1 ALLOUEZ VILLAGE BOARD MEETING TUESDAY, AUGUST 1, :30 P.M., ALLOUEZ VILLAGE HALL CALL TO ORDER / ROLL CALL President Rafter called the meeting to order at 6:30 pm. Present: Harris, Genrich, Atwood, Rafter, Dart, Green Also Present: Wieland, Clark, Berndt,, Attorney Gast MODIFY / ADOPT AGENDA Harris / Dart moved to adopt the agenda as modified. Move item #9, Amended Room Tax Cooperation Agreement / Restated Pledge and Security Agreement to #4a, move #14, Appointment of Sandy Juno to Historic Preservation Committee to #4b and #10, change the date of the fundraiser from August 2 to August 27. Motion ANNOUNCEMENTS a. Movie in the Park Rogue One: A Star Wars Story at dusk on August 18 th at Green Isle Park b. If Tombstones Could Talk - Allouez Catholic Cemetery on August 2 nd and 3 rd at 6:30 pm ROOM TAX - AMENDED AND RESTATED COOPERATION AGREEMENT / SECOND AMENDED AND RESTATED PLEDGE AND SECURITY AGREEMENT Allison Swanson, Village of Ashwaubenon Administrator - Gave an overview of the agreements and what they are trying to accomplish o Original Room Tax Agreements date back to 1999 with a couple amendments since then including 2% that goes to the Convention and Visitors Bureau. The new agreements incorporate all amendments and documents since 1999 into one document and give some additional flexibility going into the future. They are asking that all the communities buy back into the original purpose of the Room Tax Agreement which is to reinvest in the Expo Center and the entire complex to continue to spur economic development within our area. This document is re-pledging those dollars through 2029 and beyond until the debt for the new Expo Center is paid off. Attorney Gast - The Cooperation Agreement is meant to bundle some old debt for the Resch Center and KI Convention Center but also to prepare for the funding of the new Exposition Center at the site of the old Brown County Veterans Memorial Arena. - Explained obligations of the Village of Allouez under the agreement. - Recommended the Village Board approve the agreements. Harris / Genrich moved to approve both the amended and restated Cooperation Agreement and the second amended and restated Pledge and Security Agreement. Motion 1
2 PUBLIC APPEARANCES - none APPOINTMENT OF SANDY JUNO TO THE HISTORIC PRESERVATION COMMITTEE Rafter / Dart moved to appoint Sandy Juno to the Historic Preservation Committee. Motion Sandy Juno - is very interested in the history of this area and will do what she can to help preserve it. HILLCREST HOMES PDD EXTENSION CONTINGENT UPON THE PARTIES COMING TO AN AGREEMENT ON REPAIR OF THE SIDEWALK AND GUTTER AND GRASSY AREA (from 06/06/17 and 07/18/17) - Spoke to Dan Doro from Hillcrest. Repairs should be completed by next week, if not the Village can use escrow funds to complete them. - Will report back to the Village Board on August 15 th Green - Would like to see the PDD code tightened up to get projects to completion versus granting extensions and having them hanging out there. No action required. RESOLUTION TO EXTEND ALLOCATION OF STADIUM TAX FUNDS (from 07/18/17) - The original resolution had a sunset date of 7/31/17 and previous discussion was to extend the sunset date to the end of October giving us an opportunity to work with the State. Hopefully they will have a budget approved at that time and we will have a better understanding whether or not this is something that we can accomplish. Dart / Harris moved to adopt Resolution to extend allocation of stadium tax funds. Motion RAZE ORDER PROCEDURES FOR AL-50-2, LOCATED AT 1825 S. WEBSTER AVENUE (from 07/18/17) - Mr. Shah was not able to attend our last meeting, but the direction was to move forward with the paperwork necessary to have a raze order initiated and invite Mr. Shah to come tonight to see if he was able to shed some light on the building and his plans. - Recapped the issues dealt with since 2013 Harris / Dart moved to open for public comment. Motion 2
