6 7. ELIGIBILITY 1. The applicant must be a citizen of India. 2. He/ She should have attained the age of majority. For this an applicant should have completed 18 years of age as on the date of filing of the Application Form. It is further mentioned that it shall be a mandatory requirement for the Applicant to have a PAN Card and no Application Forms shall be entertained by the Company without the Applicant furnishing a validly issued Pan Card. 3. Family means spouse (if any), dependent/minor children, if any. 4. Both husband and wife can apply for allotment of apartments subject to fulfillment of eligibility condition with a stipulation that if both are found to be successful, then only one shall be allotted the apartment. 5. A Company/ LLP and Trust duly incorporated and recognized under law is eligible to apply under this Scheme. 6. An Applicant under this Scheme shall be allowed to submit only one Application Form for each category of Apartments available & thus an Applicant can submit maximum Six Application Forms altogether in the Scheme. 7. It is mentioned for the sake of clarity that in the event the Applicant wishes to apply for multiple categories of Apartments, it shall have to submit separate Application Forms for each such category alongwith processing Fees & Earnest Money. 8. APPLICATION FORM The Applicant has to apply on a prescribed Application Form. The Application Form can be collected from : (a) The office of the Company; or can be Downloaded from the Company's website or (b) Any of the branches of Corporation Bank (hereinafter referred to as the Bank ) or downloaded from Bank's Website The Company has appointed M/s Homzcart Developers Private Limited a company duly incorporate and validly existing under the companies Act, 1956 having its Registered Office at B-20, 3rd Floor, Sec-57, Noida, U.P. (here in after referred to as Marketing Agent/Channel Partner ) as the Channel Partner for marketing of the Project all over India and has authorized the Channel Partner to provide the Application Forms to any interested Applicant. 05

7 9. HOW TO APPLY (Guidelines) 1. Any Applicant who intends to purchase the Apartment is required to read the Complete Brochure along with the Application Form of the Company and acquaint himself with and fully understand the terms and conditions contained therein. The Applicant shall thereafter fill in the Application Form in CAPITAL LETTERS using ball point BLACK/BLUE PEN only and once the same is done it shall be construed that the Applicant is fully aware with the terms and conditions contained in the Application Form and consents to and accepts the same. 2. The Application Form should be duly completed and signed only by the Applicant(s), who intends to purchase the said Apartment. 3. Kindly avoid any kind of cutting, erasing, scribbling or overwriting on the Application Form. In case, such cutting, erasing, scribbling or overwriting occurs in the Application Form, it is advisable to fill a fresh Application Form. 4. A self-attested passport size colored photograph of the Applicant and the Joint Applicant (if any), should be pasted on the Application Form. In case of Company/LLP, Partnership or Trust, the photograph of the director, authorized signatory, partner or trustee, as the case may be, be affixed and counter signed and duly stamped. No Documents or any paper should be attached with Application Form. Applicants are required to fill their all details properly in respective and appropriate Boxes. 5. Please clearly fill and specify the Category of the Apartment applied for by the Applicant in the Application Form. 6. Once the Application Form has been completely filled and signed, the Applicant is required to submit the Application Form in Authorized Branch of the Bank on or before the last date of submission. Applicant should however note that no supporting Documents are required to submit along with the application. 7. The Application Forms shall be submitted along with a non-refundable Registration/Processing Fees of Rs. 2,500/- (Rupees Two Thousand Five Hundred Only), and the Earnest Money of Rs. 50,000/- (Rupees Fifty Thousand only) (for all categories of Apartments). The Registration/Processing Fees and the Earnest Money shall be deposited by the Applicant vide two separate Demand Drafts/Pay Orders, which shall be deposited in the Bank and be dealt with in the manner as stated in further paras of this clause. The Bank, after receiving the Application Form along with Demand Draft /Pay Order shall give a duly stamped receipt to the Applicant. The Applicants shall collect receipts from the Bank for the due deposit of such fees. The non-refundable Registration/Processing Fees shall be utilized to meet the expenses of the Scheme. The Applicant who has been declared successful in First Draw of Lots will approach, along with all the required documents, to the Company's Office only and no other person/agency/place within seven days from First Draw of Lots and will complete KYC with 5 % payment after adjusting Earnest Money to qualify for the 2nd Draw of Lots. 8. The Demand Drafts/Pay Orders for the amount of Rs. 2,500/- (Rupees Two Thousand Five Hundred Only), towards non-refundable Registration/Processing Fee and Rs. 50,000/- (Rupees Fifty Thousand only) towards the Earnest Money as detailed above shall be drawn/ paid in favour of M/s Rishabh Buildwell Private Limited at Delhi. 9. th Last Date of submission of the duly filled Application Form is 30 May,

