1 VILLAGE OF PEWAUKEE VILLAGE BOARD MEETING May 1, Call to Order, Pledge of Allegiance, Moment of Silence, and Roll Call President Knutson called the meeting to order at approximately 7:03 p.m. The Pledge of Allegiance was recited, followed by a moment of silence. Roll Call was taken with the following Village Board members present: Trustee Ed Hill, Trustee Bob Rohde, Trustee Heather Gergen, Trustee Cathy Baumann, Trustee Craig Roberts, Trustee Kevin Yonke, and President Knutson. Also Present: Village Administrator, Scott Gosse; Village Attorney, Mark Blum; PD Chief, Jay Iding; PD Sgt., Nate Wright; DPW Director & Engineer, Dan Naze; Village Clerk, Chaz Schumacher. 2. Approval of Minutes of Previous Meeting a. Minutes of the Regular Village Board Meeting April 17, 2018 Trustee Baumann moved, seconded by Trustee Rohde to approve the April 17, 2018 minutes of the Regular Village Board meeting as presented. Motion carried Citizen Comments Dan Deppe 326 Lake Street Mr. Deppe stated he was here in regards to the proposed bike race at the Pewaukee School District campus. He stated concerns that when these events have happened in the past, they have been captive in their home for the duration of the event, normally they would go somewhere else for the day or park somewhere else where they can access open roads. Deppe stated he has lived on Lake Street his whole life and he can remember taking the corner at the bottom of the hill when he was 8 and getting knocked out, he can t imagine a whole group of people safely taking that 90 turn. If even 3 people fell and broke their necks, $1 million insurance is not enough to cover that. Deppe asked if a different loop could be made so it s safer. Linda Deppe 326 Lake Street Mrs. Deppe stated the same concerns as her husband, Dan Deppe, in the all the years she s lived there, she has rarely seen children riding around that corner, and because this would be a race people would not be braking like they should. Deppe stated she is not against bike races, she feels this may not be the safest route. She stated they would be trapped the whole day, chances are there will be nothing of emergency going on but if they are able to come and go, she would like to know how that is going to work. Eric Hill 513 Peters Drive, Waukesha, WI Mr. Hill stated he is here as the organizer of the proposed Bike Race, he handed the Board an informational flyer he had prepared in regards to the event. Hill stated this is the 4 th year the event has been held, previously it was held in the community of Delafield, they have a lot of sponsors in Pewaukee so they asked to have it here to also help support veterans here, across the state, and across the country. The event is through USA Cycling and everyone that is participating has a registered license with USA Cycling, has insurance through them, and also signs documentation of release through them. Hill stated all racers will be over the age of 13, with parent consent for minors, he stated the kids race is on flat ground. Hill stated in regards to the course direction, they will not be going down the steepest hill, they will be running the 1

2 opposite direction of the one-way street. Hill stated the road will opened up to traffic in the direction of the course to provide access to the homes there. In regards to Trustee Baumann s question, Hill stated traffic would be going up the hill, not down it, so it will be a slower turn at the corner. Hill stated this event has been very successful in the past. Laurin Miller 335 Tower Court Mr. Miller stated he would like to make a strong recommendation for there to be no sidewalks installed on Lookout Drive project, based on comments heard from citizens that live there and the recommendation of the majority of the Public Works & Safety Committee to not spend that money to add those sidewalks unnecessarily. Linda Deppe 326 Lake Street Mrs. Deppe stated knowing the route is going up the hill rather than down it casts a different light on the situation and that it would not be as dangerous. 4. Ordinances a. Possible Action on Ordinance No , Ordinance to Amend Sections and of the Municipal Code of the Village of Pewaukee DPW Director & Engineer Naze stated he noticed some time ago that the sidewalk and curb and gutter ordinance had ambiguous and conflicting information, especially when compared to a resolution that was passed in The proposed ordinance revisions have been reviewed four times by the Public Works & Safety Committee, it s brief and concise. There are rules for sidewalks that unless there s 3 rd party damage, the Village is going to take care of repairs, the replacement policy for sidewalks was revised and approved by the Public Works & Safety Committee. Trustee Rohde stated in other communities in the area there has been an effort to pour sidewalks around trees, he looks at a lot of the problems with older sidewalks in the Village is due to tree roots, if for instance a homeowner insists a sidewalk goes around a tree but in say 10 years the roots start to push it up, it was the citizen that requested it, under this ordinance would it be the Village s responsibility for replacing the sidewalk. Naze stated it would be, he stated that in the 2 years that he has been here, the majority of sidewalk repairs has been due to tree roots and repairs done now may have to be redone in 10 or 20 years, it goes with having street trees up against the sidewalk. Rohde asked if there is any language for how far away new trees should be from sidewalks, when planted on the resident s property. Naze stated not that he knows of. Discussion followed. Rohde asked, in regards to costs of sidewalks and gutters to the homeowner, it looks like it could be up to 50% of the costs. Naze stated there is no special assessment for sidewalks, there would be a special charge if it was determined there was 3 rd party damage, curb & gutter is going to similar to what we have historically done, when there is new curb & gutter there is going to be a special assessment for that, in recent history it has been an amount of 50% of the actual costs, not to exceed $500. Naze stated the ordinance is worded so that the special assessment amount will be determined annually by the Board. Naze stated the discussions at Public Works & Safety Committee have asked why not $750, but the Village Board would have to determine what the not to exceed amount would be. Rhode clarified that curb & gutter has a small amount apportioned to the property owner, but that there s absolutely nothing for sidewalks. Naze stated that is the way it has been. Rohde stated that was not true for when he had sidewalks put in, it has been a changing rule. Baumann stated the special assessment used to be just for sidewalks and not the curb and gutter, hearing the $750 amount upsets her because it s not something people can write off their taxes and this community has always been one to pride itself on not having many special assessments. Rohde stated that previously residents were required to 2

