3 AIRPORT COMMISSION MEETING MINUTES May 7, 2002 A. CALL TO ORDER: The regular meeting of the Airport Commission was called to order at 9:00 AM in Room 400, City Hall, San Francisco, CA. B. ADOPTION OF MINUTES: The minutes of the regular meeting of April 16, 2002 and the special meeting of April 29, 2002 were adopted unanimously. No D. ITEMS INITIATED BY COMMISSIONERS: Commissioner Ito acknowledged Airport staff and thanked Mr. Duke Briscoe and Mr. Minutes, May 7, 2002, Page 3
4 Jackson Wong for their assistance during the airfield crash exercise recently held at the Airport. Commissioner Ito felt that the unfortunate episode yesterday with the Security Screeners application process was a tremendous disservice to them and to the entire Airport operation. The Federal authorities need to pay more attention to this process and its impact on the Airport, its function and safety, and the personal lives and livelihoods of the employees affected. She asked Mr. Martin to... be sure that employees make this transition in the fairest and most expeditious way, to explore all of the avenues that have been suggested by the religious community and unions that have been in support of this effort. She questioned the fairness of a process that requires people to file on line, and, given the short 24 hour time frame, how that will result in finding the best people. This is a serious flaw. Mr. Martin and our HR department have helped to facilitate the process by providing additional monitors to assist people in applying. The process is flawed and needs to be questioned. We also need an explanation as to what happened yesterday. Mr. John Martin, Airport Director responded that a follow up report will be provided to the Commission. We are still trying to piece together what happened. This is something we keep experiencing with the TSA. A month ago they announced that the Argenbright contract would terminate on May 22. Employees were notified and a few weeks later they changed their minds. Given that the TSA did not have another contractor in place and we didn t want employees to loose their jobs, we encouraged the change. With respect to the notice regarding employee applications, it was on the website as reported in the Chronicle this morning. Further, he was informed by a senior official from the TSA in Washington that May 6 would be the application date, and that information was confirmed by local TSA staff. We were never informed about a change in date. We will be formally expressing our concerns to the TSA and we will work to make sure that they give both the Airport and the screeners proper notice. He hoped the TSA will wait until they have acted on our opt out application. He will also ask the TSA to hold off hiring until the fall because in the event our opt out application is rejected the additional time will provide the opportunity for screeners to become US citizens. He has been in contact with the Immigration Director for Northern California who continues to express the view that most of the applications should result in screeners becoming citizens by August. He will follow up with the Commission on the five points for which the Mayor has indicated his support. G. NEW BUSINESS:
5 This is the Public Comment section of the calendar. Individuals may address the Commission on any topic within the jurisdiction of the Airport Commission for a period of up to three (3) minutes. Please fill out a Request to Speak form located on the table next to the speaker s microphone, and submit it to the Commission Secretary. Ms. Ofelia Albrecht, All Souls Catholic Church in San Francisco and a member of the Bay Area Organizing Committee (BAOC) explained that the BAOC is made up of Churches, unions and civic associations in San Francisco and San Mateo Counties. They appreciate Mr. Martin s leadership in implementing policies and programs that has made San Francisco Airport a national model for hiring, training, compensation and benefits for workers. These screeners truly impact the safety and security of travelers. He is to be commended for developing a stable and experience work force. The Federalization and citizenship requirement in the TSA Act threatens the progress that has been made and arbitrarily scapegoats one group of workers. The citizenship requirement does not apply to pilots, mechanics, fuelers, or the armed forces working behind the screeners. We are faced with the prospect of having trained and experienced workers replaced by workers with little or no experience at all. Other airports look to SFO as the security model for the entire country. Now, more than ever, security at airports is critical. On April 21 st more than 900 BAOC members gathered in San Francisco to recognize the screeners and ask public officials to take action. Mayor Brown was there. She asked the Commission to help save these jobs. Of the 1200 screeners, approximately 