Kindly note apart from the Registration/Processing Fees/Earnest Money to be deposited with the Bank as mentioned under the Point 7& 8 of the Clause 9 here in above, no cash/cheque/online payment shall be made to the Company or any of its agents or representatives of the Company or to the Channel Partner or to any broker/agent or any other person. The Company shall not be responsible and under no liability for any such payment/transaction made by Applicant to the Channel Partner or any person/broker/agent under any circumstances. 11. In case of dishonor of the Demand Draft/ Pay Order for any reason whatsoever or if the Application Form is incomplete in any respect whatsoever or if any column is left blank or if the photo is not pasted at the designated place or an incomplete or incorrect address is mentioned or no signature or thumb impression is found on the Application Form or other instrument(s) for any reason whatsoever or the Application Form not being accompanied with required payment or payment receipts/acknowledgements or any other terms & condition of the brochure & Application Form, the Application Form shall be liable to be rejected at the sole discretion of the Company. 12. Once the Application Form is submitted, neither the withdrawal nor any change shall be allowed in the Application Form. In case of any request for any change in the Application Form after submission, An authorized Officer of the Company,to his discretion, will accept or reject after due consideration of the request made by Applicant. The change so requested by the Applicant, can be made only after written consent/approval of the concerned Company Official deputed on this behalf, with in the mentioned stipulated time 13. By submitting the Application Form, the Applicant consents that he/she/they/it agrees to have the knowledge and understanding of the terms and conditions of the Scheme, which shall be incorporated in and shall be an integral part of the Application Form. The Applicant also agrees and acknowledges that once the Applicant is shortlisted through the First Draw of Lots, the Earnest Money paid by such shortlisted Applicant shall become non-refundable and shall not be refunded under any circumstances. 14. Kindly note that not with standing anything contained to the contrary under this Scheme, the Company reserves the right to withdraw this Scheme at any time before the publication of the results of the First Draw of Lots and in such circumstances, the total liability of the Company shall be limited to refund of the Registration/Processing Charges and Earnest Moneyas received from the Applicant. The Company shall not be responsible for any other damages, interest, penalty or liability as arising due to withdrawal of this Scheme. SUBMISSION OF DOCUMENTS The Applicant shall submit the following documents after being successful in First Draw of Lots (No Copies of these Documents are to be attached while submitting the Application before the First Draw of Lots): 1. Self-attested copy of Identity Proof (PAN Card, Aadhaar Card, Passport, Driving License, or any Government identity card having photographs affixed on it); 2. Self-attested copy of Address Proof (Copy of Passport, Aadhaar Card, Government identity card, Election Card, Ration Card, Driving License, Telephone Bill, Electricity Bill or Water Bill); and 3. Acknowledgment Receipt of the Bank. 11. PROCEDURE ON RECEIPT OF APPLICATION FORM 1. The Corporation Bank, (Code: 0506) Branch at Laxmi Nagar, Delhi is only Designated & Authorized Branch to process Application Forms so collected and sent by all other branches of the Corporation Bank as per this Scheme. 2. All other branches of the Corporation Bank, authorized to collect the duly filled Application Form will send on daily basis, by Courier to The Corporation Bank at Laxmi Nagar Branch, Delhi that will forward all the Application Forms so collected by itself and sent by other Branches also to the Company on daily basis. 3. The Company has appointed N.D. Kapur & Co., Chartered Accountants having its offices at 1st Floor, The Great Eastern Centre, 70, Nehru Place, New Delhi (here in after referred to as Agency ), which is a reputed and respectable Chartered accountant Firm to conduct the Scheme, so as to ensure transparency and diligence. Upon receipt of the Application Forms of the Applicant by the Company, the Application Forms shall be forwarded to the Agency, where the same shall be scrutinized and separated in a transparent manner and in accordance with the preference for each category of the Apartment. 