3 pay a special assessment and that would pay for almost 50% of the costs of the sidewalks, now the Village takes on the whole costs of the sidewalks, they are only paying for curb and gutter. Rohde stated the resident has a yard that is improving but the burden is shared by all the residents of the Village, he asked for us to keep in mind now, that whenever a sidewalk is being put in, we are all paying for it. Trustee Baumann stated she does not recall a special assessment being charged to property owners on Sussex Street when new curb & gutter were put in, and she doesn t recall this ordinance changing within the last 14 years, she asked for this to be researched. Rohde asked if it is the recommendation of the Public Works & Safety Committee that we stay with the $500 special assessment for curb & gutter and nothing for sidewalks. Naze stated yes, in his experience with special assessments, they are not popular so we have to be careful to keep it a small enough amount that it s acceptable and affordable, if you re going to special assess, you want to do it for a reason and to help subsidize the project, historically the number has been $500, it s up to the Board though. Trustee Hill stated the intent was to have the special assessment amount determined by resolution so that it would not have to be done through ordinance each time. Trustee Hill moved, seconded by Trustee Yonke to approve Ordinance No , an Ordinance to Amend Sections and of the Municipal Code of the Village of Pewaukee. Motion carried Resolutions a. Possible Action on Resolution No , A Resolution Recognizing the Service of Joseph Zompa as a Village Trustee Clerk Schumacher read Resolution No into the record. Trustee Baumann moved, seconded by Trustee Hill to approve Resolution No , a Resolution Recognizing the Service of Joseph Zompa as a Village Trustee, as presented. 6. Old Business None. 7. New Business a. Discussion and Direction Regarding Lookout Drive Road Project Regarding Sidewalk President Knutson stated he sent a request to the Public Works & Safety Committee, it was too late for the April agenda. Knutson asked Dan Naze to have the Public Works & Safety Committee draft a policy for when sidewalks should or should not be considered part of a road project. Currently, the Village does not have a policy or guidelines for when a sidewalk should be installed. Knutson stated he feels there should be a policy adopted so there is a consistent review of when sidewalks are installed. Knutson stated Naze asked him not to put off making a decision on Lookout Drive sidewalks because it is getting late and there s a possibility it wouldn t be done until late September or later and that could be an issue. Trustee Baumann recused herself from this discussion. Trustee Rohde stated given the requests at the Public Works & Safety Committee meetings and the fact that the costs are picked by the Village any time we make a decision on sidewalks it costs us money, approximately 3

