepada Pusat Panggilan (24 jam) Bank dan dalam tempoh notis empat puluh lapan (48) jam ini. 7.5 Atas permintaan Pemegang Kad, Kad Zing gantian akan dihantar oleh Bank kepada Pemegang Kad dalam tempoh empat belas (14) hari kalendar dari tarikh permintaan Pemegang Kad, dan yuran penggantian kad sebanyak RM10 (termasuk CBP) akan didebitkan daripada akaun Kad Pemegang Kad yang dihubungkan dengan Kad Zing. 7.6 Tertakluk kepada Fasal 10 di dalam ini, sebarang baki Nilai Belum Digunakan bagi Kad Zing yang hilang atau dicuri selepas empat puluh lapan (48) jam dari masa laporan dibuat menurut Fasal 7.2, akan dikreditkan ke dalam akaun Kad Pemegang Kad yang dihubungkan dengan Kad Zing. 8. Penamatan / Penggantungan Kad Zing 8.1 Pemegang Kad boleh menamatkan Kad Zing dengan menghubungi Pusat Panggilan (24 jam) Bank di talian Bank akan menghentikan Kemudahan Tambah Nilai Automatik dalam masa empat puluh lapan (48) jam selepas menerima panggilan daripada Pemegang Kad. 8.2 Walau apa pun yang terkandung dalam Fasal 8.1, Kad Zing dan Nilai Belum Digunakan di dalamnya tetap sah untuk digunakan bagi tempoh sembilan puluh (90) hari lagi dari tarikh penerimaan arahan penamatan daripada Pemegang Kad. Selepas tamat tempoh sembilan puluh (90) hari tersebut, Kad Zing tidak lagi berfungsi sama sekali dan sebarang Nilai Belum Digunakan di dalamnya tidak boleh digunakan dan boleh dibayar balik kepada Pemegang Kad tertakluk kepada Fasal 10 di dalam ini. 8.3 Penggunaan Kad Zing boleh digantung atau ditamatkan tanpa notis terlebih dahulu sekiranya:- (a) Pemegang Kad melanggar mana-mana Terma dan Syarat ini; (b) akaun Kad Zing milik Pemegang Kad tidak aktif, iaitu Kad Zing tidak digunakan melebihi satu (1) tahun. 8.4 Penamatan Kad Zing tidak akan menjejaskan mana-mana hak Bank dan TNGSB yang terakru sebelum penamatan. 8.5 Dengan syarat bahawa sebab penggantungan atau penamatan Kad Zing telah diselesaikan mengikut kepuasan TNGSB dan/atau Bank, Pemegang Kad boleh mengaktifkan semula Kad Zing dengan menghubungi Pusat Panggilan (24 jam) Bank di talian atau mengunjungi kaunter atau pusat jualan TNGSB yang terdekat. 9. Yuran dan Caj 9.1 TNGSB akan mengenakan caj yang berikut di mana berkenaan:- Yuran untuk Setiap tambah nilai automatik Kaedah Bayaran Debit daripada akaun Kad Pemegang Kad 9.2 Bank akan mengenakan yuran yang berikut di mana berkenaan:- Yuran untuk Pendaftaran Penggantian Kad Zing Kaedah Bayaran Debit dari akaun Kad Pemegang Kad Debit dari akaun Kad Pemegang Kad RM (termasuk CBP) 2 RM (termasuk CBP) Bayaran Dikecualikan 10

8 9.3 Walau apa pun yang dinyatakan di atas, TNGSB dan/atau Bank berhak untuk mengubah semua atau mana-mana yuran dan caj di atas dengan memberi Pemegang Kad notis sekurangkurangnya dua puluh satu (21) hari kalendar terlebih dahulu di bawah Fasal 12 di dalam ini. 10. Bayaran Balik Nilai Belum Digunakan 10.1 Nilai Belum Digunakan akan dibayar balik oleh Bank kepada Pemegang Kad dengan pengkreditan ke dalam akaun Kad milik Pemegang Kad yang dihubungkan dengan Kad Zing tertakluk kepada syarat berikut:- (a) Permintaan untuk bayaran balik akan dilayan hanya bagi Kad Zing yang tamat tempoh, hilang, dicuri, dipalsukan, rosak atau ditamatkan, tetapi tidak dalam apa-apa keadaan lain; (b) Bank menerima permintaan daripada Pemegang Kad untuk