4. The Applicant agrees to the fact that only those Application Forms shall be considered for inclusion in the draw of lots, which are complete in all respects and fulfill all the criteria laid down in this Scheme. All incomplete, illegible and defective Application Forms shall be returned by the Company to the Applicants along with the Earnest Money within 30 (thirty) days of completion of scrutiny. 5. The Applicant also agrees and acknowledges that the present Application Form is merely an expression of interest from the Applicant to register himself/herself/themselves/itself and to be included in the First Draw of lots for being considered for the allotment of an Apartment under this Scheme and the said Apartment shall be allotted strictly as per the terms and conditions of this Scheme. 12. 10 14. CONDUCT OF DRAW OF LOTS 1. The Company is allotting only 636 (Six Hundred and Thirty Six) number of Apartments in this Scheme and hence, expects the same number of Application Forms under this Scheme. In case, the number of eligible Application Forms, after scrutiny by the Agency, exceeds the number of Apartments in any category as available in the Scheme, then the Company shall conduct the First Draw of Lots through the Agency for such category of Apartments and equal number of applications shall be selected for the number of Apartments in each category. The Draw of Lots shall be conducted by the Agency in a fair and transparent manner. The information regarding the venue, date and time of the First Draw of Lots shall also be prominently published in at least 2 (two) English and Hindi newspapers Minimum 5 days before the First Draw of Lots, for the information of general public. The First Draw of Lots shall be open to public, including the Applicants. 2. The First Draw of Lots will be held for 636 Apartments in the 3 towers of the Project as specified under this Scheme i.e. a total of 6 separate draws will be held, one each for the Categories of Apartments (each Category having 106 Apartments each). In addition, depending on the number of Applications received by the Company for each Category of Apartments, a further draw of lots will also be held for a maximum of 30 additional Applicants in each of the Categories (over and above the stipulated limit of 106 in each Category) who shall be the waitlisted Applicants. That is, in the event any of the original Applicant in a Category is rejected due to noncompliance of the terms and condition of the Application and Brochure, the applicants in the wait list in order of priority shall become the eligible Applicants in their place. 3. Pursuant to the First Draw of Lots, an /SMS shall be sent to all the successful Applicants separately indicating that their Application has been successfully selected for the particular Category in which they applied for. 4. After the First Draw of Lots, the list of successful Applicants for each particular Category shall be prepared on the spot and shall be displayed prominently at the venue for the time being and later at the office of the Company and on the website of the Company. 5. Upon the publication of results of the First Draw of Lots, the Bank shall within 2 (two) working days transfer to the Company, an amount equivalent to the sum total of Earnest Money received by the Bank from the successful Applicants in the designated account. The Earnest Money amount as paid by the successful applicants as per clause 9 above along with the Application Form, shall be the Earnest Money towards the part sale consideration of Apartment. Such Earnest Money shall be strictly non-refundable. 6. It is to be noted that under no circumstances, the successful Applicants will have the right or option to withdraw from the Scheme after the First Draw of Lots. 7. Within 7 (seven) working days of the publication of the results of the First Draw of Lots, the successful Applicants across Categories shall submit the KYC documents as may be required by the Company and shall also pay 5% of the price of their respective Apartments in the manner prescribed. Upon the submission and payment of such amounts, the Company shall immediately issue the Allotment Letter to such Applicants and such Allotment Letter shall be immediately accepted and signed by such Applicants. In the event any of the successful Applicant fails to furnish such document/make the desired payments within the time limit of 7 (seven) working days from the date of publication of the results of the First Draw of Lots, such Applicant's application shall be treated as cancelled and the entire Earnest Money of such Applicant shall be liable to be forfeited by the Company. Further, upon such cancellation, an Applicant who has been placed in the wait listed category (in order of rank) shall be allotted such Apartment upon the submission of the requisite documents and payments. 