Davis and City Council Administrative Service Officer, Cindy Sheppard A. Call to Order Chair Kennedy called the meeting to order with the above persons present. B. Approval of Agenda In connection with the approval of the June 8 th meeting agenda, there was amendment to take up agenda item D-1b, Council Needs Assessment first. Council Member Gerdes made a motion that the agenda be approved as written. All were in favor of the motion. Ayes. Kennedy. Gerdes. Nurse. Nays. None. Absent. Rice. Montanari (alt). C. Approval of Minutes 1. May 25, 2017 In connection with the approval of the May 25 th meeting minutes, Councilmember Gerdes made a motion that the minutes be approved as written. All were in favor of the motion. Ayes. Kennedy. Gerdes. Nurse. Nays. None. Absent. Rice. Montanari (alt). D. New/Deferred Business 1b. Council Needs Assessment. CM Rice started the discussion with an overview of the pay ranges to consider if City Council hires Legislative Aides. The committee was provided with a handout displaying salary ranges for Legislative/Executive Aides from the City of Tampa and the Pinellas County Commission. CM Rice expressed her rationale of hiring aides more towards the PB4 range that are commensurate to our neighboring municipalities. CM Foster inquired if there was some discretion in hiring an aide between the low and high range of pay if they were more qualified. Mr. Guella stated that Administrative Authority is required to go above the 50% midpoint. CM Gerdes suggested that Council move cautiously and start with two positions, with one having a heavy finance/accounting background who can serve as budget liaison and the other position would perform legislative research. CM Montanari emphasized the need of Council having someone with analytical capacity and hiring an individual with expertise in engineering and/or infrastructure. He supports the PB2 range.

3 CM Wheeler-Bowman supports hiring 4 Legislative Aides, however wants more detail on how these positions along with the current staff structure would all fit together. There was some discussion about the hiring and firing process, which will require an amendment to the Charter. CM Kennedy asked for clarification regarding potential Sunshine Law violations as it relates to a Legislative Aide sharing information between Council Members. Attorney Williams explained that according to the Sunshine Law, no one can be a liaison between Council Members or between members of any other board. In regards to constituency outreach, CM Rice discussed the need for more administrative support, analytical preparation and being able to be more proactive. CM Rice further stated that more coverage is needed with attending neighborhood meetings, drafting newsletter, and issuing updates to constituents. CM Foster also had concerns about potential Sunshine Law violations. Attorney Williams explained that the aide cannot communicate information from a Council Member to another Council Member. In addition, the aide cannot take what was shared from various Council Members and create a document, which could be considered a meeting under case law. The committee agreed to continue the discussion at a later meeting as it relates to specific job descriptions. CM Nurse made a motion to recommend 4 positions with a PB2 pay range. All were in favor of the motion. Ayes: Approved unanimously by the committee. Ayes: Kennedy, Gerdes, Nurse, Rice, Montanari (Alt). Nays: None 1a. Consideration of a requirement for a City contractor securing future contracts of a least $2,000,000 to provide a minimum wage of a least $10.00 per hour with a schedule to raise this over time (Chris Guella and Louie Moore). Mr. Moore started the discussion recommending City Council enact a Living Wage Ordinance and explained how the ordinance will financially impact the total procurement budget. The ordinance would be for major City contracts over $100,000 and mandate the minimum wage requirements. Mr. Guella explained the Minimum Wage Analysis that was provided to the committee. CM Foster had concerns with temporary and part-time employees not starting at $12, when the City is asking contractors to start their workers at that rate of pay. Attorney Williams provided an amendment to Sec Living wage, to add the following, pursuant to the major contract while physically present with the geographic boundaries of the City. CM Kennedy recommended a few additions to the ordinance to include the following: Add a paragraph in Sec (a) Findings. An acknowledgement that this will increase the annual cost of the City and therefore increase a tax burden on our citizens and the customers of our enterprise fund. However, we believe the benefits of a living wage outweighs those detriments; Sec Payment of living wage. Add, or while working on City project at the end of first paragraph and softening the language on Indexing; Sec CM Kennedy suggested added language under Remedies for aggrieved employees to participate in our wage theft procedure. CM Nurse made a motion to approve the proposed ordinance. Ayes: Approved unanimously by the committee. Ayes: Kennedy, Gerdes, Nurse, Rice, Montanari (Alt). Nays: None CM Nurse made a motion to recommend to administration that part- time employees salaries would move in tandem with the proposed Living Wage Ordinance. Jessica Eilerman, Greenhouse Manager & Small Business Liaison Date: June 15, 2017 Subject: Revisions to the Small Business Enterprise (SBE) Ordinance & Administrative Policy Attached are the recommended updates to the City s SBE Ordinance & SBE Administrative Policy. Abbreviated Program History The City adopted its first MBE Ordinance in Over the next eight years, a variety of changes and modifications were made due to changing legal opinion and defensibility. In 1989 the City commissioned a disparity study regarding the nature and extent (if any) of discrimination against Minority-and Women-Owned Business in St. Petersburg. The results of the study confirmed the need to re-establish the MBE Program for construction projects for black businesses only. The data for the procurement of goods and services was not analyzed at that time. The MBE construction program was re-established by ordinance in In June 1998, the City commissioned a second Disparity Study. The study conducted by Policy Research Consulting, Inc. concluded that there was no disparity in the City s goods and services procurement and construction programs. Consequently, it was determined by the City Attorney that the City s race and gender conscious Minority/Women Business Enterprise (M/WBE) initiative was no longer legally defensible. In November 1999, City Council repealed the M/WBE Construction Program and, in 2001, adopted a race and gender neutral Small and Disadvantaged Business Enterprise (SDBE) Program. The intent of the SDBE program was to enhance procurement opportunities for certified SDBEs domiciled within city limits. On September 21, 2006, the City Council approved Ordinance 789- G which created a SBE program. The SBE program replaced the SDBE program to create a more effective and regional program. The intent of the SBE program is to foster growth in the economy of the City, by affording small businesses an opportunity to gain the experience, knowledge and resources necessary to compete and survive, both in the government as well as in the private procurement and construction contracting arena.

