Kindly seek clarification from MBSB if you do not understand any part of this document or the general terms stated herein. MBSB Standard Home Financing-i, MBSB Ultimate-i and My First Home Scheme-i are Islamic financing property facilities secured against residential / commercial properties. Profit is calculated based on variable rate. 2. What is the Shariah contract applicable? Bai Bithaman Ajil (BBA) is a contract of sale on a specific asset with deferred payment and on installments basis within an agreed payment period. 3. What do I get from this product? 2 5. What are the fees and charges I have to pay? Stamp Duty As per the Stamp Duty Act 1949 (Revised 1989) Legal & Disbursement Fee Include solicitor fees for financing documentation, registration of charge, land search and bankruptcy search. Processing Fee Residential Properties - Waived Commercial Properties % on approved financing amount Valuation Fee For completed properties only Letter for EPF Withdrawal RM50.00 per request Redemption Statement RM per request Note : With effect from 1st April 2015, 6% of Goods and Services Tax ( GST ) will be imposed on you where applicable. MBSB will notify from time to time if there are any changes. Notice will be given before the new fees and charges take effect (if any). 6. What if I fail to fulfill my obligations? If you have difficulties in meeting your financing obligations, contact us early to discuss alternative payment arrangements. Delay on your part could lead to the following consequences: Late Payment Compensation (Ta widh) You shall be liable to pay MBSB Late Payment Compensation (Ta widh) on any amount overdue as follows: a) if default occurs during the tenure of the facility or any part thereof, at a rate of one per centum (1%) per annum on such overdue installment under the facility or such part thereof or such other method or rate as shall be stipulated by Shariah Advisory Committee of MBSB ( SAC MBSB ) from time to time; and b) if default occurs after the maturity of the facility or any part thereof, at the rate that shall not exceed the prevailing daily overnight Islamic Interbank Money Market Rate (IIMM) on the outstanding balance. Notwithstanding the amount of Late Payment Compensation (Ta widh) charged, it is expressly acknowledged and agreed that the said amount of Late Payment Compensation (Ta widh) shall not be further compounded. Right to set-off MBSB has the right to set-off any credit balance in your account maintained with MBSB against any outstanding balance in your financing facility account. However, it will be made known to you. Legal action MBSB may proceed with legal action if you fail to respond to our reminder notices. Your property may be foreclosed. You will have to bear all costs in relation to the foreclosure. In the event, there is a shortfall after your property is sold, you are responsible to settle the remaining balance. Credit Rating Deterioration Legal action against you may affect your credit rating leading to credit being more difficult or expensive to you. 7. Will I be given Ibra (Rebate)? MBSB will grant Ibra (Rebate), on such amount of the balance Selling Price remaining unpaid by you based on the following situations:- a) For variable rate financing, in the event the amount of profit calculated based on effective profit rate is lower than amount of profit calculated based on the ceiling / contracted profit rate. b) Upon full settlement of the financing facility by you in the following scenarios:- i) Redemption or prepayment of the financing facility. ii) Due to restructuring exercise. iii) In the case of default by you. iv) In the event of termination or cancellation of the financing facility before the expiry date. MBSB shall grant rebate (Ibra ) to you that is calculated in accordance to the following formula: Settlement Amount = Outstanding Selling Price + Installments Due + Late Payment Compensation (Ta widh) + Other Charges Rebate (Ibra ) Rebate (Ibra ) = Deferment Profit Early Settlement Charges (if any) 8. What if I fully settle the financing facility before its maturity? In the event you opt to make an early settlement before the expiry of the facility tenure, you shall pay to MBSB all the actual costs incurred and duly paid by MBSB on your behalf (including but not limited to legal and valuation fees). 9. Do I need any Takaful coverage? The following Takaful policies are required to be taken from our panel of Takaful providers or other Takaful providers of your choice approved by MBSB:- Mortgage Reducing Term Takaful (MRTT) MRTT is a Takaful scheme to cover a customer who is an insured member against death or permanent disability. In the event of any unfortunate circumstances, the MRTT will pay off the outstanding financing facility amount in accordance to the MRTT Table of Benefits. MRTT is compulsory with the following flexibility: Page 2 of 4 Property Financing-i (BBA) Version 3.0

