CITY COMMISSION REGULAR MEETING Pledge of Conduct: We may disagree, but we will be respectful of one another. We will direct all comments to the issues. We will avoid personal attacks. CALL TO ORDER The meeting was called to order by Chair Seymour at 6:00 p.m. PLEDGE TO THE FLAG ROLL CALL Present: Mayor Dan Murphy, Commissioner Carol Carter, Chair Brian Seymour, Commissioner Doug Copeland, Commissioner Dale Woodland, and Commissioner Amy Tripp. Others Present: City Clerk/Treasurer LeAnne Addy, Deputy City Clerk Debbie Haynes, City Attorney Becky Vose, Public Works Manager Dean Jones, Sergeant Jones, AMI Sun and the Islander Newspaper. REGULAR MEETING General Public Comment regarding non-agenda items and items not scheduled for future agendas will be taken at the beginning of the meeting with a limitation of three minutes. The Commission's intent is that General Public comment is to be used for the public to inform the Commission of new issues within the City. Public Comment regarding agenda items will be taken with each agenda item with a limitation of three minutes. 1. General Public Comment Joe Hendricks from the AMI Sun wanted to congratulate Mayor Murphy for being the person of the year. 2. Charter Review Committee Update Mayor/Barford Mayor Fran Barford stated that we had our first meeting on Wednesday, December 19, 2018 and the Chair and the Vice Chair were elected. City Clerk LeAnne Addy updated the members the scope of the charter review. There will be a joint Charter Review Committee Meeting with the City Commission on February 6, 2019 at 10:00 a.m. The next meeting will be January 23, 2019 at 10:00 a.m. The members of the Committee are Chair, Mayor Fran Barford, Vice Chair Jack Brennan, Sissy Quinn, John Chambers, and Mark Short. 3. Discussion on Fence Ordinance Tripp Commissioner Tripp wanted to bring to the attention of the Commissioners as to how to protect our shared environment in our city. She had looked at a lot of pure cities to come up with some protections. She feels that the fencing piece fits into this area. She stated that our current ordinance includes solid fencing that creates a sterile environment. She mentioned the landscape ordinance from Collier County that she liked and it provides green space and protects our city. She would like them to consider rewriting our ordinance that stops solid fencing and creates a sterile environment. Commissioner Carter stated that she has talked to some residents and many stated that they feel that we shouldn t make a change to what we currently have and with so many already installed we would have to grandfather them. Commissioner Copeland was asking her how she implied that the current ordinance s intent meant they didn t want a solid fence. The Commissioners discussed the fence ordinance and their opinions on the matter. Alan Tripp who resides at 750 North Shore Drive stated that we have a very unique city here. He stated he doesn t want a

4 solid fence. Motion: To not explore the fence ordinance further at this time. Action: Motion by Commissioner Carter, seconded by Commissioner Woodland. On roll call vote the motion passed on a 4-1 Vote. Commissioner Tripp opposed. 4. Sunshine Law/City Pier Negotiations Vose City Attorney Vose stated that under the sunshine law that members of boards should not comment whether it is on social media, the media, or others. It is prohibited to use social media as a conduit per the sunshine law. Commissioner Woodland stated that he would like the Pier lease to state that the city is responsible for 100% of everything. 5. Parking Recommendations on Pine Mayor Mayor Murphy wanted to ask for a vote tonight to discuss the parking on Pine Avenue. He would like to look strictly at Pine Avenue and show you how the parking is currently and some options. Options we may need to look at are loading zones, time limits, parallel parking, sidewalks, City Pier parking, and etc. He would like to resurrect some of the studies in the past, talk with law enforcement, meet with some experts and come back to you all Commissioners. Tonight he is looking for authorization to continue with looking at this. Commissioner Copeland stated he would like to see the parking looked at as well as the first block of South Bay. Commissioner Carter asked about sidewalks, lighting, multi-use paths. Chair Copeland mentioned the drainage on Pine should be reviewed. Motion: To authorize Mayor Murphy to explore the options for parking on Pine Avenue. Action: Motion by Commissioner Copeland, seconded by Commissioner Woodland. On roll call vote the motion passed unanimously. 6. Resolution R Chapter 98 Signs Vose City Attorney Vose read the title to Resolution R Chapter 98 Signs. The Commissioners discussed and no issues currently with the signs. Motion: To renew Resolution R Chapter 98 Signs. Action: Motion by Commissioner Copeland, seconded by Commissioner Carter. On roll call vote the motion passed unanimously. 7. Coyotes Jones Public Works Manager Dean Jones presented a presentation on Coyotes. Suzie Fox from the Turtle watch stated that they are trained about coyotes. She explained that they are not getting in the turtle nests. She stated to not be scared of the wildlife out here. People need to be cautious. They had over 500 nests and nothing had happened. Chief Tokajer, Holmes Beach Chief of Police presented on coyotes and had brought some flyers regarding coyotes. He explained he outlook on coyotes. He stated that trapping works at only approximately 10%. 8. Mayor s Comments Mayor Murphy would like to congratulate Commissioner Carter as being named as President of the Manasota League of Cities. Mayor Murphy stated that the committee for the resident of the year has selected a resident and it is Ed Chiles. The reception will be held at our next meeting on January 24, Commissioners Comments Commissioner Carter stated that she was at the Manasota League of Cities and mentioned that we didn t get as much money

