Effective November 20, 2009, United Telephone Company of Texas, Inc. d/b/a Embarq, began operating under the name CenturyLink. Unless otherwise specified, the charges quoted in this tariff, or the General Exchange Tariff are for periods of one month, are payable monthly in advance, and entitle the customer to exchange telephone service within the exchange area and into those exchanges to which Extended Area Service (EAS) is provided. The rates and charges listed on Page 1 of each section of this Local Exchange Tariff will apply to the specified class of service as may be offered within the Exchange Rate Area Boundary. The Extended Calling Surcharge (ECS) will appear as a separate line item on the customer s bill for each access line or trunk. Other rates and charges as noted therein, may also be applicable to the class and grade of service provided. (N) (N) A zone charge may apply, in addition to the monthly rates for Local Service terminating outside the base rate area boundary of exchanges, if indicated on Sheet 1 (rate schedule) of the Local Exchange Section. Application and Regulations LOCAL EXCHANGE SERVICE (1) Customers will have under this tariff offering the option of subscribing to Local Measured Service. Business and residence one-party customers will have the option of maintaining their current telephone service or subscribing to the local measured service which provides for measured calling to all points within the existing non-toll calling area. (2) Normal service connection charges for existing customers will not apply for one customer conversion to and/or from the local measured service offering within the six month period commencing with the offering date of this service in an exchange and no activity other than this service change takes place. Changes in excess of this allowance will be billed the regular tariff charges appropriate. (3) All customer lines at a given location must be arranged for measured service and equipped for outward calling. Group billing will be provided on rotary and PBX trunks. (4) Local usage charges will not apply to calls to the Company Business Office, Repair Service, or for Emergency Service as found in the local exchange telephone directory. (Police, Fire, Ambulance, or Rescue) (5) Local measured service will not be provided for Party Line, Foreign Exchange, Optional Extended Metropolitan Service, and Optional Extended Area Service. (6) Normally, local measured service calls will be on a direct dial basis, however, at the customers option, these calls may be billed to a credit card, third number or on sent collection basis. Operator handling charges as specified under c.(3)(d) following, will apply to these type calls in addition to the normal usage charge. 17 dba CenturyLink SECTION A (T) Seventh Revised Sheet No. 15 Cancels Sixth Revised Sheet No. 15 LOCAL EXCHANGE SERVICE Lifeline Assistance Programs Pursuant to FCC order 15-71, adopted June 18, 2015, the Company no longer provides Lifeline discounted service to resellers as of August 15, Pursuant to FCC order 16-38, adopted on March 31, 2016 and released April 27, 2016, customers who received Lifeline Assistance prior to December 2, 2016 will continue to receive benefits until their annual re-certification date, at which time customers must demonstrate their continued eligibility by meeting the eligibility requirements in effect as of December 2, (N) (M) (M) (N) A. Federal Lifeline Program 1. Description The Federal Lifeline Program assists qualified low-income applicants with reductions in their monthly Local Exchange Service rate. The assistance applies to a single telephone line or broadband service at the applicant s principal place of residence. 2. Eligibility Requirements To receive assistance an applicant must demonstrate an annual household income at or below 135 percent of the federal poverty guidelines, or must demonstrate participation by the applicant, applicant s dependent(s) or a member of applicant s household [1] in one of the following programs: Federal Public Housing Assistance (FPHA) Medicaid Supplemental Nutrition Assistance Program (SNAP) Supplemental Security Income (SSI) Veterans Pension Benefit and Survivors Pension (N) [1] A household is defined, for purposes of administering this program, as any individual or group of individuals who live together at the same address and share income and expenses. Terms and Conditions a. An applicant may request Lifeline assistance through completion and submission of a State of Texas approved form provided by the Company or by an agent of the state or Low-Income Discount Administrator (LIDA). b. The Federal Lifeline Program credit may be applied to any qualifying residential Local Exchange Service provided by the Company (including Bundled or Packaged Services). c. Customers are limited to one credit per household, which may be applied towards a qualifying wireline service, broadband service or a bundled voice and data service package. Customers are not eligible to receive a credit from the Company if they receive a Federal Lifeline Program credit for a service provided by another Eligible Telecommunications Carrier or Lifeline Broadband Provider. d. The Federal Lifeline Program credit will be pro-rated on the basis of a 30-day month from the effective date of the customer s application. e. Applicants must provide proof of eligibility and be deemed eligible for participation before monthly credits begin. Credits will only be issued on a go-forward basis. f. Nonrecurring charges will not apply when establishing this program on existing service. g. Partial payments made by Lifeline customers will be applied first towards local service charges. Terms and Conditions (Cont d) h. Toll and Casual Dialing Restriction (also known as Toll Restriction or Toll Blocking) is available to Lifeline customers upon request at no charge. No service deposit will be required for applicants who voluntarily elect toll restriction with the initiation of Lifeline service. Any Lifeline customer who has a past due balance in toll message charges will be automatically restricted from access to toll services until the outstanding balance is paid. The customer will not be charged for the toll restriction placed on the account. The Restoration Charge applies to Lifeline customers whose message toll service has been restricted for nonpayment. If a Lifeline customer is toll restricted for a second occurrence, the Company may, at its discretion, place the Lifeline customer on a permanent toll restriction. A Lifeline subscriber's request for reconnection or re-establishment of local service will not be denied if the service was previously suspended or disconnected for non-payment of toll charges. 