I/We have examined the details and have carefully noted the conditions of contract and the specification with all the stipulations of which I/We agree to comply with. I/We further agree that I/We will not withdraw this tender either in full or in part during the time that will be required for intimation of the acceptance or non acceptance of the tender being given to me/us or until expiry of a period of three months from the date of receipt hereof and if I/We do so withdraw the tender then I am/we are liable to forfeit the tender deposit. I/We hereby undertake and agree to forward within fourteen days after the notifications of the acceptance by the CMWSS Board of this tender, securities to the value equivalent to 15,000/- for 6000 litres and 9000 litres capacity tanker lorries or such other amount as may be demanded as a guarantee for the due fulfillment of my/our cost the agreement attached within fourteen days after notification of acceptance of this tender. I/We further agree that the acceptance of this tender shall result in a valid and concluded contract binding on me/us the terms whereof shall be taken to be those mentioned in the form of agreement here to annexed not withstanding the non execution of the said agreement. I/We further agree that in the event of my/our failing to deposit securities mentioned above or to execute the agreement within the period of fourteen days before referred to for the sum of 10,000/- deposited with the tender shall be forfeited to the CMWSS Board and the Managing Director, CMWSS Board shall be entitled to cancel the contract which shall have been explained by virtue of the said acceptance and there upon arranged for any other person or persons to undertake the work herein before mentioned and I/We agree to be liable irrespective of the forfeiture aforesaid for all damages, losses, charges and expenses arising from or by reason of such failure and arrangement. Tenderers intending to quote more number of vehicles may use a separate sheet to quote and the same is to be enclosed with the tender 2. EMD : 10,000/- (per vehicle) VALIDITY OF TENDER : 90 Days TENDER SCHEDULE FOR HIRING OF WATER TANKER LORRIES OF 9000 LITRES AND 6000 LITRES CAPACITY ON CONTRACT BASIS FOR THREE YEARS Sub: CMWSSB - Hiring of water tanker Lorries of 9000Litres and 6000Litres capacity on contract basis for three years - rates invited. Lowest rate is invited for Hiring of water tanker lorries of 9000Litres and 6000Litres capacity on contract basis for three years as per the specifications given herein as well as confirming to the conditions laid down in the Schedule. The tenderer must furnish requisite EMD either by a Bank Draft (or) Pay Order (or) Bankers cheque payable at Chennai drawn on any Nationalised Bank in favour of the Managing Director, CMWSSB for the requisite amount of EMD. No other form of EMD will be entertained. No relaxation in EMD is contemplated in the tender The tenderer should fill up the Price Schedule and to sign all the pages of Tender Schedule, Price Schedule and Letter of Tender. The tender submitted with the above documents not duly signed shall be treated as non-responsive. I. ELIGIBILITY A. Tanker lorries of capacity 9000litres and 6000litres of year 2004 or later years models satisfying the pollution norms will alone be considered for evaluation in the tender. B. Vehicles fitted with elliptical tank mounted on chassis with pumping arrangement by taking power from main engine by the provision of suitable power take off unit (PTO unit) (i.e without conventional rear engine) will alone be considered. C. The gross weight of the lorry with tanker including 9000litres and 6000litres of water filled therein should not exceed the registered laden weight prescribed in the RC book of that particular vehicle. Tenderers satisfying the above conditions along with those detailed in the tender schedule alone should apply along with the copy of the RC book, Weighment certificate, Road Tax, Insurance certificate. If the tenderer is not owner of any vehicle, he shall participate provided, he furnishes a lease agreement entered with the real owner of the vehicle, along with the bid. There shall be only one bid for one vehicle. II. TERMS & CONDITIONS 1 AWARD OF WO RK ORDER The tender will be evaluated as per the Tamil Nadu Transparency in Tenders Act, 1998 and Tenders Rules The lowest rate quoted by the tenderer will be considered for award of contract. Willingness will be asked from the other participated tenderers. Those who have offered their willing for the accepted rate will be selected in the following order: 1. Vehicles in the descending order of manufacture viz, from 2010 up to Work orders will be issued in favour of bidders owning water tankers registered during 2004 shall be given for one year only and water tanker registered during 2005 shall be given for two years only respectively. However, the tanker owners may be given an option to change the vehicle of later year model for continuation of contract. 3. The Board has full rights to change the Model of the vehicle, if necessary, as and when the requirement arise in case of non-availability of the specified model of vehicles satisfying the other conditions of this contract. 