bayaran balik melalui e-mel atau panggilan telefon kepada: Pusat Panggilan (24 jam) AmBank / AmBank Islamic Tel : E-mel : customercare@ambankgroup.com (c) Sebarang dan semua yuran yang berkenaan yang dikenakan ke atas Pemegang Kad hendaklah diselesaikan terlebih dahulu seperti dalam Fasal 9, daripada Nilai Belum Digunakan, sebelum bakinya dikembalikan kepada Pemegang Kad Jika Nilai Belum Digunakan tidak dapat dikreditkan ke dalam akaun Kad milik Pemegang Kad yang dihubungkan dengan Kad Zing menurut Fasal 10.1, Bank akan mengkreditkan Nilai Belum Digunakan ke dalam akaun deposit Pemegang Kad seperti yang dinasihatkan oleh Pemegang Kad kepada Bank. 11. Pindaan Terma dan Syarat Ini 11.1 Bank berhak untuk meminda, menambah atau menggugurkan sebarang Terma dan Syarat dari semasa ke semasa dengan: (a) memaklumkan Pemegang Kad sekurang-kurangnya dua puluh satu (21) hari kalendar lebih awal; dan (b) memaklumkan dan menerbitkan Terma dan Syarat baharu sebelum tarikh kuat kuasa dengan sebarang cara yang dianggap wajar oleh Bank. 12. Notis 12.1 Sebarang notis daripada TNGSB atau Bank kepada Pemegang Kad menurut Terma dan Syarat di dalam ini akan diberikan dengan:- (a) mengirim notis ke alamat terakhir Pemegang Kad di dalam rekod Bank; atau (b) memaparkan notis di TNGSB atau di cawangan Bank, atau di mana-mana pusat jualan Touch n Go TNGSB; atau (c) penerbitan di laman web TNGSB, atau laman web Bank, ambank.com.my; atau (d) apa-apa cara lain yang dianggap perlu oleh TNGSB dan/atau Bank. dan hendaklah dianggap telah diserahkan kepada Pemegang Kad:- (a) jika dihantar dengan tangan atau kurier, pada masa penghantaran; (b) jika dihantar melalui pos, pada hari perniagaan ke-5 selepas pengeposan; (c) jika dipaparkan di cawangan Bank atau premis TNGSB atau mana-mana pusat jualan Touch n Go TNGSB, pada tarikh pemberitahuan tersebut pertama kali dipaparkan; (d) jika diterbitkan di atau ambank.com.my, pada tarikh penerbitan. 13. Force Majeure 13.1 Setakat yang dibenarkan oleh undang-undang, Bank atau TNGSB tidak akan bertanggungjawab terhadap Pemegang Kad bagi apa-apa kerugian atau kos yang disebabkan oleh sebarang kelewatan atau kegagalan dalam melaksanakan tanggungjawab di bawah ini jika kelewatan atau kegagalan tersebut adalah disebabkan oleh bencana alam, peperangan (sama ada diisytiharkan atau tidak), mogok, rusuhan, kekacauan awam, letupan, gangguan umum, keganasan, pertikaian perindustrian, kekacauan buruh, sekat masuk kerja, kebakaran, kemalangan, kerosakan mesin atau sistem komputer atau pautan penghantaran atau kegagalan sistem telekomunikasi atau kegagalan elektrik, sebarang tindakan atau kegagalan bertindak pengendali telekomunikasi yang lain atau apa-apa sebab atau keadaan lain di luar kawalan Bank atau TNGSB yang mana berkenaan. 14. Pendedahan 14.1 Pemegang Kad dengan ini memberi kuasa kepada Bank untuk mendedahkan sebarang maklumat mengenai Pemegang Kad kepada TNGSB untuk memudahkan penggunaan Kad Zing Pemegang Kad mengesahkan bahawa Pemegang Kad telah membaca, memahami dan bersetuju untuk terikat dengan Notis Privasi Kumpulan AmBank yang terdapat di cawangan AmBank / AmBank Islamic dan laman web dan membenarkan Kumpulan AmBank untuk memproses data peribadinya bagi kegunaan seperti yang dinyatakan di dalam Notis Privasi tersebut.
