3 RESOLUTION NO. 2013/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, APPROVING AMENDMENT #001 TO CONTRACT #JP BETWEEN THE AREAWIDE COUNCIL ON AGING OF BROWARD COUNTY, INC. AND THE CITY OF DEERFIELD BEACH/NORTHEAST FOCAL POINT SENIOR CENTER FOR EMERGENCY HOME ENERGY ASSISTANCE PROGRAM FOR THE ELDERLY TO DECREASE AMOUNT TO $21, WHEREAS, on June 19, 2012, the City Commission approved Contract #JP with the Areawide Council on Aging of Broward County, Inc. (the Council) for Emergency Home Energy Assistance Program for the elderly; and WHEREAS, the contract period is from July 1, 2012 to June 30, 2013; and WHEREAS, the parties wish to amend the contract to decrease the total contract funding from $32, to $21, and decrease the level of services accordingly; and WHEREAS, the City Commission believes that it is in the best interest of the City to amend Contract #JP ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, AS FOLLOWS: Section 1. The above referenced Whereas clauses are true and correct and made a part hereof. Section 2. The City Commission does hereby approve Amendment #001 to Contract #JP with the Council to decrease the amount from $32, to $21, and to decrease the level of services accordingly. The City Manager or his designee is authorized to execute all documents necessary to implement same. 4 THIS AMENDMENT is entered into between the Areawide Council on Aging of Broward County, Inc, hereinafter referred to as the Council, and City of Deerfield Beach, Florida/Northeast Focal Point Senior Center hereinafter referred to as the Contractor, and collectively referred to as the Parties, amends. The purpose of this amendment is to decrease the contract amount by $11, and decrease the level of services accordingly. This amendment changes total contract funding from $32, to $21, Additionally, this amendment: 1) amends Section 4 of the Standard Contract; 2) amends Section 3.1 of Attachment I; 3) revise and replace Attachment III, Exhibit I; and 4) revise and replace Attachment VII, Budget Summary. 1) Paragraph 4 of the Standard Count is hereby amended to read: 4. Contract Amount The Council agrees to pay for contracted services according to the terms and conditions of this contract in an amount not to exceed $21,719.93, or the rate schedule, subject to the availability of funds. Any costs or services paid for under any other contract or from any other source are not eligible for payment under this contract. 2) Paragraph 3.1 of Attachment I is hereby amended to read: 3.1 General Statement of Method of Payment This is a cost reimbursement contract. The Council agrees to pay for contracted services according to the terms and conditions of this contract in an amount not to exceed $21,719.93, subject to the availability of funds. 3) Attachment III, Exhibit I is hereby replaced with the revised Attachment III, Exhibit I. 4) Attachment VII, Budget Summary, is hereby replaced with the revised Attachment VII, Budget Summary.