480 are U.S. citizens. Those 480 employees face layoffs as well. The TSA was supposed to begin hiring yesterday. It was chaos. The TSA did not consider that some employees would not have access to computers. Mr. Martin had computers made available to screeners. The screeners wasted an entire day without pay waiting for an opportunity to apply. The TSA denied that they ever made such an announcement. The TSA does not care about the welfare of the screeners. In the six airports where applications were being processed, those who have applied for citizenship were not given an opportunity to apply for positions. At SFO 100 screeners have applied for citizenship but the INS has refused to speed up approval so that the screeners can keep their jobs. More than 500 screeners are legal permanent residents but are not yet eligible for citizenship. The TSA is making no allowance for job experience, competence or loyalty. The TSA clearly shows disregard to the workers value and their important contributions to provide Airport security. She asked the Commission to take action. Minutes, May 7, 2002, Page 5
6 The following people were introduced as supporters. Father Roberto Andrea of St. Augustine s Catholic Church in So. San Francisco and the Co-Chair of BAOC. Father Ken Weare, acting Pastor of All Souls Church in So. San Francisco. Ms. Lizette Sioson, parishioner of St. Augustine s Church and member of the BAOC. Ms. Erlinda Valencia, baggage screener with Globe Aviation Security for American Airlines. Ms. Maria Aurora Rallonza, Globe Aviation Security employee and member of SEIU Local 790. Mr. George Yen, St. Anne s Church of San Francisco and member of the BAOC. Ms. Josie Mooney, Executive Director of SEIU Local 790, President of the Labor Council and Co-Chair of BAOC. Ms. Erlinda Valencia, said she came to American from the Philippines through her husband who is a US citizen. When she started as an Airport screener she was earning $4.25 an hour. In spite of the fact that the salary was too low to support her six children she still performed her job with sincerity and dedication, and was recognized with a promotion to supervisor and duty manager. She is currently working as a CTX screener. In the past two years she was able to detect a hand grenade, knives and loaded handguns. She is a competent employee who will loose her job because she is not a citizen. A screener needs to be skilled, experienced and loyal. Citizenship has nothing to do with it. Local 790, in conjunction with the BAOC, asked Mr. Martin to support them in waiving the citizenship requirement and support them with the INS to expedite the citizenship process. Ms. Maria Aurora Rallonza said that she has worked for Globe for five years as a CTX operator. She applied for citizenship status on December 5, She is scheduled for a citizenship interview on May 16. She hoped that she would be a citizen by the time the TSA accepts applications. She hoped that SFO will be exempted by the TSA. Ms. Lizette Sioson read the attached five point proposal into the record. She asked the Commission to direct Mr. Martin to begin implementing the points in this proposal. Ms. Josie Mooney thanked the Commission for being the most visionary Airport Commission in the country and in having the most visionary and competent Airport Director in the country. 7 Before these screeners were in her union they made $6.00 an hour and had no vacation time, no breaks, no health, dental or vision plans. They had to work two to three jobs to keep food on the table. The Airport Commission single handedly made the difference in these workers lives. If the Commission and the Director don t follow through with the points raised then everything done up to now will have been for nothing. They will be on the street, jobless in an economy that is in a declined state. They count on the Commission s continued support, vision and leadership on these issues. She thanked the Commission in advance for their assistance. Father Ken Weare said that he was impressed by the discussion at the beginning of the meeting. Commissioner Strunsky said that he was supportive of the basic idea of finding a way to keep our trained screeners employed. Commissioner Ito thanked them for coming to the meeting. We need to be reminded of the lives that are being impacted. She commended the union for taking a leadership role and asked if they were getting support from their counterparts in other parts of the country. Ms. Mooney responded that where the screeners are organized we are organizing. In many of the airports in the country they are not organized. Our international union has been looking for Republican sponsors for the bill without much luck. Everyone in the country is looking for the Commission s leadership to establish a standard to which everyone will be held. Mr. Martin said that since September 11 he has publicly commented on the