Doug Nadorozny Chief Administrative Officer Application: To amend By-law Z being the City of Greater Sudbury Zoning By-law from "RU", Rural to "", Seasonal Limited Service (4) in order to permit a lot addition and to avoid a split zoning. Proposal: To amend By-law Z being the City of Greater Sudbury Zoning By-law from "RU", Rural to "", Seasonal Limited Service (4) to permit the addition of an approximately 0.75 hectare (1.85 acre) parcel to the abutting property owner s parcel. A condition of the consent approval, file #B165/2011, includes that the lands be rezoned to the same as the abutting lands.
2 Official Plan Conformity: The subject property is located at the boundary of the Mining/Mineral Reserve and Rural designations in the Official Plan. Section 20.9 of the Official Plan indicates that in interpreting the Plan that boundary designations on the maps are general guidelines only, and that minor adjustments to the Plan, without formal amendment, through the passing of by-laws are permitted provided the general purpose and intent of the Plan is maintained. Planning staff are satisfied that an Official Plan amendment is not required in order to permit the lot addition and associated rezoning application. Site Description & Surrounding Land Uses: The subject property is located on the south side of Fairbank Road North (private), north of Little Fairbank Lake and to the east of 453 Fairbank Road North. The subject site is well forested and is bounded by lands zoned "", Seasonal Limited Service (4) to the west and "RU", Rural to the east. Departmental & Agency Comments: Development Engineering This site is not currently serviced with municipal water and sanitary sewer. We have no objection to changing the zoning classification from "RU", Rural to "", Seasonal Limited Service Special to permit a lot addition and to avoid a split zoning. Transportation Engineering Roads No comments. Traffic and Transportation No comments. Operations No comments. Public Consultation: Given the minor nature of this application, a neighbourhood meeting was not recommended. As of the date of this report, no phone calls or letters regarding this proposal have been received by the Planning Services Division. Planning Considerations: Zoning By-law Conformity The subject lands are to be rezoned from from "RU", Rural to "", Seasonal Limited Service (4). The
3 development on the existing lot that the rezoned lands will be added to will remain consistent with the Zoning By-law standards for "", Seasonal Limited Service (4). Summary The proposed rezoning conforms to the Official Plan. No conditions other than a registered survey of the lands to be rezoned are necessary to address the issues associated with the proposed lot addition. This application for "", Seasonal Limited Service (4) zoning is appropriate at this location and the Planning Services Division recommends that the application to amend By-law Z be approved.