4 2. TANKER a) Closed elliptical water tankers with exact capacity of 9000/6000Litres or with marginal variation on higher side will be considered subject to the condition that the water filled therein should not exceed the permitted laden weight of the vehicle. Lorries with excess capacity than the above will not be accepted. Additional payment will not be made for extra capacity. Tank mounted on the chassis alone will be considered. b) The tenderers should mention the model and year of registration and capacity for each vehicle. Year 2004 and later year model registration alone will be accepted. The registered laden weight of the vehicle should not exceed the guidelines issued by the RTO authorities. c) No air horn shall be fitted in the vehicle. Bulb horn should be provided in the vehicle compulsorily. d) Vehicles confirming to BS IV, BS III, EURO III & EURO II emission norms will be preferable. Updated Emission Check Certificate issued by Tamil Nadu Pollution Control Board should be produced as and when required by the Board. e) There should not be any spillage of water while the vehicle is plying on the road. by providing double lids. Ladder should be provided in the rear side of the tank. f) The tanks should have intermediate 2 nos. of baffle walls for 9000 litres and one number for 6000 litres capacity water tankers. The interior portion of the tank should be neatly painted with foodgrade epoxy paint for drinking water supply. The inspection holes on the top of the tank should have two nos. of watertight lid and there should not be any water leak from the inspection hole while the vehicle is in transit. g) The hired vehicle should be painted with approved blue and yellow stripes on the longitudinal sides as directed. The Work Order No., Area No., Route No. and Slogans to propagate conservation of rain water should be written predominately on the rear and both sides of the tanker. The word ON CONTRACT WITH METRO WATER in English with white colour for one foot height should be mentioned on both sides and in Tamil br id FoÚ thça x gªj C Â at backside and frontside. The tankers that are not following these conditions will be stopped from plying. Side cover plate using sheet metal for a height of minimum 2 feet should be provided on both longitudinal sides below the bottom of the tank in between the front and rear wheels to prevent any pedestrian or cyclist getting trapped inside the vehicle. h) The tankers should be fitted with flow meters at the at the outlet point. 3 CALIBRATION FOR CAPACITY OF WATER TANKER LORRIES The tenderer should calibrate for the tanker capacity with marginal variation as offered in the tender on weight basis. The laden weight with water and the unladen weight shall be weighed at any of the uthorized weighbridge and the weighment certificate issued by the agency shall be produced before issue of work order. However, the total laden weight of the vehicle of 9000litres/6000litres of water shall not be more than the registered laden weight prescribed in the RC Book of the vehicle. Page 4 of 9

5 4 RATE i) The rate should be inclusive of fuel charges, salaries to crew, all incidentals, repairs etc. No other charges will be paid by the Board other than the hire charges quoted. The rate per trip is for conveyance of water from the allotted water distribution stations to the allotted tank number erected at various locations in Chennai City and Adjacent Urban Areas or to destinations authorized by the Engineer in charge of mobile water supply distribution. The approximate average to and fro distance per trip would be 8KM. The rate quoted shall be firm throughout the contract period except for the adjustment in the cost of diesel as mentioned in Clause II below: ii) The cost of diesel per litre prevailing on the third day prior to the due date of opening of tender i.e. on shall be the basis for the hiring charges per trip quoted by the tenderers. For any increase or decrease in cost of diesel announced by the Govt. applicable for Chennai, proportionate increase/decrease in rate per trip will be considered adopting the following price escalation formula. Price adjustment will be effective from the effective date as per the official announcement of price by the Govt. of India, whenever there is increase / decrease in cost of diesel. The following Price adjustment clause applicable for both capacity water tanker lorries (9000ltrs. / 6000 ltrs.) shall be considered. V f = ( 0.85 x P f )x (R x (F 1 -F 0 ) / F 0 ) 5 PUMPING ARRANGEMENT 6 WATER SUPPLY V f - Increase or decrease in the hire charges per trip. The increase / decrease in hire charges shall be effected from the effective date as per the official announcement of price by the Government of India. F 0 - The official retail price per litre of High Speed Diesel (HSD) at the existing consumer pumps of IOC at Chennai on the third day prior to the date of opening of tender. F 1 - The new official retail price per litre of HSD at the existing consumer pumps of IOC at Chennai, as announced by the Government of India. R - Settled Hire charges per trip for each capacity. P f - Percentage of Fuel component