6 Beginning in 2015 there has been an increased desire from the community to examine an expansion or addition to the current SBE program into a W/MBE program. To do this, a disparity study will need to be commissioned and conducted. Until such a study is commissioned, the Greenhouse/Economic Development staff has prepared the recommendations outlined herein to update and strengthen the current SBE program. Discussions with members of the SBE Committee, key impacted City Departments as well as with members of the public have been held to incorporate suggestions and feedback as appropriate. Summary of Proposed SBE Program Revisions SBE Ordinance Revisions Minor revisions proposed relating to the expansion of the SBE committee and reporting process SBE Administration Policy Revisions The bulk of the revisions are found in the Administrative Policy. Please see attached for full overview. In closing The ordinance revisions, if supported by PSI, can be rescheduled for Council action in July The Administrative Policy revisions would become effective upon adoption of the revised ordinance. 88 Planning & Economic Development Budget, Finance & Taxation Committee: June 15, 2017 Administrative Revisions to the Small Business Enterprise Program SBE Committee: Add two citizens to the SBE Committee one appointed by Mayor, one by Council Requiring mandatory department participation of City staff on the committee to include at least one from the following: o Procurement, o Engineering, o Water Resources, and o Economic Development Certification: Increase the number of allowable full time permanent employees to 50 (currently at 25) Increase annual sales volume criteria for goods and services companies to $5 million annually (currently at $3 million) Increase annual sales volume criteria for construction companies to $8 million annually (currently at $5 million) All certifications are effective for a period of three years (currently at two years) Accept electronically transmitted submissions of the SBE application including the affidavit Institute Rising Annual Goal: Establish the following annual goals: o FY 17 8%; o FY 18 10%; o FY 19 12%, and; o FY %. o The annual goals will be reviewed every two year to see if market conditions warrant any adjustments to the goals. The goals will then be adjusted accordingly. If any adjustments are made, Council will be notified in a timely manner.

