5 a) PRESENTATIONS (DELEGATIONS): Page 2 of 8 Battle River School Division - Hon. Laurie Skori, Chair At the request of the Town of Hardisty Council, Chair and Trustee, Laurie Skori, fielded concerns from Council as it related to our declining student enrollment. She passed along information from The Division in regards to the schools within our county, their enrollment numbers as well as challenges. The Division is not interested in closing schools. The Division and their Superintendent are engaged to looking "outside" of the box to keep schools viable. BRSD passed a policy that they are keeping a minimum of five staff per school. The cost of this added another $1,000/student to AJS. The School Div. felt that this is important to the viability of smaller rural schools and the ability to provide quality education to the students. This provides the ability for new clubs to develop (archery and hockey academy) to attract students. The School Division is looking at reassigning schools by age and grades also which may come into play in the future to also make our smaller rural schools viable. 68/17 MOVED by Councillor Beringer THAT Council accept the report from Hon, Laurie Skori, Battle River School Division, Trustee/Chair as presented. 6 a) REQUESTS FOR DECISION: Page 3 of 8 RFD Awarding of Lease Contract for Office Copier-Printer- Scanner & MICR Printer 72/17 MOVED by Councillor Beringer THAT Council accept the information as presented by administration regarding the awarding of a five yr lease contract for office equipment consisting of one office printer/copier/scanner and one MICR printer for cheque printing purposes to Xpert Office Solutions Inc. who will supply Xerox equipment to proposed spec in the amount of $ quarterly plus a service agreement at a cost per copy for black & white $ and color $ Council directs the CAO to sign lease and service agreement documentation. CARRIED RFD Town of Hardisty AEP Waterworks Inspection Report 73/17 MOVED by Deputy Mayor Lane THAT Council accept the information as presented by Alberta Environment pursuant to their inspection of the Town of Hardisty Waterworks system conducted on February 23, CARRIED RFD Spring Clean-up 74/17 MOVED by Deputy Mayor Lane THAT Council declares April 29th & 30th as Spring Clean-Up Town Wide. Hardisty Regional Transfer site will be open to residents of the Town: Saturday 8:30 a.m. -12:00 (noon) & then 1:00-4:30 p.m. and Sunday 8:30 p.m. 12:00 (noon) and then 1:00-4:30 p.m.. Also, the Town will hand out recycle bags for those residents who wish to clean-up their lawns and flowerbeds. This compost material will be picked up by public works on the Monday following the Town Wide Clean-Up. CARRIED RFD Feb. 14/17 Minutes - Amend something previously adopted 75/17 MOVED by Councillor Beringer THAT Council recommends to amend the February 14th, 2017 Town of Hardisty Regular Minutes to reflect the recorded vote of Councillor Beringer for Motion #46/17 as OPPOSED and Motion #47/17 as OPPOSED pursuant to Robert s Rules of Order 10th Edition Sec 35 and Sec 48 and the Town of Hardisty Procedural Bylaw 1175/11 as amended. 7 a) Page 4 of 8 RFD Health, Safety & Loss Control Ltd. - Hardisty Needs Assessment 76/17 MOVED by Councillor Beringer THAT the Town of Hardisty Council accept the Needs Assessment completed by SDI Group as information to use going forward and develop a work plan for Administration and Public Works to use in determining areas that need immediate attention. As well for this report to be used by FIP and the CAO working committee as a tool for reviewing any possibilities of regionalization of a Safety Plan that could be used by member municipalities. CARRIED RFD Hardisty Continuing Care Residents hosting the "Seniors Olympics" 77/17 MOVED by Councillor Lefebvre That Council approve a donation of $ GST from account to the Hall Rentals account in support of the June 7, 2017, Seniors Olympics event hosted by the Hardisty Continuing Care Residents to assist with hosting this event and program for Seniors. CARRIED RFD ACCPA 2017 Conference 78/17 MOVED by Mayor Miller THAT Council approve to become a member of the Alberta Community Crime Prevention Association for the fee of $125 and send (1) member of Council and solicit to see if any of the other Towns, Villages, or County in Flagstaff or Village of Amisk would like to send a member so that we can get the group rate of $250/pers. DEFEATED RFD Proclaiming April 28th as a National Day of Mourning 79/17 MOVED by Councillor Beringer THAT the Town of Hardisty Council directs the Mayor to declare April 28th, 2017 as a National Day of Mourning a time to remember the 144 lost men and women who died due to workplace injury and illness. 