INITIAL INTRODUCTION CHAPTER 0 EXECUTIVE SUMMARY Long An 220 kv substation is proposed to locate on the right of 1A Nation Road on the way from Ho Chi Minh City to Long An at Binh Thanh commune, Thu Thua district, Long An province. Investor of the project is Southern Power Project Management Board (SPPMB) on behalf of Electricity of Viet Nam (EVN) with total investment cost is VND 135,528,000,000. Credit No.CR3680-VN, borrowing from WB SCOPE OF PROJECT - SOCIO-ECONOMIC PROFITS OF PROJECT Long An 220 kv substation is proposed in order to satisfy additional power demand of Long An province in period at industrial park in Ben Luc and Thu Thua district, Tan An town TOTAL INVESTMENT - CAPITAL SOURCE Investor: EVN Management Board: SPPMB Investing capital: VND 135,528,000,000 Capital source: From the remaining budget of "System Efficiency Improvement, Equitization and Renewable" project, credit 3680-VN, borrowing from World Bank (WB) IMPACTS OF THE PROJECT Main impacts of the project include: permanent land acquisition at substation site, pole foundation, temporary impacts in construction phase and relocation of houses and architectural works away from substation area as well as houses below the incoming and outgoing transmission lines according to the Decree No.54/1999/ND-CP of Government on protection of the high voltage network and the Decree No. 1 18/2004/ND-CP of Government on adjustment and complement of the Decree No.54/1999/ ND-CP. + Permanent acquisition area need to be compensated is 35,649m2, in which 8,4% (3005m2) is residential land, 87,4% is paddy field (31144m 2 ), and the remaining is garden (1 500m 2 ). + 3 affected houses in substation area, 10 affected houses in ROW need to be relocated, 59 households are affected farming land and crop. + There is no impact on ethnic minorities. + There is no impact on historical and cultural monuments, temples, pagodas of local residents ELIGIBILITY The cut-off day of this project will be decided by the RC. The cut-off date of this RAP has been fixed at the day of the inventory completion of DMS (30/04/2005) and will be proclaimed by local authorities. 6 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan The objects would be compensated are all Displace Persons (DPs) with legal paper or DPs can prove that they owned, rented, or used these properties before the cut-off day. Households having incomes affected by this project are applied similarly. Households encroach into the project affected area after the cut-off day will not be compensated RESETTLEMENT PRINCIPLES The capital source of this project is remaining budget of "System Efficiency Improvement, Equitization and Renewable" project, credit 3680-VN of World Bank financial resources. The policy applied in RAP of the main project was approved by Vietnam Government and cleared by WB. So, the resettlement principles applied in this project followed the principles in RAP of the main project and obeyed Vietnamese Laws and WB policy on involuntary resettlement (OP 4.12). The Government Decree No 197/2004/ND-CP and resettlement principles of World Bank; resettlement and compensation programs must be designed so as to allow the improvement or at least the maintenance of living standards of DPs as before the project. Both resettlement and land acquisition must be minimized as much as possible. Cash compensation (for houses or structures, farm products,...) shall be paid at the price of Resettlement and Compensation Committee which be approved by Province People's Committee. Resettlement and compensation programs must be carried out in the progress on schedule and have an appropriate monitoring program. 1. Resettlement and compensation programs must be designed so as to allow the improvement or at least the maintenance of living standards of DPs as before the project.. 2. Both resettlement and land acquisition must be minimized as much as possible. 3. Resettlement distance must be minimized in case compensation is land for land type. 4. Cash compensation for house or structures shall be paid at the cost approved by province PC; cash compensation for crop shall be paid at the market - price. 5. Resettlement period must be minimized and the cash of compensation should be provided to DPs before the beginning of the construction activities affecting them, no site clearing if the full compensation have not been done yet. 6. All of PAHs who have land or house located in the project area before cut-off date are entitled receiving compensation according to their lost properties and/or incomes ENTITLEMENT POLICIES Followed the same entitlement policy in RAP of the main project ""System Efficiency Improvement, Equitization and Renewable" project, credit 3680-VN of World Bank financial resources. This policy was approved by Vietnam Government and cleared by WB. Affected land area less than 25% total area is compensated in cast with approved price list. Affected land area equal or more than 25% total area is compenisated by the same quality aind area or cash with approved price lists according to DPs option. Cash compensation for property related to land. Compensation price in this report is defined follow unit cost issued by province, actual compensation cost will be considered by RCC and submitted to PPC for approval. 7 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan Compensation for houses, farm product will be pay in cash SUBSIDY ALLOWANCES Subsidy in cash for DPs as stipulated in the Decree No. 197/CP of GOV and Decree of People's Committee of Long An Province. These allowances are: subsidy for house moving (transport allowance): 03 millions VND/household; relocation subsidy for resettlement (30kg of rice /person/month in six months); subsidy for difficulties of changing occupation to households that have been lost farmland or income (01 million/person); besides PAHs also entitled to timely movement incentive (05 millions/household) PUBLIC PARTICIPATION AND CONSULTATION This RAP is developed in close consultation with local authorities of Long An province and DPs in order to maximize their participation in Resettlement Action Planning and implementing and the socio-economic benefits of DPs to the project. The consultation with DPs in disseminating information and getting their feedback will reduce contradiction and avoid delays in project implementation. Local authorities and DPs were consulted on line alignments, resettlement policy, RAP implementation, grievance mechanism, and monitoring and evaluation on the resoration of DPs livelihoods after the project implementation. Public participation and consultation embraces three steps: Step 1: In investigation process of scale, sphere of influence of Project, investigator will present