2 TERMS & CONDITIONS RELATING TO REWARDS AVAILABLE UNDER THE CIMB TESCO PLATINUM CREDIT CARD The rewards available under the CIMB TESCO PLATINUM CREDIT CARD ( Co-Brand Card ) are established by CIMB Bank Berhad (13491-P) ( CIMB ) in conjunction with TESCO STORES (MALAYSIA) SDN. BHD. ( K) ( Tesco ) and shall be subject to the terms and conditions hereinafter set out and read in conjunction with the prevailing Cardholder(s) Terms and Conditions ( CIMB Cardholder Agreement ). All the expressions in these terms and conditions if not specifically defined shall have the same meaning as defined in the CIMB Cardholder Agreement. In the event of any discrepancy or inconsistency between the terms and conditions herein and those contained in the CIMB Cardholder Agreement, these terms and conditions governing the rewards shall prevail in so far as they apply to the Co-Brand Card. 1. Definitions and Interpretation 1.1. Unless the context otherwise requires the following words and expressions shall have the meanings respectively set out opposite them: Cash Rebate means cash earned by the Co-Brand Cardholder in respect of expenditure charged to the Co- Brand Card. Points means points earned by the Principal Co-Brand Cardholder in respect of expenditure charged to the Co-Brand Card. Co-Brand Card means the CIMB TESCO PLATINUM CREDIT CARD issued by CIMB, which includes Tesco s logo imprinted thereon, and/or any other name, logo and/or trademark as may be determined by CIMB from time to time, unless otherwise stated. Co-Brand Cardholder(s) means the holders of the Co-Brand Card, and includes both principal and supplementary cardholders, unless otherwise stated. Maximum Cash Rebate means the maximum amount of cash that can be earned by the Co-Brand Cardholder within one Co-Brand Card billing cycle to another. Merchant means any retailer or other person, firm or corporation, its employees, servants or agents which agrees to accept or cause its offices, outlets, shops, stores, business premises and locations in Malaysia or elsewhere to accept the Co-Brand Card when properly presented to allow a Co-Brand Cardholder to make credit card transaction to the Co-Brand Card. Non-Tesco Products and Services means the products and services other than Tesco Products and Services. Principal Co-Brand Cardholder means the principal cardholders to which CIMB has issued the Co-Brand Card. Reward Program means the program under which Co-Brand Cardholders are entitled to earn Points and receive the Cash Rebate. Supplementary Co-Brand Cardholder means a holder of a supplementary Co-Brand Card issued by CIMB at the request of the Principal Co-Brand Cardholder. Tesco means TESCO STORES (MALAYSIA) SDN BHD (Company no K), a company incorporated in Malaysia under the Companies Act 1965 having its registered address at Level 8, Symphony House, Block D13, Pusat Dagangan Dana 1, Jalan PJU 1A/46, Petaling Jaya, Selangor Darul Ehsan, Malaysia. Tesco Stores means any retail outlet operated and managed by Tesco in Malaysia designated as a Tesco store for the purposes of these terms and conditions. Tesco Products and Services means the products and services offered by Tesco at the sales floor within Tesco Stores.

3 1.2. Unless there is something in the subject or context inconsistent with such construction or unless it otherwise expressly provided: a) words denoting one gender include all other genders and words denoting the singular include the plural and vice versa; b) words denoting persons shall also include their respective heirs, personal representatives, and successors in title or permitted assigns; c) any reference to a sub-clause, clause or party is to the relevant sub-clause, clause or party of and to these terms and conditions and includes all amendments and modifications made to these terms and conditions from time to time in force; d) any reference to a statutory provision includes any modification, consolidation or re-enactments for the time being in force, and all statutory instruments or orders made pursuant thereto; e) the word Ringgit Malaysia and the abbreviation RM mean the lawful currency of Malaysia; f) any reference to a Business Day is to a day on which CIMB is open for business in Kuala Lumpur; g) if any period of time falls on a day, which is not a Business Day, then that period is to be deemed to only expire on the next business day; h) the headings in these terms and conditions are inserted merely for convenience of reference and shall not affect the interpretation of the provisions herein contained; 2. Reward Program 2.1 The rewards available under the Co-Brand Card as stated herein are only applicable to the Co-Brand Cardholders whose accounts are current, valid, subsisting and who are not in default of any of the terms of the CIMB Cardholder Agreement. 2.2 Subject to the terms and conditions set out herein, Co-Brand Cardholders shall be eligible for the rewards of the Co-Brand Card in the following manner: Cash Rebate for spending on Tesco Products and Services a) 5% Cash Rebate is awarded to Co-Brand Cardholders for transactions spend on Tesco Products and Services at Tesco Stores for a particular billing cycle provided that the total Statement Balance* of the relevant Co-Brand Card at the end of such billing cycle (as evidenced in the relevant monthly billing statement) is RM3,000 and above; and b) 2% Cash Rebate is awarded to Co-Brand Cardholders for transactions spend on Tesco Products and Services at Tesco Stores for a particular billing cycle in the event the total Statement Balance* of the relevant Co-Brand Card at the end of such billing cycle (as evidenced in the relevant monthly billing statement) is below RM3,000; c) Maximum Cash Rebate which a Principal Co-Brand Cardholder and/or a Supplementary Co-Brand Cardholder can earn for transactions spend on Tesco Products and Services at Tesco Stores is capped at a total of RM50/per Co-Brand Cardholder/per monthly statement. *Statement Balance includes any outstanding balances which are carried forward from the previous month s statement and new transactions made during the current month on a Co- Brand Card. For the avoidance of doubt, Statement Balance shall be calculated separately for principal and each supplementary Co-Brand Card and no combination of the principal and supplementary(ies) Statement Balance shall be allowed for purposes of earning the Cash Rebate.