8 a) Page 5 of 8 RFD Proclaiming April 24 - April 30 as Rail Safety Week 80/17 MOVED by Deputy Mayor Lane Whereas Public - Rail Safety Week is to be held across Canada from April 24 to April 30th, 2017; Whereas it is in the public s interest to raise citizens awareness on reducing avoidable accidents, injuries and damage caused by collisions at level crossings or incidents involving trains and citizens; Whereas Operation Lifesaver is a public/private partnership whose aim is to work with the rail industry, governments, police services, the media and other agencies and the public to raise rail safety awareness; Whereas Operation Lifesaver has requested the Town of Hardisty Council adopt this resolution in support of its ongoing effort to save lives and prevent injuries in communities, including our municipality; CARRIED RFD Banking Request for Proposal 81/17 MOVED by Deputy Mayor Lane That Council directs the CAO to inform ATB Financial that we accept their banking proposal as submitted to the Town of Hardisty for financial services and to commence the process to transfer the Town of Hardisty financial business to ATB as it permits (investment maturities) with the main banking transfer to happen by August 1st, CARRIED RFD Land Use Bylaw Steering Committee - Terms of Reference 82/17 MOVED by Deputy Mayor Lane That Council accept the Land Use Bylaw Steering Committee Terms of Reference as presented. Seconded by Councillor Wurz CARRIED Development Proposal from Clean Harbors for Lot 14-16, Blk 1, Pl /17 MOVED by Councillor Beringer THAT Council direct the CAO to engage consultation services from Municipal Planning Services, upon Clean Harbors paying the associated fee of $1000 and permission is granted from the property owner of Lot 14-16, Blk 1, Pl to allow this type of development to occur and for their land to be rezoned accordingly to accommodate this type of development. Municipal Planning Services will provide Council with a proposed Land Use Bylaw amendment and the proposed amendment would provide for a new Land Use District to be created that would allow for this type of development to occur as a discretionary use along with its own development regulations, application requirements and additional regulations. 43 2.3 a) Town of Hardisty REQUEST FOR DECISION April 25 th, 2017 SUBJECT: Workplace Health and Safety Policy #3901 RECOMMENDATION: THAT Council adopt the revised Heath and Safety Policy #3901 for the Town of Hardisty. CAO COMMENTS: Clean and concise document that provides notice to employees and volunteers that the Town of Hardisty is committed to workplace safety. Foreman Comments: To post at our worksites, it is common practice that a policy be one page in length and can be easily displayed. The current Policy, #3901, located in the safety manual is 2 pages in length, repeated itself, and could be shortened. (Current policy #3901 is attached) RECOMMENDATION REPORT/DOCUMENT: Attached X Available KEY ISSUE(S)/CONCEPTS DEFINED: The Health and Safety Needs Assessment completed by SDI mentioned the requirement of a current Policy that is signed by the CAO and posted at all town worksites. When obtaining a SECOR Element 1 States that an employer must have a Health and Safety Policy that is: Signed and dated by the current manager and/or elected official. Signed within the last 3 years. Reviewed annually. All employees must be made aware of the policy. (Training) Be posted publicly. Be included in the health and safety manual. The purpose and goal of the health and safety program is to provide a positive working environment and an injury free workplace for all employees. Management and Supervisors are responsible for: Ensuring hazards are identified and appropriately controlled Creating an environment that promotes active employee participation in health and safety-related activities Ensuring that health and safety-related initiatives are adequately resourced Workers are responsible for: Working safely Ensuring their co-workers are protected and work safely Assisting in the identification of health and safety issues and concerns Participating in activities or programs initiated by the municipality that enhance health and safety Observe all safety regulations, safe work procedures and requirements under the Occupational Health and Safety Act as conditions of their employment. 