1 ROUND LAKE VILLAGE BOARD OF TRUSTEES MEETING HELD SEPTEMBER 17, 2014 PRESENT: Mayor Dixie Lee Sacks Trustee Dominick DeLorio Trustee Thomas Bergin ALSO PRESENT: Superintend John Stevenson Fred Sievers Debbie Rice Christine Van Patten Trustee Christopher Nellissen Trustee Caroline Woerner Attorney Thomas Peterson Chief Frank Mazza CEO Peter Sheridan Michael Roets Mayor Sacks called the regular meeting of the Village Board to order at 7:00 P.M. The pledge of allegiance was recited. PUBLIC COMMENT PERIOD: There was no one wishing to address the Village Board at this time. REPORTS: Superintendent Stevenson: The Superintendent has been working on getting pricing on the drainage for Rowe Park. A quote from Tholin for $39,500 has been received, still waiting for quotes from Schultz, Malloy and Kubrick Construction companies. The Superintendent wants to get started on this project. The Superintendent is also waiting for quotes on this project Malloy Construction has quoted $3,200 for 2-4 valves per day; this is for a worker and equipment for the replacement of the valves & bolts. This would also include the DPW working along with them on this project. The part-time worker would be working on other things while the rest of the DPW work on the replacement of the valves & bolts. On a good day 5 or 6 replacements could be done per day. This does not include patching or paving of the roads. There was some discussion about waiting until spring to start this project. The carbon steel bolts are rotten, it would cost more money to wait until they failed then replaced them. Trustee Bergin suggested paying for this project out on the parkland funds, then pay back over the next 10 years. Trustee DeLorio stated that this has to be done. It was suggested that the water rate be increased $15 per year. Trustee Woerner asked whither the Village can do the project with a loan from the parkland funds and pay back over the next 10 years. Superintendent Stevenson stated that he wants to do the project ASAP. Mayor Sacks informed the Village Board that we will lose 4 trees along the south side of Rowe Park when the drainage line is installed. The line is going down where the trees are located.

2 Superintendent Stevenson stated that we may be able to work around the trees, but the tree roots may be damaged. The superintendent continued his report. The tree on 8 th Street was taken down today. The crack sealing on Round Lake Road, Morris Road 7 Herlihy Road has been done. Morris road and Herlihy road will be paved. Whitfield and Janes Avenue were patched. At 16 Andrews Avenue, the Galloway drive way, was cut back and a patched to help with a drainage problem. DPW is cleaning up behind the village garage. Trustee Woerner commented that it s the end of the season; he may be able to get some trees at a lower cost. Trustee Nellissen stated that he has free trees behind his house. The superintendent has talked with Lowes about trees. Linda Peterson has helped put in many trees around the Village. Animal Control Officer: On Sunday, September 7 there was a complaint about a dog, a ticket was issued, and the court date is October 8. Fire Chief Mazza : The shared station in Malta is almost finished. An open house is scheduled for Sunday, October 5, from 12 noon to 5 pm. Hose Company President Fred Sievers: Its budget time again, we need to negotiate the contracts with the Village and the Town of Malta and the Village and the Town of Ballston. The Village Board was provided with budgets for the Round Lake Fire Department and the Round Lake Hose Company. This is the third year of a three year contract with the Town of Ballston. Their assessment for fire protection is 68 cents per $1,000 for a total of $74,000. The Town of Malta contract to provide fire protection to Fire Protection District No. 1 on year to year basis beginning January 1, 2015 in the amount of $ 872,200. A similar contract will be awarded to the Malta Ridge Volunteer Fire Company. RESOLUTION # 60 OF 2014 BE IT RESOLVED that the Round Lake Hose company and the Round Lake Fire Department are hereby submitting a proposal for furnishing fire protection to Fire Protection District No. 1 of the Town of Malta in a year to year contract beginning January 1, 2015, in the amount of $872,200.