4 2.2.2 Points a) In addition to the Cash Rebate referred to in clause above, the Principal Co-Brand Cardholder will also be entitled to earn Points at the following rates:- Spending on Tesco Products and Services at Tesco Stores Spending on Non Tesco Products and Services at other Merchants excluding the transactions set out in clause 2.4 below For every RM2 charged to the Co-Brand Card (including transactions charged using the supplementary Co-Brand Card(s), the Principal Co- Brand Cardholder will earn one (1) Point For every RM4 charged to the Co-Brand Card (including transactions charged using the supplementary Co-Brand Card(s), the Principal Co- Brand Cardholder will earn one (1) Point b) There is no maximum amount of Points which a Principal Co-Brand Cardholder can earn under clause 2.2.2(a). 2.3 Additional Cash Rebate and Points may be given from time to time on tactical campaigns to promote the Reward Program. 2.4 The following transactions are herein expressly excluded from the Reward Program and shall not be entitled to any Cash Rebate and or Points:- (i) Purchase of petrol, diesel and any other purchases made at the petrol kiosk; (ii) Balance Transfer, CashLite, cash deposit, cash advance and cash withdrawal transactions; (iii) Quasi Cash transactions (example: betting and/or gaming transactions); (iv) Reversals, fraudulent retail transactions, disputed transactions by the Co-Brand Cardholder; (v) Government tax, similar taxes, late payment charges and payment of any other fees and charges; (vi) Instalment Payment Plan transactions; (vii) Recurring payments transactions. (viii) Lump sum repayment of the original transaction amount which the Co-Brand Card Cardholder has previously effected to make repayment of such original transaction by monthly installments under any installment payment facility provided by CIMB or other banks. (ix) Payments to charity under designated Merchant Category Code (MCC) Charitable and social service organisations; and (x) Any government related payments under designated MCC below: Court costs, including alimony and child support 9222 Fines 9223 Bail and bond payments 9311 Tax payments 9399 Government services 9402 Postal services government only 9405 Intra-Government Purchases-Government only 2.5 Any determination by CIMB as to whether a transaction(s) falls within clause 2.4 (i) to (x) and are excluded from the entitlement to Cash Rebate and or the Point(s) shall be final and conclusive save for manifest error. 2.6 If any transactions are being reversed, the reversal will result in the Cash Rebate and/or Points being reversed. The applicable percentage of Cash Rebate will be based on the current month s percentage of Cash Rebate.

If any transactions are disputed or alleged to be fraudulent, the Cash Rebate and Points earned on such transactions may be reversed or cancelled by CIMB at its sole and absolute discretion. 2.8 Treatment of Cash Rebate earned by Co-Brand Cardholder a) The Cash Rebate earned by the Co-Brand Cardholder for each current month will be calculated (rounded down to the nearest Malaysian Ringgit) up until the statement date and will be posted to the Co-Brand Cardholder(s) s account in the following month s statement. b) The Cash Rebate earned shall be applied firstly towards settlement of the interest incurred (if any). In the event the Cash Rebate earned is more than the interest incurred, the remaining Cash Rebate earned shall be utilized towards payment for retail transaction(s) made. 2.9 Treatment of Points earned by Principal Co-Brand Cardholder a) Point(s) earned pursuant to transactions charged using the Co-Brand Card (including transactions charged using the supplementary Co-Brand Card(s)) will be calculated (rounded down to the nearest point) and credited to the Principal Co-Brand Cardholder s Tesco account, provided the Principal Co-Brand Cardholder is a Tesco holder and has updated his/her Tesco number with CIMB. b) It is the responsibility of the Principal Co-Brand Cardholder to ensure the accuracy of their Tesco number recorded in CIMB s records. The Principal Co-Brand Cardholder may contact the

6 customer services number stipulated at the back of their Co-Brand Card to update CIMB s records. In the event of a lost or replaced Tesco, the Principal Co-Brand Cardholder shall be responsible to update their new Tesco number with CIMB. CIMB reserves the right to forfeit Point(s) earned in the event of the Principal Co-Brand Cardholder s failure to update and or ensure the accuracy of the Tesco number maintained in CIMB s records. c) Point(s) earned shall accrue to the Principal Co-Brand Cardholder and shall be reflected in the Principal Co-Brand Cardholder s monthly billing statement The Points earned are not transferable and the Principal Co-Brand Cardholder shall not be permitted to nominate another person or any other third party to receive or utilize the Points earned The Principal Co-Brand Cardholder hereby acknowledges that there will be a lapse of time between a transaction being made using the Co-Brand Card and the crediting of the Point(s) to his/her Tesco account. As such, CIMB and Tesco do not represent or warrant that any Point(s) earned under the Co-Brand Card will immediately be available for redemption at Tesco Stores In the event the Co-Brand Cardholder s Co-Brand Card and/or Tesco is temporarily suspended, the Principal Co-Brand Cardholder acknowledges and agrees that the Point(s) earned on transactions carried out on the Co-Brand Card, but which have not yet been credited to the Principal Co-Brand Cardholder s Tesco account will not be credited but will continue to accumulate and only be credited when the suspension is uplifted on the Co-Brand Cardholder s Co-Brand Card and/or Tesco. In the event