1 Request for Qualifications & Proposal On the Children s Water Play Area Project (Permit Nos /07/08/09) For Fresno s Chaffee Zoo Corporation, Fresno, CA Project No Located at 894 West Belmont Avenue Fresno, California, RFQ/P FCZ WPA PH II project,

2 Water Play Area & Storm Sewer Extension Fresno s Chaffee Zoo Corporation (FCZC) formally requests a Statement of Qualification (SOQ) and Bid Proposal from general contractors based upon the criteria detailed in the following Request for Qualifications & Proposal ( RFQ/P ). This RFQ/P will provide guidelines for the requirements of a 16,800-SF City of Fresno: Permit Nos /07/08/09 custom built high quality wilderness theme children s water play area located inside the center of an active public Fresno Chaffee Zoo at 894 West Belmont Avenue, Fresno, California, Public Funded Project: This project is being funded through Measure Z and therefore Prevailing Wages are required to be paid on this project. Executive Summary FCZC is a non-profit 501(C)(3) corporation and was created for the specific purpose of: 1. Scientific research and education; and 2. To acquire, establish, operate, maintain and control zoological gardens, and collections and specimens of animals, including mammals, fish, birds, reptiles, and insects, for the study and promotion of zoology and natural history and for the education, recreation, and pleasure of the general public. Project Overview FCZC operates 39-acres at the southeast section of the 148-acre Roeding Regional Park in Fresno, California. Zoo is open to the public on Monday through Sunday from 9am 4pm (Winter Schedule), year round. The Water Play Area project is 16,800 SF exhibit located within the Fresno Chaffee Zoo between the Jungle Bungalow and Dino Dig Exhibits and Zoo s Safari Café & Restrooms. Water Play Area consist of a real world realistic wilderness environment (70 water moving creek, 20 tall lookout tower, 9 tall waterfall, play and rest areas, shower/changing area, night lighting, speakers and fencing, etc.) while attaining a mandated very high quality product and authentic appearance requirements (similar to work in Fresno Chaffee Zoo s African Adventure and Disneyland, Anaheim, CA with regards faux rocks, waterfalls, rivers, creeks, plantings, fencing, pathway textures and hiding non-natural elements from public view, etc.). It is a strict FCZC policy that construction cannot disrupt the visitor experience or animal behavioral habits. No hauling, deliveries, excessive noises and other disruptive activities will be permitted when zoo is open to the public; exceptions maybe granted on a case-by-case basis by FCZC. The location of this project is adjacent to other exhibits and facilities that will remain open during the construction of this project. The Dino Dig exhibit, the Safari Café, Jungle Bungalow and the Restrooms serving these areas must remain open including all ADA accessible options, with no exceptions, during the course of construction for the Water Play Area construction. A Notice to Proceed will be issued on May 8, 2017 that allows for full site access and mobilization. The project duration is 110 calendar days. RFQ/P FCZ WPA PH II project,

3 The Children s Water Play area project will proceed in two separate phases: Phase I, is NOT included in this Bid Package. The work is under separate contract, and is scheduled for completion on March 8, This work consists of limited storm drain, water, sanitary sewer, gas, and electrical infrastructure activities. Refer to bid documents, plans, and Addendums to confirm utilities installed during this first phase. Phase II, duration is from May 8, 2017 through August 25, 2017 and will consist of all work necessary to complete the project. If the work within these constraints is not completed by August 25, 2017 liquidated damages of $2,500 per day will be assessed and deducted off final payment to General Contractor. An area just outside of the zoo s East Gate will be available for General Contractor s lay-down and trailer area; General Contractor responsible for providing their own required utilities and security of belongings and materials, etc. until completion of the project. Trees designated to be relocated and/or installed will be done by the Owner. A 3-day duration for this work will be included in the General Contractor CPM schedule. General Contractor to coordinate with Owner for all Owner Furnished Owner Installed items during the project and Owner direct work items. No. 1 (Permit No. s /07/08/09) and stamped by the City of Fresno approved on November 7, 2014 Revised Vortex Equipment drawings, 12 pages, dated Alan Mok Storm Water Pollution Prevention Program (SWPPP), dated , and amended on Moore Twining Geotech report Tree Investigation report prepared by John Pape with Kuhtz Consulting As-Built documents from various sources including ground penetrating radar findings FCZ Schedule for 2017 Zoo Hours of Operation to General Public, 1 page Utility Relocation, Abandonment & Protection of Existing infrastructure is of Extreme Importance to FCZC. As illustrated on the drawings the site is congested with various utilities and it will be a contractual obligation for the General Contractor to include in bid the cost to pot hole, abandon, relocate, support and install new utilities no exceptions. Utility shutdowns of any nature must be pre-approved RFQ/P FCZ WPA PH II project,