5 from FEMA for the pier and Mr. Gary Tibbitts was present and he stated that possibly Vern Buchannan s office may be able to help us. She also stated that LeAnne will make copies of a document that she received today relating to some upcoming legislature items. Chair Seymour stated that he will be filling in for Mayor Murphy while he is out. He will be attending the Art event tomorrow night if anyone is interested in attending. 10. 10 SPECIAL EVENT PERMIT GENERAL INFORMATION SEE ORD: Special Event Permits are required for a wide range of activities, including but not limited to: Indoor and outdoor arts and craft shows; bazaars; carnivals; sports events; commercial and sales activities; sidewalk sales; flea markets; rummage sales; holiday events, Christmas tree sales, plant sales, grand openings, festivals, fairs, auctions, breakfasts; beach weddings and wedding receptions with fifteen (15) or more attendees and similar events; charitable and other fundraising events; and parades. Before a Special Event permit can be issued, an application must be completed and submitted to the City using the following procedure: D D D Completion of the Special Event Application form. All attached sheets must be completed. THE APPLICATION MUST BE NOTARIZED. The City must receive the completed application at least six (6) weeks prior to the date of the event for which the application is being submitted. Staff shall route the application for review and signature of applicable departments and agencies involved. Once all departments and agencies have completed the review, the Director of Public Works shall submit a summary to the Commission with the recommended contingencies and conditions from the reviewing agencies. D D D D D Once approved, the applicant will be notified and informed of all conditions and required fees. Copies of such approval shall be forwarded to the Mayor, City Commission, Manatee County Sheriff's office, West Manatee Fire District, Anna Maria Public Works Department, Applicant, and any other regulatory agencies involved. A Special Event Permit may be approved for no more than three (3) days; however, the applicant may choose to designate a rain date in the application which may be approved in conjunction with the preferred date of the Special event. The Special Event Permit shall be specifically contingent upon the conditions required by the City Commission, and if not met, the permit may be withdrawn by the Director of Public Works. A pre-application conference with the Director of Public Works is encouraged, but not required. Issuance of a Special Event Permit does not excuse the applicant from applying for other required permits, which may include building permits, electrical permits or Health Department permits. These permit applications may be processed simultaneously with the review of the application.

11 SPECIAL EVENT PERMIT SERVICES The reviewing agencies shall review the application and may recommend any reasonable contingencies or conditions designed to lessen the impact of the Special Event on the general public. The reviewing agencies shall use their own professional judgment in reviewing the application and in making any recommendations. SECURITY SERVICES: The Manatee County Sheriff's Office, chief administrative officer of the City of Anna Maria, will review the permit application and assess the need for security services using the criteria in AM Ordinance #00-59 as well as their own inhouse criteria. If police services are required, you MUST contract for their services before the permit can be issued. NOTE: The chief administrative officer for the Manatee County Sheriff's office, Anna Maria substation or his designee is the final authority on the need for police services, including the number of officers required and the hours assigned. This same personal will also assess a fee for Special Police Services as required. PUBLIC WORKS SERVICES: The Public Works Department will review the permit application and determine the need for Public Work's assistance. If Public Work's services are required, you MUST contract for their services before the permit can be approved. NOTE: The Director of Public Works or his/her designee is the final authority on the need for Public Works' services, including the scope of services and manpower needed. The Director of Public Works will also assess a fee for services if they are required. This fee shall be based on the scope of services provided to the Special Event and no greater than the actual cost to the City for such services WEST MANATEE FIRE DISTRICT: The West Manatee Fire District staff will review the permit application and assess the need for Fire District services based upon their criteria. NOTE: The Fire Chief or his designee is the final authority on the need for Fire District services.

