Dear Sir, In terms of the New Coal Distribution Policy (NCDP) issued by the Ministry of Coal with the approval of Govt. of India vide Office Memorandum No /4/2007-CPD dated it is hereby informed that for the purpose of issuance of Letter of Assurance (LOA) for supply of coal to your unit(s) you are required to furnish to ECL commitment guarantee (CG) either in cash or in the prescribed format of the bank guarantee. The amount of CG to be furnished by you would be equivalent to 10% of the notified base price of your annual coal requirement considering the highest grade of coal applied for. Such CG, however, would not be less than or exceed stipulated amount, details of which may be seen from the Model Letter of Assurance along with the format of BG available on CIL s website also in the website of ECL As would reveal from the copy of the model LOA, you would be required to complete the stipulated miles stones in a time bound manner in terms of the provisions of the model LOA. Accordingly. You are requested to furnish stipulated CG at the earliest but not latter than 3(three) months from the date of issuance of this letter. 8 In terms of the New Coal Distribution Policy, circulated by Ministry of Coal, Govt of India vide Office Memorandum No /4/2007-CPD dated , all valid linked consumers, including the consumers having ongoing FSA (except Power Utilities) are required to enter into a bilateral arrangement of enforceable Fuel Supply Agreement (FSA)within Failure to enter into FSA will result in discontinuation of coal supply at fixed price. All the above categories of consumers are requested to execute FSA at the earliest in order to ensure commencement of coal supplies under FSA from April 08 onwards. However, in any case, for sustained supplies the FSA would need to be executed by or before 30 th April 08. Dear Sir, This is to bring to your kind notice that Ministry of Coal has introduced a New Coal Distribution Policy with the approval of Govt. of India vide Office Memorandum No /4/2007-CPD dated Under this policy consumers in small and medium sector having annual requirement up to 4200 tes and having no Fuel Supply Agreement with a subsidiary company of CIL or CIL, can source their coal requirement from agencies nominated by state governments. The nominated state agencies along with quantities allocated by the concerned state authority have been communicated by CGM(S&M), CIL vide reference No. CIL/CMO/47252/363-69/1509 dated 25/ According to that you have been nominated as the designated state agency for the state of West by the Joint Secretary, Commerce & Industries Deptt. Govt. of West vide letter dated 17/01/08.

10 According to above, you are required to enter into Fuel supply Agreement (FSA) with ECL by for continuation of coal supplies. Failure to enter into FSA will result in discontinuation of supply through your agencies. As a condition precedent to execute the FSA, you are required to deposit with ECL a sum equivalent to the base price of the supplying grade multiplied by ACQ/24 as non-interest bearing Security Deposit either in cash or in the form of Bank Guarantee. However, you have the liberty to deposit 100% of the Security Deposit prior to signing of this agreement or deposit a minimum of 20% of the security amount prior to signing of this agreement and balance amount in the form of Bank Draft / Banker s 10% of base price of the monthly scheduled quantity every month till the said balance security deposit amount is fully covered. Copies of the New Coal Distribution Policy, Model FSA including the format of Bank Guarantee towards Security Deposit are already available on CIL website and apart from ECL s website i.e. You are requested to please execute FSA with Eastern Coalfields Limited by in order to ensure commencement of coal supplies.