8. Kindly note that if in any case, a situation arises where the number of Applicants whose applications are found eligible for being included in the First Draw of Lots is equal to the number of Apartments of a particular category as available in this Scheme or the number of Applicants are less than the number of Apartments of a particular category as available in this Scheme, then the Applicant who had applied for the said category of Apartment shall be declared a successful Applicant without proceeding for a draw of lots in that particular category. 09

11 15. DISCOUNTING SCHEME DETAILS 1. After the completion of allotment formalities, the Company shall hold a Second Draw of Lots, within 30 (thirty) days of the First Draw of Lots ( Second Draw of Lots Cut Off Date ), which shall be conducted in a fair and transparent manner by the Agency to determine the entitlement of each of the Allottees for discounts as per the Discounting Scheme. The Second Draw of Lots shall be conducted in the presence of the Allottees, whosoever are present. The Second Draw of Lots shall be held at any venue which the Company may deem appropriate and such venue shall be intimated by the Company to the successful Applicants within a reasonable time frame prior to the conduct of the Second Draw of Lots. All the Shortlisted Applicants shall be separately notified personally by It is provided herein that in the event the Company is unable to conduct the Second Draw of Lots even after 30 (thirty) days subsequent to the Second Draw of Lots Cut Off Date, then in such an event the Company shall be liable to return the Earnest Money and the Processing Fees of all the successful Applicants (and any Applicants in the waitlisted category, if applicable). Provided further that such Earnest Money and Processing Fees shall be refunded in full to the successful Applicants (unless already withdrawn or cancelled) within a time frame of 45 (forty five) days from the Second Draw of Lots Cut Off Date with an interest of 9% (nine percent) till the date of payment, and upon such refund to the Applicants the Company shall be left with no liability whatsoever with regard to such Applicants. 3. The Discounting Scheme for all Allottees, selected through the second draw of lots, for each category of Apartment sizes of (1590/1445/1245/1050/950/775 Sq. ft.) shall be as under: (a) First 6 Allottees, shall be given 90% discount calculated over Basic Sale Price (BSP) (b) Next 6 Allottees, shall be given 80% discount calculated over Basic Sale Price (BSP) (c) Next 6 Allottees, shall be given 70% discount calculated over Basic Sales Price (BSP) (d) Next 6 Allottees, shall be given 60% discount calculated over Basic Sales Price (BSP) (e) Next 6 Allottees, shall be given 50% discount calculated over Basic Sales Price (BSP) (f) Next 6 Allottees, shall be given 40% discount calculated over Basic Sales Price (BSP) (g) Next 6 Allottees, shall be given 30% discount calculated over Basic Sales Price (BSP) (h) (i) (j) Next 198 Allottees, shall be given 20% discount calculated over Basic Sales Price (BSP) Next 198 Allottees, shall be given 15% discount calculated over Basic Sales Price (BSP) Next 198 Allottees, shall be given 10% discount calculated over Basic Sales Price (BSP) 4. The balance sale consideration for the Apartment shall be payable by the Allottee as per the agreed Payment Plan annexed as Annexure-I, subject to entitlement to discounts as per the Scheme above. If the allotment formalities/documentation or execution of Flat Buyer Agreement are not completed within 7 days of the Second Draw of Lots or the Allottee withdraws from the Allotment of the Apartment, the Company shall be entitled to cancel the Allotment and forfeit the 5% deposit/earnest Money of the concerned Allottee. An Applicant shall be permitted to sell/transfer/assigns the Apartment only after the due execution of the Flat Buyer Agreement, which shall be executed upon payment of atleast 20% of the Total Sale Consideration of the Apartments which shall include all other charges and the applicable taxes except those allottees who home been selected in 90% discount scheme. 10

