1 THE CORPORATION OF THE MUNICIPALITY OF GREENSTONE POLICY MANUAL SECTION: PARKS & RECREATION SUBJECT: High Hill Harbour Marina DOcking, Mooring and Storage DATE: March AUTHORIZATION: POLICY & PROCEDURES ]t is the objective of the Municipality of Greenstone to offer to the public seasonal access to High Hill Harbour Marina. The operation of the marina is the responsibility of the Parks and Recreation Department. Its administration is coordinated through the Municipal Administration Office, Public Services Department. TERMS & CONDITIONS Users of High Hill Harbour Marina are required to sign the High Hill Harbour Marina Docking, Mooring and Storage Agreement on an annual basis. High Hill Harbour Marina Docking, Mooring and Storage Agreement PUBLIC COMMUNICATIONS The Public Services Department shall provide a communication plan that informs the public and municipal staff about municipal marina policies, regulations and procedures. Fielated By-Laws and Policies: ATV By-Law Marine Fueling Policy Fuel Drum and Propane Storage Policy Land fill Standard Operating Procedures (for reference to reporting a bear problem) Communications: Documentation and analysis of public inquiries/complaints. Follow-up to public inquiries. Safety advisories (eg. TSSA) Municipal website 2

3 CORPORATION OF THE MUNICIPALITY OF GREENSTONE HIGH HILL HARBOUR MARINA, BEARDMORE WARD Beardmore Ward Office Phone No (Year Round) Marina Attendant Cell Phone No (ln-season ONLY) DOCKING/MOORING/STORAGE AGREEMENT (Resolution 16-64) DEFINITIONS For the purposes of this Agreement: "Municipality" means the corporation of the Municipality of Greenstone. "Marina" means the High Hill Harbour Marina and includes the area encompassed by the marina facilities, including buildings, grounds, docking and mooring facilities and the harbour. "Operator" means the operator of the High Hill Harbour Marina which is the Corporation of the Municipality of Greenstone or any person authorized to represent the Municipality. "Owner" means the Owner of a boat, any person who is otherwise using the facility, or any person who is in charge of a boat where such person is not in fact the registered Owner of the boat. "Season" means the period from the May long weekend to the Labour Day long weekend. "Dockage day" means the period beginning at 12:00 hours and ending at 12:00 hours the following day. "Wake speed" means 5 mph or any lesser speed capable of resulting in a wake not exceedjna 4 inches. TERIVIS OF AGREEMENT The occupancy Agreement shall be in effect year-round, in recognition of dryland storage, the boat launch, docks and wet mooring season is from the May long weekend to the Labour Day long weekend, or any part thereof, unless sooner terminated by reason of: a. the dest ruction of the facility by storm or other calamity. b. the breach of the terms of this Agreement by the Owner, his or her passengers, crew or guests. It is understood and agreed that this Agreement is for the provision of a dock, wet mooring or dry land parking space only and the Marina services, equipment and other facilities are to be used entirely at the risk of the Owner, his or her passengers, crew or guests. 10. The Municipality ofgreenstone will not be held liable forthe care and protection of 11. the boat and its contents, the passengers, crew or guests or for any loss, damage or injury occasioned to the boat or its contents or to the Owner, his or her passengers, crew or guests, however caused. The Owner agrees to indemnify and save harmless the Corporation of the 12. Municipality of Greenstone from any liability, damages or expenses for which the Municipality of Greenstone may be held liable on any action arising out of the use of the marina areas of the High Hill Harbour Marina or any of its services, equipment or other facilities by the Owner, his or her passengers, crew or guests. The Municipality of Greenstone assumes no responsibility whatever for loss or damage to vehicles parked on property owned or leased by the Municipality of Greenstone, however caused Notwithstanding anything elsewhere in the Agreement contained, the Municipality of Greenstone shall not be liable for damages caused by the negligence or willful acts of its servants, agents and employees. Each Owner will be held responsible for damages he or she may cause to other boats in the Marina area and to the structures or facilities thereon. It is understood and agreed by the owner that the rules and regulations may from time to time be added to or deleted from this Agreement at the discretion of the Corporation of the Municipality of Greenstone. 1

