Accept Voluntary Emission Reduction Agreement (VERA) funds in the amount of $66, Approve the attached Budget Resolution to amend the District Budget to appropriate $66,750 in unanticipated revenue from the Tejon Mountain Village Voluntary Emission Reduction Agreement. BACKGROUND: Since 2005, the San Joaquin Valley Air Pollution Control District (District) has entered into Voluntary Emission Reduction Agreements (VERA) with developers to mitigate the air impacts of their development projects. These agreements benefit air quality by achieving emission reductions in excess of District Rule 9510 (Indirect Source Review) requirements, applicable to development projects. Funds paid to the District through VERAs are used by the District's existing Emission Reduction Incentive Program to fund emission reduction projects, achieving emission reductions on behalf of the project. DISCUSSION: On December 20, 2007, the District entered into a VERA with the Tejon Ranch Company to offset impacts from the Tejon Mountain

2 SJVUA PCD Governing Board APPROPRIATE UNANTICIPATED REVENUE FOR THE DISTRICT'S EMISSION REDUCTION INCENTIVE PROGRAM February 18, 2010 Village development located approximately 40 miles south of Bakersfield. This project is expected to encompass over 7,800 acres and include a mixture of commercial, retail and residential development. The Tejon Mountain Village VERA included a provision which allowed the Tejon Ranch Company to pay the mitigation fees in stages, based on the expected development schedule. On November 18, 2009 and December 7, 2009 the District received payments from the Tejon Ranch Company of project funds totaling $64,080. Additionally, the District will invoice the Tejon Ranch Company for $2,670 in administrative fees, pursuant to the VERA. Because of the uncertainty of the development schedule, funding for this VERA was not included in the District's Budget and, therefore must be appropriated for use in the District's Emission Reduction Incentive Program. FISCAL IMPACT: Approval of the attached Budget Resolution will amend the FY Budget and appropriate $64,080 of Voluntary Emission Agreement funds to be utilized in the District's Emission Reduction lncentive Program and $2,670 in associated administrative fees. RESOLU'TION NO. WHEREAS, The San Joaquin Valley Unified Air Pollution Control District [District) is a duly constituted unified district, as provided in California Health and Safety Sode sections to 40161, and; WHEREAS, said District is authorized by California Health and Safety Code section to make and enforce all necessary and, proper orders, rules and -egulations to accomplish the purpose of Division 26 of the Health and Safety Code, and; WHEREAS, said District is authorized to participate in, and agrees to comply ~ith the requirements of, Voluntary Emission Reduction Agreement, and; WHEREAS, said District has agreed to enter into an agreement with Tejon Mountain Village in the amount of $66,750 and; WHEREAS, monies for this agreement were not reflected in the Appropriations and Estimated Revenues of the District Budget; NOW, THEREFORE, IT IS ORDERED THAT the District's Director of Administrative Services is authorized to increase the District Budget as follows: APPROPRIATIONS: NCENTIVE PROGRAMS VERA - Tejon Mountain Village $ 64, TOTAL INCEN-TIVE PROGRAMS $ 64,080 TOTAL APPROPRIATIONS $ SJVUAPCO 1990 E.