12 INSURANCE REQUIREMENTS All persons requesting City property for the location of the event or requesting City services shall be required to have appropriate insurance as a condition for approval of the permit. Proof of insurance showing the City as an also-named insured and with a minimum of One Million Dollars ($1,000,000) general liability coverage, shall be provided to the City at least FORTY EIGHT (48) HOURS PRIOR to the start of the Special Event. The applicant shall also agree to indemnify, defend and hold the City, its officials, employees, agents and assigns harmless from any liability or damage or claims that may occur during or arising out of the permitted Special Event. The applicant may be required to post an appropriate performance bond to ensure that the proper cleanup, damage and fees are paid after completion of the permitted event. (TEMPORARY SALES AND SERVICE OF ALCOHOLIC BEVERAGES) Notwithstanding the provisions of the City of Anna Maria, Sections , to the contrary, alcoholic beverages may be dispensed or sold in conjunction with a special event permit issued pursuant to this Ordinance. Approval of temporary sales and service of alcoholic beverages shall be pursuant to the following conditions: 1. Any application for temporary sales and service of alcoholic beverages in conjunction with a Special Event Permit must be properly filed with the City NO LESS THAN SIX (6) WEEKS PRIOR to the Special Event. 2. The applicant must not only provide the insurance as required above, but also an alcohol liability rider with the City as an also-named insured in an amount of no less than One Million Dollars ($1,000,000). 3. The boundaries of the site where the Special Event is located must be clearly marked and the attendees must be informed alcoholic beverages must be kept within th,e perimeter of the site designated for the event, and also that persons with alcoholic beverages outside of the boundaries of the Special Event are subject to prosecution if other applicable laws are violated. 4. The City Commission reserves the right to attach each additional conditions pertaining specifically to alcoholic beverage consumption to any Special Event Permit, such as limiting the hours alcoholic beverages will be available or limiting the type of alcoholic beverages dispensed at the Special Event. 5. Alcoholic beverages are not permitted on the Public Beach, even with the issuance of a Special Event Permit.

18 A maximum of five (5) Temporary off-site directional signs may be allowed providing the following standards are met: 1. A map indicating the location of the off-site directional signs shall be included in the special events application. 2. Off-site directional signs shall not include streamers, wind signs, balloons, rotating devices and unofficial flags. 3. Off-site directional signs must be a minimum of 18" X 24" and a maximum of 24" X 32" and shall include the special events Permit number on the back of each sign. 4. Off site directional signs may only be erected 5 days prior to the event and must be removed within 24 hours after the completion of the event. 5. Off-site directional signs may not be located within street medians, attached to traffic control signs or highway signs. 6. Off-site directional signs shall be located a minimum of thirty (30) feet from street intersections, and a minimum distance of six (6) feet from the edge of the payment. Please use the map provided on the next page.

20 WEST MANATEE FIRE DISTRICT SPECIAL SERVICES AGREEMENT Conditions of Permit: The charges for the Fire Department special services personnel shall be $15/hr per person. The minimum charge for any special services shall be two (2) hours per person. The charges for Fire Department vehicles will be: 1. Fire Engine 2. Ladder Truck 3. Support Vehicle 4. Command Vehicle $150 $250 $100 $100 NOTE: The West Manatee Fire District will bill the Applicant/Organization. The above fees are subject to change upon 14 days written notice from the Fire Department to the Special Event applicant. Cancellation: The Fire Department may cancel this agreement with or without notice if deemed advisable by the Fire Department. Fire Department personnel performing special services under the terms of this permit shall be deemed to be on duty as employees of the West Manatee Fire District, and their principal responsibility shall be to the general public. Any special assignment under this situation in which the special duty personnel deems it appropriate to respond to a call for the protection of the public safety; in any situation where the special duty firefighter is ordered by a supervising officer to terminate the special duty assignment and respond to a matter affecting the general public. The private contractor understands that the Fire District assumes no liability for any damages resulting from the services performed by the special duty firefighters in connection with duties under this permit. In the event a special duty employment is interrupted for the aforementioned reasons, it is understood that the Fire District shall assume no liability for any damages that may occur during the suspension of service.

