3 NOTICE INVITING TENDER To All Concerned xx/01/2015 New Delhi Sub: Inviting the quotations for providing Desktops and UPS at PFRDA 1. Sealed Bids are invited under two Bid system for Supply, Installation and commissioning of Desktops and UPS from OEM or its channel partners / service providers, authorized distributors / dealers / resellers at PFRDA, New Delhi. 2. The tender bids duly filled in all respect enclosing necessary documents may be addressed to The Manager-IT, Pension Fund Regulatory and Development Authority, Plot No.6, First Floor, ICADR Building, Vasant Kunj Institutional Area, Phase-II, New Delhi so as to reach on or before till 14:30 hrs which will be opened on the same date at 15:00 hrs i.e at PFRDA, New Delhi. 3. The terms & conditions of the tender are enclosed as per Annexure I 4. The interested vendors fulfilling the terms and conditions stated may submit their bids along with the earnest money as mentioned in the tender document in sealed cover duly superscribed as Quotation for Desktops and UPS for PFRDA. 5. PFRDA reserves the right to reject all or any of the tenders without assigning any reason thereof. 4 ANNEXURE I INVITATION OF BIDS & TERMS AND CONDITIONS 1. Pension Fund Regulatory and Development Authority (PFRDA) was initially established by the Government of India on 10th October 2003 to promote old age income security by establishing, developing and regulating funds, to protect the interests of subscribers to schemes of pension funds and for matters connected therewith or incidental thereto, through National Pension System(NPS). The PFRDA Act 2013 governing the powers and functions of the Authority has been enacted by the Parliament and notified w.e.f The Central Government has introduced the National Pension System (NPS) with effect from 1 st January The NPS covers at present, new entrants to Central Government services (excluding Armed Forces), most State Government services and autonomous bodies at their discretion and all citizens of India on a voluntary basis with effect from 1 st May The website of PFRDA is 2. The PFRDA is presently located at 1st Floor, ICADR Building, Plot No.6, Vasant Kunj, Institutional Area, Phase-II, New Delhi and intends to purchase the desktops and UPS which are to be supplied, installed and commissioned in Pension Fund Regulatory and Development Authority, Plot no.6, ICADR Building, Vasant kunj Institutional Area, Vasant Kunj, New Delhi This document does not constitute nor should it be interpreted as an offer or invitation for the supply, installation and commission of the above mentioned items. Prospective Bidders are advised to go through the complete tender document, including terms and conditions carefully before applying and understand the eligibility conditions, etc. The bid once submitted shall not be ordinarily permitted to be withdrawn, after the closing date of submission of bids, which shall be at the sole discretion of PFRDA. The terms and conditions of the tender, including eligibility conditions shall be construed on the date of Notice Inviting Tender. 4. The validity period of the bid will be three months from the date of opening of tender documents viz., the Technical and financial bid, which may be extended by the bidders for such period as may be requested by PFRDA. The bidders shall ensure that timelines are adhered to and any bids received later than the specified time and date shall not be entertained. 5. The various crucial dates relating to Supply, Installation and Commissioning of Desktops and UPS are cited as under: a. Date Of Issue 22/01/2015 c. Likely date for Award of Supply Order 16/02/2015 PFRDA reserves the right to change any date/time mentioned in the schedule above under intimation to all concerned. 6. PFRDA reserves the right to accept or reject any quotation in full or in part, and to suspend this process and reject all quotations or part at any time prior to the award of contract, without assigning any reason and thereby incurring any liability to the affected supplier/s on the grounds of the purchaser s inaction. PFRDA also reserves the right to cancel/reissue the Tender. 7. Eligibility Criteria: The bidder should have the following qualifications for bidding: a. Shall have OEM presence in India or channel partners / service providers, authorised distributors / dealers / resellers. b. Shall have been in existence for not less than three years. c. The bidder must have service centre/ OEM service centre in Delhi/NCR and Bidders, if not OEM, should have authorization from manufacturer for supply, installation, commissioning, services etc of the quoted items. d. Shall have experience of supplying orders for Govt. Deptt./ PSU etc. for more than 3 years e. Shall have PAN/TAN number, Sales tax registration, VAT registration f. It is not blacklisted by any Ministry/ Department of the Government of India or any PSU or any other organization. g. Shall have annual turnover of Rs.30 Lakhs for each of the last three years. 8. The tender has been invited under two bid system i.e. Technical Bid and Financial Bid. a. Technical Bid The technical bid shall consist of documents mentioned in Annexure-IV b. Financial Bid The Financial Bid should have only Prices/Rates quoted by the bidder in proforma enclosed as Annexure-V. The following points may also be noted:- i. The rates/prices should be quoted in Indian Rupees only in words as well as figures. The rates/prices quoted should be inclusive of all taxes / packing /cartage etc. However, a break-up of price and applicable taxes should be mentioned therein. ii. A bidder must quote for both the items of this tender enquiry. iii. The rate quoted must be valid for three months from the date of opening of bid. iv. If the charges of any item gets reduced during the validity of tender, the benefit thereof would be passed on to PFRDA. Further, no claim for compensation or loss due to fluctuations in currency rates or any other reason shall be entertained.

