1 RETAIL COMPETITION Selfie French Terminal Building This competition is operated by The Channel Tunnel Group Ltd with offices at UK Terminal, Ashford Road, Folkestone, Kent CT18 8XX ( Eurotunnel Le Shuttle ) Terms and Conditions of Entry Acceptance of these terms and conditions is a condition of entry to the competition. By submitting a competition entry, you are agreeing to be bound by these terms and conditions. A. HOW TO ENTER i. The competition runs from 12 December 2018 to 24:00 (midnight) on the 11 January ii. All competition entries must be received by Eurotunnel Le Shuttle by posting an image to either the Twitter or Instagram platform by using the #EurotunnelSelfie hashtag by 24:00 (midnight) on 11 January All competition entries received after that time will not be accepted. iii. To enter, log into your Twitter account or Instagram account and post your selfie taken in the Passenger Terminal Building in Calais with the backdrop of our selfie wall using the hashtag #EurotunnelSelfie before the deadline. Entries that appear via private message, wall post or comments on a different post, using incorrect or misspelled hashtags, or not featuring the Eurotunnel selfie wall will not be counted. iv. There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. No entrant may win more than one prize. All correct guesses will be entered into a draw and the winner will be selected at random. v. Duplicate entries will not be counted. vi. Eurotunnel Le Shuttle does not accept responsibility for competition entries that are lost, mislaid, incomplete, illegible, damaged or delayed in

2 transit, regardless of cause. Proof of posting or sending is not proof of receipt. Automatically generated entries or entries via agents or third parties are invalid and shall not be considered. Entries become the property of the Promoter and are not returned. B. ELIGIBILITY i. No purchase is necessary. ii. The competition is open to residents in all countries aged 18 years or over, except employees of Eurotunnel Le Shuttle, their families, agents or any third party directly associated with administration of the competition. iii. By entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. Eurotunnel Le Shuttle may require you to provide proof of your identity and that you are eligible to enter the competition you agree to cooperate with such enquiries. iv. By entering the prize draw, you confirm that in the event you are selected as a prize winner you are agreeing to Eurotunnel Le Shuttle sharing your photography, name and surname on social media. v. Eurotunnel Le Shuttle will not accept competition entries that are automatically generated by computer, completed by third parties or in bulk, illegible, have been altered, reconstructed, forged or tampered with, photocopies and not originals or incomplete. vi. By entering the competition you confirm that your entry form and any accompanying materials and submissions: - do not contain any material which is defamatory of any person or which is obscene, offensive, hateful or inflammatory; - do not promote sexually explicit material, violence or any illegal activity; - do not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; - do not infringe any rights of any other person. - are not likely to deceive any person; - are not made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; - are not threatening, abusive or invade another s privacy, or cause annoyance, inconvenience or needless anxiety; - are not likely to harass, upset, embarrass, alarm or annoy any other person; - are not used to impersonate any person, or to misrepresent your identity or affiliation with any person; - do not give the impression that they emanate from Eurotunnel Le Shuttle, if this is not the case; or

3 - do not advocate, promote or assist any unlawful act such as (by way of example only) copyright or trade mark infringement or computer misuse. vii. Eurotunnel Le Shuttle reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition or if (in Eurotunnel Le Shuttle s opinion) you are in breach of these terms and conditions. Eurotunnel Le Shuttle reserves the right to contact the relevant authorities to report any inappropriate content you submit in connection with the competition or otherwise. C. WINNER ANNOUNCEMENT i. One winner will be selected at random from all valid entries across Twitter and Instagram. The winner will be notified via private message via the platform on which they entered (either Twitter or Instagram) on or before 20 th January ii. The decision of Eurotunnel Le Shuttle and the judges is final and no correspondence or discussion will be entered into. D. THE PRIZE i. The prize is a hamper including products from our Partner World Duty Free (including perfume and French food products). ii. There is no cash alternative for the prize and the prize is not negotiable or transferrable. iii. Prize is subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into. iv. Eurotunnel Le Shuttle offers the prize in association with World Duty Free Shop and WHSmith. Eurotunnel Le Shuttle will confirm to the winner by private message details of how they may claim and can receive the partner prize. Eurotunnel Le Shuttle is not responsible for any loss, claim or expense arising from a partner offer.

4 E. CLAIMING THE PRIZE i. The prize winner will be notified via a comment on their selfie post from Eurotunnel Le Shuttle on the corresponding platform that the post was published on. Eurotunnel Le Shuttle will give details in the comment of how to respond in order to claim the prize. ii. The winner must respond to Eurotunnel Le Shuttle within 8 days of being notified they have won in order to claim their prize. iii. If the winner does not respond to Eurotunnel Le Shuttle within 8 days of being notified, then the winner s prize will be forfeited and Eurotunnel Le Shuttle will be entitled to select another winner from all valid entries at random. iv. The prize may not be claimed by a third party on your behalf. v. Eurotunnel Le Shuttle does not accept any responsibility if you are not able to take up the prize. F. LIMITATION OF LIABILITY Insofar as is permitted by law, Eurotunnel Le Shuttle, its agents and distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Eurotunnel Le Shuttle, its agents and/or distributors or that of their employees. Your statutory rights are not affected. G. OWNERSHIP i. All competition entries and any accompanying material submitted to Eurotunnel Le Shuttle will become the property of Eurotunnel Le Shuttle on receipt and will not be returned. ii. You agree that Eurotunnel Le Shuttle may make your entry and accompanying materials available on its website and any other social media platform in connection with any publicity of the competition. You agree to grant Eurotunnel Le Shuttle a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights, in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes. H. DATA PROTECTION AND PUBLICITY i. By entering the prize draw, you agree that any personal data supplied to Eurotunnel Le Shuttle in connection with the prize draw (including your name, image and contact details) may be used by Eurotunnel Le Shuttle in

5 connection with the administration of the competition[en1]. Please review Eurotunnel Le Shuttle s Privacy Policy (available at for more information on how Eurotunnel Le Shuttle may use your personal data. I. GENERAL i. If there is any reason to believe that there has been a breach of these terms and conditions Eurotunnel Le Shuttle may, at its sole discretion, exclude you from participating in the competition, to withdraw the prize or to require you to return the prize if already received. ii. By entering this competition each entrant confirms that his/her entry is their wholly-owned creation and to the extent that such entry makes use of any third party materials that these have been fully cleared unless they are no longer protected by copyright or other intellectual property rights. Entrants will keep the Promoter harmless from any claims in relation to their entry that the entry infringes the personal or proprietary right of any other person. By submitting an entry, each entrant (or their parent/guardian on their behalf) grants to the Promoter a perpetual, royalty-free, non-exclusive licence to edit, publish, translate, modify, adapt, make available and distribute the entry throughout the world in any media now known or hereafter invented. Each entrant (or their parent/guardian on their behalf) undertakes to complete any necessary documentation to formalise the licence. iii. Eurotunnel Le Shuttle reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so. iv. If a provision of these terms and conditions is or becomes invalid or unenforceable, that part shall not affect the validity of the other provisions in these terms and conditions and shall be severed from those provisions. v. These terms and conditions shall be governed by English law, and you submit to the exclusive jurisdiction of the courts of England and Wales. J. CONTACT US i.