that the Co-Brand Cardholder s Co-Brand Card and/or Tesco is terminated any Point(s) earned will be cancelled and/or forfeited The Tesco is owned and operated by Tesco. The terms and conditions governing the use of Point(s) can be found on Tesco s website at For any enquiries relating to Tesco and/or Points, the Co-Brand Cardholder may call Tesco s Helpline at Tesco reserves the right to vary the said terms and conditions at any time for legal, regulatory, business or policy reasons The rewards under the Reward Program are awarded subject to the following terms: a) Co-Brand Card account is not cancelled, terminated or suspended by CIMB. b) Co-Brand Card account is valid and has good credit standing with no default payments in the Co-Brand Cardholder s account; and c) Rewards awarded are not transferable to any third party and not exchangeable for cash, credit or kind. 3. Insurance Coverage 3.1. For the avoidance of doubt, there is no insurance coverage or any other similar benefits available under the Co-Brand Card. 4. General Provisions 4.1. The Co-Brand Cardholder hereby expressly covenants and undertakes with CIMB that it shall be the duty of the Co-Brand Cardholder to report to CIMB in writing within such time period as may be specified by CIMB in the CIMB Cardholder Agreement of any error, discrepancy or inaccuracy of any kind whatsoever indicated in the billing statement, particularly in relation to the transactions relating to the Cash Rebate and the point(s) earned. In the event that the Co-Brand Cardholder does not within the time period specified in the CIMB Cardholder Agreement notify CIMB in writing of any such error, discrepancy or inaccuracy then the Co- Brand Cardholder shall be deemed to have accepted the entry therein as correct and as final and conclusive evidence of the facts contained therein and the statement shall be considered as binding against the Co- Brand Cardholder and the Co-Brand Cardholder shall thereafter be precluded from making any claims against CIMB by alleging that the said statement contains any error, discrepancy or inaccuracy.

7 4.2. CIMB reserves the right to vary the Cash Rebate rate or the Points earn rate or impose limits on the benefits accorded on the Co-Brand Card or vary, suspend for a definite period or indefinitely, cancel, terminate or replace the Reward Program with alternative reward program deemed suitable by it at any time and from time to time upon giving twenty one (21) calendar days prior notice to the Co-Brand Cardholder. Such variation shall be effective on the date stipulated in the letter or any other communication methods used to notify the Co-Brand Cardholder(s) as provided for in the CIMB Cardholder Agreement. Without limiting the generality of the foregoing provisions, CIMB will not be liable for such variation, suspension, cancellation, termination or replacement of the Reward Program or the benefits available there under nor for any losses or damages whatsoever and howsoever incurred by the Co-Brand Cardholder as a direct or indirect result of the act of variation, suspension, cancellation, termination or replacement The Co-Brand Cardholder further agrees to access CIMB s website via regularly to view these terms and conditions, and to ensure that they are kept up-to-date with any changes to these terms and conditions For the purpose of calculating the Cash Rebate and/or Points, foreign currency spending of the Co- Brand Cardholder will be converted to Ringgit Malaysia in accordance with the terms specified in the CIMB Cardholder Agreement. CIMB s records on Cash Rebate and/or Points earned by the Co-Brand Cardholder shall be conclusive and binding save for manifest error The rewards afforded to the Co-Brand Cardholder as set out in clause 2 of these terms and conditions are in lieu of bonus points and/or any other rewards usually associated with CIMB s other credit cards unless otherwise expressly stated or specified pursuant to tactical campaigns organized by CIMB Where the Co-Brand Cardholder has elected to make repayment of the transaction by monthly installments under any installment payment facility provided by CIMB, the rewards accorded are only granted to the Co- Brand Cardholder based on the amount of monthly installment posted on the Co-Brand Cardholder(s) s billing statement each month CIMB reserves the right upon giving twenty-one (21) calendar days prior notice to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) (hereinafter called the Amendment ) any of these terms and conditions and the Amendment shall become effective on such date as CIMB may elect to adopt. Any Amendment to the provisions herein may be effectively notified to the Co- Brand Cardholder(s) by way of any of the communication methods used to notify the Co-Brand Cardholder(s) of amendments to the CIMB Cardholder Agreement as provided for in the CIMB Cardholder Agreement CIMB reserves the right to share the Co-Brand Cardholder s information contained in the Co-Brand Cardholder s application form for the Co-Brand Card with Tesco, its successor or any of its related companies to enable the Co-Brand Cardholder to enjoy the rewards, services and benefits offered under the Co-Brand Card These terms and conditions shall prevail over any representations contained in any other promotional or advertising materials advertising the Co-Brand Card If there is/(are) any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version or other language version of these terms and conditions herein, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned, where request had been made by the Co-Brand Cardholder and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Co-Brand Card, then the Bahasa Malaysia version of the terms and conditions herein shall prevail.

