1 Agenda Item No: 13 Wolverhampton City Council OPEN INFORMATION ITEM Committee / Panel PLANNING COMMITTEE Date 31OCTOBER 2006 Originating Service Group(s) PERFORMANCE AND DEVELOPMENT Contact Officer(s)/ JULIE ILLIDGE Telephone Number(s) Title/Subject Matter PLANNING APPEALS 1.0 Purpose of Report 1.1 To provide the Committee with an analysis of planning appeals in respect of decisions of the Council to either refuse planning or advertisement consent or commence enforcement proceedings. 2.0 Planning Appeals Analysis 2.1 The Appendix to this report sets out the details of new planning appeals, ongoing appeals and those which have been determined by the Planning Inspectorate in respect of the decisions of the Council to either refuse planning or advertisement consent or commence enforcement proceedings. 2.2 In relation to the most recent appeal decisions of the Planning Inspectorate i.e. those received since the last meeting of the Committee, a copy of the Planning Inspector s decision letter, which fully explains the reasoning behind the decision, is attached to this report. If necessary, Officers will comment further on particular appeals and appeal decisions at the meeting of the Committee. 3.0 Financial Implications 3.1 Generally, in respect of planning appeals, this report has no specific financial implications for the Council. However, in certain instances, some appeals may involve the Council in special expenditure; this could relate to expenditure involving the appointment of consultants or Counsel to represent or appear on behalf of the Council at Public Inquiries or, exceptionally, if costs are awarded against the Council arising from an allowed planning/enforcement appeal. Land rear of 34 Wood End Road WEDNESFIELD SOUTH Mr R Shackleton (06/0497/FP/R) Erection of 1 four bedroom detached dwelling and double garage Planning Written representations The proposal would be out of character with the established pattern layout and plot size of surrounding dwellings and gardens and is therefore unacceptable. 2. The proposal would result in an unacceptable impact upon the residents of 13 Lewis Grove. 3. Contrary to UDP/SPG Policy. Site at 22 Linden Lea, Finchfield TETTENHALL WIGHTWICK (06/0476/FP/R) First floor rear extension Planning Written representations The proposal would result in a serious and unacceptable loss of amenity for the residents of 24 Linden Lea in terms of an overbearing impact and loss of light/sunlight. 2. The proposal is regarded in planning terms as unsatisfactory rear garden development. 3. The Council considers that it is unsatisfactory in planning terms to allow further dwellings off this private drive until such time as it is brought upto adoptable highways standards. 4. Contrary to UDP/SPG Policy 4 Horsehills Drive Compton Mr and Mrs D Mathauru (06/0666/VV/R) Retrospective removal of condition 3 of planning permission 05/1239/FP/R to allow the insertion of a floor in roof space of previous approved single storey extension.