has been fixed as 25% for both 9000litres and 6000litres capacity water tanker lorries. CMWSSB will engage water lorries having self driven pumping arrangement by taking power from main engine by providing suitable power take off unit arrangement. i.e without conventional rear engine. A minimum of 10metre PVC hose of size 3 inch dia should be provided with the vehicle to unload water at various locations in Chennai as directed at the rate of 3000 litres in 5 minutes. Tenderers having vehicles of above mentioned special type of pumping arrangements have to furnish a certificate from the manufacturer of the vehicle or from other agency in this regard and this certificate should be enclosed with the tender. Failure to enclose this certificate will be treated as vehicle without self driven pumping arrangement and the tender will be liable for rejection. The drinking water should be unloaded in the allotted tanks erected in the street mentioned in the trip sheets from any of the water distribution stations within the Chennai City. The water lorry will be allowed minimum of 5 trips per day. However, the number of trips shall be increased or decreased as per the requirement at the discretion of Board's official. If the supply is not effected to the allotted tanks, a fine of 1000/- would be levied. Any water tanker levied with the above penalty for more than 3 times, is liable for termination from this contract without any notice and will be black-listed for participation in any other similar tenders of the Board in future. If any water tanker is not able to run minimum 5 trips per day or as ordered by the Board, for any reason or thereof due to the defect in the water tanker frequently in a period of one month, the work order of that particular vehicle would be cancelled. 6 7 OWNERSHIP The tenderer should either own the vehicle or should have a valid agreement entitling him to use the vehicle and enclose acceptable copies of documentary evidence along with the offer and produce original documentary evidence before placement of order by Metro Water. 8 REPLACEMENT OF VEHICLE 9 R.C.BOOK/ PERMIT/ INSURANCE / WEIGHMENT RECEIPT 10 DRIVERS & CLEANERS 11 DISTRIBUTION OF VEHICLE Each transporter shall give a replacement vehicle which will satisfy the tender conditions and to the satisfaction of the competent authority at the time of stopping the vehicle for FC works, repair or due to out of order without any delay. The replacement vehicle thus provided should be of the same or later model as of the vehicle for which the work order was issued. The replacement vehicle will not be allowed to run for operation for more than 30 days and within this time the original vehicle should be produced for operation. If the transporter desires to continue the operation of the replacement vehicle for more than 30 days, he must submit valid agreement entitling him to run the vehicle and enclose copies of documental evidence. If the vehicle is absent consecutively for more than 5 days without any intimation, the work order of the vehicle will be liable for cancellation and forfeiture of Security Deposit without any notice. R.C.Book/Permit/Insurance/Road Tax/Weighment in original and the vehicle should be produced to the Purchase Manager or to his authorised representative to verify the model and other details before issue of work order. Tanker lorry permit /Insurance and fitness certificate should be valid for the entire contract period. The tenderer shall employ the drivers with minimum age of 25 years and maximum age of 55 years holding valid licence to drive heavy vehicles with minimum experience of 3 Years and possessing unblemished record. The documents towards driver s experience, age shall be furnished before issuing the work order. The tenderer should ensure that the drivers employed must have attended the 2 days Refresher Course conducted by the Institute of Road Transport (I.R.T.), Taramani and the certificate issued by the I.R.T. shall be furnished. The original or copy of the driving licence should be always available with the driver. It is the duty of the tenderer to arrange for a standby driver with valid licence satisfying the above conditions in case of the nominated driver not turned up for duty without any stoppage. The tenderer shall employ the cleaner with minimum age of 20 years only. The driver and the cleaner should wear Khaki Uniform as per norms while on duty. Otherwise, a fine of minimum 100/- will be imposed on each occasion and deducted from the transporter s bill. Metrowater Board will give a photo identity card to each of the driver and cleaner which should be displayed on these persons during service to Metrowater. The Board reserves the right to allot any vehicle to any area and to re-allot the area as per the need at any time. In case, if the tenderer refuses to take up the area, the Board reserves the right to remove the vehicle from the contract and the EMD/SD paid will be forfeited. Demand for operating in a particular area, while tendering will result in rejection of the tender, similarly any demand for operating in a particular area will lead to termination of the contract. 12 DISCIPLINE The tenderer is fully responsible to the Board for the perfect discipline and good conduct of the Driver/Cleaner who should function without giving room for any complaint from Board Staff or Public. The tenderer shall change the Driver/Cleaner if ordered to do so by the competent authority and the competent authority's decision in this regard shall be final and shall not be questioned by the tenderer. The cleaner should not drive the vehicle under any circumstances. On inspection, if found, a fine of 500/- will be imposed on two occasions after that liable for cancellation of the work order of the concerned vehicle. Page 6 of 9