9 TERMA-TERMA & SYARAT-SYARAT BERKENAAN DENGAN GANJARAN YANG DISEDIAKAN DI BAWAH KAD KREDIT PLATINUM CIMB TESCO Ganjaran yang disediakan di bawah KAD KREDIT PLATINUM CIMB TESCO ( Kad Dwi-Jenama ) adalah ditawarkan oleh CIMB Bank Berhad (13491-P) ( CIMB ) bersama-sama dengan TESCO STORES (MALAYSIA) SDN. BHD. ( K) ( Tesco ) dan hendaklah tertakluk kepada terma-terma dan syarat-syarat yang dinyatakan selepas ini dan dibaca bersama-sama dengan Terma-terma Dan Syarat-syarat Pemegang Kad semasa ( Perjanjian Pemegang Kad CIMB ). Semua ungkapan dalam terma-terma dan syarat-syarat ini jika tidak ditakrifkan secara khusus hendaklah mempunyai maksud yang sama sebagaimana yang ditakrifkan dalam Perjanjian Pemegang Kad CIMB. Sekiranya terdapat sebarang percanggahan atau ketidakselarasan antara terma-terma dan syarat-syarat di sini dan terma-terma dan syarat-syarat yang terkandung dalam Perjanjian Pemegang Kad CIMB, terma-terma dan syarat-syarat ini yang mengawal ganjaran akan mengatasi yang lain setakat mana ia terpakai bagi Kad Dwi-Jenama. 1. Definisi dan Pentafsiran 1.1. Melainkan jika konteks menghendaki sebaliknya, perkataan-perkataan dan ungkapan-ungkapan berikut hendaklah membawa maksud yang masing-masingnya dinyatakan di sebelahnya: Rebat Tunai bermaksud tunai yang diperolehi oleh Pemegang Kad Dwi-Jenama berhubung dengan perbelanjaan yang dicaj ke Kad Dwi-Jenama. Mata bermaksud mata yang diperolehi oleh Pemegang Kad Dwi-Jenama Utama berhubung dengan perbelanjaan yang dicaj ke Kad Dwi-Jenama. Kad Dwi-Jenama bermaksud KAD KREDIT PLATINUM CIMB TESCO yang dikeluarkan oleh CIMB, yang termasuk logo Tesco yang dicetak padanya, dan/atau apa-apa nama, logo dan/atau tanda dagangan lain sebagaimana yang ditentukan oleh CIMB dari semasa ke semasa, kecuali dinyatakan sebaliknya. Pemegang Kad Dwi-Jenama bermaksud pemegang-pemegang Kad Dwi-Jenama, dan termasuk pemegang kad utama dan tambahan, kecuali dinyatakan sebaliknya. Rebat Tunai Maksimum bermaksud maksimum amaun tunai yang boleh diperolehi oleh Pemegang Kad Dwi-Jenama dalam satu kitaran bil Kad Dwi-Jenama hingga yang lain. Peniaga bermaksud mana-mana peruncit atau orang, firma atau perbadanan lain, pekerja, kakitangan atau agennya yang bersetuju untuk menerima atau menyebabkan pejabat, outlet, kedai, stor, premis dan lokasi perniagaan di Malaysia atau tempat lain untuk menerima Kad Dwi-Jenama apabila dikemukakan dengan baik untuk membenarkan Pemegang Kad Dwi-Jenama untuk melakukan transaksi kad kredit kepada Kad Dwi- Jenama. Bukan Tesco bermaksud produk-produk dan servis selain daripada Product dan Servis Tesco. Pemegang Kad Dwi-Jenama Utama bermaksud pemegang kad utama yang CIMB telah mengeluarkan Kad Dwi-Jenama. Program Ganjaran bermaksud program di mana Pemegang Kad Dwi-Jenama adalah layak untuk memperoleh Mata dan menerima Rebat Tunai. Pemegang Kad Dwi-Jenama Tambahan bermaksud pemegang Kad Dwi-Jenama tambahan yang dikeluarkan oleh CIMB atas permintaan Pemegang Kad Dwi-Jenama Utama. Tesco bermaksud TESCO STORES (MALAYSIA) SDN BHD (no. Syarikat K), sebuah syarikat yang diperbadankan di Malaysia di bawah Akta Syarikat 1965 dan mempunyai alamat berdaftarnya di Level 8, Symphony House, Block D13, Pusat Dagangan Dana 1, Jalan PJU 1A/46, Petaling Jaya, Selangor Darul Ehsan, Malaysia. Stor Tesco bermaksud mana-mana stor runcit yang dikendalikan dan diuruskan oleh Tesco di Malaysia yang ditetapkan sebagai stor Tesco untuk tujuan terma-terma dan syarat-syarat ini. Tesco bermaksud produk-produk dan servis yang ditawarkan oleh Tesco di tingkat jualan dalam Stor Tesco.