46 2.3 a) Town of Hardisty Policy 3901 Page 1 Title: Safety Program Policy No: 3901 Approval: Town Council September 23, 2009 Effective Date: January 11, 2006 Reviewed: November 4 th, 2008 August 20, 2009 August 24, 2011 Supersedes Policy No: Policy Statement: It is the policy of the Town of Hardisty to incorporate and enforce safe working conditions. Health and safety will be given primary importance in planning and operating all Town activities in order to protect employees against hardship and suffering caused by industrial injuries and to protect the Town against unnecessary financial burden and reduced efficiency. Management is responsible for the safety and the education of fellow employees. Every employee is entitled to work under the safest possible conditions and to this end, every reasonable effort shall be made to provide for safe and healthy working conditions and to eliminate hazards that may cause injury to workers or damage to property or equipment. Each individual employee is responsible for the success of the health and safety program. A safe and healthy work environment is a goal everyone shares. For that reason, the Occupational Health and Safety Act is an important piece of legislation, which was passed to protect employer, management and workers. The Act provides a framework within which the Town management, supervisors and employees can work together to keep the worksite safe and free from health hazards. The Town shall appoint a Safety Officer who will manage the Town Safety Program as approved by Council, and, as per the Occupational Health and Safety Act. Management and Supervisors shall: 1. Familiarize themselves with the sections of the Occupational Health and Safety Act as it pertains to their worksite; 2. Do everything reasonable to protect the health and safety of themselves and their workers; 3. Ensure workers have the skill and training necessary to do their jobs safely; 4. Inform workers of any hazards which exist at the job site; 5. Ensure workers are aware of their obligations; 6. Investigate and eliminate any danger that exists when a worker refuses to perform a job that would pose an imminent danger to himself or his fellow workers; 7. Ensure only qualified workers will be assigned to do jobs; Policy 3901 Safety Program Page 46 of 62

47 2.3 a) Town of Hardisty Policy 3901 Page 2 8. Notify their Supervisor if an incident occurs which results in, or may have resulted in, an injury to a worker; 9. Prepare Safe Work Procedures for the worksite; 10. Hold regular safety meetings to inform employees of any changes in Act. The Employee shall: 1. Be familiar with all regulations that apply to his or her worksite; 2. Work in a safe manner and be safety conscious on the job; 3. Co-operate with his or her supervisor by following the health and safety rules established for safety; 4. Wear or use personal protective equipment as outlined or provided by the employer; 5. Notify the Safety Supervisor immediately of any safety hazard; 6. Notify the Supervisor or Management if a known hazard is not rectified; 7. If asked to do work that he or she believes poses an imminent danger to himself or others, refuse to do it and: a) immediately notify Supervisor; b) explain his or her reasons; and c) if supervisor does not agree, then contact Management; 8. If a serious accident occurs which results in, or may have resulted in, serious injury to himself or another worker, notify the Supervisor or Management; 9. Cooperate with an Occupational Health and Safety Officer and provide any information requested by him during an investigation. Any contractor to the Town shall observe all safety regulations, safe work procedures and requirements under the Occupational Health and Safety Act as conditions of their contract. CAO COMMENTS: RECOMMENDATION REPORT/DOCUMENT: Attached X Available Nil KEY ISSUE(S)/CONCEPTS DEFINED: Pursuant to Sec. 5.2 of Bylaw 1219/16 this bylaw is to be reviewed prior to approval of the next Capital & Operating Budget of the Town of Hardisty. In budget discussions Council has indicated that the purpose of this bylaw is not warranted going forward and do not wish to proceed with granting of a Municipal Tax Rebate for 2017 tax year. May 29, 2016: After inspecting the assessment roll for the Town of Hardisty and reviewing comments from ratepayers within land adjacent Hardisty Lake and in areas that do not have connections to municipal water and wastewater Council felt the desire to review a municipal tax rebate. At first Council felt that it may be prudent to provide a municipal rebate to ALL RESIDENTIAL ratepayers that are not connected to municipal water & wastewater and who had a dwelling on their