7 Tenderer shall not be Board employee or member of his/her family. No Board employee shall directly or indirectly engage himself/herself or permit any member of his/her family to engage in any contract or trade, business or other transaction with CMWSS Board. If it is noticed, the contract would be liable for termination immediately without any notice and disciplinary action will be taken against the employee. The water tanker should be run within the speed limit as specified in the traffic rules. The tanker should not be parked near the filling stations during the nonsupply time unless it is allowed by the Board. Any vehicle found parked near the filling points after completion of day's schedule of work shall be levied a fine of 250/- per day of parking. The engagement of 9000 / 6000 ltrs. capacity water tanker lorry is for transportation and distribution of water from water distribution stations to allotted tanks erected in Chennai City or to destinations authorized by the Engineer in charge of mobile water supply distribution on emergency basis and it is considered as essential service. Any tenderer who initiates or indulge in agitation, non plying of services, or taking part in any strike for any reasons will be liable for cancellation of work order, forfeiture of EMD/SD and forfeiture of payment to the contractors if any without any notice. The contractor or the driver engaged by the contractor should not initiate or indulge in agitation, non plying of services or taking part in strike for any reasons. Such act will be liable for cancellation of work order, forfeiture of EMD/SD and forfeiture of payment due to the contractor, if any, without any notice. 13 DAMAGE The contractor will be responsible for all liabilities due to accidents or damages caused to properties including loss of life of any public or employee of Board or contractor's employee. In case of fatal accidents, the vehicle will be stopped from operation and the work order will be cancelled immediately and forfeited the SD amount without any prejudice to any other action under the law besides the vehicle registration number will be blacklisted and will not be allowed to operate in any area or under any other name for the services of the Board. In case of minor accidents, the vehicle will be stopped from operation for a minimum period of two days for each occasion and if the same vehicle is involved in more than three minor accidents, then also the work order will be cancelled and the vehicle registration number will be blacklisted. The Metrowater Board is not responsible for any legal or criminal action that may arise on the owner or crew of the vehicle contracted for any reason and such action will not bind Metrowater legally. 14 ILLEGAL SUPPLY If illegal supplies are detected by the Departmental officers, the contract is liable for termination besides levying penalty as may be decided by the competent authority. If any illegal supplies are made other than that is authorised by the departmental officer, minimum fine of 1000/- will be levied besides the cancellation of the trips of the particular day for first occurrence and the same is repeated for the second time, the contract is liable for termination and forfeiture of EMD/SD without any notice. If the supply is made to other places than the locations specified in the trip sheets, a fine of 1000/- would be levied and the penalty is levied for more than three times, the work order of the vehicle would be cancelled. 15 LEAKAGE The tanks mounted on the chassis and all connected pipes, pumps, valves, etc. should be free of leaks. Any leak that develops during the contract period should be rectified by the contractor at his cost. The inspection lids and covers should be provided with water tight rubber rings to avoid water spillage. The tanker should at all time be kept neat and clean. The valves provided in the tanker should be water tight and the make of the valves fitted should be of standard one and with ISI mark. The tanker should have internal baffles to avoid water surge (2 nos. of baffle walls for 9000 litres tankers). Failure to comply with the above to the satisfaction of the Department will lead to rejection or termination of the contract. Page 7 of 9

