Should legally trained non-lawyers be permitted to perform limited sets of tasks traditionally done by lawyers? Should nonlawyer ownership of law firms be allowed? How should law firms and solos respond to online firms that offer legal advice and services at bargain basement prices? Advances in technology push the limits of traditional practice, forcing lawyers to reconsider relations with clients, communication strategies, marketing practices forcing a re-imagination of the nature of the profession. This seminar explores the ethical dimensions of these incipient changes from tiered licensing to non-lawyer ownership, from the development of a new kind of engagement letter to the new nature of the legal business. Once gathered, of course, protecting information entrusted to the law firm is a key obligation of every practicing attorney. We are now see how the courts are dealing with these issues if the parties are unable to resolve their disputes before trial. This seminar will look at title insurance claims arising out of mortgage fraud, new statutes, & sloppy work by lenders and attorneys. Real case studies will provide a critical analysis of what went wrong and how these claims could have been mitigated or avoided all together. Panelist: Harland L. Miller, III, First American Title Saturday, January 19, 11:45-1:00pm Unbundling: Benefits, Ethics, Risks (1.25 MCLE Credits incl..75 Ethics) Limited representation is a recent innovation in VT courts which allows lawyers to provide selected services in parts of cases. This unbundling of legal work is a valuable resource for clients who must limit costs, a boon to courts flooded by pro se litigants, and an opportunity for additional revenue or pro bono service for lawyers. She has worked as a reporter and editor in Vermont for 17 years. Galloway was the editor of the Sunday Rutland Herald and Barre Times Argus from 2004 to She began her career in newspapering as a pre-med-student-turned-literature major at the University of Kentucky, when her first feature story was published in the Kentucky Kernel. She moved to her husband s home state, Vermont, in 1988 and took a job as a staff writer for the Hardwick Gazette and then the Barton Chronicle. For many years, Galloway was a contributing writer for Seven Days Newspaper and a visual arts reviewer for the Times Argus. Her reporting has appeared in The New York Times (the Vows column), the New York Daily News, Vermont Life and City Pages (Minneapolis). She is a member of Investigative Reporters and Editors.