Melainkan terdapat sesuatu di dalam subjek atau konteks yang tidak konsisten dengan konstruksi tersebut atau melainkan jika ia dinyatakan sebaliknya dengan nyata: a) perkataan yang merujuk kepada satu jantina merangkumi semua jantina lain dan perkataan yang merujuk kepada bilangan tunggal merangkumi bilangan jamak dan sebaliknya; b) perkataan yang merujuk kepada orang hendaklah merangkumi waris, wakil peribadi, dan pengganti hakmilik atau pemegang serah hak yang dibenarkan masing-masingnya; c) apa-apa rujukan kepada sub-klausa, klausa atau pihak adalah kepada sub-klausa, klausa atau pihak yang berkaitan dengan terma-terma dan syarat-syarat ini dan termasuk semua pindaan dan pengubahsuaian yang dibuat kepada terma-terma dan syarat-syarat ini dari semasa ke semasa yang berkuat kuasa; d) apa-apa rujukan kepada peruntukan perundangan termasuk apa-apa modifikasi, penyatuan atau penggubalan semula yang pada masa itu berkuatkuasa, dan semua instrumen perundangan atau perintah yang dibuat menurutnya; e) perkataan Ringgit Malaysia dan singkatan RM bermaksud mata wang sah Malaysia; f) apa-apa rujukan kepada Hari Perniagaan kepada hari di mana CIMB buka untuk perniagaan di Kuala Lumpur; g) jika apa-apa tempoh masa jatuh pada hari yang bukan Hari Perniagaan, maka tempoh itu hendaklah dianggap hanya tamat pada hari perniagaan yang berikutnya; h) tajuk dalam terma-terma dan syarat-syarat ini adalah dimasukkan hanya untuk memudahkan rujukan dan tidak harus menjejaskan taksiran peruntukan yang terkandung di sini; 2. Ganjaran disediakan di bawah Kad Dwi-Jenama seperti yang dinyatakan di sini hanya terpakai untuk Pemegang Kad Dwi-Jenama yang mempunyai akaun yang semasa, sah, wujud dan yang tidak berada dalam keingkaran mana-mana terma-terma Perjanjian Pemegang Kad CIMB Tertakluk kepada terma-terma dan syarat-syarat yang dinyatakan di sini, Pemegang Kad Dwi-Jenama hendaklah layak untuk ganjaran Kad Dwi-Jenama dengan cara berikut: Rebat Tunai bagi perbelanjaan ke atas Tesco a) 5% Rebat Tunai akan diberikan kepada Pemegang Kad Dwi-Jenama untuk transaksi yang dibelanjakan ke atas Tesco di Stor Tesco untuk kitaran bil tertentu dengan syarat bahawa jumlah Baki Penyata* Kad Dwi-Jenama berkenaan pada akhir kitaran bil tersebut (seperti yang dibuktikan dalam penyata bil bulanan yang berkenaan) adalah RM3,000 dan ke atas; dan b) 2% Rebat Tunai akan diberikan kepada Pemegang Kad Dwi-Jenama untuk transaksi yang dibelanjakan ke atas Tesco di Stor Tesco untuk kitaran bil tertentu sekiranya jumlah Baki Penyata* Kad Dwi-Jenama berkenaan pada akhir kitaran bil tersebut (seperti yang dibuktikan dalam penyata bil bulanan yang berkenaan) adalah di bawah RM3,000; c) Maksimum Rebat Tunai yang boleh diperolehi oleh Pemegang Kad Dwi-Jenama Utama dan/atau Pemegang Kad Dwi-Jenama Tambahan untuk transaksi yang dibelanjakan ke atas Produk dan Servis Tesco di Stor Tesco adalah dihadkan pada jumlah RM50/setiap Pemegang Kad Dwi- Jenama/setiap penyata bulanan. *Baki Penyata termasuk apa-apa baki yang belum dijelaskan yang dibawa ke hadapan dari penyata bulanan sebelumnya dan transaksi-transaksi baru yang dibuat pada bulan semasa ke atas Kad Dwi-Jenama. Bagi mengelakkan keraguan, Baki Penyata hendaklah dikira secara berasingan bagi Kad Dwi-Jenama utama dan setiap Kad Dwi-Jenama tambahan dan tiada gabungan Baki Penyata Kad Dwi-Jenama utama dan tambahan akan dibenarkan bagi tujuan mendapakan Rebat Tunai.

