1 IMPORTANT NOTICE TRANSITION OF MUDHARABAH DEPOSIT ACCOUNTS 9 th April 2014 Dear Valued Customers, Pursuant to the Islamic Financial Services Act (IFSA), 2013, we will be converting your Mudharabah General Investment Account-i (GIA) / Special Investment Account-i (SIA) into Fixed Term Account-i (FTA-i), which uses the Shariah concept of Tawarruq. The Mudharabah Current Account/Saving Account (CASA) will be converted into Wadiah CASA. The conversion exercise will take effect on 1 st May However, if you do not wish for your account(s) to be converted, kindly contact us or walk in to home branch within 21 days from the date of this notice. If no feedback received within the stipulated period, you hereby agree with this conversion and authorise the Bank to perform all actions and processes related to the conversion. 2 PELAN PERTUKARAN DEPOSIT ISLAM SOALAN-SOALAN LAZIM Pelanggan yang Dihormati; Selaras dengan Akta Perkhidmatan Kewangan Islam (APKI) 2013, berikut merupakan soalan lazim untuk pemahaman dan bimbingan lanjut berkenaan dengan proses pertukaran ini. Apakah yang dimaksudkan dengan APKI 2013? - Akta Perkhidmatan Kewangan Islam (APKI), 2013 adalah akta yang menyediakan peruntukan untuk pengawalseliaan dan pengawasan seluruh institusi perbankan Islam untuk menggalakkan kestabilan kewangan dan pematuhan terhadap Syariah dan juga bagi perkara yang berkaitan, berbangkit atau sampingan. - Akta ini memperkenalkan dua klasifikasi utama bagi produk untuk penerimaan wang daripada pelanggan oleh bankbank Islam kepada sama ada deposit Islam atau akaun pelaburan - Kesemua bank-bank Islam akan memulakan proses pertukaran untuk mengklasifikasikan semula deposit Islam sebagaimana yang telah ditakrifkan di bawah APKI Apakah produk yang terlibat di dalam pertukaran ini? Produk BMMB yang terlibat di dalam pertukaran ini adalah produk yang berasaskan kontrak Mudharabah, seperti: - Akaun Pelaburan Am Mudharabah-i (APA) - Akaun Pelaburan Khas Mudharabah-i (APK) - Akaun Simpanan Mudharabah-i (OneReach) - Akaun Semasa Mudharabah-i (OneReach) - Akaun Simpanan Mudharabah-i (BeeStar) 3. Apakah produk yang tidak terlibat di dalam proses pertukaran ini? - Akaun Semasa Wadiah-i - Akaun Simpanan Wadiah-i 4. Bilakah pertukaran ini akan dikuatkuasakan oleh BMMB? Pada 1 Mei Bagaimanakah kesan proses pertukaran ini kepada saya? - Sekiranya anda seorang pemegang akaun APA/APK Mudharabah, akaun anda akan ditukarkan kepada Akaun Berjangka Tetap-i (ABT-i), produk deposit berasaskan Tawarruq oleh BMMB. - Sekiranya akaun Mudharabah anda adalah sama ada Akaun Simpanan/Akaun Semasa (ASAS), akaun anda akan ditukarkan kepada produk deposit berasaskan Wadi ah. - Tiada yuran atau caj yang akan ditanggung oleh pelanggan bagi proses pertukaran ini. - Tempoh notis adalah 21 hari bermula dari 9 April 2014, selepas itu akaun pelanggan akan ditukarkan secara automatik. 3 6. Apakah yang dimaksudkan dengan Mudharabah, Tawarruq and Wadi ah Yad Dhamanah? Ia adalah kontrak Syariah yang digunakan bagi produk pelaburan dan deposit oleh bank-bank Islam. Definisinya adalah seperti berikut: Mudharabah Tawarruq Wadi ah Kontrak di antara dua pihak bagi menjalankan sesuatu usaha niaga. Ia melibatkan rabbul mal selaku pelabur yang menyediakan modal, dan mudarib selaku pengusaha yang menjalankan usaha niaga tersebut. Sebarang keuntungan yang terhasil daripada usahasama akan dikongsi antara pelabur dengan pengusaha berdasarkan syarat dan nisbah yang dipersetujui, manakala kerugian akan ditanggung sepenuhnya oleh pelabur. Satu mu'amalah dengan dua peringkat urus niaga. Pertama, pembelian aset secara kredit daripada penjual, dan kedua, pembeli akan menjual aset tersebut secara tunai kepada pihak ketiga. Satu mekanisma yang membolehkan seseorang untuk mengamanahkan asetnya kepada orang lain bagi tujuan penyimpanan. 7. Adakah deposit saya dilindungi oleh PIDM? Ya, deposit Islam di bawah APKI layak mendapat perlindungan PIDM (tertakluk kepada terma dan syarat PIDM). 