1 Planning Commission Application Summary Project Name: Galena Park Place Zone Change Address: 538 W. Fox Chase Dr. Current Zoning: CC Hearing Date: April 28, 2016 Background This rezone fixes a zoning discrepancy that resulted from the 2014 land swap between Rocky Mountain Power and DR Horton. In 2013 DR Horton rezoned approximately ten acres from CC to RM1, as shown on Exhibit A of the staff report. In 2014 there was a land swap between the applicant and Rocky Mountain Power, which has a power substation near South. The land swap resulted in a reconfigured project boundary that took in 0.36 acre of ground that was not part of the original rezone from CC to RM1. Exhibit B of the staff report shows the reconfigured project boundary that includes the small section of CC. The application at hand fixes this oversight. General Plan and Zoning In 2013 the City Council changed the land use designation for Galena Park Place from Neighborhood Commercial to Residential Medium-High Density, and the zoning from CC to RM1. The 0.36 acre in question has retained the original land use and zoning designations. Analysis The area in question contains three newly-constructed townhome units. While it is necessary to change the hard zoning designation to RM1 to bring these units into conformity with the zone, the land use plan was essentially changed with plat approval and construction of the units. Staff Recommendation Staff recommends that the Planning Commission forward a positive recommendation on to the City Council. In a memo dated April 19, 2016, Brien Maxfield states that he has no issues with the proposed zone change. Fire Review. In a memo dated April 13, 2016 Shirl White with the Unified Fire Authority states: The proposed zone change does not appear to create any concerns as shown. If fire access can be provided to all structures within the new boundary then I see no issues with the change. Noticing. Notice has been properly issued in the manner outlined in the City and State Codes for amending a zoning map. STAFF RECOMMENDATION Staff recommends that the Planning Commission forward a positive recommendation to the City Council to approve the rezone request by Krisel Travis, representing DR Horton, application MA This recommendation is based on the following findings: 1. That the proposed amendment is consistent with goals, objectives and policies of the City s General Plan; Galena Park Place Zone Change 1 App. MA

3 2. That the proposed amendment is harmonious with the overall character of existing development in the vicinity of the subject property; 3. That the proposed amendment is consistent with the standards of any applicable overlay zone. 4. That the proposed amendment will not adversely affect adjacent property; and 5. That there is adequacy of facilities and services intended to serve the subject property, including but not limited to roadways, parks and recreation facilities, police and fire protection, schools, stormwater drainage systems, water supplies, and waste water and refuse collection. 6. That the subject property is already part of the Galena Townhomes subdivision plat and contains townhome units that have been constructed. MODEL MOTION Sample Motion for Positive Recommendation. I move we forward a positive recommendation to the City Council regarding the rezone request by Krisel Travis, representing DR Horton, application MA , which will change the zoning on the subject property from CC to RM1, based on the findings for approval listed in the staff report dated April 15, List any additional findings, if any.