11 Mata a) Sebagai tambahan kepada Rebat Tunai yang dirujuk dalam Klausa di atas, Pemegang Kad Dwi-Jenama Utama juga layak untuk memperolehi Mata pada kadar berikut:- Perbelanjaan ke atas Tesco di Stor Tesco Perbelanjaan ke atas Produk dan Servis Bukan Tesco di Peniaga lain tidak termasuk transaksi-transaksi yang dinyatakan dalam klausa 2.4 di bawah Bagi setiap RM2 yang dicaj kepada Kad Dwi-Jenama (termasuk transaksi yang dicaj menggunakan Kad Dwi- Jenama tambahan), Pemegang Kad Dwi-Jenama Utama akan mendapat satu (1) Mata Bagi setiap RM4 yang dicaj kepada Kad Dwi-Jenama (termasuk transaksi yang dicaj menggunakan Kad Dwi- Jenama tambahan), Pemegang Kad Dwi-Jenama Utama akan mendapat satu (1) Mata b) Tiada jumlah maksimum Mata yang boleh diperolehi oleh Pemegang Kad Dwi-Jenama Utama di bawah klausa (a) Rebat Tunai dan Mata tambahan boleh diberikan dari semasa ke semasa pada kempen taktikal untuk mempromosikan Program Ganjaran Transaksi-transaksi berikut adalah secara nyata dikecualikan daripada Program Ganjaran dan tiada Rebat Tunai atau Mata akan diberikan:- (i) Pembelian petrol, diesel dan sebarang pembelian lain yang dibuat di stesen minyak; (ii) Pindahan Baki, Cash Lite dan transaksi-transaksi deposit wang tunai, pendahuluan wang tunai dan pengeluaran wang tunai; (iii) Transaksi-transaksi Tunai Separa (Quasi) (sebagai contoh: transaksi-transaksi judi dan/atau perjudian); (iv) Pembalikan, transaksi runcit penipuan, transaksi yang dipertikaikan oleh Pemegang Kad Dwi-Jenama; (v) Cukai kerajaan atau cukai yang bersamaan dengannya, caj-caj bayaran lewat dan bayaran fee dan caj yang lain; (vi) Transaksi Pelan Pembayaran Ansuran; (vii) Transaksi Pembayaran Berulang; (viii) Pembayaran balik sekaligus jumlah asal transaksi-transaksi di mana Pemegang Kad Dwi-Jenama telah dahulunya memilih untuk membuat pembayaran balik transaksi asal tersebut secara ansuran bulanan di bawah apa-apa kemudahan bayaran ansuran yang telah diberikan oleh CIMB atau mana-mana institusi kewangan lain. (ix) Pembayaran kepada badan amal di bawah Kod Kategori Peniaga (MCC) Perbadanan amal dan organisasi perkhidmatan sosial; dan (x) Sebarang pembayaran berkaitan kerajaan di bawah MCC yang ditetapkan di bawah: Kos mahkamah, termasuk nafkah cerai dan nafkah anak 9222 Denda 9223 Ikat jamin dan pembayaran bon 9311 Pembayaran cukai 9399 Perkhidmatan Kerajaan 9402 Perkhidmatan pos - kerajaan sahaja 9405 Pembelian Antara Kerajaan - Kerajaan sahaja 2.5. Sebarang keputusan oleh CIMB sama ada sesuatu transaksi terjatuh dalam klausa 2.4 (i) hingga (x) dan dikecualikan daripada hak mendapat Rebat Tunai dan/atau Mata adalah muktamad dan konklusif kecuali untuk kesilapan nyata.

12 2.6. Sekiranya apa-apa transaksi telah dibalikkan, pembalikan akan menyebabkan Rebat Tunai dan/atau Mata dibalikkan. Peratusan Rebat Tunai yang terpakai akan berdasarkan pada tahap Rebat Tunai bulan semasa. Rebat Tunai dan Mata yang diperolehi oleh Pemegang Kad Dwi-Jenama untuk bulan semasa tidak akan diposkan ke kad akaun Pemegang Kad Dwi-Jenama dalam penyata bulanan berikutnya sekiranya Pemegang Kad Dwi-Jenama gagal untuk membuat pembayaran minimum yang kena dibayar pada tarikh matang pembayaran seperti yang dinyatakan di dalam penyata bulan semasa Pemegang Kad Dwi-Jenama. Sekiranya apa-apa transaksi dipertikaikan atau didakwa sebagai penipuan, Rebat Tunai dan Mata yang diperolehi daripada transaksi tersebut boleh dibalikkan atau dibatalkan oleh CIMB atas budi bicara tunggal dan mutlaknya Pengendalian Rebat Tunai yang diperolehi oleh Pemegang Kad Dwi-Jenama a) Rebat Tunai yang diperolehi oleh Pemegang Kad Dwi-Jenama bagi setiap bulan semasa akan dikira (digenapkan ke bawah kepada Ringgit Malaysia yang terdekat) sehingga tarikh penyata dan akan diposkan ke akaun Pemegang Kad Dwi-Jenama dalam penyata bulanan yang berikutnya.

