1 April 12, 2018 REQUEST FOR PROPOSALS (RFP) CONSTRUCTION MANAGER AS CONSTRUCTORS LAWRENCE POLICE DEPARTMENT HEADQUARTERS I. Authority The City of Lawrence is seeking a Construction Manager as Constructor (CMc) as allowed under Indiana Code 5-32 for the construction of a new Police Headquarters ( Project ) for the Lawrence Police Department ( Department ). Below are the project descriptions, selection criteria, and submittal requirements for interested parties wishing to submit their proposals for consideration. II. Project Description The Project is to construct a new police headquarters. The Designer (RQAW Corporation) has proposed an approximately 37,000 square foot, two story police station with a basement, a sally port for the safe transfer of arrestees, a 2,000-square foot detached police vehicle maintenance garage, a 150-space parking lot with 50 designated public parking spaces, a 125-person community training room, and an exterior running track available to the public which will accommodate LPD s needs both now and into the future. Additional details about the project can be found in Attachment 1 to this RFP. III. Request for Proposals Overview Per IC (b), Notice of a request for proposals shall be given as other notices are required to be given under the applicable public works statute. The City of Lawrence is advertising this RFP similar to other public works projects via newspaper advertisements. Per IC : (a) A request for proposals must include at least the following: (1) A statement of the criteria, process, and procedures, which must include consideration of qualifications and fees, by which: (A) an offeror will be evaluated; (B) a CMc will be selected; and (C) a CMc contract will be awarded. The RFP process will consist of two stages. The first stage will be a qualification based review. From these responses, firms will be shortlisted to proceed to the next stage. The second stage will consist of interviews of the top three respondents. A tentative schedule for this process will be: 4/12/18 RFP Released 4/13/18 and 4/20/18 RFP notice published 4/27/18 RFP Responses Received 4/30/18 RFP Responses Evaluated, Shortlisted firms notified 5/2/18 5/3/18 Conduct interviews 5/9/18 Selected Firm is contacted 6/15/18 GMP Established Summer 2018 Construction Begins Summer Owner Move-in

IV. Request for Proposals The following table will serve as a template for responding to the RFP. These items will serve as the qualifications by which your firm will be evaluated and shortlisted. If your firm is interested in responding to this RFP, please send eight (8) hard copies and one (1) electronic copy of the following information, using separate tabbed sections for each item, by 11:00 AM EST, April 27, Cover Letter - Cover letter should confirm that offeror s submittal is in response to RFP Office Location - Location of office in charge of project and location of other project 2 team member offices, if applicable. Include appropriate contact information for any follow up. 3 Organization Chart - Organization chart showing the project team members, resumes and their respective roles, including all sub-consultants or partner firms. 4 Safety Record - Provide Statement of Experience Modification Rate MBE, WBE, VBE, XBE Participation - Respondents should provide detail as to their firm s history on hiring and contracting practices related to diversity. Specifically, 5 respondents should provide information on contracting practices and programs that respondent s firm uses to increase involvement opportunities for minority, women, and veteran business enterprises CMc Experience - Respondents should list any projects on which your firm has 6 served in the role of CMc under Indiana Code In addition, respondents should indicate any private projects on which respondents served in the role as CMc. Previous Experience - The Respondents should indicate their previous experience with the construction of public safety offices, or similar facilities. Experience should be limited to projects completed within the last 10 years for municipalities located 7 within the State of Indiana. Respondents should identify the individual members of its team responsible for the construction of the Project. When describing the structure of development teams, Respondents should provide examples of previous projects where team members have functioned together in similar roles. 8 Designer Experience - List a minimum of three (3) projects in which the designer of record was RQAW Corporation. GMP Approach Provide details of your approach to GMP development. 9 Considerations should be given to: timing of GMP, percentages and types of contingencies at GMP, expectations of penalties or incentives included in the GMP. 10 References - Provide at least three (3) named client references with contact information. Fee - Include separate fees for Pre-Construction and Construction Phase services for 11 Construction Management (CMc) based on the proposed project scope. A. Preconstruction Services Fixed Fee:

3 P a g e 3 The proposed fixed fee for Pre-Construction Services to include: Planning and Scheduling, Estimating, Value Management, Quality Review, Preparing Contracts for Construction, Life-Cycle Costing, Front End Specifications, Bid Procurement, Tracking Costs Against the Budget, Design Meetings and all Staffing Costs. B. Construction Services: a. Provide a fixed fee for Construction Services to include: Cost of all on-site and off-site CM staff that will be working on the project. Provide an Effort Schedule that identifies the estimated man hours charged each month by each staff position over the course of the project. These hours should be multiplied by an hourly billing rate that include wages and customary fringes per the attached Effort Schedule example. b. Provide a fee percentage for overhead and profit that will be multiplied by the Cost of the Work. C. The proposal does not need to identify the predicted costs for the following (these items will be considered reimbursable expenses). Items to be included in the General Conditions will be: safety equipment, first aid supplies, handrails and toe boards, opening protection, fire extinguishers, temporary fencing, storage rental, temporary toilets, temporary stairs, temporary enclosures, temporary barricades, project signs, bulletin boards, on-site equipment, printing, telephone expenses, temporary power service, temporary water service, temporary heating service, heating energy charges, temporary wiring, temporary lighting, periodic clean-up, trash dumpsters, dump permit and fees, traffic control, temporary roads, roadway maintenance, job trailer/trailer utilities, material testing, project website, permitting and all other jobsite construction related miscellaneous expenses excluding construction manager staffing costs. The Construction Manager s employee expenses shall be included within the fixed CMc Fee as previously noted above in Item B. Per IC : Each offeror selected to meet with the evaluation committee, based on the evaluation committee's review of the RFP responses, must be given an equal opportunity to meet and communicate with the evaluation committee. The final stage of the RFP process will be interviews with the shortlisted firms. The interview will last one hour and will consist of an opportunity for your firm to present your proposal followed by a question and answer discussion. The City requests that your interview team be limited to no more than five (5) individuals. The evaluation committee will consist of the following individuals: Mayor Steve Collier Lawrence Police Chief David Hofmann Controller Jason Fenwick Corporation Counsel - David Johnson After the interviews, the evaluation committee will review all information from the RFPs. The following criteria will be used:

MBE, WBE, and VBE participation history and good faith efforts to fulfill state s goals for contracting with or hiring minority, women, and veteran business enterprises 3. Experience 4. Reference Feedback 5. Interview 6. Fees V. Additional Information Per IC (a): (2) Information about how the GMP may be established as part of the contract. The City of Lawrence intends to establish a Guaranteed Maximum Price (GMP) on this project. The GMP delivery date is currently June 15, Design development documents have been delivered to the City. The GMP will include not only the price, but will also guarantee the schedule. Final details of contingencies, allowances, incentives, or damages will be coordinated with the selected firm. Per IC (a): (3) A description of the insurance requirements for the CMc. The Construction Manager shall carry the following minimum Insurance policies and limits: a. The limits for Worker's Compensation Insurance shall meet statutory limits mandated by State and Federal Laws. If (1) limits in excess of those required by statute are to be provided or (2) the employer is not statutorily bound to obtain such insurance coverage or (3) additional coverages are required, additional coverages and limits for such insurance shall at a minimum be as follows: b. The limits for Employer s Liability shall be as follows: Bodily Injury by Accident $1,000,000/each accident Bodily Injury by Disease $1,000,000/policy limits Bodily Injury by Disease 1,000,000/each employee c. The limits for Commercial General Liability insurance including coverage for Premises- Operations, Independent Contractors' Protective, Products-Completed Operations, Contractual Liability, and Personal Injury shall at a minimum be as follows: $1,000,000 Each Occurrence $2,000,000 Job Site Aggregate $1,000,000 Personal and Advertising Injury $2,000,000 Products-Completed Operations Aggregate i. The policy shall be endorsed to have the Job Site Aggregate apply to this Project only. Provide a $2,000,000 General Aggregate. ii. The Contractual Liability insurance shall include coverage sufficient to meet the obligations in AIA Document A under Paragraph iii. Products and Completed Operations insurance shall be maintained for a minimum period of at least two (2) years after either 90 days following Substantial Completion or final payment, whichever is earlier. d. Automobile Liability insurance (owned, non-owned and hired vehicles) for bodily injury and property damage shall at a minimum be as follows: $1,000,000 Each Accident

5 P a g e 5 e. Umbrella or Excess Liability coverage shall at a minimum be as follows: $5,000,000 over primary insurance. $10,000 retention for self-insured hazards each occurrence. VI. Miscellaneous Provisions A. The City of Lawrence reserves the right to terminate the RFP process for any reason, to be the sole judge of the responses submitted, to reject all responders to this RFP, and to waive any informalities or irregularities in any of the responses. B. The City of Lawrence creates no obligation, expressed or implied, of any kind or description in issuing this RFP or receiving a response. Neither this RFP nor the response shall be construed as a legal offer. C. The City of Lawrence assumes no responsibility or liability for any expenses incurred by the selected or prospective Construction Managers as Constructor, in connection with the preparation or delivery of a response, requested interview or any action related to the process of completing and submitting a response to this RFP. D. Prospective Construction Managers as Constructors shall, if requested by the Selection Committee, provide a fully completed Financial Statement specific enough for the Owner s governing body to make a proper determination of the Bidders capability for completing the project if awarded.
