1 EBA WAGE RATE BULLETIN Effective from the first full pay period on or after 1 October 2015 This wage rate bulletin only applies to those members bound by the EBA. For those members bound by the EBA the 1 October 2010 wage rates continue to apply, however, nothing precludes you at law from applying the 1 October 2014 rates. CHANGE Site allowance increases in accordance with CPI movements National Employment Standards The National Employment Standards (NES) are a new set of minimum employment standards that commence operation on 1 January The NES consists of 10 minimum terms and conditions of employment that are in addition to those terms and conditions of the EBA. A copy of the NES can be downloaded from NECA s website at Modern Award System Electrical, Electronic and Communications Contracting Award 2010 Clerks Private Sector Award 2010 Australia s new modern award system commences operation on 1 January Neither award has any direct impact on electrical workers of EBA employers; however, it is important to be aware of their existence. A copy of each award can be downloaded from NECA s website at Pay Progression In addition to an apprentices anniversary date wage increase, those employers bound by the EBA are also required to provide apprentices with a wage rate increase on 1 st March of each year, up until March This means that a Construction 2013 second year apprentice on the current base rate of $ will progress to $ per week on 1 March If all modules have been passed (or only 1 failed) then a 2013 second year apprentice will progress from the achievement rate of $ to $ per week on 1 March 2014 The increase above is additional to the anniversary increases available under the apprentice pay progression scheme that came into effect on 1 January The progression scheme only applies to those employers bound by the , and EBAs. It does not apply to those employers who are bound by earlier EBA s e.g EBA. Importantly, assessment for progression occurs when an apprentice reaches his/her anniversary of commencement date. Clause 17.5 of the EBA provides the arrangement for apprentice pay progression and is called the TAFE Institute/RTO Achievement Allowance. The basic principle is that apprentices must pass most of their TAFE/RTO modules in each year to be entitled to the TAFE Institute/RTO Achievement Allowance. If they have passed all modules, or failed only 1 module, then they receive the allowance. If they have failed 2 or more modules then their base pay progresses but they do not receive the TAFE Institute/RTO Achievement Allowance.

2 If they pass the 2 or more previously failed modules within the six month period (typically January to June) following the initial failure date, then the Allowance is to be back paid to the anniversary date. More specific detail is contained in the applicable apprentice wage rate tables of this bulletin. By way of example a Construction first year apprentice in 2013 receives $ per week. When the apprentice reaches their second year anniversary date in 2014 they progress to the base rate of $ per week. If all modules are passed (or only 1 failed / not complete module), then progression is to the achievement rate of $ per week. Travel Time: Allowance: All employees, except apprentices, shall be paid travel time allowance of $7.48 per day for each day on which they present themselves for work. s shall receive a travel time allowance at the rate set out in the Wage schedule. The allowance is to be paid for rostered days off and in the case of apprentices, the days on which they attend trade school, but not payable for sick leave, annual leave or public holidays. As it is an allowance received during ordinary time, it should also be included in calculations for superannuation contributions. Employees, including apprentices, required to start and/or finish work on the site, and where the work site is between 0-50 km from the workshop or registered office are entitled to fares allowance as follows: (a) If the employee PROVIDES OWN TRANSPORT $25.89 per day (b) If the employee is PROVIDED WITH TRANSPORT $4.19 per day Excess travelling time as well as the above mentioned fares allowance is payable if the work site is beyond 50 km from the workshop or registered office. Where these conditions are met the Travel and allowances payable shall be a total sum of $26.74 per day. The weekly all purpose rate is divided by 36 and used to calculate overtime, annual leave, annual leave loading, sick leave, public holidays and pro rata payments on termination. This applies to employees working in Construction (Part B) and Non-Construction (Part A Service, Maintenance & Installation). For employees working in Workshops (Part A), Cottage and Country sector work (Part C) the divisor remains at 38 hours as those sectors operate on a 38 hour week.

