5 D. Terms and Conditions of tender will be given with tender forms which can be collected from the institute up to 5.00 PM on all working days till or can be downloaded from our website (3).3. The Contractors / Agencies have to meet the following statutory requirements at the time of submitting their tenders : 1) Possess valid labour license issued by the Labour Commissioners (State or Central) 2) Registered with EPF, ESI and Service Tax authorities 3) Possess Latest Income Tax / Professional Tax Clearance Certificate 4) Any other statutory obligations as are required to be complied with from time to time. Tenders will be issued to those who show proof of their Registration / License as mentioned above and Experience Certificate. The Tender Documents (non-transferable) can be obtained in person from AIISH, Mysuru between A.M to 5.00 P.M on all working days on payment of `1,000/- in cash (non-refundable) %. Those who intend to obtain Tender Documents by post should write to the undersigned enclosing therewith a Demand Draft for a sum of `1,100/- (non-refundable) %. The Demand Draft should be drawn in favour of Director, AIISH, Mysuru and payable at Mysuru. Any other form of payment will not be accepted. Tender Procedure : The tender will be two-part system. (a) Technical Bid and (b) Financial Bid. The Technical Bid and Financial Bid should be enclosed in two separate envelopes. Both the envelopes should be separately sealed which should be superscribed as Technical Bid for Providing manpower for regulating movement of men, materials, vehicles and prevention of tress-passing at AIISH, Mysuru and Financial Bid for Providing manpower for regulating movement of men, materials, vehicles and prevention of tress-passing at AIISH, Mysuru respectively and addressed to the Director, AIISH, Mysuru Both the envelops should be put in a 3 rd envelope, properly sealed and super scribed as "Tender for Providing manpower for regulating movement of men, materials, vehicles and prevention of tress-passing at AIISH, Mysuru and addressed to the Director, AIISH, Mysuru. Technical Bid shall contain the TENDER DOCUMENTS duly filled in and signed on all pages along with EMD (Bid Security) and all the relevant documents and certificates, etc. and the Financial Bid should contain PRICE BIDS ONLY. Price bids of

6 only those contractors, who fulfill the eligibility criteria set for the purpose would be opened on the same day. The tenders can be submitted upto , 5.00 PM and the same will be opened on at AM. in the Board Room / meeting hall of the institute. The Tenders shall be valid for a period of 90 days from the date of opening. (4).4. Criteria for Short listing of applications: (1) Preference will be given to Contractors / Agencies having 3 years of experience in providing security services to Government establishments / Public Sector Undertakings / R&D Institutions / Established Private Sectors / other similar organizations. (2) Preference will be given to Contractors / Agencies registered with DGR/ Sainik Boards. (3) The job contracts handled by the Agencies / Contractors at present and corresponding value of such contracts. (4) A clientele list provided by the agency with the performance certificate. (5) Financial status of the agency. (6) Infrastructure of the agency. (7) Demand Draft for `1,00,000/- towards EMD (Bid Security) drawn in favour of the Director, AIISH, Mysuru payable at Mysuru. The successful tenderer will be required to submit a Bank Guarantee for an amount equivalent to the bill amount for three months (Total wages and service charges in respect of the manpower engaged) valid till 6 months after the expiry of Contract, i.e., initially for a period of 18 months from the date of commencement of Contract of one year tenure. Only ex-servicemen are to be deployed for duty. The Director, AIISH, Mysuru reserves the right to accept or reject any or all the Tenders either in full or part thereof without assigning any reasons whatsoever, and the decision of the Director on all matters in this regard shall be final and binding. 12 (10) SCOPE OF WORK:.10. PART II Providing Manpower for Regulating Movement of Men, Materials, Vehicles and prevention of Trespassing at AIISH, Mysuru A. Maintenance of security and vigilance at the premises of AIISH and safeguarding all its materials and properties (movable and immovable), lands, buildings etc., by posting the required staff in such a manner and at such points to ensure the following: a) Every aspect of the security including plant protection, personnel security and prevention of theft, prevention of unauthorized sale of institute s goods. b) Protecting the buildings, fixtures / fittings / materials from theft and fire. c) Detecting / tracing employees or outsiders in case of theft and reporting to the authority. d) Screening and recording all incoming and outgoing vehicles, goods, men and materials. e) Verification of gate passes, regulation of visitors identity and their verification etc., f) Introducing and implementing anti-theft measures. g) Establishing and maintaining cordial relations with local police. Take up all security related issues of the Institute with police. h) Informing and assisting the fire brigade staff in emergency. i) Providing escorting services for men, materials and valuables whenever required.