The Owner agrees to comply with the By-laws of the Corporation of the Municipality of Greenstone, and all other existing requirements of Municipal, Provincial and Federal legislation or legislation which may hereafter be affecting harbour and marina operations. RULES AND REGULATIONS NO swimming, diving, waterskiing or fishing will be permitted in the Marina area. iits understood and agreed that the sub-leasing of dock space, moorings, the transferring of boats from one slip to another, or one mooring to another, shall not be permitted without the approval in writina of the Operator having first been obtained. In case of emergency, the Owner authorizes the Operator to move the boat at its discretion at the Owner's expense and risk. The Owner agrees to move his boat in accordance with the Operator's instructions, and when unattended authorizes the Operator to move the boat at its discretion at the Owner's expense and risk. The owner shall not store supplies, materials, accessories, articles or debris upon Marina property and shall not construct or install thereon any lockers, chests, cabinets, structures or modify the docks in any way. Owners shall not attach any foreign objects or materials to dock structure whatsoever. For visiting recreational boats, there will be a minimum assessment of one day's docking fee after 6:00 p.in. For visitors requiring overnight docking, check out time will be 12 noon the following day. Any boat occupying a berth or mooring after 12 noon will be assessed a docking fee for that day. No refuse shall be thrown overboard. Garbage shall be deposited in receptacles supplied for this purpose throughout the Marina, and other debris shall be placed where specified. No oil, inflammable liquid, or other liqujds, will be discharged in the Marina. Fueling of boats while moored in the Marina is strictly prohibited. All boats shall fuel and empty waste tanks at the Marina service dock. Within the Marina all power and auxiliary powered vessels shall be under said power when entering and leaving the Marina. Maximum vessel movement shall not exceed "wake speed". Sail and keel boats are to be under power when entering and leaving the Marina area. Permanenton board living is not permitted. 29. The operatoror his designate is authorized to check the size of any and all boats in the presence of the Owner if it is felt that there is a need. The Owner will be invoiced for any discrepancies noted. 30. Any maintenance activities including painting, scraping or repairing of boats and gear will not be permitted on the docks or piers, unless approved by the Operator in writing No advertising orsoliciting of any nature will be carried on, in or from the Marina. All boat Owners will notify the Operator when leaving for a lengthy cruise or for a period of time in excess of 48 hours. The Operator reserves the right to rent the berthing or mooring space provided in the Agreement when vacant. Transients, who have rented the vacant space, will remove their boats as directed by the Operator to accommodate the returning boat. In the event that a boat sinks at the dock, moorings or elsewhere in the Marina, the Owner must remove such wreck at once. Failure to do so will result in the Operator removing the wreck at the Owner's expense, which will become a debt due to the Operator from the Owner. The Operator reserves the right to cancel the Agreement and repossess the dock or mooring space should a sinking occur. All boats must be properly marked with a name and registration number clearly visible For daily lessees the dockage day starts at 12:00 hours; check out time will be 12:00 hours the following day and any boat occupying a berth after 12:00 hours will be charged a docking fee for that day. The Owner shall, when checking out, report to the Operator's office and settle all 2

5 accounts before leaving. All posted signs are to be obeyed including "NO PARKING" signs. Vehicles will be ticketed and recurring offenders will be towed away at the expense of the Owner. The Owner shall have the right to cancel this Agreement at any time prior to the Friday before the May long weekend with a full refund less a cancellation charge of 100/o. Any Owner wishing to cancel this agreement on or after the Friday before the May long weekend shall not be entitled to any monetary refund, except in cases where the Operator feels a refund is justifiable under extraordinary circumstances. The owneragrees that once his/her boat has been removed from the waterforthe Winter season, it is to be removed from the Marina area of the High Hill Harbour Marina immediately or pay for a dryland storage permit in a designated area for medium to long term storage. Failure to pay or remove the boat will result in the Corporation of the Municipality of Greenstone, at its discretion, having the boat moved at the Owner's risk and expense to any other place of storage outside the Marina area. Notwithstanding any other provisions of this Agree, the Municipality will not be liable for damages, loss, or other mishap occasioned to the boat or its contents while on Municipality of Greenstone property awaiting removal. Signatures of registered Owners only will be accepted on Agreements. Signed statements by an authorized agent for an absentee Owner will be accepted. 41. Docking and mooring spaces will be allotted by a seniority system. Seniority to be 42. determined on the basis of written requests date stamped on arrival at the Municipality of Greenstone. Seniority may be retained from year to year if all conditions of this Agreement and the Rules and Regulations are met. It is understood that if a boat is sold from an allotted dock or mooring space, the Corporation of the Municipality of Greenstone will be notified in writing, and that the new Owner must remove the boat from that space and the person next on the waiting list will be allotted that dock orb mooring. 43. Officially allotted spaces will be in the name or names of the person(s) the boat is registered in. When the boat is offjcia[iy registered in more than one person's name (i.e. husband and wife, father and son, two or more partners) and one or more persons gives up their share of the boat for any reason, the allotted space will pass on to the remaining owner(s) of the boat. Once a second transfer or sale of shares from the original owners who were allotted a space has occurred, the boat must be removed and the next person in line will be awarded the space. Reasonable effort will be used to provide the space as stated herein, by the Municipality of Greenstone accepts no responsibility for guaranteeing same.
