ARCHITECTURE PLANNING URBAN DESIGN FURNITURE BID DOCUMENTS LAGRANGE COUNTY PUBLIC LIBRARY Introduction Thank you for your interest in providing furniture-related items for the LaGrange County Public Library. The LaGrange County Public Library Board of Trustees is soliciting proposals from qualified contractors and vendors for library shelving end panels and tops, as well as a custom children s activity table/desk. Terms and Conditions 1. The right is reserved to reject any and all bids, to waive informalities, and to make award as may be determined to be in the best interest of the LaGrange County Public Library, hereinafter, Library. 2. Prices quoted must include delivery to and installation of the LaGrange Co. Public Library Main Branch, currently under construction, located at 203 West Spring Street, LaGrange, IN Floor plans have been furnished in the bid packages to aid in this process. 3. The award to the successful bidder may be canceled if successful bidder should fail to prosecute the work with promptness and diligence. 4. The successful bidder shall replace, repair or make good, without cost to the LaGrange County Public Library, any defects or faults arising within one (1) year after date of acceptance of articles furnished hereunder (acceptance not to be unreasonably delayed) resulting from imperfect or defective work done or materials furnished by the Contractor/Vendor. 5. The Contractor/Vendor shall indemnify and save harmless the Library and all persons acting for or on behalf of it from all suits and claims against them, or any of them, arising from or occasioned by the use of any material, equipment or apparatus, or any part thereof, which infringes or is alleged to infringe on any patent rights. In case such material, equipment or apparatus, or any part thereof, in any such suit is held to constitute infringement, the Seller, within a reasonable time, will at it's expense, and as the Library may elect, replace such material, equipment or apparatus with non-infringing material, equipment or apparatus, or remove the material, equipment or apparatus, and refund the sums paid therefore. 6. The successful bidder shall comply with all applicable Federal State and Local laws and regulations. 7. Purchases made by the Library are exempt from Federal excise taxes and bid prices must exclude any such taxes. Tax exemption certificates will be furnished upon request. 8. Verbal orders are not binding on the Library and deliveries made or work done without formal Purchase Order or Contract are at the risk of the Contractor/Vendor and may result in an unenforceable claim. 9. The Contractor/Vendor shall agree to indemnify, defend and hold the Library harmless from any and all claims arising out of the performance of this contract. Lincoln Tower 116 E. 2 10. The attached furniture schedules specify a basis of design or base product that defines the style, size, finish, and other qualities desired for each of the respective products. The Library will entertain equal products, provided they meet the requirements listed below. An item equal to that named or described in the specifications of the contract may be furnished by the Contractor/Vendor and the naming of any commercial name, trademark or other identification shall not be construed to exclude any item or manufacturer not mentioned by name or as limiting competition but shall establish a standard of equality only. An item shall be considered equal to the item so named or described if (1) it is at least equal in quality, durability, appearance, strength and design; (2) it will perform at least equally the function imposed by the general design for the work being contracted for or the material being purchased; and (3) it conforms substantially, even with deviations, to the detailed requirements for the item in the specifications. The name and identification of all materials other than the one specifically named shall be submitted to the Library in writing for approval at the time of Bid, and prior to purchase, use, or fabrication of such items. Approval shall be at the sole discretion of the Library, shall be in writing to be effective, and the decision of the Library shall be final. The Library may require tests of all materials so submitted to establish quality standards at the Vendor's expense. All directions, specifications and recommendations by manufacturers for installation, handling, storing, adjustment and operation of their equipment shall be complied with; responsibility for proper performance shall continue to rest with the Contractor/Vendor. For the use of material other than the one specified, the Contractor/Vendor shall assume the cost of and responsibility for satisfactorily accomplishing all changes in the work as shown. If no manufacturer is named, the Contractor/Vendor shall submit the product he intends to use for approval of the Library at the time of Bid. The Vendor shall not have any right of appeal from the decision of the Library condemning any materials furnished if the Vendor fails to obtain the approval for substitution under this clause. If any substitution is more costly, the Vendor shall pay for such costs." BID CHECKLIST Instructions to Bidders For all bid submissions of Equal products, the vendor/contractor/supplier shall submit the following for review at the time of bid: 1. Bid Forms: Contractor s Bid Form (3 pages), Contractors Bid for Public Work-Form 96 (5 pages), and Furniture Schedule(s) in sealed envelope. 2. Product Submittal: Option 1: Full-size sample of product, including proposed materials, joinery, fasteners, finishes, and written summary of all differences between specified product and proposed item(s). Label item(s) with company name and contact information. Option 2: Dimensioned drawing/illustration of proposed product, sample of finish, written summary of all differences between specified product and proposed item(s). Include all paperwork inside sealed envelope and label all loose item(s) with company name and contact information. SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE 1. Explain your plan or layout for performing proposed work. (Examples could include a narrative of when you could begin work, complete the project, number of workers, etc. and any other information which you believe would enable the governmental unit to consider your bid.) 2. Please list the names and addresses of all subcontractors (i.e. persons or firms outside your own firm who have performed part of the work) that you have used on public works projects during the past five (5) years along with a brief description of the work done by each subcontractor. 3. If you intend to sublet any portion of the work, state the name and address of each subcontractor, equipment to be used by the subcontractor, and whether you will require a bond. However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the governmental unit in the event that you subsequently determine that you will use a subcontractor on the proposed project. 4. What equipment do you have available to use for the proposed project? Any equipment to be used by subcontractors may also be required to be listed by the governmental unit. 5. Have you entered into contracts or received offers for all materials which substantiate the prices used in preparing your proposal? If not, please explain the rationale used which would corroborate the prices listed. SECTION III CONTRACTOR S FINANCIAL STATEMENT Attachment of bidder s financial statement is mandatory. Any bid submitted without said financial statement as required by statute shall thereby be rendered invalid. The financial statement provided hereunder to the governing body awarding the contract must be specific enough in detail so that said governing body can make a proper determination of the bidder s capability for completing the project if awarded.