13 j) Ensuring that unauthorized vehicles and persons do not enter the institute s premises, with due regard to vigilance of the entire institute campus after normal working hours of office, and on Saturdays, Sundays and other recognized holidays..(11).11. k) Taking care of water supply including operation of pumps, tanks and bore wells and to ensure 24-hour water supply. l) Looking after / receiving guests at the Guest House, noting their particulars in the register, handing over keys and room verification after checkout of the guests. m) Screening and recording of materials, vehicles and movement of men at the Panchavati campus. While opening the Panchavati Sports Complex, they are required to take stock of materials available at Sports Complex and also to handover the charge at the time of changing the shift. n) Regulating and monitoring vehicular movement within Institute and strict implementation of orderly parking of vehicles. o) Maintaining of names, addresses and other particulars of the Watchmen and Inspectors on roll with one or two references for verification and production of the same to the Institute, as and when necessary. p) The agency shall issue identity cards to the personnel deployed in accordance with labour laws. q) The security agency is responsible for training of all the persons deployed by them depending upon the duty requirements. r) Performance of any other tasks allotted by the Institute in the interest of security of the Institute s property and premises. A more detailed list of all the specific activities will be given to the successful agency at the time of signing the contract. Tenderer / Agency Director

15 TERMS AND CONDITIONS.12. PART - III The tenderer shall not be permitted to tender at the Institute in case any of his relative is posted in a supervisory capacity. He shall also intimate the names of persons who are working with him in any capacity or subsequently employed by him and who are relatives as mentioned below. [Note: A person shall be deemed to be a relative of another if, and only, (a) they are members of a Hindu Undivided Family; or (b) they are husband and wife; or (c) the one is related to the other in the following manner: Father, Mother (including step mother), son (including step son), son s wife, Daughter (including step daughter), Father s father, son s son, son s son s wife, son s Daughter, son s Daughter s Husband, Daughter s Husband, Daughter s son, Daughter s son s wife, Daughter s Daughter, Daughter s Daughter s Husband, Brother (including step Brother), Brother s Wife, Sister (including step sister), Sister s Husband] 1) On award of Contract, the contractor shall obtain the necessary Licence under the Contract Labour (Regulation and Abolition) Act, 1970 from the competent authority within a month at his own cost and comply with the provisions of the act and the rules made there under by the Government from time to time. In the event of award of the contract, the contractor should furnish detailed Postal address, Telephone / Mobile Number., Fax No., id etc. If he does not have an office in Mysuru, he should open a Branch Office at Mysuru within 15 days of award of contract and furnish the address to AIISH. The contractor or his representative should be available at AIISH on every working day. It is his duty to meet his workers at least once a month to solve their difficulties, if any. 2) The personnel employed by the Contractor shall be Ex-servicemen below 50 years of age, well disciplined and must possess good health and physique. The ex-servicemen engaged for security duty should be from the relevant cadre only. Proof of their experience / service to be obtained / produced. 3) The Contractor shall get the antecedents of his personnel verified through Police channels and the verification reports made available to AIISH. 4) The Contractor has to provide Security Guards and Security Supervisors as shown in the Part V No. of personnel to be deployed. The Contractor shall at all times maintain full strength of security personnel as specified in the schedule of quantity. 5) The Contractor is required to supply any additional manpower whenever demanded by the Institute either for short term or for longer periods on the same rates, terms and conditions. It is the complete responsibility of the contractor to provide 24 hours security services in three shifts of eight hours each. In no case the Contractor should allow his personnel to perform continuous duty beyond eight hours in a day. The Guards shall be so deployed by the Contractor as to enable each of the guards to compulsorily avail one paid WEEKLY OFF in each week. (13)

