1 GENERAL TERMS AND CONDITIONS FOR YOUR PARTICIPATION IN THE PROMOTION 1. ORGANIZER OF THE PROMOTION ORGANIZED BY TAVEX EOOD The present Promotion ("Promotion") is organized and conducted by Tavex EOOD, established and existing under the legislation of the Republic of Bulgaria, entered in the Commercial Register of the Registry Agency under UIC with seat in Sofia and registered office at: 1505 Sofia, Oborishte district, 48, Sitnyakovo Blvd., Serdika Center Mall, level -1, tel , represented jointly and separately by Magardic Harutuyn Baklayan and Kuno Raak - Directors ("Organizer"). These General Terms and Conditions govern the relationship between the Organizer on the one hand and the customers participating in the Promotion ("Participants ) on the other, as well as the conditions for participation therein. By participating in the Promotion, Participants agree to comply and to be bound with these General Terms and Conditions. 2. ACCESSIBILITY OF THE PRESENT GENERAL TERMS AND CONDITIONS AND INFORMATION OF THE ORGANIZER These General Terms and Conditions of Participation in the Promotion (the "General Terms and Conditions") are available at throughout the Promotion period in a way that permits their storage and reproduction. In addition, Participants may receive a hard copy of the General Terms and Conditions on their request at any of the Organizer s locations. The Organizer reserves the right to supplement or modify unilaterally the present General Terms and Conditions in accordance with the Bulgarian legislation in force and the amendments will enter into force at a time specified by the Organizer after their prior announcement on the website The Organizer reserves the right to terminate the Promotion at any time in an event of force majeure, by notifying the Participants on the above mentioned site. DEFINITIONS 3.1. Participants are any capable physical person over 18 years of age, as well as any legal entity, is eligible to participate in this Promotion. Employees (and their immediate families) of the Organizer, Western Union Employees, Agents and Sub-agents, and service providers/marketing agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin "Service" is the service of sending or receiving a money transfer via the Organizer, in its capacity as Western Union agent, regardless of the currency/amount of the transfer "Winner" is a Participant who is drawn by random selection and is eligible to receive the prize announced below as defined in these General Terms and Conditions.

"Prize" is a sum of money in BGN currency equal to the transfer fee paid by the Participant (respectively by the sender, in the cases where the Participant receives a money transfer), multiplied by 100, but limited to not more than BGN 2, The Organizer is a representative of a payment service provider within the meaning of Art. 3, para. 1, item 3 of the Payment Services and Payment Systems Act (PSPSA) - the payment institution Western Union Payment Services Ireland Limited, licensed in another Member State (Republic of Ireland). PERIOD AND TERRITORY OF THE PROMOTION The Promotion will take place between [insert start time, date and time zone] and [*insert end time, date and time zone] ( Promotion Period ) and is subject to extension by the Promoter. MECHANISM OF PROMOTION During the Promotion Period, any person meeting the criteria specified in paragraph who at least once uses the Service as defined in paragraph has the right to enter the Promotion and request the participation in the Promotion before the Organizer's cashier. Participation is dependent on the use of the Service in the period referred to in item 4 and to the provision of a contact telephone number that will be used only for calls/sms notifications related to the Promotion. A valid statement is considered to be the one in which the eligible Participant has provided his/her contact telephone number. Subject to these General Terms and Conditions, the Participant is eligible to participate in the Promotion and in the drawings of the Prize. Each Participant may participate in the Promotion in an unlimited number of times. Participation in the Promotion is voluntary. It is not obligatory nor conditional on the provision of a pledge by the Participants. Commented [APL2]: Should it be always with the same phone number? DESCRIPTION OF THE PRIZE AND CONDITIONS OF THE RANDOM SELECTION Within the Promotion Period, two prizes will be awarded, i. e. two Winners will be drawn from all Participants. 3 The winners will be determined by random selection in the presence of a commission set up for this purpose at the registered office of the Organizer. The latter will not use procedures allowing the outcome of the prize distribution to be predicted. In addition to the Winner, 2 (two) Backup Participants will be also selected from the draw. The results of the random selection as well as the personal data of the Winners and Backup Participants will be filled in protocols which will be kept at the registered office of the Organizer for a period of 1 (one) month after the random selection, except for data the Organizer has the obligation to keep for a longer period under a legal obligation. The Organizer s decision shall be final and binding in all respects on all Participants. No correspondence will be entered into. Entries that do not comply in full with these General Terms and Conditions will be disqualified. The Organizer reserves the right to change the Prize if it is necessary for reasons beyond its control. 7. NOTIFYING THE WINNER The Winner will be informed of winning the prize by a phone call to the number he has provided not later than by the end of the day following the day of the draw. In the event that the Winner refuses to receive the Prize or the Organizer cannot connect with the Winner within [x] days of the draw date, the Prize will be awarded to the Backup Participant. The Organizer is not responsible for any incorrect or incomplete contact details provided by the Participant. PROHIBITION OF SUBSTITUTION AND TRANSFERRING OF THE PRIZE TO THIRD PARTIES The Prize cannot be substituted for another prize. In case of refusal from the Winner to receive the Prize, the Organizer will proceed as provided in section 6 with the Backup Participants. Granting (transferring) of the Prize to a third party is not permitted. The Organizer will not be liable for prizes that do not reach the winners for reasons beyond the Organizer s reasonable control. 9. RECEIPT OF THE PRIZE The Prize should be received personally by the Winner at any location of the Organizer, within 7 (seven) calendar days of the date of notifying the Winner. After such 7 (seven) days, of the Prize is not picked up, the Prize will be granted to the next Backup Participant. In order to receive the Prize and comply with the legal requirements for declaring the Prize awarded, the Winner should provide a full name and personal identification number. Upon receipt of the Prize, the Winner is obliged to fill in and sign a hand-over-and-acceptance protocol provided by the Organizer. 10. REQUIREMENTS OF THE PERSONAL INCOME TAX ACT With the cash Prize from this Promotion the Winner will be issued by the Organizer an official notice as income from other sources under Art. 35 of the Personal Income Tax Act (PITA) (taxable income acquired during the tax year from monetary and object prizes from games and competitions not provided by an employer or a contracting authority). The Winner is deemed to be informed that the value of the Prize is a taxable income within the meaning of the PITA and is subject to declaring and taxation under Bulgarian legislation. The Organizer shall not be held liable for incorrectly provided data

