The Govt of India, Ministry of Labour & Employment, vide their Notification No.S-38025/04/2010-SS.1 dated have amended Rule 50 of ESI (Central) Rules, 1950 as a result of which the wage ceiling for coverage of employees under the Act has been enhanced from Rs,10,OOO/-to Rs.15,OOO/- w e.f 1st May, A copy of the notification issued by the Ministry is enclosed In order to give effect to the above amendment in the ESI (Central) Rutes, the following actions may be taken on priority basis:- Wide publicity may be given to the above amendment by sending mailers to all employers, employers'/employees' associations, Chamber of Commerce and Regional Board/Local Committee members. No press advertisement need to be done now. in all letters Issued from Regional Office, stamp may be affixed indicating that wage limit for coverage of employees has been enhanced from RS.10,OOO/-to Rs,15,OOO/-w.e.f The employers may be advised to submit Declaration Forms of all persons drawinq wages above RS.10,000/- and upto Rs.15,OOO/- per month to the appropriate Branch Office positively by io" May, On receipt of Declaration Forms, immediate action may be taken to issue Pehchan cards to all such newly covered employees. 2 -2- To ensure that Pehchan cards are issued to all these newly covered employees, Pehchan teamslwlpro may be suitably advised. Employers may be advised that the employees' and employers' contribution in respect of all such employees drawing wages above RS.10,000/- and upto Rs.15,000/- shall be required to be paid w.e.f. 1st May, As per the provision of Regulation 4 of ESI (General) Regulations, 1950, the first shorter contribution period in respect of all such newly covered employees shall commence from 1 st May, 2010 and the corresponding benefit period for them shall commence only after expiry of a period of nine months from the date of such employment. The benefit rates upto Rs.25,OOO/- are already available in the table of standard benefits given in Rule 54 of ESI (Central) Rules, As per proviso to Rule 55 of ESI (Central) Rules, 1950, all such newly covered persons shall be eligible for Sickness Benefit if contribution in respect of them were payable for not less than half the number of days available for working in such shorter contribution period. Provision of benefit to all such employers may be regulated accordingly. A monthly report regarding number of newly covered employees falling in the wage bracket of Rs.10,OOO/- to Rs.15,OOOI- registered as well as employees who had gone out of coverage earlier due to increase in their wages and have been re-covered, may be sent to the undersigned by 10 th of every month beginning 10 th June, This issues with the approval of Insurance Commissioner. (E)- The following draft rules further to amend the Employees' State Insurance (Central) Rules, 1950 were published as required under sub-section(l) of section 95 of the Employees' State Insurance Act, 1948 (34 of 1948) in the notification of the Govenunent of Indian in the Ministry of Labour & Employment vide No. G.S.R.164(E), dated the 26 th February, 2010, in the Gazette of India, Part Il, Section 3, Sub-section (i), dated 27th February, 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public; And whereas the copies of the said Gazette were made available to the public on 27th February, 2010; And whereas, objections and suggestions received from persons likely to be affected thereby have been considered by the Government; Now, therefore, in exercise of powers conferred by section 95 of the Employees' State Insurance Act, 1948, the Central Govenunent, after consultation with Employees' State Insurance Corporation, hereby makes the following rules further to amend the Employees' State Insurance (Central) Rules, 1950, namely:- 1. These Rules may be called the Employees' State Insurance (Central) Amendment Rules, These shall come into force from the 1st day of May, In the Employees' State Insurance (Central) Rules, 1950, in Rule 50, for the words "ten thousand", wherever they occur, the words "fifteen thousand" shall be substituted.