3 Pravin Shah, owner of 1825 S Webster Avenue - Explained his difficulty with hiring people to do the repairs and getting a loan. Currently a structural engineer is checking the building out to see what needs to be fixed, then piece by piece he will get it fixed and rent it out. Genrich / Harris moved to return to regular order of business. Motion Attorney Gast - Explained his firm was authorized at the last meeting to continue with the raze order process. Therefore, the raze order has been issued, he was personally served and the process is in place. From the date he was served, Mr. Shah has a 30 day window should he choose to file a court action to try to prevent the razing of the structure. - Board can stick to the raze order or afford more time (45 days) to allow Shah to file or show proof of planned repair. Wieland - Placed placard on the door (statutory provision of a raze order) and is the only one that can authorize entrance into the building. Staff will put together and send Shah a letter explaining what would be required to stop the raze order (cost of what needs to be done, proof of financing, detailed timeline) No action required. RESOLUTION , THANKING KENDRA HANSEN FOR HER YEARS OF SERVICE ON THE PLAN COMMISSION Dart / Atwood moved to adopt Resolution thanking Kendra Hansen for her years of service on the Plan Commission. Motion VENDOR PERMIT FOR DOWN SYNDROME ASSOCIATION OF WI GREEN BAY FOR AWARENESS WALK AND ANNUAL FUNDRAISER ON AUGUST 27, 2017 FROM NOON TO 4 PM AT GREEN ISLE PARK Green / Genrich moved to approve vendor permit for Down Syndrome Association for Awareness Walk and Annual Fundraiser on August 27, 2017 from noon to 4 pm at Green Isle Park. Motion WINTER MAINTENANCE AGREEMENT FOR FOX RIVER TRAIL Clark - Brown County Parks Department is planning for winter snow and ice removal operations for this coming winter along the length of the Fox River State Recreational Trail and are requesting financial assistance again this year. Previous agreement was for one year not to exceed $5,267 (actual invoice for 2016/2017 was $1,772.60) and terminated on June 1,
4 Green / Harris moved to approve, per staff recommendation, that we budget up to $5,300 for fiscal year 2018 and pursue a similar agreement with Brown County that we had last year. Motion BROWN COUNTY 200 TH YEAR ANNIVERSARY OPOLY GAME - All Sports Marketing USA, LLC contacted all communities within Brown County to participate in a board game similar to Monopoly that will be created for the 200 th anniversary of Brown County at a cost of $795 per space on the board game. The Village will receive 30 games to do with as they choose, with a suggested retail price of $ Discussion - Where do proceeds go? Genrich / Rafter moved to approve that we participate and allocate the $795 to do so. Motion PUBLIC WORKS COMMITTEE MINUTES DATED JULY 12, 2017 a. No Parking Here to Corner signs for 100 ft on Arrowhead and St. Francis Drive Public Works Committee recommended approval of the No Parking from here to corner of the first 100 ft on the south side of Arrowhead Drive and St. Francis Drive near Webster Avenue to provide a safer intersection. Genrich / Green moved to approve the signs as recommended. Motion APPOINTMENT OF A TRUSTEE TO PUBLIC WORKS COMMITTEE Dart / Harris moved to appoint Trustee Green to the Public Works Committee. Motion SAVE THE VALUABLE HISTORIC PRESERVATION TAX CREDIT Per the League of Wisconsin Municipalities - The Historic Preservation Tax Credit is an economic development success story, but the changes to the credit proposed in the Governor s budget threaten to cripple the credit s usefulness as a great tool to revitalize Wisconsin s communities. The League of Wisconsin Municipalities asks that we contact our Legislators and ask that they reject the changes to the credit proposed in the Governor s budget. Green / Genrich moved to oppose the changes to the credit proposed in the budget. Motion CONSENT AGENDA Genrich / Atwood moved to: 4

Approve of accounts payable dated 07/14/17, 07/20/17 Motion ROOM TAX COLLECTION - ADDRESSING SHORT-TERM HOUSING (from 09/20/16) Harris - Summarized how things stand, how the money gets collected, what our portion is and where we need to go as a part of the Room Tax Commission to continue to do our part. - Looking for a way to collect and enforce room tax for short term housing who are benefitting from things being done with tourism promotion the same as we do for any hotel. - Will work with to put together process and bring back to the Board for review. Discussion: - Staff time required (monitor, administer, enforce) FUTURE AGENDA ITEMS - Look at tightening the PDD process to keep projects from hanging out there. What are others communities doing?