6 v. The rates must be quoted only for the popular and current brand items and should be clear in all respect. PFRDA reserves the right to determine such brand based on its requirement and the decision of PFRDA thereon shall be final. 9. Submission of Bid: a. The bid shall be typed/ printed, legible and be in English language only. All the pages of the bid should be numbered and signed. b. The bid prepared by the bidder shall comprise of (i) Technical bid and (ii) Financial bid. c. Bid may be submitted in the following manner: (i) Envelope No. 1- Shall contain the Earnest Money Deposit (EMD)/bid Security The envelope must be superscribed as EMD/ Bid Security (ii) Envelope No. 2- Shall contain Technical Bid. (iii) Envelope No.3- Shall contain Financial Bid. (iv) Envelope No. 4- Shall be a bigger envelope containing envelopes 1, 2 & 3 as mentioned above. d. All the envelopes must be sealed and suprescribed as Tender for Desktop Computers and UPSs and addressed to The Manager-IT, Pension Fund Regulatory and Development Authority, Plot No.6, First Floor, ICADR Building, Vasant Kunj Institutional Area, Phase-II, New Delhi The Tender shall be dropped in the Tender Box placed in the Reception Office, above addrress before last date and time of submission of tender, i.e upto 3.00 pm. e. If the last date happens to be a holiday, the same would be accepted on next working day as per above schedule. f. Late submission of tenders will not be accepted. Tenders by Telex/Telegram/Fax/ will not be accepted. Tenders may be submitted by Registered Post, by hand in person or by courier so as to positively reach before the last date and time of submission. However, any delay on this account shall not be accepted as reason for exception. g. All the envelopes shall also indicate the name and address of the bidder enabling the bid to be returned, if required. 10. Earnest Money Deposit: An Earnest Money Deposit (EMD) of Rs /-(Rupees Ten thousand only) through a Demand Draft on any scheduled bank in Delhi drawn in favor of Pension Fund Regulatory and Development Authority, New Delhi must accompany the quotation letter. a. Quotation received without EMD will not be considered. b. The bid security of unsuccessful bidders will be returned within 30 days after approval of the tender without any interest. The EMD of finally selected bidder will be returned /discharged upon his furnishing the acceptance report after completion of the Supply, Installation and commissioning of supplied Desktops and UPS at PFRDA. 6 P a g e

The EMD may be forfeited: (a) if a bidder withdraws its bid during the period of bid validity specified by the bidder in the bid from Or (b) In case the successful bidder fails to acknowledge the order after the award of the contract ( c ) If at any stage of the tender process, the information or declaration furnished by the bidder is found false; 11. Opening of Bid The technical bid shall be opened on at 15:00 hours. The financial bid of the eligible bidders shall be opened on at 15:00 hours Determination of lowest bidder and award of contract Lowest bidder (L-1) for each of Desktop Computers and Offline UPSs will be evaluated separately. In case of tie, PFRDA reserves the right to select any of such bidder. After selection of lowest evaluated bidder, purchase order shall be placed with him for supply of items which is subject of this tender notice. 13. Delivery Schedule : The company shall be able to deliver the required items within a reasonable period of time, preferably within 15 days of placing order. The company shall adhere with all seriousness to the time schedule provided by the PFRDA. Delivery/Installation is to be done at Pension Fund Regulatory and Development Authority, Plot No.6, First Floor, ICADR Building, Vasant Kunj Institutional Area, Phase-II, New Delhi Delivery/Installation/Commissioning : a. The procured items shall be of good quality and delivered free of any defect at the office of PFRDA during office hours within 7 days of issue of Purchase Order. b. The delivered items shall be installed and commissioned by the bidder at the request of PFRDA. c. In case of delayed delivery without valid reason, a compensation of an amount equal to 0.5% of the tender value will be payable to PFRDA upto 15 days. Thereafter, a compensation at the rate of 1% of the value of the items upto one month is payable. The penalty may be recovered from EMD. Besides, the purchase order for remaining quantity may be cancelled and PFRDA reserves its right to recover any losses, expenses incurred etc. 15. Maintenance Warranty/ Complaint Redressal: a. The bidder shall provide Comprehensive Onsite Warranty for a period of three years for Desktop Computers and one year for UPSs. The period of comprehensive onsite warranty will start from the date of installation of items but not later than 30 days from the date of delivery of items in the PFRDA. b. The bidder shall maintain the supplied items free of charge during warranty period. c. The bidder or his OEM shall provide a convenient mode of lodging the complaint and redressal thereof. The complaint should invariably be attended within 4 hours of lodging the same and must be resolved within 24 hours during warranty period at the location of the item (s) in the PFRDA. 16. Liquidated Damages :