4 by FCZC in order not to compromise the varied environments that the animals reside in throughout the Zoo. FCZC will award the contract to the lowest responsive and qualified proposer, FCZC may reject any or all proposals, waive any technicalities and advertise for new proposals. Bidders shall review all referenced documents. The Work under this Contract is publicly funded through Fresno County Measure Z and must be performed in accordance with the requirements of Title 8 California Code of Regulations sections to 17270, which govern the payment of prevailing wage rates on publicly funded projects. The prevailing wage rates set forth are the minimum that must be paid by the Contractor and their Trade Contractors on this project. Selection Process The intent of the Qualifications section of the proposal and documents required therewith to assist FCZC in determining and aid in selection of selecting the lowest responsive bidder. This RFP includes Qualification Requirements that are required to be responded to by the proposing General Contractors. The lack of responding to this section or any of the questions asked is cause for dismissal of the Contractor s bid altogether. FCZC will return unopened any prequalification packet that is not submitted in accordance with time and date as noted throughout bid documents. The responses to these Qualification Requirements will be scored and combined with the proposed cost using the following formula to determine the lowest responsive bidder: Proposed Cost of the Work Total Qualification Requirements Score = Proposal Score The proposer with the lowest Proposal Score will be determined to be the lowest responsive bidder. Qualification Requirements (200 points possible) As part of the required bid documents the General Contractor will be required to provide the following information. This information will be turned in at the day and time designated for the bid opening as a separate sealed package along with the other bid documents and labeled Statement of Qualifications. This information will be reviewed by FCZC representatives. 1. Experience (50 points) a. Provide General Contractor s Legal Name, License number(s) including expiration dates, key contact personnel including address and phone number, and main office address. b. Provide details of the proposers experience working at the Fresno Chaffee Zoo and/or other facilities of this type. List the following; Description of project and work performed, total Value of Construction, and whether or not the project was finished within agreed upon timeline including any time extensions granted by Owner. c. Is this firm a subsidiary, parent, holding company or affiliate of another construction firm, if so please address in writing. d. Provide resumes of management and supervisors staff proposed to work on this project. Additionally, clearly identify your company s safety representative for this project. e. List all similar projects the firm has completed during the last seven (7) years. For the purpose of this project similar projects shall mean projects where the respondent was the Construction Manager or General Contractor and shall mean projects where the RFQ/P FCZ WPA PH II project,

5 construction cost for the project was for an amount similar or greater to the amount of the estimated construction cost of this Project; the project was one of similar complexity; the project was of similar type or scope; and the project was the approximate size of this Project or larger. 2. Construction Scheduling and Project Planning (15 points) a. Provide an overall CPM schedule that demonstrates the project being completed using the time constraints required by the Owner. Please figure on no more than 20 activities for this request. 3. Logistics & QC (35 points) a. Provide a narrative of the proposer s plan on accomplishing the work as reflected in the bid documents. b. Address the company s quality control program and how it will be implemented on this project, including who will be ultimately responsible onsite for the program. 