In particular, discovery is not regulated nor allowed in in most civil law countries. Conversely, in most common law jurisdictions litigation is not conceivable without a discovery pre-trial procedure. This panel will analyse the possibility and limits for using information or documents obtained in civil or foreign proceedings in domestic criminal cases considering the arguments on the admissibility of the evidence obtained abroad. Someone wrote that what had begun as an ordinary investigation into money laundering quickly turned into something much greater, uncovering a vast and intricate web of political and corporate corruption. By far the largest corruption investigation in Argentine history, the Notebooks case exposed a wide web of illegal activities involving former pubic officials and businessmen. It also lies at the heart of modern crime and, therefore, the detection of crime. With each advance in technology there is a corresponding development in crime that exploits that technology and a reaction by law enforcement to combat that crime. Honest people want to keep their data private and safe from criminals. Criminals want to keep their communications out of reach of law enforcement. Governments want to equip law enforcement with effective tools to address modern technology. Lawyers have to understand both the technology and the rules that surround it. Business Crime Committee overview The Business Crime Committee s primary objective is to discuss, address and advocate on core and recently developing white-collar issues. The Committee s goal is also to promote awareness within the business community and among transactional lawyers of the growing significance of novel criminal defence tactics. The Committee has recently been focusing on the new trends of international cooperation in criminal matters. Other topics covered in recent seminars and conferences include discussions on money laundering issues, cybercrime, internal investigation challenges and strategies and on the new legal framework designed to combat bribery and corrupt practices in international business transactions. Latin American Regional Forum overview The Latin American Regional Forum covers all countries in Latin America as well as Mexico, Puerto Rico and Spanish-speaking areas of the Caribbean. The Forum provides a focus for all activities in the region, organising sessions at IBA conferences, and in particular has been instrumental in ensuring that a Latin American perspective is addressed during relevant special sessions.