4. Description State Lifeline Support credit is available to assist low-income applicants with reductions in their monthly Local Exchange Service rate. The assistance applies to a single telephone line at the applicant s principal place of residence. Specific rates are as prescribed by the Public Utilities Commission of Texas and are set forth in this tariff. Customers who receive State Lifeline Support are only eligible to receive benefits under the Federal Lifeline Program if they meet the federal eligibility requirements specified in A. preceding. 2. Eligibility Requirements State Lifeline Support is available to applicants whose household income is at or below 150% of the federal poverty level or who demonstrate participation by the applicant, applicant s dependent(s) or a member of applicant s household in one of the following Federal or State assistance programs: Medicaid Supplemental Nutrition Assistance Program (SNAP) Supplemental Security Income (SSI) under Title XVI of the Social Security Act Federal Public Housing Assistance (FPHA), or Section 8 Low Income Home Energy Assistance Program (LIHEAP) National School Lunch Program s Free Lunch Program Temporary Assistance for Needy Families (TANF) Health benefits coverage under the state child health plan under Chapter 62, Health and Safety Code. Terms and Conditions b. Vacation Service is not available on Lifeline accounts. c. Foreign Exchange Service is not available on Lifeline accounts. d. Customers who receive State Lifeline Support credit shall not be disconnected from local service for non-payment of toll charges. In addition, the Telephone Company will not deny re-establishment of local service to customers who were not previously recipients of the State Lifeline Support credit and are eligible for Lifeline Assistance and have previously been disconnected for non-payment of toll charges. Customers who were not previously recipients of the State Lifeline Support credit and have been disconnected for non-payment of toll charges will incur a Secondary Service Order Charge and a Line Connection Charge when local service is reestablished, unless the customer elects to receive toll restriction. e. Any customer who has a past due balance in toll message charges will be automatically restricted from access to toll services until the outstanding balance is paid. If a customer is toll restricted for a second occurrence, the Telephone Company may, at its discretion, place the Lifeline customer on permanent toll restriction. f. Partial payments will first be applied to local service charges and then to any outstanding toll charges. g. Customers who are eligible for the State Lifeline Support credit will receive free toll limitation services (e.g., toll restriction), upon request. h. The Telephone Company s service deposit requirement will be waived if the customer elects to receive toll restriction. Terms and Conditions (Cont d) i. The Telephone Company shall provide the State Lifeline Support credit to all eligible customers as determined by the Low-Income Discount Administrator (LIDA). j. Applicants who participate in LIHEAP, FPHA, Free Lunch Program, or SSI, or whose household income level is at or below 150% of the federal poverty guidelines, may self-enroll for State Lifeline Support credit by completing an application form that they either participate in a qualifying program or meet the income requirements specified above. The Telephone Company or LIDA will send a blank application upon customer request. Customer must return the form to the LIDA. On a monthly basis, the Telephone Company will send a list of customers to the LIDA. The LIDA will match the names with the Texas Department of Human Services (TDHS) file containing the names of applicants who participate in a qualifying program and customers who self enroll. The LIDA will then send a file to the Telephone Company of new customers who are eligible for Lifeline Service. The Telephone Company will utilize this file to give the Lifeline discount to eligible Telephone Company customers. The Telephone Company will enroll customers in or remove them from State Lifeline Support credit within five days of receipt of the LIDA file. k. Service charges do not apply for changes in telephone service arrangements that are made in order to qualify for State Lifeline Support credit, or for service order charges associated with transferring an account to State Lifeline Support. l. Service charges are applicable when existing State Lifeline Support customers request additional features, such as special or custom calling features. m. Customers are limited to one credit per household, which may be applied towards a qualifying wireline service or a bundled voice and data service package. Customers are not eligible to receive a credit from the Company if they receive State Lifeline Support credit for a service provided by another Eligible Telecommunications Carrier. Monthly Credit Credit Amount State Lifeline Support credit, per month Up to $3.50 [1] (T) (M) [1] The State Lifeline Support credit is up to $3.50, but will not result in a rate of less than zero for the service against which the credit is