Peabody aims to manage parking for its residents and their visitors in a positive manner. 1.3 Peabody enlists a Parking Contractor to manage parking enforcement on its estates. The Parking Contractor works alongside Peabody staff to enforce parking regulations and issue Penalty Charge Notices (PCNs) to unauthorised vehicles on Peabody land. 1.4 The policy applies to all Peabody estates where the Parking Contractor carries out parking enforcement. In addition to this policy some estates have locally agreed arrangements. 1.5 On sheltered housing schemes, the Parking Contractor will enforce parking provisions that have been agreed locally with residents and staff. 1.6 This policy does not cover residents of former Crown Estate homes at Millbank, Victoria Park, Lee Green and Cumberland Market, who have their own local parking arrangements. 1.7 This policy does not cover bicycles but Peabody may remove any bicycles that are not parked in designated areas. 2. Key Definitions Parking Contractor 2.1 The organisation contracted by Peabody to manage the parking enforcement arrangements on behalf of Peabody.
2 PARKING PEABODY 2.2 The Contractor deals with unauthorised vehicles by issuing PCNs and manages the signage and maintenance of the parking bays. 2.3 Parking enforcement operates on Peabody property where it has been requested, or where Peabody believes it is needed. If a majority of residents feel strongly that either they do or do not want or need parking enforcement on the estate where they live, Peabody may activate or suspend parking enforcement in that area. Penalty Charge Notice (PCN) 2.4 The Parking Contractor will issue unauthorised vehicles with a PCN. The charge amount will be stated on the PCN and the charge is payable directly to the Parking Contractor. Vehicle 2.5 For the purposes of this policy, a vehicle is defined as a car, van, moped, motorcycle or scooter. However, this list is not exhaustive. 2.6 All vehicles parked on Peabody estates must meet the following criteria: park within the designated parking bays be able to move independently without a tow i.e. not trailers, caravans or boats be able to be driven legally on public roads: o have a valid M.O.T o a valid tax disc clearly displayed (except for scooters, mopeds and motorbikes) o have vehicle insurance o have the full registration number displayed be within Peabody s maximum vehicle size of 6 metres long, 3 metres high and 2.5 metres wide not cause a health and safety risk or public nuisance Licence Agreement or Licence Holder 2.7 Residents who are granted a parking permit must sign a licence agreement and are known as a licence holder. Where a resident breaks the terms of the licence agreement, Peabody will take action to end the licence. Carer 2.8 Peabody defines a carer as someone who fulfils the following criteria: They are in receipt of Carer's Allowance for the customer they are looking after. They are the principal carer and need to be a permanent customer. The customer they care for is in receipt of higher rate Personal Independent Payment. 3. Policy Parking Bays 3.1 All vehicles parked on Peabody estates must display a valid resident or visitor parking permit or a dispensation code and a disabled badge (if applicable). 3.2 All vehicles must display a valid vehicle tax disc except motor scooters, mopeds and motorbikes where there is a risk of these being stolen or vandalised. 3.3 Visitors must park in visitor labelled bays only. Visitor bays can be used on a first come first served basis. 3.4 Where enforcement is in place Peabody will ensure that clear signage is installed to display parking information. Eligibility Page 2 of 6
3 PEABODY PARKING 3.4 All permanent adult household members are eligible for a licence agreement and permit provided their household are in no more than four weeks rent arrears, except for housing benefit paid in arrears where the resident can provide the relevant documents. 3.5 All licence agreement holders under the age of 18 years old must get a parent or legal guardian to sign the agreement on their behalf, and that signatory will then be responsible for any unpaid charges. Waiting Lists 3.6 Parking bays will be allocated strictly according to the waiting list, which is ordered by application date. Low Demand 3.7 If there are no residents on the waiting list on a particular estate, vacancies may be made available to non-residents at the market rate. Unallocated bays may also be made available for staff who are essential car users. No Parking Facilities on an Estate 3.8 If a resident lives on an estate where there are no parking facilities but lives within a short walking distance from another Peabody estate with parking facilities, they can apply for a bay on that estate. Charges 3.9 Charges for parking bays vary according to location. Peabody sets charges annually and issues increase notices to residents Residents carers who are allocated a parking bay will pay the same charge as residents, even if they are not a resident themselves. Arrears 3.11 Parking bay arrears will be collected in line with the Rent Collection Policy If a resident is in rent arrears (beyond four weeks housing benefit paid in arrears) a request for a parking bay will be refused Existing licence agreements will be terminated if the resident has arrears in their main rent account and has failed to respond to the second arrears contact A parking permit will not be renewed if the resident is in arrears when the existing licence expires. Renewing Licence Holders Parking Permits 3.15 Residents need to reapply to the parking contractor for their parking permit annually on 1 st April. Renewal with not be permitted if the resident is in rent arrears. Licence holders do not have to sign a new licence agreement on renewal. Notice Period 3.16 Four weeks written notice to a Peabody Neighbourhood Manager must be provided to terminate an existing agreement. Page 3 of 6
