ACT To amend the Railways and Harbours Pensions Amendment Act, 1941, so as to substitute the word "employee" for the word "servant"; to amend sections 2 and 5 of the said Act so as to make the provisions of the Act also applicahle to staff transferred from Iscor to the South African Railways; to amend the Railways and Harbours Service Act, 1960, so as to substitute other words for certain words; to amend sections 3, 14, 18, 19, 20, 21, 22 and 32 and to substitute section of the said Act, and to amend section 8 of the Railways and Harbours Pensions Act, 1971, and section 7 of the Railways and Harbours Pensions for Non-Whites Act, 1974, so as to amend the provisions of the Administration's disciplinary code; to insert section 3B in the Railways and Harbours Service Act, 1960, so as to provide for the Administration to waive its right to recover certain debts; to amend section 2 of the Level Crossings Act, 1960, so as to provide for the Level Crossings Elimination Fund to be credited monthly wit. interest calculated at the prevailing rate which the Administration receives on its temporary investments; to amend the Railways and Harbours Pensions Act, 1971, so as to substitute the word "employee" for the word "servant"; to amend section 17 of the said Act so as to provide for an increase in annuities; to amend the Railways and Harbours Pensions for Non-Whites Act, 1974, so as to substitute the word "employee" for the word "servant"; to repeal section 2C of the Railways and Harbours Finances and Accounts Act, 1977, so as to eliminate the duplication of provisions; to amend section of the said Act and section 27 of the Exchequer and Audit Act, 1975, so as to bring the provisions thereof into line with existing Railway legislation; to amend section 19 of the Railways and Harbours Finances and Accounts Act, 1977, to substitute the words "an employee" for the words "a servant"; to amend section 21 of the said Act so as to eliminate disparity in existing provisions; to amend section 24A of the said Act so as to bring the Railways into line with the Treasury in so far as the provisions of section 31 of the Exchequer and Audit Act, 1975, are concerned; to insert section 24B in the Railways and Harbours Finances and Accounts Act, 1977, so as to provide for the remission or refunding of revenue; and to provide for other incidental matters. 4 4 No GOVERNMENT GAZETfE, 11 MARCH 1981 Act No. 29, 1981 Substitution for the word "servant" of the word "employee" in Act 26 of RAILWAYS AND HARBOURSACfS AMENDMENT Act, 1981 BE IT ENACTED by the State President and the House of. Assembly of the Republic of South Africa, as follows: 1. The Railways and Harbours Pensions Amendment Act, 1941, is hereby amended by the substitution for the word "servant" of the word "employee" wherever it occurs. 5 section 2 of Act 26 of 1941, section 6 of Act 23 of 1944, and section 3 of Act 60f 1965 and substituted by section 2 of Act 45 of section 5 of Act 26 of 1941, section 31 of Act 44 of 1959 and section 5 of Act 45 of Substitution of certain words in Act 22 of section 3 of Act 22 of 1960, section 46 of Act 6 of 1965, section 5 of Act 85 of 1971 and section 6 of Act 8 of Insertion of section 3D in Act 22 of Section 2 of the Railways and Harbours Pensions Amendment Act, 1941, is hereby amended by the insertion after subsection (3) of the following subsection: "4 The rovisions of subsections 1 and 2 shall a I mutatis mutandis in the case of any person who transferre from the South African Iron and Steel Industrial Corpora tion Limited, without a break in service, to the service 0 the Administration in consequence of the purchase of the Sishen-Saldanha Bay Project in terms of the Railway and Harbour Purchase Act, 1977 (Act No. 47 of 1977).".. 3. Section 5 of the Railways and Harbours Pensions Amendment Act, 1941, is hereby amended by the substitution for subsection (1) of the following subsection: "(1) In calculating the period of service of any person as a basis for a pension benefit under this Act (whether for himself or for his dependants), all separate periods, reckoned in days, during which that person was in the service of the Administration or of an old Administration or in the service of the South African Iron and Steel Industrial Corporation Limited in the case of any person referred to in subsection (4) of section 2 shall, subject to the provisions of subsection (2), be added together, and if the total period of his service amounts to a number of full years and a number of days less than a year, that number of days shall be taken into account as a corresponding fraction of a year.". 