27 SPECIAL EVENT PERMIT GENERAL INFORMATION SEE ORD: Special Event Permits are required for a wide range of activities, including but not limited to: Indoor and outdoor arts and craft shows; bazaars; carnivals; sports events; commercial and sales activities; sidewalk sales; flea markets; rummage sales; holiday events, Christmas tree sales, plant sales, grand openings, festivals, fairs, auctions, breakfasts; beach weddings and wedding receptions with fifteen (15) or more attendees and similar events; charitable and other fundraising events; and parades. Before a Special Event permit can be issued, an application must be completed and submitted to the City using the following procedure: Completion of the Special Event Application form. All attached sheets must be completed. THE APPLICATION MUST BE NOTARIZED. The City must receive the completed application at least six (6) weeks prior to the date of the event for which the application is being submitted. Staff shall route the application for review and signature of applicable departments and agencies involved. Once all departments and agencies have completed the review, the Director of Public Works shall submit a summary to the Commission with the recommended contingencies and conditions from the reviewing agencies. Once approved, the applicant will be notified and informed of all conditions and required fees. Copies of such approval shall be forwarded to the Mayor, City Commission, Manatee County Sheriff's office, West Manatee Fire District, Anna Maria Public Works Department, Applicant, and any other regulatory agencies involved. A Special Event Permit may be approved for no more than three (3) days; however, the applicant may choose to designate a rain date in the application which may be approved in conjunction with the preferred date of the Special event. The Special Event Permit shall be specifically contingent upon the conditions required by the City Commission, and if not met, the permit may be withdrawn by the Director of Public Works. A pre-application conference with the Director of Public Works is encouraged, but not required. Issuance of a Special Event Permit does not excuse the applicant from applying for other required permits, which may include building permits, electrical permits or Health Department permits. These permit applications may be processed simultaneously with the review of the application.

28 SPECIAL EVENT PERMIT SERVICES The reviewing agencies shall review the application and may recommend any reasonable contingencies or conditions designed to lessen the impact of the Special Event on the general public. The reviewing agencies shall use their own professional judgment in reviewing the application and in making any recommendations. D SECURITY SERVICES: The Manatee County Sheriff's Office, chief administrative officer of the City of Anna Maria, will review the permit application and assess the need for security services using the criteria iri AM Ordinance #00-59 as well as their own inhouse criteria. If police services are required, you MUST contract for their services before the permit can be issued. NOTE: The chief administrative officer for the Manatee County Sheriff's office, Anna Maria substation or his designee is the final authority on the need for police services, including the number of officers required and the hours assigned. This same personal will also assess a fee for Special Police Services as required. D PUBLIC WORKS SERVICES: The Public Works Department will review the permit application and determine the need for Public Work's assistance. If Public Work's services are required, you MUST contract for their services before the permit can be approved. NOTE: The Director of Public Works or his/her designee is the final authority on the need for Public Works' services, including the scope of services and manpower needed, The Director of Public Works will also assess a fee for services if they are required. This fee shall be based on the scope of services provided to the Special Event and no greater than the actual cost to the City for such services D WEST MANATEE FIRE DISTRICT: The West Manatee Fire District staff will review the permit application and assess the need for Fire District services based upon their criteria. NOTE: The Fire Chief or his designee is the final authority on the need for Fire District services.