4 $40,000 for Lookout Drive, he feels we need to look at the whole policy and make the best decision for the Village and that s to use the money for areas where there s high pedestrian traffic, it doesn t make sense to put sidewalks where there is virtually no traffic. Trustee Yonke stated his agreement with Rohde. Trustee Hill stated that was also the consensus of the Public Works & Safety Committee, that the expense was of little or no benefit. Trustee Gergen stated her agreement with what has been said. Trustee Hill moved, seconded by Trustee Rohde to proceed with the Lookout Drive improvement project but without the installation of sidewalks. President Knutson stated we need to have a policy in place to prevent us from picking winners and losers in the future, as far as who gets sidewalks and who doesn t. Motion carried , Trustee Baumann abstained. b. Discussion and Possible Action on Special Event Permit for Project Echelon Omnium Sponsored by the Pewaukee School District Administrator Gosse stated this is an application for a new event in Pewaukee, the Pewaukee School District Superintendent Cady asked for it to be clarified that the school is sponsoring the event in name only, they are not contributing any funds towards the project. Staff reviewed the event, it s route area, and the proposed use of 1 patrol officer. Due to concerns about access to the cemetery and in order to provide access, the need for a 2 nd patrol officer is being requested. Trustee Hill stated he knows the sponsor for Project Echelon rather well, and he would like to make a record of the fact that he will in no way get a financial benefit, in fact he will be volunteering to help. Hill feels he can stay on the Board and make a decision. Trustee Gergen asked about the music. Eric Hill, applicant for Project Echelon Omnium, stated it will not be amplified, it will be located at the entrance of Pewaukee High School, it will be used for announcements and music. Gergen stated that any music at Pewaukee campus ends up getting amplified down the hill, she asked that if music is being played to please be considerate of people on a Sunday morning and starting it after 9. Discussion followed. Gergen asked if School Street is going to be shut down. Sgt. Wright stated that no it wouldn t be closed and that is why an officer will be posted there, there will be a road closed sign and a barricade. Trustee Rohde asked if there are any recommendations to the neighbors of when there will be gaps in the races so they can access roads. Mr. Hill stated he will be introducing himself to each of the residences and going over the event. Mr. Hill stated the race is contained within itself and about every 1 minute 40 seconds/2 minutes the racers would be coming through, there is a lead and a follower vehicle, there are no stragglers. Trustee Rohde moved, seconded by Trustee Gergen to approve the Special Event Permit as presented for Project Echelon Omnium for their event dated Sunday, August 12, Motion carried 7-0. c. Discussion and Possible Action on Recommendation that the Joint Park & Recreation Department Coordinate and Run 4 th of July Events President Knutson stated it has been requested by Park, Recreation, & Building Services Director, Kelley Woldanski, to have this deferred until the August 7 th Village Board Meeting. Trustee Rohde stated it would be best to go through the event and then have an informed discussion. 4

5 Trustee Rohde moved, seconded by Trustee Gergen to defer item 7c until the August 7, 2018 Village Board Meeting. Motion carried 7-0. d. License Approvals and Vendor Permits 1. Operator Licenses New/Renewals Trustee Baumann moved, seconded by Trustee Hill to approve New Operator Permits for the remainder of the license term ending June 30, 2018, as presented, to: Amber Schlise, Laurel Stofan, and Sharon Jackson. Motion carried 7-0. Trustee Gergen moved, seconded by Trustee Hill to approve the Renewal Operator Permits for the remainder of the license term ending June 30, 2018, as presented, to: Bari Geers and Megan Vasquez. Motion carried Liquor Licenses Class A Cider Only Pewaukee BP Trustee Rohde moved, seconded by Trustee Gergen to approve the Class A Cider Only Liquor License to Pewaukee BP, as presented, for the remainder of the license term ending June 30, Motion carried Temporary Class B / Class B Picnic License VFW Car Show Trustee Gergen moved, seconded by Trustee Hill to approve the Temporary Class B / Class B Picnic License for the VFW Post 9537 Annual Car Show event, held on May 28, 2018, at Pewaukee Kiwanis Village Park. Motion carried 7-0. e. Discussion and Possible Action on Committee Appointments 1. Zoning Board of Appeals 1 Alternate No Action Taken. 2. Public Works & Safety 2 Citizens Trustee Hill moved, seconded by Trustee Gergen to appoint Bill Mertens as a citizen member to the Public Works & Safety Committee for the term ending on April 30, Motion carried 7-0. Trustee Gergen moved, seconded by Trustee Hill to appoint Laurin Miller as a citizen member to the Public Works & Safety Committee for the term ending on April 30, Motion carried Joint Park & Recreation Board 1 Citizen No Action Taken. 4. Water Utility Commission 1 Citizen No Action Taken. 5. Plan Commission 1 Trustee and 1 Citizen Trustee Roberts moved, seconded by Trustee Gergen to appoint Jim Grabowski as a citizen member to the Plan Commission for the term ending on April 30, Motion carried

6 Trustee Baumann moved, seconded by Trustee Hill to appoint Trustee Craig Roberts as the trustee member to the Plan Commission. Motion carried Citizen Comments No Comments Given. 9. Closed Session The Village Board of the Village of Pewaukee will enter into closed session pursuant to Wis. Statute Section 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, specifically to discuss negotiation strategy regarding PPA Collective Bargaining Agreement. Trustee Baumann moved, seconded by Trustee Hill to move into Closed Session at approximately 7:53 p.m. Motion carried on Roll Call Vote, Reconvene Into Open Session Trustee Baumann moved, seconded by Trustee Hill to reconvene into Open Session at approximately 8:44 p.m. Motion carried on Roll Call Vote, Adjournment Trustee Baumann moved, seconded by Trustee Hill to adjourn the May 1, 2018 Regular Village Board Meeting.