8 The driver or cleaner must be able to regulate the valve during filling the tank of the vehicle at the filling point without wasting the water. If wastage by overflow is noticed, a minimum fine of 100/- and if the person found cleaning the vehicle or taking bath at the filling point or elsewhere, a fine of 150/- will be imposed for each occasion. The inspection cover should be water tight and must always be kept closed unless it is required to be opened. If tank develops leakage, the transporter himself should immediately stop the vehicle. If the tanker is noticed to be in operation with leaky tank, a minimum fine of 500/- will be imposed. Further no trips would be given unless the leaks are rectified. The vehicle will be allowed by the AE/JE, Mobile Water Supply after inspection. If the leak occurs frequently, the tank should be replaced by the transporter otherwise the vehicle will be stopped from operation by cancelling the contract. Any spillage of water while moving on the roads is liable for a minimum penalty of 1000/- for each occasion. 16 PRIVATE WATER SUPPLY The water tanker hired by the Board should not be used by the owner for operating any other private trips even after the completion of regular trips. If noticed, the contract is liable for termination besides levying penalty as may be decided by the competent authority including forfeiture of EMD/SD amount without any intimation or notice. 17 PAYMENT Payment will be made by the concerned Area Engineer for transportation of 9000 / 6000 litres of water, even if the tanker offered by the tenderer is of higher capacity. Payment will be settled on submission of bills at a mutually agreeable interval after execution of agreement. The mode of payment will be through the Electronic Clearances System (ECS) (or) crediting in the account of the respective contractor. 18 INCOME TAX As per Income Tax Act and Rules, Income Tax, Surcharge and Educational Cess, etc. and any other appropriate levy by the Government as may be notified from time to time will be deducted from each bill towards the recovery of Income Tax at source. 19 SERVICE TAX The Service Tax as applicable from time to time will be borne by the contractor. 20 CONTRACT PERIOD 21 SECURITY DEPOSIT 22 CORRUPT OR FRAUDULENT PRACTICES Thirty Six months with effect from the date of issue of first Work Order. However the Board reserves the right to extend or reduce the contract period if warranted. The Board also reserves the right to terminate the contract without any prior intimation. a. The successful tenderer should furnish the required Security Deposit of 15,000/- per vehicle for 6000 and 9000 litres capacity in the prescribed form and execute an agreement in the prescribed format within 14 days from the date of work order. b. The Security Deposit may be remitted in cash in CMWSSB Cash Counter and the original remittance Challan should be furnished before execution of agreement (or) FDR from any Nationalised Banks / Small Savings Scripts pledged in favour of Managing Director, CMWSS Board A/C "name of the owner / transporter" for a period of not less than 48 months. c. On payment of Security Deposit and execution of agreement, the EMD of the successful tenderer will be returned. The EMD of the unsuccessful and invalid tenders will be returned as soon as possible after the final disposal of tenders. The Board requires that tenderers observe the highest standard of ethics during the evaluation and execution of such contracts. In pursuance of this policy, the Board, a)defines, for the purposes of this provision, the terms set forth below as follows, i) corrupt practice means the offering, giving, receiving or soliciting of any thing of value to influence the action of a public official in the evaluation process or in contract execution; and Page 8 of 9

9 ii) fraudulent practice means a misrepresentation of facts in order to influence the evaluation process or the execution of a contract to the detriment of the Board and includes collusive practice among tenderers (prior to or after bid submission) designed to establish bid prices at artificial non-competitive levels and to deprive the Employer of the benefits of free and open competition. b) will reject a proposal for award if it determines that the tenderer recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question. c) will declare a firm or individual ineligible, either indefinitely or for a stated period of time, to be awarded a contract if it at any time determines that the firm has engaged in corrupt of fraudulent practices in competing for, or in executing a contract. INSTRUCTIONS TO TENDERERS : 1. The Metrowater Board means Chennai Metropolitan Water Supply and Sewerage Board. 2. Validity of tender is 90 days 3. Tenderers shall abide by all the subsequent instructions issued by the Board after the award of contract 4. Copy of R.C. Book, Permit, Insurance, Road Tax, Weighment Certificate and Lease agreement, if any, of the vehicle is to be enclosed with the tender. 5. Letter of Tender, Tender Schedule, Terms & Conditions and Price Schedule should be signed and submitted. Any bid received without signature in the above documents and requisite EMD amount per vehicle will be summarily rejected. 6. Conditional Tender will not be considered. Note : The Board reserves the right to accept or reject any tender without assigning any reason thereof. It is open to the Board to alter the conditions of the tender schedule in appropriate cases in the interest of the Board.