29 INSURANCE REQUIREMENTS All persons requesting City property for the location of the event or requesting City services shall be required to have appropriate insurance as a condition for approval of the permit. Proof of insurance showing the City as an also-named insured and with a minimum of One Million Dollars ($1,000,000) general liability coverage, shall be provided to the City at least FORTY EIGHT (48) HOURS PRIOR to the start of the Special Event. The applicant shall also agree to indemnify, defend and hold the City, its officials, employees, agents and assigns harmless from any liability or damage or claims that may occur during or arising out of the permitted Special Event. The applicant may be required to post an appropriate performance bond to ensure that the proper cleanup, damage and fees are paid after completion of the permitted event. (TEMPORARY SALES AND SERVICE OF ALCOHOLIC BEVERAGES) Notwithstanding the provisions of the City of Anna Maria, Sections , to the contrary, alcoholic beverages may be dispensed or sold in conjunction with a special event permit issued pursuant to this Ordinance. Approval of temporary sales and service of alcoholic beverages shall be pursuant to the following conditions: 1. Any application for temporary sales and service of alcoholic beverages in conjunction with a Special Event Permit must be properly filed with the City NO LESS THAN SIX (6) WEEKS PRIOR to the Special Event. 2. The applicant must not only provide the insurance as required above, but also an alcohol liability rider with the City as an also-named insured in an amount of no less than One Million Dollars ($1,000,000). 3. The boundaries of the site where the Special Event is located must be clearly marked and the attendees must be informed alcoholic beverages must be kept within th.e perimeter of the site designated for the event, and also that persons with alcoholic beverages outside of the boundaries of the Special Event are subject to prosecution if other applicable laws are violated. 4. The City Commission reserves the right to attach each additional conditions pertaining specifically to alcoholic beverage consumption to any Special Event Permit, such as limiting the hours alcoholic beverages will be available or limiting the type of alcoholic beverages dispensed at the Special Event. 5. 37 A maximum of five (5) Temporary off-site directional signs m y be allowed providing the following standards are met: 1. A map indicating the location of the off-site directional signs shall be included in the special events application. 2. Off-site directional signs shall not include streamers, wind signs, balloons, rotating devices and unofficial flags. 3. Off-site directional signs must be a minimum of 18" X 24" and a maximum of 24" X 32" and shall include the special events Permit number on the back of each sign. 4. Off site directional signs may only be erected 5 days prior to the event and must be removed within 24 hours after the completion of the event. 5. Off-site directional signs shall be located a minimum of thirty (30) feet from street intersections, and a minimum distance of six (6) feet from the edge of the payment. 38 WEST MANATEE FIRE DISTRICT SPECIAL SERVICES AGREEMENT Conditions of Permit: The charges for the Fire Department special services personnel shall be $15/hr per person. MANATEE COUNTY SHERIFF'S OFFICE OFF-DUTY EMPLOYMENT UNIT AGREEMENT/CONTRACT GUIDELINES Payment shall be made in the form of a check or money order, made payable to the Manatee County Sheriffs Office. No deputy shall be employed in a law-enforcement related off-duty assignment for less than $35.00 an hour. Deputies are paid a minimum of 3 hours even if detail is for a shorter time period. Payment shall be made prior to the assignment. Cancellations or changes must be confirmed at least twenty-four hours in advance of the detail, unless prior arrangements have been discussed with the Off-duty Coordinator. If the employer cancels the detail and the Off-duty Unit does not confinn that notification was received, then the deputies scheduled for that detail must be paid the 3-hour minimum. Clearly describe what duties the deputy is to perform while working off-duty security and who he/she is to contact in case of emergency. If the deputy is to make contact with someone at the beginning of his tour of duty, please identify that person. The employer is responsible to ensure that all special requests are clearly outlined. If the employer wishes to not have a deputy work the detail any more, they shall first call and then write a letter detailing the problem. Any detail over six hours is subject to being split into separate shifts. 51 SPECIAL EVENT PERMIT.GENERAL INFORMATION SEE ORD: Special Event Permits are required for a wide range of activities, including but not limited to: Indoor and outdoor arts and craft shows; bazaars; carnivals; sports events; commercial and sales activities; sidewalk sales; flea markets; rummage sales; holiday events, Christmas tree sales, plant sales, grand openings, festivals, fairs, auctions, breakfasts; beach weddings and wedding receptions with fifteen (15) or more attendees and similar events; charitable and other fundraising events; and parades. Before a Special Event permit can be issued, an application must be completed and submitted to the City using the following procedure: Completion of the Special Event Application form. All attached sheets must be completed. THE APPLICATION MUST BE NOTARIZED. The applicant shall also agree to indemnify, defend and hold the City, its officials, employees, agents and assigns harmless from any liability or damage or claims that may occur during or arising out of the permitted Special Event. A map indicating the location of the off-site directional signs shall be included in the spedal events application. 2. Off-site directional signs shall not include streamers, wind signs, balloons, rotating devices and unofficial flags. 3. Off-site directional signs must be a minimum of 18" X 24" and a maximum of 24" X 32" and shall include the special events Permit number on the back of each sign. 4. Off site directional signs may only be erected 5 days prior to the event and must be removed within 24 hours after the completion of the event. 5. 76 A maximum of five (5) Temporary off-site directional signs m y be allowed providing the following standards are met: 1. A map indicating the location of the off-site directional signs shall be included in the spec/al events application. 2. Off-site directional signs shall not include streamers, wind signs, balloons, rotating devices and unofficial f)ags. 3. Off-site directional signs must be a minimum of 18" X 24" and a maximum of 24" X 32" and shall include the special events Permit number on the back of each sign. 4. Off site directional signs may only be erected 5 days prior to the event and must be removed within 24 hours after the completion of the event. 5. Off-site directional signs may not be located within street medians, attached to traffic control signs or highway signs. 6. Off-site directional signs shall be located a minimum of thirty (30) feet from street intersections, and a minimum distance of six (6) feet from the edge of the payment.
