Cosgrove - Rutan & Tucker, LLP, City Attorney Date: November 2, 2017 Re: Transition to District Based Elections for City Councilmembers Recommendation: t is recommended that the Council receive public comment and discuss the draft voting district maps presented (Attachment A) pursuant to Elections Code section (a)(2). t is further recommended that the Council consider eliminating any draft maps that it no longer wishes to consider adopting, as well as determining the number of districts the Council will ultimately adopt. Discussion: On August 7, 2017, the City received a letter from the law firm Shenkman & Hughes questioning the City's compliance with the California Voting Rights Act ("CVRA") (Elec. Code ), and requesting the City voluntarily convert to a by-district election system. The CVRA only applies to jurisdictions, like the City of Duarte, that utilize an at-large election method, where voters of the entire jurisdiction elect each of the members of the City Council. The CVRA was enacted in 2002 with the specific intent of facilitating private suits to force public entities to shift from "at-large" to "by-district" elections. t does so by eliminating several key burden of proof requirements that exist under the Federal Voting Rights Act of 1965 ("FVRA") (52 U.S.C et seq.) after several jurisdictions in California successfully defended themselves in litigation brought under the FVRA. Specifically, the CVRA removes two elements that must be met in order to establish a violation of the FVRA: (1) the requirement that the plaintiff show a majority-minority district can be drawn; and (2) the "totality of the circumstances" or "reasonableness" test, where the defendant can demonstrate that certain voting trends - such as racially polarized voting - occur for reasons other than race, or show that minority voters are still able to elect their candidate of choice. Under the CVRA, the only "element" a plaintiff must establish is that racially polarized voting occurs in a jurisdiction with at-large elections, without regard for why it might exist. This threshold for establishing liability under the CVRA is extremely low, and prevailing CVRA plaintiffs are guaranteed to recover their attorneys' fees and costs. As a result, the CVRA is tilted heavily in favor of plaintiffs' attorneys, which is no surprise, as it was enacted with that specific intent in mind. Over the relatively short history of the CVRA, and only after an initial challenge to it was resolved in 2006, plaintiff public agencies have paid over $15 million to CVRA plaintiff attorneys, including a recent settlement in West Covina for $220,000. Every public agency defendant in the history of the CVRA that has challenged the conversion to district elections has either lost in court or settled/agreed to implement district elections, and has been forced to pay at least some portion of the plaintiffs' attorneys fees and costs. Payments by cities to CVRA plaintiff attorneys have been as high as $4.5 million (Palmdale), $3 million (Modesto) and $1.2 million (Anaheim). 1

4 Recognizing the heavy cost burden it had assigned under the CVRA to at-large jurisdictions facing challenge, in 2016, the California Legislature amended the Elections Code to simplify the process of converting to by-district elections and to provide a "safe harbor" process to protect agencies from litigation. f a city receives a demand letter, such as the case here, then the city is given 45 days of protection from litigation to assess its situation. f within that 45 days, the city adopts a resolution declaring the Council's intent to transition from at-large to district based elections, the prospective plaintiff is prohibited from filing a CVRA action for an additional 90 day period. (Elec. Code (e)(3).) n light of the foregoing, in order to avoid the potentially significant litigation expenses that are likely to occur if the City retains its at-large method of election, at the City Council's September 20, 2017 hearing, the Council adopted Resolution No outlining its intention to transition from at-large to by-district elections, pursuant to Elections Code section (e)(3)(A). Accordingly, no potential plaintiff can file a CVRA lawsuit against the City before December 19, As stated in the resolution, the City Council adopted Resolution No in furtherance of the purposes of the CVRA. More information about the City's transition to by-district elections is available on the City's website: Following the adoption of Resolution No , the City Council held two public hearings on September 26 and October 10, 2017, in order to receive public comment regarding the potential composition of voting districts before any draft district maps were drawn, pursuant to Elections Code section (a)(1 ). At its September 26, 2017 hearing, in addition to considering public comment and discussing potential voting district boundaries, the Council adopted Resolution No , which sets forth criteria that may be considered when drawing the City's voting districts, including the mandatory criteria imposed by federal law (population equality, compliance with the FVRA, and not using race as the "predominant" factor or criteria when drawing districts) and permissive criteria set forth in the California Government and Elections Codes. The City's districting consultant, National Demographics Corporation ("NOC"), has now drawn six proposed district maps pursuant to the factors set forth in Resolution No , and input provided by both the Council and the public. (See Attachment A) Pursuant to the Council's direction, NOC prepared maps with 5, 7 and 9 voting districts (two of each). Additionally, the public submitted a number of maps (also included in Attachment A), but only one is population balanced, and therefore the others cannot be legally adopted. However, the preferences indicated by the public in the submitted maps were considered by NOC when it drew its six legally acceptable maps. The purpose of this hearing is to take public comment, discuss the proposed maps, and provide any further input to NOC that the Council deems necessary. Staff recommends that at this time, the Council decide how many districts it will ultimately adopt, which will allow NOC to focus on maps solely with the correct number of districts, as well as enable the Council to have a productive discussion regarding the sequencing of the district elections. The Council should also eliminate any maps that it no longer wishes to consider in order to properly focus the remaining two hearings. 2

5 The Council will hold a second public hearing concerning draft voting district maps on November 13, 2017, where pursuant to Elections Code section 10010(a)(2), the Council will again take public comment and discuss the draft voting maps that either were not eliminated at the November 2, 2017 hearing, were submitted by the public at or following that hearing, or any new maps drawn by NOC. Any new maps that the public would like the Council to consider at its November 13, 2017 must be received by the City no later than November 3, 2017 in order to be publically posted for the legally required amount of time. While the public is free to submit any input it would like, members of the public should consider submitting maps with the same number of districts as chosen by the Council. The public may submit a hand-drawn district map or use the City's online districting tool. Both the online districting tool and downloadable City maps with census blocks are available on the City's website at The Council's goal at the conclusion of its next public hearing, on November 13, 2017, will be to select a district map and election seqeunce for adoption. This will allow staff to prepare an ordinance adopting by district elections, district boundaries, and an election sequence for the Council's fifth and final public hearing on December 4, 2017, where Council will introduce the ordinance for first reading. 6 NDC Duarte Election Sequencing Options October 24, 2017 Any five-district map chosen must maintain the City's current sequence of three 2018 elections (formerly 2017) and two 2020 elections (formerly 2019). Any seven-district map must have four districts in 2018 and three in 2020 (though one 2020 district will hold its first election in 2018 for a two-year term). Any nine-district map must have five districts up for election in 2018 and four in 2020 (though two 2020 districts will hold their first elections in 2018 for a two-year term). Where possible, districts with only a single resident current Councilmember, and districts with multiple resident current Councilmembers whose current terms all end in the same year, should be assigned election year sequences that match the resident Councilmember's term. Districts with no resident Councilmember and populations that traditionally have relatively lower turnout rates face a decision: hold an election in 2018 to gain representation from that district as soon as possible; or assign that district to 2020 because the higher turnout in the Presidential cycle will assist the historically under-represented voters in that district a higher chance of electing their preferred candidate in 2020 and in every election cycle after that.