4 PARKING PEABODY Provision for Disabled Residents 3.17 Disabled residents who have a valid badge, issued by the local authority, will be allowed a free parking bay from the date of notification to Peabody. No rebate will be paid for back-dated periods where Peabody has not seen evidence of a valid disabled badge Disabled residents are given priority on the parking waiting list when they apply for a parking bay Vehicles displaying a disabled badge must park in bays clearly designated for disabled use. If a vehicle displaying a disabled badge is found to be parking in any other bay or unauthorised manner a PCN will be served Disabled residents in rent arrears will still qualify for a free parking bay, but only if they have an arrangement to pay off their rent arrears, or if they are waiting for housing benefit. If disabled residents stop paying off their arrears as agreed, the licence agreement will be terminated The vehicle must be registered in the name of a permanent member of the household, and driven by them. Residents with Carers 3.22 Permanent carers of a Peabody resident, who meet the criteria defined in 2.7, may apply for a parking permit Temporary carers will need to apply for dispensation codes. Change of Vehicle 3.24 The household may only hold one vehicle permit, assigned to one parking bay where applicable If a licence holder has a replacement vehicle for a short period of time, they must notify the Parking Contractor of the temporary vehicle registration number. A dispensation code will be provided for the vehicle for a maximum of 14 days. Visitor Parking 3.26 There is a limit of 5 visitor permits booklets per year (each booklet contain 10 permits) but further permits may be issued in exceptional circumstances Visitor permits will not be granted where a resident is more than four weeks in rent arrears, unless they are adhering to an agreed payment plan Visitor permits are not available for non-resident licence holders Annual visitor permits will be issued if the majority of residents on an estate agree that this is the preferred option. Local Enforcement Arrangements 3.30 Parking bays may be rented on some estates where parking enforcement is not in operation, A licence agreement will be signed to entitle the licence holder to park in a designated bay. Staff Parking 3.31 Parking bays may be allocated to non-office based staff in low demand areas. Staff are not permitted to use resident parking bays. Page 4 of 6
5 PEABODY PARKING 3.32 Staff are only entitled to use visitors bays on a temporary basis when visiting estates on official business 3.33 Senior management will decide which job titles qualify for a staff parking permit. Permits will only be authorised for staff that need to visit estates on a regular basis to carry out their job. Contractor Parking 3.34 Contractors are not required to sign a licence agreement but will be allocated contractor parking permits or dispensation codes Contractors are not permitted to use resident parking bays other than where allocated. Unauthorised Parking and Charges Anti-Social Behaviour associated with driving 3.36 Reports of dangerous or anti-social driving will be investigated in line with our Anti-Social Behaviour Policy. Abandoned Vehicles 3.37 Where abandoned vehicles are identified, a Tort notice may be served as per the Torts (Interference with Goods) Act Peabody may take steps to remove the vehicle, if the owner cannot be traced or does not remove the vehicle Where parking enforcement does not exist, Peabody will follow the Abandoned Goods Policy and process, serve Torts notices and contact the Parking Contractor who may remove the vehicle Vehicles causing obstruction to emergency entrances and exits may be repositioned to another location nearby by the Parking Contractor or by the Emergency Services. 4. Other Information Complaints and Appeals 4.1 All initial appeals against parking enforcement should be made directly to the Parking Contractor. 4.2 If the customer is not satisfied with the appeal outcome from the Parking Contractor, Peabody may respond to the complaint and/or signpost the resident to appeal about the Parking Contractor through the Parking on Private Land Appeals (POPLA) online process ( New Estate Acquisitions and Development 4.3 During the consultation period Peabody will identify any local undertakings, arrangements, informal agreements and legal obligations concerning parking that are currently in place. Peabody will encourage new residents to adopt the arrangements set out in this policy, with adaptations to reflect local circumstances if necessary. 5. Legal and Regulatory Information Housing Act 2004 s This Act sets out the designation of areas subject to additional licensing. A local housing authority may designate either- (a) the area of their district, or (b) an area in their district, as subject to additional Page 5 of 6
6 PARKING PEABODY licensing. Torts (Interference with Goods Act) This Act governs the disposal of unclaimed goods left on private land or premises. Protection of Freedoms Act 2012 Part 3, Chapter The Protection of Freedoms Act, enacted in October 2012, makes it an offence to clamp on private land. However, landowners are boosted by stronger laws on ticketing. 5.4 As part of the Act the Government has agreed to create an independent appeals service, funded by the British Parking Association (BPA). This service will allow motorists to appeal against a parking charge issued on private land by a company that is a member of the BPA s approved operator scheme. 6.