applied. The credit amount is calculated by adding the applicable rates for residence local exchange service, including Extended Area Service and other non-discretionary charges for basic residential service and the interstate subscriber line charge. The Federal Lifeline credit, if applicable, is subtracted from the total and the State Lifeline Support remaining difference is the State Lifeline Support credit amount. If, after applying the State Lifeline Support Credit, the net rate is less than zero, the State Lifeline Support credit amount is reduced by the amount required to achieve a net rate of zero. (N) (N) C. Texas High Cost Universal Service Plan (THCUSP) 1. Description Customers who qualify for State Lifeline Support as specified in B. preceding will automatically qualify to receive a Texas High Cost Universal Service Plan (THCUSP) Incumbent Local Exchange Company (ILEC) area discount. Pursuant to the Public Utilities Commission Subst. Rule 23.40, Prepaid Local Telephone Service (PLTS) is being provided to residential customers who are indebted to an Incumbent Local Exchange Company (ILEC) or other eligible telecommunications carriers for telecommunication services, including the carriage charges of interexchange carriers. B. An applicant who subscribes to PLTS may be required to enter into a deferred payment plan for outstanding debt previously incurred under basic local telecommunications service and now subscribes to under PLTS. The customer is responsible to make the initial deferred payment, if applicable, in the third billing cycle and every month thereafter, for up to twelve months. C. No deposit is required from any residential applicant who is applying for PLTS. D. An applicant who subscribes to PLTS must have mandatory toll blocking and usage sensitive blocking placed on the customer's telephone lines. A customer may not place or receive calls, including intralata and interlata long distance or other usage-sensitive services, for which additional charges are billed to the customer's telephone number by the Company. E. The Company may disconnect a customer from PLTS for failure to comply with the terms and conditions as set forth under Section A of this tariff. A customer previously disconnected from PLTS by the Company does not have the right to receive PLTS from the Company again. F. A customer subscribing to PLTS may return to basic local telecommunications service provided the customer has paid all outstanding debt to the Company in full, including indebtedness for the carriage charges of interexchange carriers, if applicable. Disconnection of PLTS A. The Company may disconnect PLTS after notice for any of the following reasons: 1. Failure to comply with the terms of a deferred payment plan for PLTS; 2. Upon conclusion of all periods for which an advance payment has been applied to the PLTS account and when the customer's PLTS account has a zero balance; or 3. Violation of the Company's rules pertaining to the use of PLTS in a manner which interferes with the service of others or the operation of nonstandard equipment, if a reasonable attempt has been made to notify the customer and the customer is provided with a reasonable opportunity to remedy the situation. CenturyLink Line Volume Plan (CLVP) is available to business customers subscribing to 10 or more basic business lines, key lines or key trunks. A customer may have a maximum of 3,000 participating lines across all service territories served by CenturyLink incumbent local exchange carriers (each, a CenturyLink ILEC). Lines served by a CenturyLink competitive local exchange carrier (CLEC) are not contributory to or eligible for CLVP. B. CLVP is offered as a tiered plan with each tier having a Minimum Line Requirement. Lines and/or key trunks provided by a CenturyLink ILEC which are already discounted under an existing term discount plan, line volume plan or any contractual arrangement which contains a volume and/or minimum term commitment, may contribute to the aggregate line count used for determining the applicable tier and rates for services under this CLVP, but are not eligible for additional discounts under this CLVP. C. The terms, conditions, and application of rates for services in Qwest Corporation locations may differ from those contained herein, and are as described in the applicable tariffs, catalogs, and/or other local terms of service documents for those service locations. 2. Regulations A. Qualifying CLVP services in locations other than those served by Qwest Corporation are defined as follows: Flat rate business individual lines local exchange service terminating into a single line instrument. Flat rate key lines or key trunks local exchange service terminating into any system classified as a key system pursuant to FCC Part 68 Rules and any hybrid system designed to function like a key system, e.g. an outbound line is manually selected, usually by pushing a button on the handset, rather than being selected automatically (usually by dialing 9). Any lines added after execution of the initial CLVP are contributory towards the Minimum Line Commitment but will not prompt a change in the assigned tier for the previously established lines. E. Customers with a previously existing CLVP offered by Qwest Corporation may select a separate (second) CLVP for services in an eligible location other than Qwest Corporation. Lines in all CenturyLink ILEC service locations, including locations served by Qwest Corporation, may, at Customer s request, be contributory towards determining the tier for the second CLVP. Services in a Qwest Corporation service location are not eligible for the rates associated with the tier assigned for the second CLVP and will continue to be charged at the tier rates under the original CLVP offered by Qwest Corporation for the remainder of its term commitment period. Alternatively, customers may discontinue a previously existing CLVP and establish a new CLVP as