4. The Railways and Harbours Service Act, 1960 (hereinafter called the "Service Act"), is hereby amended by (a) the substitution, in the Afrikaans text, for the word "tug" of the word "dissipline", the word "tugoortreding" of the words "dissiplinere oortreding", the word "tugstappe" of the words "dissiplinere stappe", the word "tugstraf" of the words "dissiplinere strar', the word "tugaanklag" of the words "dissiplinere aanklag", the word "tugappelraad" of the words "dissiplinere appelraad" and the word "tugappelle" of the words "dissiplinere appelle", wherever they occur; and (b) the substitution for the word "servant" of the word "employee" wherever it occurs. 5. Section 3 of the Service Act is hereby amended by the substitution for paragraph (a) of the following paragraph: "(a) a decision made under the provisions of this Act and the regulations governing the [servant] employee in regard to discipline [and inefficiency]; or". 6. The following section is hereby inserted after section 3A of the Service Act: ':Administra- 38. 6 6 No GOVERNMENT GAZETTE, 11 MARCH 1981 Ad No. 29, 1981 RAILWAYS AND HARBOURS ACTS AMENDMENT ACT, 1981 was legally due to him in terms of any law 0 any agreement, express or implied, governin his employment; or (b) become indebted to the Administration (other wise than under the circumstances mentioned i 5 paragraph (a)) by virtue of any agreement. express or implied, with regard to any matte affecting or incidental to his employment, an through some error or omission on the part 0 the Administration or its employees, was no required to discharge or satisfy such indebted ness at the time when it arose, the Administra tion may, if it is satisfied that (i) the employee or former employee con cerned acted in good faith and withou knowledge that he was not entitled t receive such payment, or that he wa indebted to the Administration aforesaid; and (ii) the case is one where the employee 0 former employee concerned should 0 equitable grounds be granted some relief, waive its right to recover the whole or an portion of the amount overpaid or outstanding as the case may be, notwithstanding that suc amount may be legally recoverable from th person concerned: Provided that the Adminis tration shall not where the person concerned is still in the Service, waive its right under this subsection in respect of any amount which w 30 overpaid during, or which became due i respect of, the twelve months immediatel preceding the date on which the overpaymen or the omission to discharge or satisfy th indebtedness, as the case may be, is officiall 35 brought to notice. (2) Any reference to the Administration in paragraphs (a) and (b) of subsection (1), shall b deemed to include a reference to any Superannuation or Sick Fund controlled by the Administration. 40 (3) The Administration may, on such conditions as it may deem fit, delegate to the General Manage and to one or more other officers of the Administra tion, authority to exercise on its behalf the power conferred upon it by this section.". 45 Substitution of section of Act 22 of The following section is hereby substituted for section of the Service Act: "Retirement on the ground of in efficiency.. (1) The services of an emplo ee in ermanent employment may be dispensed with prior to the dat of his superannuation if he is found to be inefficient. 50 (2) If an employee in permanent employment i reported to be inefficient in such degree tha consideration of his retirement on such ground i considered justified, he shall be informed according ly in writing and offered the opportunity of submit 55 ting in writing, within thirty days after receipt 0 such notification, any comments he might wish t make for the information of the committee referre to in subsection (3). (3) On receipt of the reply of the employ 60 concerned or, should the employee fail to reply upon the expiry of the period of thirty days referre to in subsection (2), the matter may be referred to committee, which shall be constituted in such manne as may be prescribed by regulation. 65