excellent job our screeners are doing. They have a long tenure at the Airport, in part because they are paid a decent wage and benefits. We no longer experience a high turnover rate. The Airport Commission and staff are supportive of trying to retain screeners as much as possible, given the constraints Congress has put in the Security Act. The Commission will be provided with a recommendation and will continue to be very supportive of the screeners now working at the Airport. Father Weare asked the Commission if they will direct Mr. Martin to act on implementing these proposals. Commissioner Strunsky said that Mr. Martin has indicated that he will return to the Commission at the next meeting with an analysis and the Commission will decide which way to go. Father Weare thanked the Commission for the opportunity to address them on this issue. Commissioner Berman thanked the group for attending the meeting, especially the clergy, and for their noble endeavors. They have the Commissions blessings, if not their vote. 8 E. ITEMS RELATING TO ADMINISTRATION, OPERATIONS & MAINTENANCE: Item No. 1 was put over. 1. Modification No.1, to Contract No Public Parking Facilities Operating Agreement - AMPCO System Parking - $13,511,493 Resolution approving Modification No.1 to Contract 8106, Airport Public Parking Facilities Operating Agreement with AMPCO System Parking reducing scope of work with a reduced annual cost not to exceed $13,511,493, which reduces the management fee to $1,438,443. Item No. 2 was moved by Commission Strunsky and seconded by Commissioner Ito. The vote to approve was unanimous. 2. Modification No. 2 to Contract No. 5706A - AirTrain Domestic Terminal Stations Dennis J. Amoroso Construction Co.,Inc. - $1,455,000 No Resolution approving an increase to the construction contract in the amount of $1,455,000 for a new contract value of $31,173,855 for additional work for the domestic terminal AirTrain stations. Funds will be provided from the CIP budget and from the existing project budget with no impact to the Master Plan Budget. Mr. Ivar Satero explained that this modification provides for several AirTrain facilities improvements in preparation for the opening of AirTrain later this year. The MBE/WBE combined goal on this contract is 10.2%. This modification provides for 9.3% participation. Participation through this modification will be 8.2%. Minutes, May 7, 2002, Page 8
9 Funding will come from project contingency and CIP funds. Commissioner Strunsky noted that there is an implication that we are about $2.8 million under budget yet this is not the final change order. Will we have this kind of an underrun? Mr. Satero responded that the forecast shows an expenditure of the total budget because of the uncertainty still remaining, however, we have a high level of confidence with our budget. Item No. 3 was moved by Commission Strunsky and seconded by Commissioner Ito The vote to approve was unanimous. 3. Trip Fee Reduction for Scheduled Transit Operations and Door-to-Door Van Operations Assigned to Red and Blue Loading Zones No Resolution approving trip fee reduction for scheduled transit and door-to-door van operations assigned to the Red and Blue loading zones to $2.00 from $2.75 and $3.25 respectively, effective May 1, 2002 to reflect reductions in the Curbside Management Program. Mr. Martin explained that earlier this year the Commission approved an amendment to the DAJA/ShuttlePort contract, reducing the scope of the contract by eliminating the service they provide at the curb for scheduled bus service and at the Red and Blue Zones for the vans. This modification to fees charged to door-to-door van companies and scheduled bus companies is a reflection of the reduction in fees paid to DAJA for these services. In 1999, prior to the DAJA/ShuttlePort contract, the per trip fee was $1.45. While this represents an increase, it is only 40% of cost recovery so a subsidy is still being provided to the operators. Given the increased costs in opening the Master Plan facilities, this is an appropriate fee. Super Shuttle will be providing service in the Blue Zone at their own cost. Lorries will provide the service in the Red Zone and will be reimbursed by the other operators. Super Shuttle and Lorries took over the operation on Minutes, May 7, 2002, Page 9