3 For financing amount below RM250K: 100% coverage for full financing tenor; or For financing amount RM250K to RM500K: 70% coverage for a minimum of 10 years; or For financing amount above RM500K: 50% coverage for a minimum 5 years. Fire Takaful Fire Takaful covers damages or destruction due to fire to any property charged to MBSB as collateral. This is a compulsory Takaful to protect the property and help you cope with any costs of rebuilding or repairing the property in the event of fire. 10. What are the major risks? Variable Rate The financing rate is a variable rate and may change according to change(s) in the reference rate (i.e. ECOF-i). An increase in profit rate may result in higher monthly installment or extension of tenure. Exceeding Retirement Age For financing tenure that extends into retirement age, you are obliged to meet the financing payments during your retirement age by considering alternative avenues of payment. 11. Do I need to provide guarantor? Case to case basis depending on your credit assessment by MBSB, you may be required to provide a guarantor. 12. Can I appoint a lawyer who is not listed in MBSB s panel lawyer? Yes, subject to MBSB s approval for such an appointment. However it is not recommended as the lawyer may not be well versed with MBSB s documentation requirement and hence may result in delays. 13. How do I make payment for my financing account? Financing payments can be made at / via:- Any of MBSB s branches nationwide cash or cheque; Any of Bank Simpanan Nasional (BSN) under Giro Service; Maybank2u online Bill Payment Service ( CIMB - online Bill Payment Service ( 14. What do I need to do if there are changes to my contact details? It is important that you inform MBSB of any change(s) in your contact details to ensure that all correspondences reach you in a timely manner. If you have difficulties in making payments, you should contact us earliest possible to discuss alternative payment arrangements. The financing amount and tenure approved by MBSB may be lower than the applied amount, in accordance with MBSB s policies and discretion and shall depend on MBSB s due credit processes and/or your credit profile or creditworthiness. MBSB Standard Home Mortgage-i, MBSB Ultimate-i dan Skim Rumah Pertamaku-i adalah kemudahan pembiayaan hartanah berdasarkan syariah yang dicagar oleh hartanah kediaman dan komersial. Kadar keuntungan dikira berasaskan kadar keuntungan boleh ubah. 2. Apakah kontrak Syariah yang digunapakai? Bai Bithaman Ajil (BBA) adalah kontrak jual beli sesuatu aset secara pembayaran bertangguh dan secara ansuran dalam tempoh pembayaran yang telah dipersetujui. 3. 6 5. Apakah Fi dan Caj yang perlu saya bayar? Duti Setem Seperti terkandung dalam Akta Duti Setem (Semakan 1989). Fi Guaman berkaitan dengan Termasuk yuran guaman untuk dokumentasi pembiayaan, pendaftaran gadaian, dokumentasi pembiayaan dan yuran carian tanah, carian kebankrapan/ muflis dan lain-lain yuran yang berkenaan. pengeluaran Fi Penilaian Hartanah Bagi hartanah yang telah siap dibina sahaja. Fi Pemprosesan Hartanah Kediaman Dikecualikan Hartanah Komersil 0.15% dari jumlah pembiayaan Surat Pengeluaran KWSP RM50.00 setiap permohonan Surat Penebusan RM setiap permohonan Nota :Berkuatkuasa dari 1 haribulan April 2015, Cukai Barang dan Perkhidmatan ( GST ) sebanyak 6% akan dikenakan ke atas anda jika berkenaan. Jika terdapat apa-apa perubahan, MBSB akan memaklumkan dari semasa ke semasa. Notis akan diberikan sebelum fi dan caj yang baru berkuatkuasa (jika ada). 6. Bagaimana sekiranya saya gagal memenuhi syarat yang diperuntukan? Sekiranya anda menghadapi kesulitan membayar bayaran bulanan, sila hubungi pihak MBSB untuk bayaran alternatif. Kelewatan dari pihak anda akan mengakibatkan perkara berikut:- Pampasan Bayaran Lewat (Ta widh) Anda bertanggungjawab membayar kepada MBSB Pampasan Bayaran Lewat (Ta widh) pada mana-mana jumlah tertunggak seperti berikut: a) Jika berlaku tunggakan sepanjang tempoh kemudahan atau mana-mana bahagiannya, pada kadar satu peratus (1%) setahun ke atas ansuran tertunggak di bawah kemudahan tersebut atau mana-mana bahagiannya atau apa-apa kaedah atau kadar lain yang ditetapkan oleh Jawatankuasa Penasihat Syariah MBSB ( JPS MBSB ) dari semasa ke semasa; dan b) Jika berlaku tunggakan selepas tarikh matang kemudahan tersebut atau mana-mana bahagiannya, pada kadar yang tidak melebihi Kadar Semasa Pasaran Wang Antara Bank Islam (IIMM) ke atas baki tertunggak. Walaubagaimanapun jumlah Pampasan Bayaran lewat (Ta widh) tidak akan dikompaun. Hak penolakan MBSB mempunyai hak untuk menolak sebarang baki kredit dalam akaun anda di MBSB terhadap mana-mana baki belum jelas dalam akaun pembiayaan anda. Walaubagaimanapun, ia akan dimaklumkan