7 STAATSKOERANT, 11 MAART 1981 No WYSIGINGSWET OP SPOORWEG- EN HAWEWETTE, 1981 Wet No. 29, 1981 wettig aan hom verskuldig was uit hoofde va 'n wetsbepaling of 'n uitdruklike of stilswyende ooreenkoms wat sy diensbetrekking beheers; 0 (b) aan die Administrasie iets verskuldig geword het (behalwe onder die omstandighede in para graaf (a) vermeld) uit hoofde van 'n uitdruklik of stilswyende ooreenkoms betreffende ' aangeleentheid wat op sy diens betrekking he of daarmee in verband staan, en as gevolg va 'n fout of versuim aan die kant van die Administrasie of sy werknemers, daar nie van hom verlang is om sodanige skuld te vereffen 0 af te los toe dit ontstaan het nie, kan di Administrasie, indien hy oortuig is dat (i) die betrokke werknemer of voormalig werknemer te goeder trou gehandel het en sonder te geweet het dat hy nie 0 sodanige betaling geregtig was of dat h iets soos voormeld aan die Administrasi verskuldig was nie; en (ii) dit 'n geval is waar daar op billikheids gronde tegemoetkoming aan die betrokke werknemer of voormalige werknemer betoon behoort te word, afstand doen van sy reg om die bedrag wat t veel betaal of verskuldig is, na gelang van die geval, in geheel of ten dele te verhaal, nieteenstaande dat sodanige bedrag wettig op die betrokke persoon verhaal kan word: Met dien verstande dat waar die betrokke persoon nog in die Diens is, die Administrasie nie kragtens hierdie subartikel afstand mag doen nie van sy regte ten aansien van 'n bedrag wat te veel betaal is gedurende, of wat verskuldig geword het ten opsigte van, die twaalf maande onmiddellik voorafgaande aan die datum waarop die oorbetaling of die versuim om die skuld te vereffen of af te los, na gelang van die geval, amptelik onder die aandag gebring word. 8 8 No GOVERNMENT GAZETTE, 11 MARCH 1981 Ad No. 29, 1981 section 14 of Act 22 of 1960, section 11 of Act 62 of 1962, and section 5 of Act 8 of 1968, substituted by section 11 of Act 46 of 1975 and amended by section 11 of Act 8 of section 18 of Act 22 of 1960, section 8 of Act 7 of 1963, section 4 of Act 33 of 1972 and section 14 of Act 8 of section 19 of Act 22 of 1960, section 1 of Act 43 of 1960, section 9 of Act 7 of 1963, and section 5 of Act 54 of 1964, substituted by section 5 of Act 33 of 1972 and amended by section 12 of Act 67 of section 20 of Act 22 of 1960, section of Act 7 of 1963, section 6 of Act 54 of 1964, section 51 of Act 6 of 1965, RAILWAYS AND HARBOURS ACTS AMENDMENT ACT, 1981 (4) The committee shall consider the matter an shall take into account the information laid before i together with any other information provided at it request. (5) An employee who is retired on the ground 0 inefficiency shall be paid the benefits that woul have been paid to him had he been retired from th Service in accordance with the provisions of sectio 11.". 8. Section 14 of the Service Act is hereby amended by the substitution, in subsection (1), for the words "section 12A" of the words "sections and 12A". 9. Section 18 of the Service Act is hereby amended (a) by the substitution for subsection (4) of the following subsection: "(4) (a) No punishment shall be placed on record 20 against [a servant] an employee unless he has been notified in writing thereof and the decision by virtue of which the punishment is imposed, shall be deemed to be given at the time when the [servant] employee is so notified thereof. 25 (b) If an employee is convicted on a criminal charge and the circumstances are such that althoug disciplinary action is not contemplated it is nevertheless considered desirable to place the infringe ment on the disciplinary record of the employee 30 concerned, such infringement may, without disciplinary action being taken, but with written notification to the employee, be recorded. The decision to record the infringement shall b deemed to be given at the time when the 35 em ee is so notified thereof."; and (b) by the deletion 0 subsection 7).. Section 19 of the Service Act is hereby amended by the insertion after subsection 5 of the following subsection: "(6) If an employee is sentenced to imprisonment for a 40 period exceeding three months, such employee may, withou the disciplinary code being applied, be deemed to hav been dismissed from the Service as the result of a infringement of a serious nature from the date th imprisonment commences or from the date of suspension i 45 he was suspended from an earlier date.". 11. Section 20 of the Service Act is hereby amended by the substitution for subsection (2) of the following subsection: "(2) (a) A recorded punishment [of a caution or reprimand, or] of a fine not exceeding [four rand,] twenty-five 50 rand and an infringement recorded in terms of section 18 (4) (b) [whether imposed before or after the commencement of this Act], shall be expunged from

