Implementation of CDPS Stormwater Management Program (Attachment) The purpose of the Annual Report is to report on the status of your implementation of the permit requirements, including compliance with the standard of reducing the discharge of pollutants from your MS4 to the Maximum Extent Practicable (MEP). As an attachment to this form, address each of the following items for each of the six program areas (public education and outreach on stormwater impacts, public participation/involvement, illicit discharge detection and elimination, construction site stormwater runoff control, post-construction stormwater management in new development and redevelopment, and pollution prevention/good housekeeping for municipal operations). Note that although the Annual Report only requires the submittal of certain information as outlined below, additional information may be requested by the Division and/or the EPA to audit the implementation status of your CDPS Stormwater Management Program. As the permittee, you must collect and maintain adequate information to demonstrate implementation of the six program areas as per your CDPS Stormwater Management Program. For example, construction site inspection reports, outreach materials, and records of maintenance activities performed may be requested by the Division outside of the Annual Report. If another entity does not have its own permit but is instead covered under your permit, the Annual Report information under Section D of this form must also be provided for each such entity. Your attachments may be formatted by Minimum Control Measure or by Item number. Depending on the size of the municipality and the complexity of the programs, the attachments for this section will likely comprise 5 to 12 pages. 1. Implementation status of CDPS Stormwater Management Program. Provide the status of any Measurable Goal scheduled for completion during the reporting period or for which activities have begun. For program elements started, but not completed, any milestones that have been met must be indicated. If a change will be proposed to the BMP or Measurable Goal as part of the Annual Report, this must be stated and the proposed changes discussed in Item #4 below. See Item #4 for additional guidance on changes. This information should be provided in a table format in accordance with the example provided below, and attached to this form. A separate table should be provided for each Program Area. 3 STORMWATER ANNUAL REPORT MS4 2. Results of information collected and analyzed, if any, during the reporting period, including any monitoring data used to assess the success of the program at reducing the discharge of pollutants to the Maximum Extent Practicable (MEP). If a program element included a Measurable Goal to collect data, you must submit a short summary of the information and any analysis completed. The following are examples of program elements for which information would need to be reported: EXAMPLE ONLY - PLEASE ATTACH INFORMATION AS SEPARATE SHEET Measurable Goal Results of information collected and analyzed that must be reported for this item i. Conduct Survey A brief summary of the results of the survey and any analysis. ii. Inventory of all municipal facilities and A brief summary of the facilities and activities for which plans activities to determine which will be needed. facilities/activities require the development of stormwater quality plans. iii. Monitor ten MS4 outfall locations five A brief summary of the monitoring data and any analysis. times each year during storm events to develop baseline wet weather water quality data. Data collected to audit the implementation status of a program element does not need to be reported in the Annual Report unless required by Item #1 (numeric Measurable Goals) or Item #3 (inspection/enforcement information). For example, data such as street miles swept, visitors at an information booth, or visits to a web site should not be included in the Annual Report unless directly related to a Measurable Goal or committed to be reported and/or analyzed in a program description. However, this information may need to be reported separately to the Division as part of a program audit. 3. A summary of the number and nature of inspections and formal enforcement actions performed. Site-specific information may also be included, but is not required. (Information recorded under Item 1, Measurable Goals status, does not need to be repeated here.) 4 4. Proposed changes to the CDPS Stormwater Management Program. For the BMPs/Measurable Goals that were previously described in reports or the permit application, provide a summary of proposed changes and/or additions. See the examples below, which are based on the examples in Item 1. Significant changes that involve replacing or deleting an ineffective or infeasible BMP may require Division review, as outlined in Part 1.D.2.a.3 of the permit. For each change proposed, you must provide: A) The applicable Program Area; B) The BMP/Measurable Goal for which a change is being proposed; C) Any proposed changes to the BMP description; D) Any proposed changes to the Measurable Goals (including specific dates and numeric measures); and E) The rationale for the proposed changes. You must complete an internal review of your overall compliance with permit conditions, including an assessment of the appropriateness of the identified BMPs and progress towards achieving the statutory goal of reducing the discharge of pollutants to the MEP. For those BMPs/Measurable Goals that you have determined to not be appropriate, you must propose changes to the BMP description and/or the Measurable Goal, as needed. By not listing a BMP or proposing a change in this table, you are indicating your determination that the BMP is appropriate to achieve the statutory goal of reducing the discharge of pollutants to the MEP. To avoid being in a position of non-compliance, if a Measurable Goal will not be met, you must provide a request to change the BMP and/or Measurable Goal prior to the deadline in the Measurable Goal. If the deadline is before the due date for the Annual Report, the change must be requested independent of the Annual Report submittal. Change #1 (from Row ii in Item #1 example, above): A) Program Area #1, Public Education B) Place 5 bus stop ads by 3/10/04. C) Increase number of ads from 5 to 6. D) Place 3 bus stop ads by 11/1/03 and 3 bus stop ads by 12/31/04. E) The cost of 2 additional bus stop ads did not fit into the 2003/2004 budget. The 2 additional ads will be placed in late 2004 when the public education budget allows for the cost. One additional ad will also be placed to compensate for the delay in implementation. Change #2 (from Row iii in Item #1 example, above): A) Program Area #1, Public Education B) Develop program and make 10 presentations to elementary school classrooms by 12/1/07. C) Change goal to setting up booth and making presentations at elementary school water festivals. The water festivals will be held at two different schools in the permitted area and will be attended by approximately 500 students, parents, and teachers each. D) Set up booth and make a presentation at two elementary school water festivals per year by 12/31/05, and 12/31/06. E) After meeting with the school district, it was decided that the existing water festivals would be a more efficient way to reach the students. The presentations and booths at the water festivals will reach a larger audience than individual classroom presentations, even though fewer total presentations will be made. 5 5. Activities for next reporting cycle. Provide the Measurable Goals with dates (including the changes proposed in Item #4 above) for the activities you plan to undertake during the next reporting cycle (i.e., the next calendar year). This information should be provided in a table format in accordance with the example provided below, and attached to this form. A separate table should be provided for each Program Area. Program Area #1 Public Education i. 40% of MS4 storm drains stenciled by 12/1/04 6. Notice of Program Element Operation by a Second Party Another government entity may be relied on to perform requirements of your MS4 permit. However, as the permittee, you remain liable for compliance with the terms of the permit if the requirements are not fulfilled. You must complete this Annual Report for the geographic areas covered under your permit, for all program areas, even if one or more program elements/areas is being performed by another entity. (However, if you are performing a program element for another permittee, you do not need to include that activity in this report.) If you are relying on another government entity to satisfy some of your permit obligations (and if the information has not been previously provided to the Division in earlier reports or the application), the Annual Report must include a statement to that effect. If the BMP and/or Measurable Goal will be modified in addition to the change of operator to another government entity, the change must be included in Item #4, above. Example statement: As of September 15, 2003, Monroe County is performing the construction site plan reviews for the City in accordance with the procedures in the City's original application. E. Certification I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted.