described in J. following, in which instance a new tier will be established and will apply for all service locations. All qualifying services must be associated with the same customer. The Company may, at its discretion, provide this plan to Affiliates or Franchisees of Customer. An Affiliate or Franchisee is an entity whose operation of business is substantially associated with Customer s name, mark, or commercial symbol. When, at the Company s discretion, this plan is provided to Affiliates or Franchisees of Customer, Customer must designate the specific account to which Early Termination Charges and Shortfall Penalties will be applied. G. Services subject to rates under this CLVP are not eligible for discounted rates under any other local voice discount plan. Only the qualifying services listed in 2.A. preceding are both contributory to and eligible for the CLVP rates herein. However, a line or key trunk in any packaged service may contribute towards the minimum line requirement. PBX trunks are neither eligible for or contributory to CLVP for purposes of determining the appropriate rate tier and minimum line requirement. H. Customers may select a CLVP tier lower than their actual quantity of contributory services. I. Services receiving promotional or competitive response discounts or recurring charge waivers under other term commitment programs are not eligible for CLVP rates until the terms of those offers have been satisfied for those lines. J. Additional business lines may be added at any time during Customer s term commitment period, but will not affect the tier and monthly discount levels established upon execution of the CLVP agreement unless Customer commits to a new agreement for a greater number of lines than the existing agreement. Rates applicable under the new agreement will not apply retroactively nor will the months accrued under the initial agreement apply towards the new commitment period. K. Customer may move all or some of the lines under this CLVP to any eligible CenturyLink service location without incurring termination charges, as long as Customer maintains the overall minimum line requirement. Early Termination Liability A If CenturyLink terminates the Service(s) for cause, or if Customer terminates the Services(s) in whole without cause before expiration of the initial commitment period, the customer will pay termination charges of $15.00 per line of the customer s Minimum Line Requirement multiplied by the remaining number of months left on the Term. For example: a customer terminating all service with 3 months remaining on the Term and a Minimum Line Requirement of 50 lines will pay $15.00 x 50 x 3 = $2, B. If during an annual review of Customer s account, the account falls below the Minimum Line Requirement for the discount tier, the customer will pay a shortfall penalty of $60.00 for each line below the Minimum Line Requirement. If the customer is charged a shortfall charge, the Company may subsequently conduct quarterly audits and apply shortfall charges until the customer meets the Minimum Line Requirement. C. The optional CLVP Feature Package does not contribute to the discount tier and is not subject to termination charges or shortfall penalty. D. Early Termination Liability charges will be waived for CLVP customers who commit to a new term agreement that includes the same or greater number of equivalent lines or similar services (e.g. channels within a Mbps service) for the same or greater term than their existing agreement. Touch-Tone service, Extended Area Service, and Expanded Local Calling Service are included in the rates specified herein. Charges for lines and key trunks in a hunting arrangement (a.k.a. rotary line service or rotary access service) that would otherwise apply as an incremental charge are also included in the rates specified herein. B. Customers will not incur service charges or other nonrecurring charges when switching existing basic business line service to CLVP. C. Nonrecurring charges and/or Service Connection Charges will apply as specified in applicable CenturyLink tariffs, guidebooks, schedules, and/or local terms of service documents. Nonrecurring charges may be waived if customer moves future services from another telecommunications service provider to lines under the CLVP. However, such subsequently moved lines will not affect the tier and monthly discount level established upon execution of this agreement. D. Qualifying services may be aggregated across the entire CenturyLink Incumbent LEC service territory to determine the applicable Tier (based on total number of lines). The monthly rate(s) in effect for each service location upon execution of a CLVP agreement will apply for the duration of the term commitment period, and are not subject to Company initiated rate increases. E. At the end of the initial CLVP term commitment period, the CLVP term will automatically renew for up to two consecutive renewal periods unless either party provides thirty days written notice of its intention not to renew or Customer executes a new CLVP agreement. Each renewal period will be equal to the initial term commitment period for existing lines in place. During the renewal periods, Customer must retain the minimum number of lines required for the Tier assigned under the original agreement. Lines added during an auto-renewal period are eligible for the rates extended under the CLVP. If, at the end of the second auto-renewal period, Customer has not executed a new agreement, the rates for business individual lines and/or key lines/trunks, including lines/trunks in a hunting arrangement (a.k.a. rotary line service or rotary access service), and ala carte rates for optional features selected with CLVP Feature Package, if applicable, will revert to the non-contractual monthly rates in effect for those services as specified in CenturyLink s tariffs, guidebooks, schedules, and/or other local terms of service documents.
