The permit has been modified to incorporate changes to annual permittee reporting requirements. The Year 2 Annual Reporting forms and the Year 2 Stormwater Management Program Annual Report requirements have been amended slightly from last year. The attached MS4 SPDES modification statement and amended annual report directions explain these changes in detail. Please refer to them for comprehensive information on this modification. 2 th Division of Environmental Permits, 4 Floor 625 Broadway, Albany, New York Phone: (518) FAX: (518) STATEMENT OF MS4 STATE POLLUTANT DISCHARGE ELIMINATION SYSTEM (SPDES) PERMIT MODIFICATION TO BE KEPT WITH SPDES GENERAL PERMIT GP EFFECTIVE DATE MARCH 10, 2005 Per Department of Environmental Conservation changes to the reporting and certification requirements for MS4 annual reports, the MS4 State Pollutant Discharge Elimination System (SPDES) Permit is hereby modified to reflect those changes. This Department initiated modification to your permit deletes the annual report reporting requirements (Part V.C) of the MS4 SPDES permit effective January 8, 2003 and replaces them with the following requirements: C. Reporting Reports for the annual period ending March 10 must be submitted to the DEC Central Office (MS4 Permit Coordinator, 625 Broadway, Division of Water - 4 th Floor, Albany, NY ) no later than June 1 of each year in a format specified by the Department. The report must include: This Department initiated modification to your permit also deletes the certification requirements (Part V.D) of the MS4 SPDES permit effective January 8, 2003 and replaces them with the following requirements: D. Certification In addition to the reporting required in Part V.C. above, each MS4 covered by this permit must annually submit a Municipal Compliance Certification (MCC), on a form to be provided by the Department, along with the annual reporting form. The form certifies that all applicable conditions of Part IV of this permit

3 are being implemented and complied with. The MCC must be submitted, with the report described in Part V.C., no later than June 1 of each year. It must be signed by the same entity allowed to sign the NOI as described in Part VI.I.1. The certification provided by the MCC does not affect, replace or negate the certification required under Part VI. I. 2. d. If implementation of and/or compliance with any requirement cannot be certified to by the MCC, a description of why implementation/compliance is not being achieved and what is being done to implement/comply must be included in the MCC.

4 Division of Water Bureau of Water Permits, 4 th Floor 625 Broadway, Albany, New York Phone: (518) FAX: (518) MS4 STATE POLLUTANT DISCHARGE ELIMINATION SYSTEM (SPDES) PERMIT ANNUAL REPORT: DIRECTIONS AND DESCRIPTION OF CHANGES EFFECTIVE DATE MARCH 10, 2005 The Year 2 Municipal Compliance Certification (MCC) form and the SWMPAR form have been combined into one document and are available at the Division of Water (the Division s) FTP site (ftp:// They are saved as a Microsoft Word file (ms4year2annualreport.doc) and a WordPerfect file (ms4year2annualreport.wpd). The following minor changes have been made to the Year 2 SWMPAR: - the executive summary and table of contents are no longer required; - the narrative overview has been replaced with room for additional notes to explain and/or describe changes to the specific minimum measures; and - the planned activities for the upcoming year specifically require a list of the BMP s, measurable goals and a schedule for implementation. Instructions for completing the MCC form and SWMPAR form are also on the Division's FTP site. They are saved as a Microsoft Word file (ms4year2reportinstructions.doc) and a WordPerfect file (ms4year2reportinstructions.wpd). The instructions for completing the forms describe the information required for each section of the changed SWMPAR form. By June 1, 2005, two completed hard copies (an original and a photocopy) of these forms must be submitted at the same time to the DEC Central Office at the following address: MS4 Permit Coordinator 625 Broadway Division of Water - 4 th Floor Albany, NY DO NOT send these forms to the DEC Regional Office.
