Mobile mergers, cooperative agreements and investment in the mobile telecoms sector Besides the recent wave of mergers, network operators are also increasingly sharing the infrastructure both in fixed (co-investment) and in mobile (radio access network sharing, spectrum sharing or national roaming), as a means to facilitate investments and innovation. In the merger context, infrastructure sharing has been considered as the alternative to concentration. However, network sharing also raises antitrust questions regarding the potential negative effects of such cooperation on competition. Various regulators have assessed network sharing practices and published (or will be publishing) guidelines on this topic. The panel will discuss how infrastructure sharing is developing and how it should be assessed from regulatory and competition law viewpoints, as well as the status of ongoing antitrust investigations at European and national levels. 3 Monday continued IoT and the commercial and legal challenges facing the 5G roll out 5G connectivity and Internet of Things (IoT) are technological developments, which, by progressing in parallel, are going to dramatically change everyday life and business in the next years. 5G connectivity will bring more capacity, lower latency, more mobility and increased reliability, thus enabling plenty of devices to be connected simultaneously with an incredible variety of services and functions. IoT applications and services will reshape the relationships between users and manufacturers; citizens and public services; consumers and markets; and more. To get to that point various issues need to be analysed and arranged in order to achieve success in areas such as incentivising network investments, improving network sharing arrangements and considering new access models. These include: joint ventures; open access and whole-sale only; setting adequate spectrum allocation; taking into account market demand; efficiency needs and competition principles; coordinating new 5G investments cycle with current business plans on 4G; creating the conditions for the European IoT system to be open; innovative and competitive; finding a fair balance for sharing value and revenues among the operators; and integrators and application providers in the IoT world. This session will explore in further detail the challenges ahead of 5G deployment, as well as IoT development. Tech players like Amazon, Google and Facebook are omnipresent, with their services, such as e-commerce, search services and social platforms, used throughout the world. Although not all agree, many legislators argue that, given the market positions of these and other tech companies, a greater degree of regulation should be imposed. This raises the question of whether antitrust, with its focus on the question of whether consumers are worse off, is the appropriate regulatory tool. If further legislation is in fact desirable, this may be required in other areas, for example, in broader areas of communications law, such as telecommunications and media, and also for example in the area of intellectual property, to address issues that have raised concerns. Delegates tax resident in an EU member state are able to recover VAT in accordance with the EU 8th Directive on VAT refund claims. Non-EU residents delegates are able to recover Italian VAT incurred under the EU 13th VAT Directive where their country agrees to take reciprocal measures. Conference sell-outs The IBA places its conferences in venues of a suitable size for each event; however, there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waiting list will operate. The waiting list will function on a first come, first served basis, subject to receiving registered delegate cancellations. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to the Conference without a confirmed place at the event. 7 Cancellation of registration If cancellation is received in writing at the IBA office by Friday 11 May fees will be refunded less a 25 per cent administration charge. Refunds will be made minus any monies owed to the IBA. We regret that no refunds can be made after this date. Registrations received after Friday 11 May will not be eligible for any refund of registration fees. Please note that NO exception will be made to this policy. Should you have difficulties in obtaining your visa and are not able to attend the Conference this cancellation policy will still apply. Upon submission of your completed Conference registration form to the IBA, you are considered registered pending payment. Please note that as soon as your registration is received the cancellation terms and conditions as indicated will apply. Provided you have cancelled your registration to attend an IBA conference in accordance with the terms of the cancellation of registration clause included in the Information section of the relevant conference programme, you must then confirm to us in writing at the IBA office as soon as possible but in no event later than one year (12 calendar months) from the date of any such conference all necessary details to enable any reimbursement owed to you to be paid. We regret that no refunds will be made after the date that is one year (12 calendar months) after the date of the relevant conference. Travel arrangements and visas Participants are responsible for making their own travel arrangements. It is recommended that you check your visa requirements with your local embassy or consulate. We are unable to dispatch visa invitation letters to support your visa application prior to receipt of your registration form and full payment of registration fees. Please apply for your visa in good time. Hotel accommodation The IBA has reserved a limited number of guestrooms for the nights of June inclusive at the Principe di Savoia Hotel. Cancellation and no-show policy Please note that in the event of any cancellations or no-shows, rooms will be charged to the individual guest s credit card given at the time of booking. Cancellations can be made until Thursday 10 May, after this date prepayment will be taken and 100% of the cancellation charges will apply. Please note that any reservation made after Thursday 10 May will be subject to availability and cannot be guaranteed at the special IBA rate. As a limited number of rooms have been blocked at the hotel, availability cannot be guaranteed once the room block is full. Delegates are responsible for making accommodation reservations directly with the hotel and entering into an agreement with the hotel regarding credit card guarantees, cancellation terms and conditions, and room rates (should these differ from the special IBA rate). The IBA cannot accept responsibility for hotel accommodation disputes between a delegate and the hotel. Unauthorised Accommodation Agents It has been brought to our attention that there are multiple companies contacting past attendees, claiming to represent the IBA, offering assistance with registration and hotel bookings. They are operating by cold-calling and spamming companies whose names have appeared on previous List of Participants, Programmes and Sponsorship recognition. The only Accommodation Agent the IBA works with is Judy Lane ICS. Judy Lane ICS do not contact delegates on behalf of the IBA without delegates making initial contact.