3 Casuals: Hours: Casual employees receive a 20% loading on the hourly rate. Casuals do not receive annual leave, sick leave or payment for public holidays (unless they actually work). 36 ordinary hours per week, with a maximum of 8 hours per day, Monday to Friday between 6 am and 6 pm, or an average of 36 hours per week calculated over an employee s work cycle (Construction and Non-Construction). For Workshops (Part A), Cottage and Country sector work (Part C) it is 38 ordinary hours per week. Annual Leave: 4 weeks annual leave with pay for every 12 months service plus 17.5% loading (including apprentices). To calculate pro rata annual leave for the 36 hour week employees working under Appendices B & C use hours per week of service. For Appendices D, E and F the pro rata annual leave formula is hours per week of service to accommodate the 38 hour week. Annual leave loading of 17.5% is payable when employees take leave, and on termination, where employees accrued annual leave is paid out (except if dismissed for misconduct). If an employee is working shift work or on a site with an all purpose site allowance immediately prior to taking leave, then that shift loading or site allowance is payable during annual leave. An employee engaged in continuous shiftwork over a 12 month period is entitled to one additional week of annual leave eg total of 5 weeks per annum. Overtime: From 1 October 2011 all overtime performed in Construction (Part B) is paid at the rate of double time. For Service, Maintenance & Installation (Part A Non-Construction): Monday to Friday: Time and one half for the first two hours, double-time thereafter. Each day is stand alone for the purpose of calculating overtime unless averaging hours over the 4 week cycle has been agreed. Saturday: Time and one half for the first two hours double-time thereafter. Minimum 4 hours. Sunday: Double time all day. Minimum 4 hours. Public Holidays: Double time and one half all day. Minimum 4 hours. PERSONAL LEAVE The personal leave provisions of the EBA mirror those contained in the National Employment Standards (NES). Personal/Carer s Leave (Sick Leave): Personal/carer s leave is a combination of paid sick leave for personal illness or injury and paid or unpaid carer s leave for the caring of an employee s immediate family member or member of the employee s household. An employee is entitled to a combined total of 10 days paid personal/carer s leave per annum. Employees are also entitled to an additional 2 days unpaid carer s leave on each occasion but only in circumstances where they have already used up all of their paid carer s leave entitlement. Personal/carer s leave now accrues on a pro-rata basis for each four week period worked. A full time employee (38 hours per week) accrues hours of personal/carer s leave for each four week period worked which equates to hours per week. A full time employee (36 hours per week) accrues hours of personal/carer s leave for each four week period worked which equates to

4 hours per week. Personal/carer s leave should be paid at the employee s basic periodic rate of pay. Compassionate Leave: Previously referred to as bereavement leave in the Award, compassionate leave is paid leave taken for the purposes of spending time with an employee s immediate family member or member of the employee s household who has a life threatening illness or injury and/or after the death of such a person. An employee is entitled to 2 days paid compassionate leave for each occasion that arises. There may be more than one occasion during any twelve month period. This entitlement is additional to the 10 days paid personal/carer s leave entitlement. Termination of Employment: If terminating an employee s employment, the notice periods required, or payments in lieu of notice (set out in the NES) are as follows: Employee s period of continuous service Not more than 1 year More than 1 year but not more than 3 years More than 3 years but not more than 5 years More than 5 years If the employee is over 45 years of age and has at least two years continuous service Period of notice 1 week 2 weeks 3 weeks 4 weeks 1 additional week Termination of employment, unless for negligence or serious misconduct, should also involve a process of counselling and warnings. If an employee resigns and does not give one week's notice, then the employer is entitled, to withhold one week s pay in lieu of notice (see EBA clause 20.1(d)). Redundancy: The NES introduces a new redundancy payment scale which is additional to the notice period scale above. From 1 January 2010 the following scale applies: Employee s period of continuous service At least 1 year but less than 2 years At least 2 years but less than 3 years At least 3 years but less than 4 years At least 4 years but less than 5 years At least 5 years but less than 6 years At least 6 years but less than 7 years At least 7 years but less than 8 years At least 8 years but less than 9 years At least 9 years but less than 10 years At least 10 years Redundancy pay 4 weeks 6 weeks 7 weeks 8 weeks 10 weeks 11 weeks 13 weeks 14 weeks 16 weeks 12 weeks* *The reason for a reduction to 12 weeks after 10 years is because an employee receives the benefit of a long service leave payment. If continuous service which is less than a full year at any of the year levels referred to above, then a pro rata payment will apply. Any redundancy payment due to an employee is offset by the amount the employer has contributed for the employee to the severance scheme Protect. All outstanding entitlements (annual leave, payment in lieu of notice, redundancy pay etc.) are to be paid out on the day termination of employment takes effect. A separation certificate should also be provided upon cessation of employment.

