1 MEMBERSHIP REQUIRMENTS! 1. Before becoming a member of Charter House, the following is required of all vessels/crew: Business License as it applies to your region of operation. A copy of your commercial registration from V.I. Dept. of Planning and Natural Resources. USCG Captain s License (or applicable) and STCW 95 certificate. Current insurance binder (the page which shows the liability amount and expiration date) Copies of passports for all crew and visas if appropriate. If you are offering SCUBA diving, a copy of your professional certification and insurance will be required. Rate Schedule Calendar Information Brochures if available and website Crew Profile and Sample Menu CHARTER HOUSE LISTING AGREEMENT! Upon signing this agreement and payment of the start- up fees in effect at the time of signing, Charter House will act as the exclusive calendar clearing house for the vessel: which is actively engaged in the business of crewed term chartering. FEES! Basic Membership: CharterHouse will invoice the subscriber $125 per month for base level services, plus 1% of charter revenue confirmed during the month. Membership Plus: Additionally, if subscriber elects to utilize Charterhouse s harbor resources, including refrigeration, freezer space, storage space, discounted docks, moorings and discounted fuel, water and electricity, Charterhouse will invoice an additional $50 per month for those services. CHARTER HOUSE WILL: Contact all qualified brokers with all pertinent information about your yacht. Confirm charters on subscriber s behalf and issue a confirmation number; Distribute e-brochures at broker s request; Confirm each charter deposit is received at the appropriate time; Notify you of all changes to your calendar.

2 SUBSCRIBER WILL: Complete a Charter House yacht information (typed specification sheet); Provide and update crew information on a timely basis; Provide and update seasonal rates on a timely basis and in writing(rates change quarterly); Provide proof of insurance including at least $300,000 liability; Inform Charter House in writing within thirty (30) days of any crew changes, planned sale of vessel or any other occurrences that would affect availability. BOOKING PROCEDURES:! Charter House is authorized to commit subscriber s time to brokers (i.e. our confirmation number given to a broker is as valid as signed contract) provided the following conditions are met: Dates are open and rate is published on Charter House s rate sheet; Number and ages of guests are in agreement with your yacht information sheet provided to Charter House or any subsequent written changes you have made and which have been published to brokers in our rate sheet and Website; ARBITRATION:! Any disputes will be resolved by binding arbitration. RIGHT TO SET OFF:! When a vessel subscribes to Charter House s services and utilizes said services, both the Owner and the Captain are mutually responsible for all charges incurred. The Captain and Owner also agree to Charter House s right to set off any overdue, unpaid charges by using charter deposit monies for the vessel (which are dispersed ten days prior to the start of a charter) to which the vessel is currently entitled. COMMISSION:! A Broker s commission is considered an earned fee when he/she confirms the sale of a charter aboard your vessel. Should you cancel a confirmed charter for any reason, you are responsible to the broker for this commission. This is regardless of whether or not the charter is placed on another vessel. MEMBERSHIP TERMINATION! Written notification is required for cancelation of this membership agreement. Membership will remain active and cannot be terminated or changed up to thirty days after receipt of cancelation letter. No listing changes will be released on any Charter Yacht Agent account, Charter House or associated website listings and no monies transferred, until the thirty day period is completed. LEGAL RESPONSIBILITIES:! The Captain and Owner affirm that they are aware of and complying with all legal and jurisdictional requirements, rules and regulations, and licensing pertaining to the operation of their charter yacht in U.S. and foreign waters. Nothing in this Listing Agreement should be construed as creating an agency relationship between Charter House and Captain or Owner.

3 All bills are payable upon receipt and failure to keep account current on a monthly basis will result in Charter House s right to set off charges or may result in services being discontinued or curtailed. DISCLAIMER! Charter House provides information that in turn is provided by the owners and crews of the various charter yachts we represent. The accuracy of this information rests ultimately with the individual yacht owner. All particulars provided to the broker community either on our associated web pages or publications are believed to be accurate and true. Charter House accepts no responsibility for any errors or omissions. 4 RATES! Most vessel s rate alternate between Summer (May 1 December 14) rates and Winter (December 15 April 30) rates. Please start by giving us the rates for the current year, either starting in the Summer or the Winter and also next year s rates. This is for a total of four seasons in two years. Break the rates down by number of. Odd passenger numbers will be computed as halfway between the even rates unless otherwise noted.