4 in connection with the declaration of the Prize awarded, as well as for non-fulfillment of the obligation by the Winner to declare it. 11. OTHER CONDITIONS The Organizer is not responsible for Participants failing to participate in the Promotion or failing to receive the Prize due to occurrence of extraordinary circumstances such as: force majeure, accidental events, local area network or lobal Internet network problems, connectivity services provided by third parties, and any other cause beyond the control of the Organizer. The Organizer does not guarantee that the opportunity to participate in the Promotion will be uninterrupted, timely, secure and error-free as it is due to circumstances beyond its control. The Organizer is not responsible for the loss of stored information due to extraordinary and unpredictable system failures or technical problems associated with participating in the Promotion. Except in the case of death or personal injury arising from its negligence, or in respect of fraud, and so far as is permitted by law, the Organizer and its associated companies and agents exclude responsibility and all liabilities arising from: a) any postponement or cancellation of any competition to which these General Terms and Conditions relate; b) any change to, supply of, or use of the Prize; c) any act or default of any third party supplier, which is beyond the Organizer s reasonable control. 12. PROTECTION OF PERSONAL DATA The Participant's personal data will be used by the Organizer in accordance with the requirements of Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), the Bulgarian Personal Data Protection Act and other applicable European and national legislation and only for this Promotion purposes. The obligatory information that the Organizer is required to provide to visitors and customers of its offices under Chapter III of the GDPR is available in each of these sites, as well as online, at: The Organizer processes personal data of the customers in the first place in order to fulfill the contract with each customerfor providing a payment service within the meaning of the Payment Services and Payment Systems Act, which includes: identification of the sender and the recipient of the money transfer, specification of the parameters and details of the transfer, filling the necessary documentation, the implementation of the comprehensive verification measures within the meaning of Chapter Two of the Measures against Money Laundering Act before the operation, or in the cases provided for by that act. For the purpose of participating in the Promotion, the Organizer requires and collects additional personal Participant s information other than those required to use the Service, namely a contact telephone number that will be used only for purposes of this Promotion for calls/sms notifications related to Promotion. Participants agree that the Organizer may store, retrieve, access, process transmit and otherwise use the information that you have provided in connection with your

5 participating in the Promotion. The Organizer collects Participants personal information in order to conduct the Promotion. If the information requested is not provided, the Participant will not be eligible to participate in the Promotion. The legal basis for the processing of personal data under the previous paragraph is Article 6 (1) (b) of the GDPR (contractual relations), and in particular the purposes: 1) fulfillment of the obligations under a contract for the provision of a payment service within the meaning of the Payment Services and Payment Systems Act and 2) a contact telephone number exclusively for the participation in this Promotion. The processing of these data is a necessary condition for the use of the Service, as well as for participation in the Promotion, ensuring its proper conduction and handing over the Prize. Secondly, the Organizer processes personal data of the customers, in order to fulfill its legal obligations. Such obligations are those arising from tax and accounting legislation that impose certain responsibilities of the Organizer for accounting as a trading company. The Organizer is also subject to additional statutory obligations inherent in him as a financial institution, and in particular in its capacity as a liable person under the anti-money laundering and terrorist financing regulations and the subordinate legislation on their implementation. This predetermines the need to collect more personal data for the Organizer's customers. In certain cases, for example, in the case of an operation or transaction that exceeds certain thresholds, obligations for collecting additional information arise for the Organizer. In order to perform due diligence of the customers for each transaction and to be in a constant readiness to provide all the required information to the controlling authorities, the Organizer is also obliged to store the information about the previous operations and transactions of each customer and to take it into consideration before any subsequent transaction. According to the PITA, the Prize in the present Promotion represents taxable income and is subject to declaration and taxation under Bulgarian legislation. The legal basis for the processing of personal data under the previous paragraph is Article 6 (1) (c) of the GDPR (legal obligations applicable to the Organizer) in relation to the relevant provisions of our national legislation. The general rules described in the Information for visitors and customers of Organizer s locations pursuant to Chapter III of Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation) (GDPR) apply to matters not expressly set forth in these General Terms and Conditions and are available at the Organizer s locations and online at: The personal data required to participate in the Promotion will be deleted 1 (one) month after the end of the Promotion, except for data the Organizer has the obligation to keep for a longer period under a legal obligation. 13. REFUSAL OF PARTICIPATION A Participant who participated in the Promotion may request removal from the Promotion and cancel his/her participation at any time. To do so, Participant must notify the Organizer using the contact details of Sections 1 and 2 of these General Terms and Conditions (in person at the Organizer's address, by , or by phone) and will be fully assisted to be removed from the Promotion and his/her participation will be cancelled. This part of Participant's personal data related to the Service that is required to be stored for financial or accounting purposes or other legal obligations will be erased or destroyed upon expiry of the statutory period.

6 14. SETTLEMENT OF DISPUTES All disputes arising in connection with the Promotion will be settled by mutual consent, in good faith and in a spirit of goodwill, mutual concessions and compromises. If this is not possible, the parties have the right to refer the dispute for settlement in accordance with Bulgarian law to the competent court in Sofia.
