HAHN MAYOR March 8, 2005 The Honorable City Council City of Los Angeles City Hall, Room 395 Los Angeles, CA RE: UNCLAIMED MONIES SEIZED INCIDENTAL TO ARREST TRUST FUND Honorable Members: It is recommended that the City Council transfer $190, from the "Unclaimed Monies Seized Incidental to Arrest Trust Fund" No. 7772, which has remained unclaimed for three years, to the City General Fund in accordance with the procedures and notification requirements of the City of Los Angeles Administrative Code and current state law. Background Deposits of $190, have been made to the "Unclaimed Monies Seized Incidental to Arrest Trust Fund" and have remained unclaimed for three years. The Los Angeles Police Department (LAPD) has previously made attempts to return these funds. The State of California Government Code Section provides that any money remaining unclaimed in the City Treasury for three years or more may become the property of the City after publication of a notice, provided that within the specified period of time, no verified complaint seeking to recover all or a designated part of the money is filed in a court of competent jurisdiction. Attached herewith is the LAPD's request to escheat monies from Fund 7772 dated January 21, 2003, a memorandum dated March 2, 2005 to the LAPD acknowledging the amount to be escheated, the Treasurer's Office. request for advertising to the City Clerk dated January 29, 2003, and the subsequent notice and publication executed on February 12, 2003.

2 Report to Budget & Finance Committee April 27, 2005 Page 2 of 2 Such a notice was published on Wednesday, February 5, 2003 and February 12, 2003 for funds seized from January 26, 1985 through December 16, The notice stated that on March 27, 2003 $190, would become the property of the City. No claims have been filed as of the respective aforementioned dates. Section of the Government Code provides that if such money becomes the property of the City agency, the legislative body may transfer it to the General Fund. LAPD requested a transfer on January 21, 2003 of the respective funds to the City General Fund. Consequently, the sum of $190, can be escheated to the City as of this date from the City of Los Angeles Police Department's Fund No "Unclaimed Monies Seized Incidental to Arrest Trust Fund". Appropriate action is requested of your Honorable Body to transfer this amount to the General Fund. It will be necessary for the Police Department to notify the Treasurer's Office of any claims being considered for refund by Wednesday, April 20, 2005, so that the letter addressed to the City Council will reflect the correct amount to be escheated to the General Fund.