12 16. REFUND TO UNSUCCESSFUL APPLICANTS 1. All the non-successful Applicants, i.e., those who could not be shortlisted in the First Draw of Lots and within 10 days of the publication of results of the First Draw of Lots. Such refund shall be done by the Corporation Bank, Under no circumstances, the Processing Fees shall be refunded or adjusted. 2. The Applicants have to clearly mention his/her/it's bank account details in the Application Forms, so that the refunds are made to the proper and designated accounts of the non-successful Applicants. In case the Application is in joint name, refund will be made in the name of the first applicant only and, therefore, only his/her bank account number should be given. 3. ANNEXURE - III (General Terms & Conditions) 18.1 NATURE OF BOOKING The applicant herein agrees and acknowledges that the allotment of the Apartment under the terms hereof is entirely at the discretion of the Company. The allotment shall be confirmed for successful applicants pursuant to the First Draw of Lots, only after the issuance of letter of allotment by the Company to such successful applicants REGISTRATION & OTHER CHARGES Registration charges, stamp duty and other incidental expenses for the transfer of property as may be applicable shall be borne by the Applicant(s). Other statutory taxes, service tax or any enhancement imposed or to be imposed by the Government/Semi-Government/any competent authority and charges for additional facilities as applicable from time to time shall be extra and are to be borne by the applicant(s) MODE OF PAYMENT Payments are to be made only through demand drafts and Pay Orders and to be deposited in all branches of corporation bank only. Payments made vide demand drafts/ pay orders are to be made payable to M/s Rishabh Buildwell Private Limited at Delhi. After each payment the applicant(s) must insist on a duly signed receipt from the duly authorized person of the bank, attached herewith the application form DELAYED PAYMENTS AFTER ALLOTMENT In any circumstances the payments/instalments are delayed up to a maximum period of 60 days from the due date of such payment, 18% p.a. shall be charged on all such delayed payment of the instalments and other charges as per the construction linked payment plan accepted by such applicant(s). In case of such delayed payment the Company has the sole right to adjust the interest from the payment received from the allottee and balance payment may be adjusted in cost of Apartment or any other charges. After expiry of said 60 days limit the allotment shall be deemed cancelled with the forfeiture of the entire Earnest Money and the allottee shall have no right to make objection in any circumstances whatsoever HOUSING LOANS Loans from financial institutions to finance the said residential apartment may be availed by the applicant(s) on their own. The application and procurement of such loan/financial facility are to be applied for and pursued by the individual applicant(s) on their own. The Company will provide assistance through their personnel (without any obligations of any nature on the Company) to provide all official documents of the project for legal and technical clearance. It is however provided for the sake of clarity that the Company shall not be liable for any delays in payments by the customer. In the event of delay in approval of loan or in the event the loan application gets rejected by the bank, it shall not be used as an excuse by the applicant to delay the payments under the terms hereof and interest will be charged by the Company on such delayed payments. In addition, the Company shall be free to take any other action as per the rules and these terms and conditions. Further, if a particular bank/institution refuses to extend financial assistance to such customer on any ground whatsoever, the applicant(s) shall not make such refusal as a cause for non payment of further instalment/dues CANCELLATION OF ALLOTMENT Apartment allottee(s) hereby agree/s that the entire Earnest Money shall be treated as a security to ensure fulfilment of all the terms and conditions by the applicant(s). Any default on the part of the applicant(s) towards strict compliance of the terms and conditions of the present application (or allotment letter) shall entitle the Company to forfeit the Earnest Money and cancel the allotment. It is further agreed by the applicant(s) that if for any reason whatsoever, the applicant(s) applies for the cancellation of the allotment in his/her/their favour or if the allotment of the applicant(s) is terminated by the Company for the reason of any default(s) made by 16

18 the applicant(s) towards the compliance of the terms and conditions of such allotment 1. The allotment will be cancelled and the Earnest Money paid by the applicant(s) shall not be refunded under any circumstances. Upon such cancellation, the applicant shall be left with no rights or claims against the Company or the apartment/allotment. +_ 2. Upon the execution of the allotment agreement, if for any reason whatsoever, the applicant(s)applies for the cancellation of the allotment in his/her/their favour or if the allotment of the applicant(s) is terminated by the Company for the reason of any default(s) made by the applicant(s) towards the compliance of the terms and conditions of such allotment (including any default in making timely payments as per the opted construction linked payment plan), then in such