89 Administration: The Greenhouse staff will measure and report local participation in the SBE program. All City Departments are strongly encouraged to use SBEs when soliciting bids and quotes for supplies or services Failure to use Designated SBEs: o Any prime contractor that does use the designated SBE, which was approved during the SBE compliance audit, and did not receive prior approval for non-use by the SBE staff will forfeit retainage to be either the amount designated in the Letter of Intent, the contract amount or 10% of the amount subcontracted with the SBE. o The retainage would be transferred into a separate fund and be used for SBE training and workforce development Payment Disputes between the City of St. Petersburg and General/Prime Contractors will be speedily resolved by staff from the following departments: o Engineering o Greenhouse o Procurement o The aforementioned departments will meet on an as needed basics to resolve such payment disputes.

90 COUNCIL AGENDA NEW BUSINESS ITEM TO: Members of City Council DATE: January 23, 2017 COUNCIL DATE: February 2, 2017 RE: Increasing Small Business Enterprise Targets as a Percentage in City Contracts ACTION DESIRED: Respectfully requesting a referral to the Budget, Finance and Taxation Committee for consideration of a revision to the Small Business Enterprise ordinance to 1.) Set goals at 8% in 2017, 10% in 2018, 12% in 2019 and 15% in 2020, 2.) Require quarterly reporting of results to the Mayor and Council and 3.) Implement a plan to scale up these purchases. RATIONALE: Our City's purchasing policies administratively set a target for SBE (small business enterprises) at 5% of City contracts. The biggest tool we have to recycle City contracting spending within our community is this policy. The current ordinance leaves the policy goal setting at a staff level whereas this is policy, I believe should be both higher and set within the ordinance. City expenditures in fiscal 2016 were $165 million. SBE contracts were $9.963 million or 6% of spending Karl Nurse Council Member

91 CITY COUNCIL AGENDA NEW BUSINESS ITEM TO: Members of City Council DATE: January 19, 2017 COUNCIL DATE: February 2, 2017 RE: Creation of a Citizens Advisory Committee for the Intown CRA ACTION DESIRED: Respectfully requesting referral to the Budget, Finance & Taxation Committee for consideration of the establishment of a Citizens Advisory Committee for the Intown CRA. BACKGROUND: The experience of having a Citizens Advisory Committee for the Southside CRA has been positive and has helped insure much more citizen input and transparency. The property owners in the Intown CRA are paying significant additional property taxes. They are requesting a similar arrangement as the Southside CRA. 92 January 13, 2017 Karl Nurse St. Petersburg City Council PO Box 2842 St. Petersburg, FL Re: Citizens Advisory Committee for Intown CRA Dear Karl: The St. Petersburg Downtown Neighborhood Association proposes that a Citizens Advisory Committee be established for the Intown CRA. As we enter a crucial phase in the revitalization of downtown, it is imperative for the City, residents, and business owners to work together and for everyone to have a voice. An Intown CRA Citizens Advisory Committee will accomplish that. A parallel example would be the Southside CRA that includes an Advisory Committee. Since its establishment in 1982, the Intown CRA Plan has played a key role in transforming many parts of downtown into a vibrant community for all who live, work, and play here. Looking at the entire area within the Intown CRA boundaries, it becomes clear that there is more work to be done. Many blocks west of 4th Street still struggle with blight, parking remains extremely limited, and the area lags behind the Core in residential and commercial improvements. The Stadium Complex area has not reached its potential and is now in the process of a complete redevelopment as the Tropicana Field site is reimagined with major impact on downtown. The Webb s City area continues to languish with no apparent plans for this important area that borders the Stadium Complex. Parking and public transportation continue to be a challenge. These are just a few examples of the issues to be considered vis a vis the Intown CRA. As Council works to address these and other issues in the CRA, a Citizens Advisory Committee would be beneficial as residents and other stakeholders could share your commitment to continuing to make all of downtown a success story.
