2 2 MESSAGE FROM THE PRESIDENT Happy March~ Anyone know who John Scolinos is? He is a legendary college baseball coach, for 40 years, who became a public speaker after retirement! Following is a story that I hope everyone embraces, as only our CSEA members do, continually! Do any of you know how wide home plate is in Little League? How about high school, college, minor or major leagues? The answer is 17 inches What happens when a player can t throw the ball over that 17 inch plate? What isn t said is.oh, that s OK, we ll make it 18, 19 or 20 inches for you so you have a better chance. What happens when the best player on the team shows up late to practice? Should he, no matter their importance on the team be held accountable? Or, is the plate widened to fit that player? I m sure that you all know what HOME plate looks like picture this. Turn home plate so that the point represents the roof of a house, add a door and windows, just to give it that homey feel. This is our CSEA house now. Are we being accountable to ourselves, each other, our families, working within our 17 inches, or are we widening the plate? We can t solve the world s problems, but we can be the example of what a great CSEA member looks like and how they continuously perform their jobs! For the months of March and April we have decided to have a drive for Manna! Please bring a canned food item or a boxed item to the Chapter meetings. Just to give you an update on Negotiations. We met with management on February 14, 16, 24, and 27. On February 27th, the Negotiating Team did sign off on the following for : Salary Increase: A. Retroactive to July 1, 2016, there shall be a one and half (1.50%) percent base salary in rease to the Association s Salary Schedule for all Association members employed by the District as of February 1, (ongoing cost) Health and Welfare Benefits: A. There shall be a four (4%) percent increase to an Association member s health and welfare benefits contribution to take effective July 1, 2017, and four (4%) percent increase to take place effect July 1, (ongoing) CalPERS Retirement: A. For the school year, the District shall bear the cost of the employer CalPERS contribution increases. (ongoing cost with annual increases) This Agreement is being reviewed by the CSEA Legal Department. (610 process). Once we receive word, we will be scheduling a time for our members to come out and vote (or ratify) the above Memorandum of Understanding (MOU). The collective bargaining Agreement is still in its tentative stage, until the union members approve the Agreement. However, if the members reject the Agreement, the Negotiating Team and the District would go back to the bargaining table and flush out the details with which the union membership wasn't entirely satisfied. The Behavior Stipend for Para Pros is still on the Negotiating table. We have identified the group that would be eligible for receiving this stipend, and now we are working out the details and training that would be associated with this Stipend going forward. We understand that the existing verbiage is vague and are working to ensure clarity. We are hopeful that the details will be worked out at our next Negotiation meeting scheduled for March 23rd. I know this has been a long journey, but your patience is appreciated. Let s keep CSEA/Chapter 620 an open line to communication for everyone to have a place to share concerns, answer questions, and keep a positive force. Make every day great! 5 5 DID YOU KNOW??????.On March 2, 2017, the California Supreme Court unanimously held that when a public employee or official uses a personal account to communicate about the conduct of public business, the communication may be subject to disclosure under the California Public Records Act ( PRA ). (City of San Jose v. Superior Court of Santa Clara County (S218066, March 2, 2017).) In effect, this means that if an agency employee or official discusses public agency business on his or her personal account, cell phone, computer or other electronic means, the agency may be required to disclose those communications. When does a communication on a private account become a public record? A key aspect of the Court's holding was that, when determining whether a writing constitutes a public record, what matters most is the content of the writing, and not necessarily how and where the writing is stored. The Court stated that incidental mentions of agency business are insufficient to make a writing a public record. At a minimum, the writing must relate in some substantive way to the conduct of the public s business. The Court acknowledged that this will not always be clear, and it is not so broad as to include every piece of information the public may find interesting. For example, this generally does not include communications that are primarily personal. Whose personal accounts could contain public records? The Court clarified that any employee or official may create a public record, even if the writing is prepared and maintained on his or her private account. For public school districts, for example, this would include school board members, administrators, teachers, classified employees and any other employee who prepares a writing that substantively relates to the district s business. Q. What does this decision mean for school districts? A. The decision by the California Supreme Court means that if a district employee or official is conducting district business on his or her personal account, cell phone, computer or by other electronic means or devices, such records might be responsive to a PRA (Public Records Act) request.

7 7 QUESTIONS ASKED BY MEMBERS AND ANSWERED BY THE PRESIDENT #1 When will we begin negotiations for school year? Answer: We began October 21, 2016, and met again on December 12, We met again on February 14, Feb. 16, Feb. 24, and Feb. 27. Read the President s Message on the first page of this Newsletter, and I encourage Chapter members to attend the next Chapter meeting scheduled on Thursday, March 16th. #2 How do I access work ? Answer: From Any browser Example: Chrome, Internet Explorer, Safari, Firefox Go to: owa.conejousd.org Type in your Username and password If you are unsure of your login, contact your Site Tech or Technology Services Department. #3 If I need to go out on Catastrophic Leave and am COMPLETELY out of sick and/or vacation days what steps should be followed? Answer: Talk to your immediate Supervisor advising them of your situation. The next step would be to find the Sick Leave Donation form online. Fill it out and submit it to Mark McLaughlin along with any pertinent documents for approval. Once approved by Mark McLaughlin, the President of CSEA along with a Catastrophic Committee would meet and a decision would be made. The employee would then be notified. If approved, the President of CSEA Chapter 620 would then go to the Secretary of the Chapter and an would be sent to Classified Employees asking for donations of Sick Time hours/days. #4 If I am NEW to CVUSD, who should I contact to see if I am a member of the local Chapter 620? Answer: Contact our Treasurer, or 2nd VP and they can check for you.. If you are not a member, we will have you fill out a membership application. You can also ask your Site Rep.to help you determine whether or not you are a member of the Local Chapter by looking at your paystub deductions. Ask your Office Manager who, at your site, is your Site Rep. #5 As a Classified employee, how do I know which days are holidays, and which days are non-work days? Answer: Every Classified Employee has a job class, which is connected to a Work Year calendar. You should be able to find your Work Year calendar on the CVUSD Website. Check with the Office Manager/Secretary or Admin. Assist. at your worksite if you are unable to locate your calendar. The Human Resources office at the District Office can also help you find the correct work year calendar for your job classification. #6 What Committees do we have for Classified Employees to get involved? Answer: Budget Committee, DAC Committee, Health Benefits Committee, Professional Growth Committee, Reclassification Committee, Safety Committee, Scholarship Committee, and Wellness Committee.

8 8 CSEA CHAPTER 620 CVUSD SENIOR SCHOLARSHIPS CSEA Para Educator Conference WHEN: March 14-16, 2017 These scholarships are available to graduating high school seniors who are dependents of CSEA Chapter 620 members of CVUSD. Applicants may qualify for scholarship based on academic merit, leadership qualities, community involvement, and other personal qualifications. This year we will be giving out 5 Scholarships in the amount of $1,000. each. Eligibility Requirements: Applicant MUST be a graduating High School Senior Applicant MUST be a dependent of a CSEA Chapter 620 member and an employee of CVUSD Applicant MUST be planning to enter, as a full time student, an accredited college by the fall term following the granting of the Scholarship (Accredited colleges include community colleges, offering trade and vocational programs, other accredited trade or vocational schools, as well as 4 year institutions) Applicants MUST have a cumulative minimum grade point average of 2.5. Application and all other required information or documents MUST be received by: April 24, 2017 For more details and to download the application, please visit the CVUSD website.