13 b) Rebat Tunai yang diperolehi hendaklah terpakai terdahulu ke atas penyelesaian faedah yang tertanggung (sekiranya ada). Sekiranya Rebat Tunai yang diperolehi melebih faedah yang tertanggung, baki Rebat Tunai yang diperolehi hendaklah terpakai ke atas pembayaran bagi pembelian runcit yang dilakukan Pengendalian Mata yang diperolehi oleh Pemegang Kad Dwi-Jenama Utama a) Mata yang diperolehi daripada transaksi-transaksi yang dicaj menggunakan Kad Dwi-Jenama (termasuk transaksi-transaksi yang dicaj menggunakan Kad Dwi-Jenama tambahan) akan dikira (digenapkan ke bawah kepada Mata yang terdekat) dan dikreditkan ke akaun Tesco Pemegang Kad Dwi-Jenama Utama, dengan syarat Pemegang Kad Dwi-Jenama Utama adalah pemegang Tesco dan telah mengemaskini nombor Tesco nya dengan CIMB. b) Pemegang Kad Dwi-Jenama Utama adalah bertanggungjawab untuk memastikan ketepatan nombor Tesco nya yang direkodkan dalam rekod CIMB ini. Pemegang Kad Dwi-Jenama Utama boleh menghubungi nombor perkhidmatan pelanggan yang dinyatakan di belakang Kad Dwi-Jenama mereka untuk mengemaskinikan rekod CIMB. Sekiranya berlaku kehilangan atau penggantian Tesco, Pemegang Kad Dwi-Jenama Utama adalah bertanggungjawab untuk mengemaskini nombor Tesco baru mereka dengan CIMB. CIMB menyimpan hak untuk menarikbalik Mata yang diperolehi sekiranya Pemegang Kad Dwi-Jenama Utama gagal mengemaskini dan/atau memastikan ketepatan nombor Tesco yang dikekalkan dalam rekod CIMB. c) Mata yang diperolehi hendaklah terakru kepada Pemegang Kad Dwi-Jenama Utama dan hendaklah ditunjukkan dalam penyata bil bulanan Pemegang Kad Dwi-Jenama Utama Mata diperolehi tidak boleh dipindahmilik dan Pemegang Kad Dwi-Jenama Utama tidak dibenarkan untuk menamakan orang lain atau mana-mana pihak ketiga yang lain untuk menerima atau menggunakan Mata yang diperolehi Pemegang Kad Dwi-Jenama Utama dengan ini mengakui bahawa akan ada selang masa antara transaksi yang dibuat menggunakan Kad Dwi-Jenama dan pengkreditan Mata ke akaun Tesco nya. Oleh itu, CIMB dan Tesco tidak memberi representasi atau menjamin bahawa sebarang Mata yang diperolehi di bawah Kad Dwi-Jenama akan tersedia dengan segara untuk penebusan di Stor Tesco Sekiranya Kad Dwi-Jenama dan/atau Tesco Pemegang Kad Dwi-Jenama digantung buat sementara waktu, Pemegang Kad Dwi-Jenama Utama mengakui dan bersetuju bahawa Mata yang diperolehi daripada transaksi-transaksi yang dilakukan pada Kad Dwi-Jenama, tetapi yang masih belum dikreditkan ke akaun Tesco Pemegang Kad Dwi-Jenama Utama tidak akan dikreditkan tetapi akan terus mengumpul dan hanya dikreditkan apabila penggantungan Kad Dwi-Jenama dan/atau Tesco Pemegang Kad Dwi-Jenama ditarikbalik. Sekiranya Kad Dwi-Jenama dan/atau Tesco Pemegang Kad Dwi-Jenama ditamatkan, sebarang Mata yang diperolehi akan dibatalkan dan/atau ditarikbalik Tesco dimiliki dan dikendalikan oleh Tesco. Terma-terma dan syarat-syarat yang mengawal penggunaan Mata boleh didapati di laman web Tesco di Untuk sebarang pertanyaan berkaitan dengan Tesco dan/atau Mata, Pemegang Kad Dwi-Jenama boleh menghubungi Talian Bantuan Tesco di Tesco menyimpan hak untuk mengubah terma-terma dan syarat-syarat tersebut pada bila-bila masa atas sebab-sebab undang-undang, kawal selia, perniagaan atau dasar Ganjaran di bawah Program Ganjaran adalah diberikan tertakluk kepada syarat-syarat berikut: a) akaun Kad Dwi-Jenama tidak dibatalkan, ditamatkan atau digantung oleh CIMB; b) akaun Kad Dwi-Jenama adalah sah dan mempunyai kedudukan kredit yang baik dengan tiada bayaran tertunggak di dalam akaun Pemegang Kad Dwi-Jenama; dan c) Ganjaran yang diberikan tidak boleh dipindahmilik kepada mana-mana pihak ketiga dan tidak boleh ditukar dengan wang tunai, kredit atau barangan lain.

14 3. Perlindungan Insurans 3.1. Bagi mengelakkan keraguan, tidak ada perlindungan insurans atau apa-apa manfaat lain yang bersamaan dengannya akan diberikan di bawah Kad Dwi-Jenama. 4. Peruntukan Am 4.1. Pemegang Kad Dwi-Jenama dengan ini berjanji dan mengaku janji dengan CIMB bahawa Pemegang Kad Dwi- Jenama adalah bertanggungjawab untuk melaporkan kepada CIMB secara bertulis dalam tempoh masa sebagaimana yang ditentukan oleh CIMB dalam Perjanjian Pemegang Kad CIMB mengenai sebarang kesilapan, percanggahan atau ketidaktepatan dalam apa jua bentuk yang dinyatakan dalam penyata bil, terutamanya berhubung dengan transaksi-transaksi yang berkaitan dengan Rebat Tunai dan Mata yang diperolehi. Sekiranya Pemegang Kad Dwi-Jenama tidak dalam tempoh masa yang dinyatakan dalam Perjanjian Pemegang Kad CIMB memaklumkan CIMB secara bertulis tentang sebarang kesilapan, percanggahan atau ketidaktepatan, maka Pemegang Kad Dwi-Jenama akan dianggap telah menerima pernyataan di dalamnya sebagai betul dan sebagai bukti muktamad dan konklusif fakta yang terkandung di dalamnya dan penyata tersebut hendaklah dianggap sebagai mengikat terhadap Pemegang Kad Dwi-Jenama dan Pemegang Kad Dwi-Jenama hendaklah selepas itu dihalang untuk membuat sebarang tuntutan terhadap CIMB dengan menyatakan bahawa penyata tersebut