5 Severance Pay: For the (and ) EBA severance pay is to be paid for all employees (except apprentices) into Protect at the rate of $80.00 per week for Non-Construction sites (Service, Maintenance & Installation Part A), or $95.00 per week for Construction sites (Part B). For those employers bound by the EBA severance payment is at the rate of $57.40 per week, unless an employer has agreed to contribute at a higher rate. Severance payments are optional for those EBA employees engaged solely in Workshop, Cottage and Country sector work. For general enquiries contact Protect on Income Protection Insurance: Income protection insurance is to be paid for all employees into Protect at the rate of $27.75 for Grades 1-10 and $18.65 for apprentices from 1 March 2014 (includes GST). For further information phone Protect on Rostered Days Off: Employees working in Construction and Non-Construction accrue 0.8 of an hour per day towards RDO s with the effect that if they work always under Construction and Non-Construction they will accrue 26 RDO s per annum. This is provided for in the EBA at clause 9 (Construction) and clause 6 (Non-Construction). Employees working under the Workshops, Cottage and Country sectors retain the 38 hour week accrue 0.4 of an hour per day towards 13 RDO s per annum. Site Allowances: Site allowances are adjusted annually in line with CPI movements. No site allowance is payable where the minimum project value is below 3.0 million. Long Service Leave: From 1 July 2001, access to pro rata long service leave applies after 7 years service. This means workers can take 6.06 weeks leave on full pay after seven years of service in the industry and with the agreement of their employer. Increase in benefit accrual rate to 13 weeks after 10 years for service applies after 1 July The previous accrual rate was 13 weeks after 15 years of service. NECA members must cover electrical employee s long service leave entitlements through CoINVEST, 478 Albert Street, East Melbourne, Phone or and website: Annual leave and sick leave accrue while an employee is on long service leave. RDO s are absorbed (no extra days). If the employee is sick whilst on leave, he/she cannot use accrued sick leave in lieu of long service leave.

6 A contribution rate of 2.7% of normal earnings applies from 1 July Normal earnings exclude overtime, travel and fares and leave loading. The contribution can be paid monthly or after each 4 months i.e. 15 November, 15 March, 15 July. You are encouraged to pay electronically as it is much easier than calculating manually. There is an option to pay monthly and if you choose it can be arranged with CoINVEST whose contact details are above. Superannuation: For EBA employers the minimum amount payable is 9.50% (with a minimum of $95 per week except for apprentices) of ordinary time earnings (OTE), whichever is the greater (except apprentices who receive 9.50%). The Australian Tax Office has advised NECA that allowances, other than expense allowances, payable for ordinary time, are to be included in calculation of 9.50% OTE. An A Grade s 9.50% OTE will include, for example : Travel time allowance $7.48 x 5 = $37.40 allowances (where applicable) $4.19 x 5 = $20.95 Gross all purpose wage (Construction) = $ Total = $ % of OTE = $ In this case the superannuation contribution of 9.50% of ordinary time earnings would apply because it is greater than the minimum amount payable of $95. allowance of $25.89 (start and / or finish on the job using own vehicle within 50km radius) is deemed to be an expense allowance and thus not included when calculating 9.50% OTE). When working on site, site allowances paid during ordinary time are also included when calculating superannuation. Comms Cabler Registration Allowance: To register for superannuation with CBUS (the building industry superannuation fund) phone An employee who is required by the Company to hold and utilise a current communications cabling registration in the course of their employment will be paid an all purpose allowance, but only in respect of the week for which the employee is engaged in duties for which registration is required. The allowance is $30.75 per week for open registration and $23.03 per week for restricted licence. Training Fund Contribution: This fund has now ceased operation

7 METHOD FOR DETERMINING WAGE RATES CONSTRUCTION (PART B) The Gross All Purpose Wage Rate tables contained in this bulletin are applicable to each classification and comprise of the following components: (a) (b) (c) (d) (e) Minimum weekly rate of pay; Industry allowance: (i) An all purpose allowance of (*) per week shall be paid as compensation for the following disabilities associated with on-site work: (A) (B) (C) (D) (E) (F) Climatic conditions when working in the open on all types of work The physical disadvantage of having to climb stairs or ladders The disability of dust and fumes blowing in the wind, brick dust and drippings from newly poured concrete Sloppy and muddy conditions associated with the initial stages of on-site construction work. Tool allowance (where applicable, being for EW 5 and above); A-Class licence allowance (where applicable, being for EW 5 and above); and Construction allowance.