conditions the amount equal to Earnest Money and cancellation charges along with other incidental expenses incurred by the Company towards such allotment shall stand forfeited by the Company and the balance amount, if any, shall be refunded by the applicant(s) without any interest POSSESSION The Company assures that possession of the units shall be handed over to the applicant(s) within 48 months from the date of start of construction, subject to reasons to force majeure. The company however, if compelled by reasons beyond control such as earthquakes, civil riots, or other circumstances of supervening impossibilities may extend the period of possession beyond the period specified above. The company shall neither pay any interest for the delay in handing over of possession for the aforesaid reasons nor the applicant(s) will be entitled to claim any compensation for delay SUPER AREA It is defined as the total built-up area of the unit booked and shall also include walls, windows, balconies, projections etc., proportionate share of areas like staircase, common areas, lifts, walls and areas used/earmarked for installation of essential facilities like electrical sub stations, transformers, water tanks and other facilities. The total built-up area of the unit may, during the course of construction, change marginally. If there is a change of more than 3%, the BSP of the unit may be increased or decreased depending upon the variation in the area/size of the unit CHANGE IN DRAWING/DESIGNS Due to any unforeseen requirement of any Government authority (ies)/applicable laws/the Company's own requirements, the Company has every right to change the design(s) and specification(s) of an individual Apartment/Tower(s) or the Project as a whole. The applicant(s) shall get his/her/their complete address registered with the Company at the time of filing this application with the Company and it shall be his/her/their responsibility to inform the Company by registered AD letter about all or any subsequent change, if any, in his/her/their mailing address, failing which all notices and correspondence from the Company sent to the address as mentioned by the applicant(s) in this application form and all the said letters/notices sent by the Company to the applicant(s) shall be deemed to be received by them on address first mentioned here in above. I/We hereby agree that in case of cancellation of the booking of the said Apartment, I/We shall submit 'No Objection Certificate' from the concerned dealer, if any, in this regard failing which brokerage will be deducted from the amount paid by the allottee and balance will be refunded. If I/We have NRI/PIO status or if I/We are foreign national(s) then I/We shall be solely responsible to comply with the necessary formalities as laid down in Foreign Exchange Management Act, 1999 and/or any other 17

19 statutory provisions governing this transaction which may inter alia involve remittance of payments/consideration and acquisition of immovable assets in India. In case any such permission is ever refused or subsequently found lacking by any statutory authority/company, the amount paid towards booking and further consideration will be returned by the Company as per applicable rules without any interest and the allotment shall stand cancelled forthwith. I/We agree that the Company will not be liable in any manner on such account DECLARATION I/We agree that the registration in the Project shall become definitive only after completion of the process of allotment after being successful in the First Draw of Lots and upon issuance of a final communication in such regard by the Company in writing which shall be subject to the terms and conditions as may be stipulated by the Company at the time of allotment. I/We have fully read and understood the above mentioned terms and conditions and agree to abide by the same. I/We understand that the terms and conditions as comprehensively set out in the allotment letter which shall supersede the terms and conditions in this application. I/We are fully conscious that it is not incumbent on part of the Company to send reminder/notices in respect of our obligations as set out in this application and/or allotment letter. I/We shall fully be responsible for any consequence in respect of default committed by me/us in not abiding by the terms and conditions contained in this application and/or allotment letter. I/We have sought detailed explanation and clarification from the Company and the Company has readily provided such explanations sought and after giving careful consideration to all such facts, terms, conditions and representation made by the Company, I/We have now executed this Application Form and paid the monies thereof being fully conscious of my/our liabilities and obligations, including the forfeiture of the Earnest Money and cancellation charges as may be imposed upon me/us.