8. Bagi ABT-i, siapa yang akan menanggung kos transaksi komoditi? Pihak Bank yang akan menanggung kos yang berkaitan dengan transaksi ini. 9. Apakah kebaikan ABT-i? - Kadar Keuntungan ditentukan terlebih dahulu. - Tidak seperti Mudharabah APA/APK, (di mana ia adalah akaun pelaburan perkongsian keuntungan), sekiranya ada kerugian, ianya tidak akan ditanggung oleh pelanggan. 10. Bagaimana sekiranya saya tidak bersetuju untuk melakukan pertukaran tersebut? - Bagi pelanggan APA/APK, pelanggan mestilah hadirkan diri ke cawangan utama dan mengeluarkan deposit mereka dalam masa 21 hari tempoh notis. - Bagi pelanggan ASAS, pelanggan mestilah hadirkan diri ke mana-mana cawangan BMMB bagi penutupan akaun dalam masa 21 hari tempoh notis. What is IFSA 2013? - Islamic Financial Services Act (IFSA), 2013 is an Act that provides the regulation and supervision of Islamic financial institutions to promote financial stability and compliance with Shariah and also for any related, consequential or incidental matters. - The Act introduces two major classifications of products for the acceptance of money from customers by Islamic banks into either Islamic deposits or investment accounts. - All Islamic banks will embark on conversion exercise to reclassify Islamic deposits as defined under the IFSA What are the BMMB products involved in this conversion? The BMMB products affected for conversion are those with Mudharabah contracts as follows : - Mudharabah General Investment Account-i (GIA); - Mudharabah Special Investment Account-i (SIA); - Mudharabah Saving Account-i (OneReach); - Mudharabah Current Account-i (OneReach); and - Mudharabah Savings Account (BeeStar-i) 3. What products are not affected in this conversion? - Wadiah Current Account-i - Wadiah Savings Account-i 4. When will this conversion exercise for BMMB takes effect? On 1 st May How will this conversion exercise affect me? - If you are a Mudharabah GIA/SIA account holder, your account will be converted into Fixed Term Account-i (FTA-i), a Tawarruq-based deposit product by BMMB. - If your Mudharabah account is either from Current Account/Savings Account (CASA), they will be converted into Wadi ah-based deposit products. - No fees or charges shall be borne by the customer for the conversion exercise. - There will be a 21-day notice period starting from 9 April 2014, after which customers account will be automatically converted. 5 6. What are Mudharabah, Tawarruq and Wadi ah Yad Dhamanah? These are Shariah contracts applied for the investment and deposits products of Islamic banks. The definitions are as follows: Mudharabah Tawarruq Wadi ah a contract between two parties to conduct a particular joint venture. It involves the rabbul mal as investor who provides the capital, and the mudarib as entrepreneur who manages the joint venture. Any profits generated from the joint venture will be shared between the investor and the entrepreneur based on the agreed terms and ratio, whereas any losses will be solely borne by the investor. a mu`amalah with two stages of transactions. At the first stage,the buyer will purchase an asset on credit from the original seller, and at the second stage, the buyer will then sell the asset on cash basis to a third party. a mechanism that enables a person to entrust his asset to another person for the purpose of safekeeping. 7. Would my deposits be protected by PIDM? Yes, Islamic deposit under IFSA will remain eligible for PIDM protection (subject to PIDM s terms and conditions). 8. For FTA-i, who bears the cost of this commodity transaction? The Bank will bear all costs related to this transaction. 9. What are the benefits of FTA-i? - Profit Rate is determined upfront. - Unlike Mudharabah GIA/SIA, (which is a profit sharing investment account), losses, if any, will not be borne by the customer. 10. What if I do not agree to convert? - For GIA/SIA customers, the customers must visit the home branch and uplift their deposits within the 21 days notice period. - For CASA customers, the customers must visit any BMMB branches for closure of account within the 21 days notice period.
