3 PACK PREMIUM VIP Principe The VIP Premium Pack is a must. It allows you to experience the rally in ideal conditions and to be as close as possible to teams, drivers and co-drivers. Thanks to this packs, access behind the scenes of the Rally Village and the starting and finishing ceremonies under premium conditions. 5 INTRODUCTION: The present general conditions govern the relationship between the FFSA, holder of the authorisations of activity, whose headquarters are at no. 32 avenue de New York, Paris Cedex 16, France, and its clients. All the services provided by the FFSA are governed by PRICES AND MODES OF PAYMENT: In exchange for the services the client agrees to pay the FFSA the sum for the services provided on the VIP order form (hereafter called the price). This price service will be increased by the VAT in force at the date of payment and/or any other applicable taxes. The conditions of reservation and payment are as follows: the client must accompany his order form with the advance equivalent to 50% (fifty percent) of the price all taxes included to the order of the FFSA when making the reservation. The outstanding balance is to be paid any later than 40 (forty) days before the date of the event. When the order form and the advance have been received the FFSA will send him an invoice. Otherwise, the order will not be registred. Should the client cancel the order less than 40 days before the event, cancellation fees corresponding to 60% (sixty per cent) of the price will be invoiced to the client and charged.. Should the client cancel the order less than 20 the present general sales conditions (CGV) and by the payments which the days before the event, cancellation fees corresponding to 100% ( on client fully accepts unless stated otherwise in writing and agreed by the hundred per cent) of the price will be invoiced to the client and parties in question. charged. Any failure to pay or partial payment of sums owed or payment outside the deadlines is a breach of the client s contractual obligations - unless the latter can justify a case of force majeure and will result in the cancellation of the contract without any prior notice and any other formalities. In addition, the FFSA may ask the client as a penalty compensation corresponding to 50% (fifth per cent) of the price of the service. 6 VIP GENERAL CONDITIONS The FFSA s obligations: The services described on the order form will be provided by the FFSA and/or third party service providers to whom it has entrusted all or part of the services to the client in the Corsica VIP Lounge, which will be installed by the FFSA and put at the client s disposal (hereafter, the reception venue), depending on the the formulas chosen (helicopter or car) in accordance with the order form. Client s obligations: Access to the site is free for everybody. The client will only be allowed to use the reception venue put at his disposal by the FFSA as well as any other associated installations to welcome his guests. Each guest must have specific accesses to access the reception venue. The accesses to the reception venue may be left by the client at booths specially installed for this purpose. The client must ensure that his guests, managers and/or agents respect the interdictions linked to the possession of accesses for the reception venue. Only people with the accesses supplied by the FFSA may access the reception venue and/or services. The accesses can only be used by the beneficiary to the exclusion of any other person to access the reception venue. Failure to observe this rule will lead to the immediate confiscation of the accesses, which will not be replaced. Ban on distribution and/or sale of products and/or services: Unless the FFSA has given its formal agreement the client agrees to refrain from using the reception venue and other spaces to sell to his guests and/or third parties any products or services other than those supplied by the FFSA. In particular the client agrees to refrain from distributing or serving drinks or food other than those supplied by the FFSA or by a third party it has selected. Client s responsibility and insurance: Throughout the duration of the contract the client will be responsible for all acts of his guests, managers or agents (people) within the site. The client is responsible for all damages, degradations, deteriorations in the reception venue and other spaces used that are recorded by the FFSA after they have been put at the client s disposal. Thus, the client undertakes to reimburse the FFSA at first request, on presentation of the written proof, all the expenses that the former has incurred for the costs of repairs to the reception venue and/or other damaged installations. The client will be represented by a representative whose name and address are on the order form. The latter must immediately inform the FFSA of any incident, bodily or material damage in the reception venue and/or within the site involving any of the people. In addition the client agrees to take out an insurance policy covering civil responsibility for all kinds of direct or indirect bodily, material and immaterial damage caused by people s actions, to maintain this insurance in a state of validity and justify it on simple request of the FFSA. Early termination: Subject to the dispositions of the general conditions, should the client fail to fulfil any of his obligations as stipulated in the contract, in particular failure to pay within the deadlines, the FFSA can cancel the contract after notification sent by programme of the race and the consequences this could have for the client and/or people. The client acknowledges having been informed of the risks of the total or partial cancellation of the event and abandons here and now any action involving the responsibility of the FFSA to obtain damages/interest for these motifs. Should the FFSA s services involve helicopter transfers, if one or more external factors beyond the FFSA s control make the flights impossible (the pilot being the sole judge), the expenses involved in providing the helicopters and their immobilisation will be borne by the client outside any replacement solution offered by the FFSA and accepted by the client. The settlement conditions previously stated will be applied. Force majeure: The FFSA and the client accept that the case of force majeure suspends the obligations of the party affected by it towards the other. By force majeure is understood any abnormal and unforeseeable circumstances outside the control of the party concerned which results in it/him being unable to fulfil the services owed to the other party despite its best endeavours. Duration: The contract concerns the 2019 event and will come into effect when the parties have signed it. The present contract will expire at the end of the 2019 event. Intuitu personae: The present contract has been agreed intuitu personae between the parties. The rights and obligations of the client resulting from the contract cannot be ceded, delegated or transferred in whole or in part to a third party by any means whatsoever without prior written agreement of the FFSA. It is agreed between the parties that the FFSA can entrust to third party providers of its choice the execution of all or part of the services in question. Applicable law and judicial competent courts: The present contract is governed by French law. Any litigation concerning its validity, interpretation, execution and/or its cancellation and/or its expiration will be submitted to the competent courts of the Paris Court of Appeal. Miscellaneous: In case of contradiction between the contractual documents, the order form will prevail over the general conditions. The contract governs the relations between the parties concerning the object of the present agreements to the exclusion of all other documents, written or verbal agreements. The contract cancels and replaces all other prior proposals and agreements relative to the same object. The invalidation of one of the clauses of the present contract in particular in the application of a law, a rule or following the decision of a competent court of res judicata will not result in the invalidation of all the other clauses which will have the same force and effect between the signatories. No disposition of the present will be said to have been dismissed, completed or modified by one of the undersigned without a prior written and signed act by the undersigned s managers in the form of an amendment to the present contract that expressly contains the decision to deviate from the application, completion or modification of a contractual clause. Inclusion of the introduction: The above introduction is an integral part of the contract which the parties acknowledge and accept. 7 PRIVACY POLICY AND USE OF PERSONAL DATA The personal data you provide on this form is necessary for the processing of your order by the FFSA, which acts as data controller, in compliance with the regulations on the protection of individuals with regard to the processing of personal data, and in particular EU Regulation 216/679 of 27 July 2016 and Law No of 6 January 1978 as amended. In the event of withdrawal of consent, the data are no longer processed for commercial prospecting. For the management of litigation, the necessary data are kept until all legal remedies have been exhausted. Your personal data are communicated to the FFSA, as well as to its partners and subcontractors within the strict limits of the operations relating to the processing.