land. After this review and the amount of funds required to have this happen it was decided that this could not be achieved for budgetary purposes or for the purpose of creating a fair and equal evaluation as it related to assessed value. THERFORE, it was decided that in order to encourage development on ALL Municipal Residential Land that a ceiling assessment value be adopted WHEREAS, it provided an incentive for landowners to develop their land beyond an assessed value of $500K. The Town of Hardisty currently has imposed a MINIMUM Tax Rate for ALL Residential Properties and it was felt that by imposing a REBATE program it would encourage further development and expansion of residential property in ALL locations of the municipality serviced or un-serviced with municipal water and wastewater. To protect these properties from any undue hardship that may be created from these types of developments where assessment may be increased from rapidly changing markets or markets that are found to be highly desirable. It is important to Council that the amount of tax that these properties be subject to not create an undesirable market for resale purposes also. As a rural, small community with a small assessment base large developments are discouraged from occurring due to Municipal Tax Rates. Therefore to encourage larger residential assessments a rebate will provided to any residential assessment with (2) or less dwelling units but with a minimum (1) will be provided with a frozen assessment value of $500K for any assessment value over this amount. Council also desired that their be terms and conditions to the rebate and these have been provided for within the bylaw. RELEVANT POLICY/PRACTICES/LEGISLATION: Page 48 of 62

CAO COMMENTS: RECOMMENDATION REPORT/DOCUMENT: Attached _X_ Available Nil KEY ISSUE(S)/CONCEPTS DEFINED: 2017 municipal mill rates have been set to coincide with the 2017 Operating & Capital Budget planned revenue and expenditures. The assessment totals for the end of 2016 for the 2017 tax year are as follows: Residential/Farm Land - $72,072,340 Up $6,483,740 10% increase Non Residential - $26,518,580 Up $326,350 1% increase Linear - $1,471,610 Down $72, % decrease Overall the taxable assessment $100,062,530 which is up $6,737,820 which represents an 7.2% increase which is mainly due to increased values in Residential housing built in the late 50 s to mid 70 s. In order to achieve our expected revenue streams for: Single Family Residential/Farm Land $614,007 Proposed Mill Rate of Multi Family Residential $ 17,067 Proposed Mill Rate of Non Residential $381,014 Proposed Mill Rate of Linear $23,394 Proposed Mill Rate of (no change 2015) Minimum Tax proposed increase from $900 to $950. For BOTH Residential/Farm Land & Non Residential. The Alberta School Foundation (ASFF) has increased their required requisition amount from $242,295 to $263,887. 59 2.3 d) TOWN OF HARDISTY BYLAW NO. 1222/17 A BYLAW TO AUTHORIZE THE RATES OF TAXATION TO BE LEVIED AGAINST ASSESSABLE PROPERTY WITHIN THE TOWN OF HARDISTY FOR THE 2017 TAXATION YEAR Definitions This bylaw shall be known as the Tax Rate Bylaw THEREFORE COUNCIL OF THE TOWN OF HARDISTY ENACTS AS FOLLOWS: 1. In this bylaw, the following terms shall have the meanings shown: (a) The following terms have the meanings set out in the Act: Farm land Machinery and equipment Designated manufactured home Manufactured home community (b) Dwelling Unit means: A complete dwelling, a self-contained portion of a dwelling, or a set or suite of rooms which contains sleeping, cooking, living and separated or shared toilet facilities, intended for domestic use, and used or intended to be used permanently or semi-permanently as a residence for one (1) household, and which except for a secondary suite is not separated from direct access to the outside by another separate dwelling unit. (b) Multiple Family Residential property means: all residential property where the total number of dwelling units on the parcel of land, whether contained in a single building or more than one building, exceeds two dwelling units; vacant residential land held for the development of the above uses; and the non-owner occupied residential portion of non-residential property. (c) Non Residential property means: any land and/or building used for a commercial, industrial, or other non-residential purpose or business venture, or any portion of that land and/or building as is used for such purpose or business venture; any linear assessment; and vacant land held for the development of the above uses. 1 P a g e Page 59 of 62