16 .13. 6) That the contractor shall make the payment of wages, etc., to the persons so deployed by depositing their salary in their respective bank accounts and shall on demand furnish copies of wages register/muster roll, etc., to the Institute 7) The Contractor must issue pay slips showing Name of the individual, Designation, Employee No., ESI & PF No. and the number of days worked and corresponding amount to all the workers one day in advance to the date of disbursement of the wages. The contractor must also display a notice at the place of work showing the wage-period and the place and time of disbursement of wages and a copy sent by the Contractor to the Principal Employer under acknowledgement. 8) The Contract Personnel, whose work or conduct is found unsatisfactory by the Institute, should be replaced immediately at no additional cost to the Institute. The Contractor shall have to change his staff periodically as and when desired by the Director, AIISH. 9) The Contractor will, at no extra cost, make periodical and surprise checks to supervise the performance and turnout of the contract personnel provided by him. 10) The Contractor shall maintain registers and forms as are necessary for efficient performance of the work assigned. A duty register, indicating the names of the Contract personnel on duty, should be available for inspection by authorized Institute officials at all times. 11) The members of the Contract personnel provided by the Contractor shall be the employees of the contractor and not of the Institute to any extent under any circumstances. 12) The Contractor shall be liable for payment of minimum wages and Bonus, etc., to their personnel. He shall also be responsible for remittance of Service Tax, EPF, ESI and any other statutory payments on behalf of the personnel deployed by him to the appropriate authority. The monthly remittance towards Service Tax, EPF & ESI in respect of workers deployed at AIISH should be remitted separately by filing separate challans. The remittance should not be clubbed together with other departments/organizations where the contractor is having similar contracts. The contractor should produce the original challans regarding Service Tax, EPF & ESI remittance to the office along with his bills, which will be retained in the office and returned only on the expiry of the contract. 13) As per circular No. 172/7/2013-ST of Ministry of Finance, Department of Revenue, Central Board of Excise & Customs (F.No.B1/14/2013-TRU dated ), security services provided to educational institutions are exempt from payment of service tax. (14)

17 ) The contractor shall also furnish an Indemnity Bond from the General Insurance Corporation at his own cost to indemnify AIISH against any claim arising out of or connected with this agreement. 15) Any compensation for disengagement on account of death, disability of any Contract personnel provided in the Employer s campus, even though such disability manifests after the termination of assignment, shall be Contractor s exclusive liability. The Contractor shall be liable to pay retirement compensation to his employees. 16) During the validity of the Contract, the Contractor shall not make any claim for additional charges other than what is expressly mentioned in this agreement except minimum wages. Increase of minimum wages if notified by the Government /DG - (R) will be considered on production of Govt. Orders / DG-(R) Notification in this regard. 17) The Contractor shall be solely responsible for all the accidents or injuries to the Contract personnel employed by him. First Aid facilities will be provided by the institute. The institute shall not be liable for any disability claims/compensation due to such accident/injury/death. 18) The Contractor shall indemnify the Institute against all claims arising out of action under the Employees State Insurance Act or the Workmen s Compensation Act or any other Civil or Criminal Law in force in so far as they relate to the Contract personnel employed by him or claims arising out of such employment. 19) The Contract shall be initially for a period of One year. After completion of the initial period to the satisfaction of the Director, AIISH, the Contract may be extended for a further period/periods, as mutually agreed upon. 20) During the period of agreement the Contract may be terminated by the Director, AIISH by giving one calendar month s notice or on payment of one month s charge in lieu thereof. 21) Any amount due to AIISH arising out of Contract will be recoverable from any amounts due to the Contractor. 22) The Contractor shall indemnify AIISH against any losses on account of failure or negligence of the Contractor to carry out the job entrusted to him by the Institute. (15)

18 ) Except where otherwise provided, any dispute arising out of any terms & conditions of this Agreement, the parties shall strive to find mutually acceptable solution failing which all questions, disputes or differences arising under or in connection with this agreement shall be referred to the sole Arbitration of a person nominated by the Director, AIISH whose decision shall be final and binding on both the parties. The venue of the arbitration shall be at Mysuru or such other place as may be decided by him and arbitration shall be under the Indian Arbitration Act, The Arbitration may from time to time, enlarge the time for making and publishing the award. 24) The Contractor shall execute an Agreement on a stamp paper of `200/- for due performance of the Contract as per the enclosed format of Agreement. He shall also furnish a Security Deposit in the form of Bank Guarantee or Fixed Deposit Receipt from a Nationalized Bank for an amount equivalent to total wages plus Service Charges for three months, valid for a period up to six months beyond the duration of the Contract at the time of entering into Agreement. 25) In consideration of the Service rendered by the contractor, the Institute agrees to pay to him a sum calculated at the rate tendered by him and approved by the Institute on the basis of the actual number of persons deployed by him for the work every month. The Contractor will be reimbursed wages as above for the first month after award of work on production of bills. Whereas the Contractor is required to submit proof of ESIC, EPFO, Service tax and Statutory payments for having remitted the amount to the respective authorities. Income Tax and surcharge on IT and Education Cess and any other Tax as applicable will be recovered from the Contractor s bill from time to time and remitted to the concerned authorities. 26) Earnest Money / Bid Security is liable to be forfeited if the Contractor fails to sign the formal Agreement within seven days from the date of intimation to that effect to him or fails to undertake the work within seven days from the date of Award of the Contract.