kepada anda. Tindakan undang-undang MBSB boleh mengambil tindakan undang-undang sekiranya anda gagal untuk memberi respon kepada notis peringatan. Hartanah anda mungkin akan dilelong dan anda perlu menanggung segala kos yang terlibat. Anda juga bertanggungjawab menyelesaikan baki defisit (jika ada) selepas hartanah anda dijual. Penjejasan Penarafan Kredit Tindakan undang-undang terhadap anda mungkin akan menjejaskan penarafan kredit anda, lantas menyebabkan pembiayaan lebih sukar atau mahal untuk anda. 7. Adakah saya akan diberikan Ibra (Rebat)? MBSB akan memberi Ibra (Rebat) ke atas baki amaun Harga Jualan yang masih belum dijelaskan oleh anda berdasarkan situasi berikut:- a) Bagi pembiayaan kadar boleh ubah, sekiranya jumlah keuntungan yang dikira berdasarkan kadar keuntungan efektif adalah lebih rendah daripada jumlah keuntungan yang dikira berdasarkan kadar keuntungan siling / dipersetujui. b) Berdasarkan kepada penyelesaian penuh pembiayaan oleh anda dalam situasi berikut: i) Penebusan atau bayaran lebih pembiayaan. ii) Disebabkan penstrukturan semula pembiayaan. iii) Di dalam kes ingkar oleh anda. iv) Di dalam situasi penamatan atau pembatalan pembiayaan sebelum tarikh luput. Rebat (Ibra ) akan diberikan oleh MBSB berdasarkan formula seperti di bawah: Jumlah Penyelesaian = Baki Harga Jualan + Bayaran Ansuran Tertunggak + Pampasan Bayaran Lewat (Ta widh) + Caj-Caj Lain Rebat (Ibra ) Rebat (Ibra ) = Keuntungan Tertangguh Caj Penyelesaian Awal (jika ada) 8. Bagaimana jika saya membuat penyelesaian awal sebelum tamat tempoh pembiayaan? Sekiranya anda memilih untuk membuat penyelesaian awal sebelum tamat tempoh pembiayaan, anda hendaklah membayar kepada MBSB semua kos yang telah dibayar dengan sewajarnya oleh MBSB bagi pihak (termasuk tetapi tidak terhad kepada perbelanjaan guaman dan penilaian). 7 9. Perlukah saya mengambil perlindungan Takaful? Polisi Takaful berikut perlu diambil daripada panel syarikat Takaful MBSB atau syarikat Takaful pilihan anda yang diluluskan oleh MBSB. Takaful Gadai Janji Berkurangan (MRTT) MRTT adalah Skim Takaful yang memberi perlindungan kepada pelanggan yang dilindungi terhadap kematian atau hilang upaya kekal. Jikalau kes-kes sedemikian berlaku, Takaful akan menjelaskan kesemua jumlah baki yang belum langsai berdasarkan Jadual Faedah MRTT kepada pemegang polisi. MRTT adalah wajib dengan fleksibiliti berikut: Untuk pembiayaan di bawah RM250K: 100% perlindungan untuk sepanjang tempoh pembiayaan; atau Untuk pembiayaan berjumlah RM250K to RM500K: 70% perlindungan untuk 10 tahun; atau Untuk pembiayaan berjumlah RM500K ke atas: 50% perlindungan untuk 5 tahun. Perlindungan Takaful Kebakaran Perlindungan Takaful kebakaran memberi perlindungan kerosakan atau kemusnahan disebabkan kebakaran ke atas hartanah yang dicagarkan kepada MBSB. Ia merupakan Takaful wajib untuk membantu anda dalam menghadapi kos pembinaan dan pembaikian hartanah sekiranya berlaku kebakaran. 10. Apakah risiko yang perlu saya tanggung? Kadar Boleh Ubah: Kadar keuntungan adalah berdasarkan kadar boleh ubah dan mungkin berubah bergantung kepada perubahan mengikut kadar dirujuk (i.e. KDE-i). Peningkatan dalam kadar keuntungan mungkin akan menyebabkan bayaran bulanan yang lebih tinggi atau tempoh pembiayaan yang dipanjangkan. Melebihi Umur Persaraan: Bagi tempoh pembiayaan yang melebihi umur persaraan, pelanggan hendaklah mempertimbangkan kaedah pembayaran alternatif bagi menjelaskan pembayaran pembiayaan semasa umur persaraan. 11. Adakah saya memerlukan penjamin? Tertakluk kepada keadaan dan bergantung kepada penilaian kredit anda oleh MBSB, anda mungkin perlu menyediakan penjamin. 12. Bolehkah saya mencadangkan peguam yang tidak disenaraikan dalam panel peguam MBSB? Ya. Bergantung kepada kelulusan MBSB tetapi tidak disyorkan kerana peguam yang anda pilih mungkin tidak mahir dengan keperluan dokumentasi MBSB dan oleh itu boleh menyebabkan kelewatan. 13. Bagaimanakah caranya untuk saya membuat bayaran pembiayaan? Bayaran pembiayaan boleh dibuat di / melalui:- Mana-mana cawangan MBSB di seluruh negara secara tunai atau cek; Mana-mana cawangan Bank Simpanan Nasional (BSN) di bawah servis Giro; Maybank2u servis bayaran bil secara online ( CIMB - servis bayaran bil secara online ( 14. Apakah yang perlu saya lakukan jika terdapat perubahan mengenai butiran perhubungan saya? Adalah penting untuk anda memaklumkan kepada MBSB sebarang perubahan dalam butiran peribadi anda bagi memastikan semua surat menyurat sampai kepada anda tepat pada masanya. Sila hubungi (Pusat Khidmat Pelanggan) atau lawati cawangan MBSB terdekat untuk mengemas-kini butir-butir peribadi anda. 15. Di mana saya boleh mendapatkan khidmat nasihat dan bantuan? Jika anda menghadapi masalah dalam membuat bayaran, anda perlu menghubungi kami dengan segera untuk membincangkan bayaran alternatif.