4. Safety (20 points) a. Has CAL OSHA cited and assessed penalties against your firm for any serious, willful or repeat violations of its safety or health regulations in the past five years? b. Has the federal Occupational Safety and Health Administration cited and assessed penalties against your firm in the past five years? c. Has the EPA or any Air Quality Management District or any Regional Water Quality Control Board cited and assessed penalties against either your firm or the owner of a project on which your firm was the contractor, in the past five years? d. List your firm s Experience Modification Rate (EMR) (California workers compensation insurance) for each of the past three premium years (2016, 2015, 2014). If your EMR for any of these three years is or was 1.00 or higher you may, if you wish, attach a letter of explanation. An automatic deduction of 10 points will occur if the respondents EMR is above 1.00 for the current period. 5. Legal Proceedings (30 points possible) a. Respondent shall disclose any and all legal proceedings whether currently pending, or concluded within the past three (3) years, in which the respondent s firm was named a party, that involved a construction project or a construction contract. Failure to list a proceeding shall be reason for an immediate dismissal of proposer. Any legal proceeding filed against FCZC within the last 5 years is cause for immediate dismissal of proposer. For each Proceeding; Provide the project name, date of the claim, name of the claimant, brief description of the nature and amount of the claim, and a brief status of the claim (pending or, if resolved, a brief description of the resolution). Note: Points in this category are being awarded based upon a respondent having the least amount of proceedings. For respondents that respond and have Zero proceedings over the past 3 years, then that respondent will be awarded 30 points, and a company with proceedings will receive less if not zero points depending on severity of proceedings. 6. Miscellaneous (50 points possible) Please address these questions in writing on a separate sheet of paper(s). a. Has your contractor s license been revoked at any time in the last five years? b. Has a surety firm completed a contract on your behalf, or paid for completion because your firm was default terminated by the project owner within the last five (5) years? 6 c. Has any CSLB license held by your firm or its Responsible Managing Employee (RME) or Responsible Managing Officer (RMO) been suspended within the last five years? d. At any time in the last five years has your firm been assessed and paid liquidated damages after completion of a project under a construction contract with either a public or private owner? e. In the last five years has your firm, or any firm with which any of your company s owners, officers or partners was associated, been debarred, disqualified, removed or otherwise prevented from bidding on, or completing, any government agency or public works project for any reason? f. In the last five years has your firm been denied an award of a public works contract based on a finding by a public agency that your company was not a responsible bidder? g. In the past five years has any claim against your firm concerning your firm s work on a construction project been filed in court or arbitration? h. In the past five years has your firm filed a claim or dispute against FCZC concerning a project your firm worked on? i. At any time during the past five years, has any surety company made any payments on your firm s behalf as a result of a default, to satisfy any claims made against a performance or payment bond issued on your firm s behalf, in connection with a construction project, either public or private? j. In the last five years has any insurance carrier, for any form of insurance, refused to renew the insurance policy for your firm? k. Do you meet the standard insurance requirements as specified in the General Conditions document? l. During the last five years, has your firm ever been denied bond coverage by a surety company, or has there ever been a period of time when your firm had no surety bond in place during a public construction project when one was required? m. What is your company s current Bonding capacity. Provide documentation from your surety identifying the name of bonding company and surety agents contact information. Please also attach a notarized statement from an admitted surety insurer (approved by the California Department of Insurance and authorized to issue bonds in the State of California) which states your current bonding capacity. n. Has there been more than one occasion during the last five years in which your firm was required to pay either back wages or penalties for your own firm s failure to comply with the state s prevailing wage laws? The proposer must include the following statement within their proposal documents; I, the undersigned, certify and declare that I have read all the foregoing answers to this Qualifications questionnaire and know their contents. The matters stated in the questionnaire are true of my own knowledge and belief, except as to those matters stated on information and belief, and as to those matters I believe them to be true.