(5) Aan 'n werknemer wat op grond van onbe kwaamheid afgedank is, word die voordele betaal wat aan hom betaal sou gewees het indien hy ooreenkomstig artikel 11 afgedank sou gewees het.". 8. Artikel 14 van die Dienswet word hierby gewysig deur in subartikel (1) die woorde "artikel 12A" deur die woorde "artikels en 12A" te vervang. 9. Artikel 18 van die Dienswet word hierby gewysig (a) deur subartikel (4) deur die volgende subartikel te vervang:,,(4) (a) Geen straf word teen 'n [dienaar] werk 20 nerner aangeteken nie tensy hy skriftelik d~ hi"'ke'imis gestel is en die beslissing ingevolge waarvan die straf opgele word, word geag gegee te wees op die tydstip wanneer. die [dienaar] werknemer aldus daarvan in kennis gestel word. 25 b Indien 'n werknemer 0 'n strafre telike aankla skuldig bevind word en die omstandighede sodanig is dat alhoewel dissiplinere stappe nie bead word nie dit nogtans as wenslik beskou word 0 die oortreding op die betrokke werknemer s 30 dissiplinere rekord aan te teken, kan sodanig oortreding, sonder om dissiplinere stappe te doen, maar met skriftelike kennisgewing aan die werk nemer, aangeteken word. Die beslissing om di oortreding aan te teken, word geag gegee te wee 35 op die tydstip wanneer die werknemer aldu daarvan in kennis gestet word."; en (b) deur subartikel (7) te skrap.. 16 16 No GOVERNMENT GAZETTE, 11 MARCH 1981 Act No. 29, 1981 Insertion of section 24B in Act 48 of RAILWAYS AND HARBOURS ACTS AMENDMENT ACT, 1981 shall be submitted to Parliament at the next ensuing session for validation, or the matter shall be dealt with in terms of section 7 of this Act. Where the amounts involved do not exceed RlO 000 and no important principle is involved, the [Administration] General Manager may [make] approve such ex gratia payments, in which event the matter does not require to be dealt with in terms of section 7 of this Act. The Administration shall report all [such] cases annually to the Auditor-General. The Auditor-General shall mention the total amount involved in his Report to Parliament, specifying each instance where an amount of Rl 000 or more is involved, as well as any instance which in his view warrants special mention.". 27. The following section is hereby inserted after section 24A of the Finances and Accounts Act: "Remission or refund of revenue. 24B. Where the General Mana er is satisfied, in any particular case, that special circumstances ens which warrant, wholly or in part, the remission 0 refunding of revenue which is recoverable or whic has been recovered in respect of any of th 20 Administration's services, he may authorize such remission or refund, provided that the amount involved does not exceed RlO. 000 in anyone instance. In instances where the amount of RIO 000 is exceeded the Minister's authority therefor should 25 be obtained. Remissions or refunds thus authorized are not regarded as being ex gratia and it will not b necessary for the authority of Parliament to b obtained or for the matter to be dealt with in term of section 7: Provided that the General Manage 30 shall report annually to the Auditor-General th total amount of remissions and refunds in th instances where amounts of R5 000 or less ar involved, as well as details of each instance 0 remission or refund where an amount exceedin 35 R5 000 is involved. The Auditor-General shall men tion the total amount involved in respect of remis sions and refunds in his Report to Parliament an specify each instance where an amount of R more is involved, as well as any instance which in hi 40 view warrants special mention.". 5 Application of Act to South West Africa. Short title and date of commencement. 28. This Act and any amendment thereof shall apply also in the territory of South West Africa, including the Eastern Caprivi Zipfel. 29. This Act shall be called the Railways and Harbours Acts Amendment Act, 1981, and shall come into operation on a date fixed by the State President by proclamation in the Gazette, except that the provisions of (a) sections 2 and 3 shall be deemed to have come into operation on 1 July 1977; (b) section 18 shall be deemed to have come into operation on 1 December 1979; (c) sections 4 (1), 5, 7, 8,9,,11, 12 (3), 13, 14, 17 and 20 shall be deemed to have come into operation on 1 August 1980; and.