mengandungi kesilapan, percanggahan atau ketidaktepatan CIMB menyimpan hak untuk mengubah kadar Rebat Tunai atau kadar Mata yang diperolehi atau mengenakan had ke atas manfaat yang diberikan pada Kad Dwi-Jenama atau mengubah, menggantung untuk suatu tempoh yang ditetapkan atau tidak terhingga, membatalkan, menamatkan atau menggantikan Program Ganjaran dengan program ganjaran alternatif yang dianggap sesuai olehnya pada bila-bila masa dan dari semasa ke semasa dengan memberikan notis terdahulu selama dua puluh satu (21) hari kalendar kepada Pemegang Kad Dwi-Jenama. Perubahan tersebut hendaklah berkuatkuasa pada tarikh yang dinyatakan di dalam surat atau mana-mana kaedah komunikasi lain yang digunakan untuk memaklumkan Pemegang Kad Dwi-Jenama sebagaimana yang diperuntukkan dalam Perjanjian Pemegang Kad CIMB. Tanpa mengehadkan keluasan peruntukan yang terdahulu, CIMB tidak akan bertanggungjawab untuk apa-apa perubahan, penggantungan, pembatalan, penamatan atau penggantian Program Ganjaran atau manfaat yang tersedia di bawahnya atau sebarang kerugian atau kerosakan dalam apa jua jenis dan apa jua cara sekalipun ditanggung oleh Pemegang Kad Dwi-Jenama yang diakibatkan secara langsung atau tidak langsung daripada tindakan perubahan, penggantungan, pembatalan, penamatan atau penggantian Pemegang Kad Dwi-Jenama seterusnya bersetuju untuk mengakses laman web CIMB melalui dengan kerap untuk melihat terma-terma dan syarat-syarat ini, dan untuk memastikan bahawa mereka mengikuti kemaskini apa-apa perubahan kepada terma-terma dan syaratsyarat Untuk tujuan pengiraan Rebat Tunai dan/atau Mata, perbelanjaan mata wang asing Pemegang Kad Dwi-Jenama akan ditukar kepada Ringgit Malaysia mengikut terma-terma yang dinyatakan dalam Perjanjian Pemegang Kad CIMB. Rekod CIMB tentang Rebat Tunai dan/atau Mata yang diperolehi oleh Pemegang Kad Dwi-Jenama adalah muktamad dan mengikat kecuali untuk kesilapan yang nyata Ganjaran diberikan kepada Pemegang Kad Dwi-Jenama seperti yang dinyatakan dalam klausa 2 terma-terma dan syarat-syarat ini adalah sebagai ganti kepada mata bonus dan/atau apa-apa ganjaran lain yang biasanya dikaitkan dengan kad kredit CIMB lain kecuali ditetapkan atau dinyatakan dengan jelas menurut kempen taktikal yang dianjurkan oleh CIMB Di mana Pemegang Kad Dwi-Jenama telah memilih untuk membuat pembayaran balik transaksi secara ansuran bulanan di bawah mana-mana kemudahan pembayaran ansuran yang disediakan oleh CIMB, ganjaran yang diberikan hanya akan diberikan kepada Pemegang Kad Dwi-Jenama berdasarkan jumlah ansuran bulanan yang diposkan ke penyata bil Pemegang Kad Dwi-Jenama setiap bulan.

15 4.7. CIMB berhak dengan memberikan notis terdahulu selama dua puluh satu (21) hari kalendar untuk mengubah (sama ada melalui penambahan, pemotongan, modifikasi, pindaan atau selainnya walau bagaimana sekalipun) (selepas ini disebut Pindaan ) mana-mana terma dan syarat ini dan Pindaan itu hendaklah berkuatkuasa pada tarikh yang ditetapkan oleh CIMB. Sebarang Pindaan kepada peruntukanperuntukan di sini dimaklumkan secara efektif kepada Pemegang Kad Dwi-Jenama melalui mana-mana kaedah komunikasi yang digunakan untuk memaklumkan Pemegang Kad Dwi-Jenama tentang pindaan kepada Perjanjian Pemegang Kad CIMB sebagaimana yang diperuntukkan dalam Perjanjian Pemegang Kad CIMB CIMB menyimpan hak untuk berkongsi maklumat Pemegang Kad Dwi-Jenama yang terkandung dalam borang permohonan Pemegang Kad Dwi-Jenama untuk Kad Dwi-Jenama dengan Tesco, pengganti atau mana-mana syarikat yang berkaitan untuk membolehkan Pemegang Kad Dwi-Jenama menikmati ganjaran, perkhidmatan dan manfaat yang ditawarkan di bawah Kad Dwi-Jenama Terma-terma dan syarat-syarat ini akan mengatasi mana-mana representasi yang terkandung dalam sebarang bahan promosi atau pengiklanan yang mengiklankan Kad Dwi-Jenama Sekiranya terdapat apa-apa ketidaksejajaran, percanggahan, kesamaran atau kepincangan di antara versi Bahasa Malaysia dan Bahasa Inggeris atau versi bahasa lain terma-terma dan syarat-syarat ini, versi Bahasa Inggeris terma-terma dan syarat-syarat ini akan mengatasi yang lain. Walau apa pun yang dinyatakan di atas, jika permintaan telah dibuat oleh Pemegang Kad Dwi-Jenama dan diambil perhatian dan diakui oleh CIMB dalam rekodnya bahawa versi Bahasa Malaysia terma-terma dan syarat-syarat akan mengawal operasi Kad Dwi-Jenama, maka versi Bahasa Malaysia terma-terma dan syarat-syarat ini akan mengatasi yang lain.