3 Mr. Sievers stated that Mayor Sacks and Chief Mazza have work together on the Fire Department budget so that they have been able to purchase new equipment, pay cash for the vehicles and will be debt free. Code Enforcement Officer: Mr. Sheridan informed the Board that a permit has been issued for an addition to the cell tower. Everything has been quiet. A ticket was issued for the chickens; the judge did not accept the ticket without an affidavit. A new ticket will be issued. OLD BUSINESS Zoning Revisions: There is a workshop scheduled for Monday, September Albany Avenue: Mr. Peterson stated that he has not heard anything from anyone about an Article 78 for this issue. Victorian Landings: Mayor Sacks and Mr. Peterson met with George Amedore and John Bossalini this morning. Mr. Amedore has agreed to a three year letter of credit for the connection to the Village water system. Mr. Peterson stated that if the Department of Health requires the Village to relocate the water tap there would be funding available. RESOLUTION # 61 OF 2014 WHEREAS for the reason set forth in the draft agreement between Farone-Amedore, LLC and the Village of Round Lake; and upon the recommendation of the Village Attorney; it is hereby RESOLVED that Mayor Sacks is authorized and directed to enter into an agreement with Farone- Amedore, LLC in substantially the form annexed hereto, whereby Farone-Amedore, LLC may connect to the Village water supply at the location previously approved, but shall obtain an irrevocable letter of credit to secure its promise to move said water connection in the event of Village treatment of its water supply under certain circumstance within the next three years. Village Drainage: The Village Board and the Superintendent have discussed the drainage for Rowe Park. The Superintendent is still awaiting quotes from other contractors. This project needs to get underway as soon as possible. Some discussion continued.

4 RESOLUTION # 62 OF 2014 BE IT RESOLVED that the Round Lake Village Board of Trustees will allow Superintendent Stevenson to begin the Rowe Park drainage is he can provide two other quotes for this project. RESOLVED by Trustee Bergin, SECONDED by Trustee Woerner. NEW BUSINESS Comprehensive Plan: Trustee Bergin informed the Village Board that the subcommittee for the review of the Comprehensive Plan met to look at the plan. They have some questions; 1. Is there something specific the Village Board wants addressed? 2. The plan is at least 15 years old, it needs to be updated, 3. Some of the suggestions/concerns in the plan were never completed. Mayor Sacks commented that the Comprehensive Plan should be updated every 10 years. The suggestions/concerns need to be reviewed. Trustee Bergin commented that the Village Board may feel that a professional may needed to update, which is costly. We need a rational plan for the Village. The subcommittee will review the plan and make suggestions to the Village Board. CORRESONDENCE: Nothing for this meeting. APPROVAL OF MINUTES: MOTION by Trustee Nellissen to approve the minutes of the September 3, 2014 Village Board of Trustees meeting, SECONDED by Trustee DeLorio. UNAMOUSLY APPROVED MOTION by Trustee Nellissen to approve the minutes of the special meeting of the Village Board held September 10, 2014, SECONDED by Trustee Woerner. UNAMOUSLY APPROVED VILLAGE ATTORNEY: Nothing more for this meeting. MAYOR Mayor Sacks stated that the office received a call from NYSE&G about a street light on Janes Avenue. A village resident has asked for the street light to be turned off, NYSE&G has offered to black out the side of the light fixture that is next to the house. Trustee Woerner asked if they could turn the light fixture to the other side of the pole. Some discussion continued. The Trustees would not vote on this matter.

5 VILLAGE TRUSTEES Trustee DeLorio commented that there was a brief meeting for the parking committee. It was decided that they would make brief laws then the Village Board would be authorized to make amendments to the laws. Mayor Sacks commented that if there is an event in the Auditorium, there needs to be parking spaces available for people attending the shows. Trustee Woerner stated that Senator Tonko committee has started to work on Exit 11A draft proposal. APPROVAL OF ABSTRACT RESOLUTION # 63 OF 2014 BE IT RESOLVED that the Round Lake Village Board of Trustees authorize payment of the following abstracts: Abstract # 812 in the amount of $17, General Fund, $1, Water Fund, $ Sewer Fund for a total of $18, Abstract #911 in the amount of $27, General Fund, $ Water Fund and $ Sewer Fund for a total of $28, PUBLIC COMMENT PERIOD Michael Roets asked if and when the double poles are going to be removed. Trustee Nellissen stated that the utility companies don t want to remove them. They said that the last company to remove the wires from the pole has to remove the pole. The cable and telephone wires are still on the old poles. Some discussion continued. MOTION by Trustee Bergin to adjourn the meeting at 8:12 P.M. MEETING ADJOURNED Respectfully submitted, Lois J.