8 8 P a g e The bidder shall be liable to indemnify the PFRDA in all respects and meet and pay off the litigation expenses and all the liabilities including damages, sums etc. arising out of and as a consequence of the negligence, deficiencies, mistakes, lapses, delays etc. in the execution of the various jobs and the services provided. 17. Purchase Order : The purchase order for the entire quantity can be placed either in one lump sum or as per the requirement through repeat order. The quantity shown is tentative and may increase or decrease. Other terms and Conditions : 18. In the event of failure of the bidder to supply whole or part of the purchase order, the PFRDA shall request the next higher responsive bidder to supply the remaining item(s) at L1 rate(s).if any higher rates or expenses are incurred on account of failure of the successful bidder, the same shall be payable as compensation to PFRDA. In the event of non-supply by successful bidder, the performance security or earnest money so deposited by the bidder shall be forfeited and other legal action may also be initiated. Further, the bidder will be blacklisted for supply of any item to the PFRDA. 19. This tender is not transferable. 20. PFRDA reserves the right to accept or reject any or all tenders without assigning any reasons. 21. Bill Payment a. A Bill giving details of Sales Tax/VAT Registration Nos., etc. may be submitted to PFRDA for settlement. b. Payment of bill would be processed after successful installation/commissioning of equipment and furnishing of performance security deposit. c. No advance payment will be made 22. This document is meant to provide information only and upon the express undertaking that recipients will use it only for the purposes set above. No representation or warranty, expressed or implied is or will be made as to the reliability, accuracy of the competence of any of the information contained herein. It does not purport to be all inclusive or contain all the information regarding the service to be provided or be the basis of the contract. It shall not be assumed that there shall be no deviation or change in any of the herein mentioned information on roles and responsibilities of service provider. While this document has been prepared in good faith, neither PFRDA, nor any of its officers make any representation or warranty nor shall have any responsibility or liability whatsoever in receipt of any statements or omissions made herein Any liability is accordingly and expressly disclaimed by PFRDA and any of their officers even if any loss or damage is caused by any act or omission on the part of PFRDA or any of their officers, whether negligent or otherwise. 23. By acceptance of this document, the recipient agrees that any information herewith will be superseded by any subsequent written information on the same subject made available to the recipient with access to any additional information or to update this document or to correct any

9 inaccuracies, therein, which may become apparent, and PFRDA reserves the right at any time and without advance notice, to change the procedure for the selection of service provider. Accordingly interested recipients should carry out an independent assessment and analysis of the requirement of the information, facts and observation contained therein. 24. This document has not been filed, registered or approved in any jurisdiction. Recipients of this document should inform themselves or and observe any applicable legal requirement. 25. This document constitutes no form of commitment on the part of PFRDA. Furthermore, this document confers neither the right nor any expectation on any party to participate in the tender process. The bidder is responsible for all acts incurred in connection with participation in this process. This tender does not commit the PFRDA to award a contract or to engage in negotiations. The bidder participations in this process may result in PFRDA selecting the bidder to engage in further discussions and negotiations towards execution of a contract The commencement of such negotiations does not; however signify a commitment by PFRDA to execute a contract or to continue negotiations. The PFRDA may terminate negotiations at any time without assigning any reason or cancel or annul the tender process at any stage without assigning any reason. 26. PFRDA reserves the right to vary/alter/amend the eligibility criteria for the bidders at any time, in its discretion, before the last date of submission of proposals. The bidders shall comply with and abide by such directions that PFRDA may issue from time to time. 27. The proposal and all correspondence and documents shall be written in English. All proposals and accompanying documents received within the stipulated times shall become the property of PFRDA and will not be returned. 28. The proposal shall be valid for a period of three months from the date of opening of proposals. A proposal valid for a shorter period may be rejected as non-responsive. 29. Governing Laws/Jurisdiction/Arbitration: Any matter relating to the appointment of Maintenance Service Provider under this tender or the procedure for such appointment shall be governed by the Laws of Union of India. All disputes arising out of this notice inviting tender shall be subject to the exclusive jurisdiction of Courts at Delhi only. 9 P a g e