10 May 1. Mr. Martin said that some of the operators were unhappy with the DAJA curb operation and they are pleased to have control again. Some operators have concerns about the increased costs. Commissioner Ito noted that some operators are concerned about dispatching and asked who will watch over that part of the operation. Mr. Martin responded that DAJA will watch over it to make sure that standards are maintained across the board. Mr. Martin added that we need to do this to balance our budget. Mr. Tony Ruiz of Lorries delegated his time to Julio Bonilla. Mr. Bonilla said that the Airport Shuttle industry has been at ground zero of the economic impact of September 11. San Francisco Airport experienced a 33% reduction in flight activity. The few flights coming in and out were half empty. No passengers in the jetway translates to no passengers in the vans. Unlike other modes of transportation that service the Airport, such as taxis and limousines, the shuttle industry depends solely on the airport passenger. During the months of October, November and December their passengers declined to almost half of what it should have been for that time of the year. January and February were no better. In March, the Airport declared that it could no longer afford to have ShuttlePort/ DAJA run the Curbside Management Program to the same degree on the lower level, and two of the zones on the upper level would be cancelled. The Airport asked Lorries to take over curbside management of the Red Zone. Since that time Lorries has been in negotiations with the unions and the bottom line is that they have to take the ShuttlePort/DAJA employees that were working at the Red Zone at the same compensation package and pay rate that they had with ShuttlePort/DAJA. Consequently, the three operators at the Red Zone now pay $39,000 a month to keep coordination services in place. Prior to September 11 we paid $3.25 per trip to gain access to the Airport, and with it came the curb services Minutes, May 7, 2002, Page 10
11 provided by ShuttlePort/DAJA. At $3.25 per loop and 4,000 loops per month, it costs Lorries $13,000 a month to operate at the Airport. Now that they have taken on the responsibility of managing the Red Zone their costs have gone up. The cost to operate the Red Zone is $39,000 divided by the three operators... BayPorter Express, American Airporter and Lorries... comes to $13,000 per month, which is equal to what was being paid before. The Airport is now considering a loop fee reduction to $2.00 and that would mean the 4,000 loop would cost Lorries an additional $8,000 a month. They are going from $13,000 with ShuttlePort to $21,000 a month running it themselves and paying the $2.00 loop fee. Any further lowering of the loop fee would be very much appreciated. Since Lorries took over the Red Zone operation in 1994, they have been very careful, honest and hard working. Many accusations were made, but none were proven to be valid. Recently, Airport staff conducted a study that showed that no operator at the Red Zone had ever been disadvantaged. He promised to continue to operate with that standard of moral ethic. They have been at the Airport for 26 years and would like to be at the Airport for another 26 years. Mr. Arik Sharabi, Airport Express, asked for fair treatment on the Yellow Zone. Lorries shares their zone with only one company going north. Airport Express shares the Yellow Zone with eight or nine companies. Ms. Kathleen McCann, American Airporter Shuttle, operating out of the Red Zone, reiterated Mr. Bonilla s comments on the increased cost to the companies. She asked for a further reduction of the $2.00 fee. American Airporter is unhappy with an operator managing the Red Zone. Contrary to Mr. Bonilla s comments, there has been discrimination. Commissioner Strunsky suggested looking at this with some regularity, and as traffic increases we consider revisiting this issue. Minutes, May 7, 2002, Page 11
12 Mr. Martin said that a fee package will be submitted to the Commission in June that will address new loop fees across the board. Commissioner Ito agreed with Commissioner Strunsky. F. CONSENT CALENDAR OF ROUTINE ADMINISTRATIVE MATTERS: The Consent Calendar, Item Nos. 4 through 7, was moved by Commissioner Strunsky and seconded by Commissioner Ito. The vote to approve was unanimous. 4. Award Contract for Security Guard Services - A-1 Security Services - $250,000 No Resolution awarding contract for Security Guard Services to A-1 Security Services in an amount not to exceed to $250,000 effective upon contract certification through June 30, 2003 with an option to renew for an additional year to be executed by the Commission at its sole discretion in an amount not to exceed $250,000 for services from July 1, 2003 through June 20, Commissioner Ito asked if A-1 has a contract with the Airport. Mr. Jackson Wong, Chief Operating Officer responded that they do not. It is an as-needed contract and will be used as a back up. It is not for a specific assignment. We are simply anticipating the potential for new regulations or new circumstances. It would be temporary until our own City guards could be brought in. 5. Modification No. 4 to Professional Services Contract Harris, Miller, Miller, Hanson, Inc. - $200,000 No Resolution approving modification No.4 to Professional Services Contract No with Harris, Miller, Miller, Hanson, Inc. for special low frequency noise EIR analysis of the Runway Modernization Program alternatives.