overview of this project and take soundings from DPs. Step 2: Draft of this RAP report having collected and processed data will be performed People's Committee of Long An province. Step 3: Revised RAP report in accordance with province's agreement will be publicized by Project Management Board (PMB) and local authorities to DPs for reference COMPLAINTS AND GRIEVANCES During the project implementation, DP's complaints will be dealt with according to the Complain and Denounce Law of Vietnam (Decree No 197/CP of Government and Land Law of Vietnam dated November 26th, 2003 ) and will be treated and guided fairly by related agencies. No addition fee will be paid for their complaints. The complaints mechanism is instructed in chapter IX of this RAP INSTITUTIONAL ARRANGEMENT SPPMB is responsible for all of operations of the project including RAP implementation. PMB will be helped and closely cooperated by People's Committees of Long An as well as local relevant institutions SCHEDULE The proposed RAP implementation schedule is as follows: Power Engineering & Consulting Company No.3 - PECC3 6/39

8 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan - Establish resettlement committees at local levels and select an independent monitoring agency, calculating compensative price units, consulting from community would be carried out within 01 month as from beginning of implementing of project (01/12/2004 to 30/12/2004). - Compensation payment for the project construction within 03 months just after PPC has approved compensative price units and progress of project implement (01/05/2005 to 30/06/2005). - Receiving and clearing up complaints and grievances has been executed as from PPC approved compensative price units until end of project. - Monitoring will be carried out throughout project implementation COST ESTIMATE Total compensation costs are estimated about 3,885,937,500 VND. Total estimated cost forthe resettlement program is about 4,917,727,093 VND including expenses for the inventory, supervision, management, internal monitoring, independent monitoring and 10% of estimated cost is for contingency MONITORING AND EVALUATION The implementation of RAP shall be constantly supervised and monitored by PMB. Moreover, an independent consulting agency will be entrusted with independent monitoring tasks. The independent consulting agency selected by PMB will sign a contract just after RAP approval and will begin supervision and monitoring activities from the beginning of the RAP implementation. PROJECT DESCRIPTION - Project name Long An 220kV Substation - Investor Southern Power Project Management Board (SPPMB) - Total investment cost :135,528,000,000 VND - Capital sourc : From the remaining budget of "System Efficiency Improvement, Equitization and Renewable" project, credit 3680-VN, borrowing from World Bank (WB). - Location : Nearby, on the right of 1A nation road from Ho Chi Minh City to Long An at Binh Thanh commune, Thu Thua district, Long An province - Implementation time : one year after construction date TARGET OF THE PROJECT Satisfy additional charge demand of Long An province in development of additional charge of industrial parks which will occur in period at Ben Luc, Thu Thua district and Long An town. - Decrease load of 110 kv Phu Lam, My Tho substation - Decrease capacity loss and electrical energy in system. - Increase reliability and safe in power supply. - Improve quality of electrical energy PROJECT DESCRIPTION - Located at IA national road, on the right from HCMC to Long An province. - Located at Binh Thanh commune - Thu Thua district -Long An province. - Located near 220kV Phu Lam - Cai Lay 2 transmission line. - 4 km from new double circuit 110kV will be constructed in future Technical Specification - Substation scale: 2xl25MVA, one for first phase Number of outgoing bays - Number of outgoing bays from substation is proposed as follow: - 220kV: 02 outgoing bays connect to Phu Lam - Cai Lay 220kV transmission line double circuit, 2 bays for connecting to Phu Lam - Cai Lay 220kV single circuit kV: + 04 outgoing bays connecting to Phu Lam - My Tho transmission line double circuit outgoing bays connecting to current Phu Lam - Ben Luc - Tan An - My Tho transmission line future bays. - 22kV: using as self-source for substation without outgoing bay. Because Long An 220kV substation is located on agricultural and vacant land therefore it is facilitated to set up 220kV and 11 OkV equipments outside. 22kV equipment will be inside one for area saving and easy as well as quickly setting up. AFFECTIONS OF PROJECT Main impacts of the 220 kv Long An substation include: + Permanent land acquisition for building the substation, access road, tower foundations of connecting route. + Temporary impacts in construction phase due to the conductor stringing and the temporary road for material transporting. + Houses, architectural works removing from Right of Way (ROW) according to the Decree No.54/1999/ND-CP of Government on protection of the high voltage network and the Decree No.118/2004/ND-CP of Government on adjustment and complement of the Decree No.54/1999/ ND-CP According to results of socio-economic surveys, the project does not intersect any ethnic minorities or historical and cultural monuments. MEASURES DURING THE DESIGN STAGE Substation location must be considered to appropriate with local planning, avoid intersect historical and cultural monuments, natural reserve areas, resident areas, farming land areas and near transportation roads to facilitate material transportation... Mitigation measures results are as follow: - Substation locates in a planning area and gets agreement with province PC. - Substation locates in paddy field and fruit tree garden, far from public architectural works, historical and cultural monuments therefore avoiding property damage of residents. - Substation locates near 1A national road therefore the material transportation is facilitated. - Connecting route is far from residential areas, near available transportation axes to facilitate the material transportation and operation management as well as minimize land acquisition for temporary road in construction phase. - Route is designed without traversing such as: military area, airaport, bomb and mine warehouse, radio station, historical and cultural monuments, temple and pagoda. Although many measures have been considered to minimize negative impacts but a number of PAHs is could not avoided MEASURES DURING THE CONSTRUCTION STAGE In the construction stage, the construction process and organization will be used and optimized to comply with the current regulations of construction works and minimize the negative impacts: + The construction works will be finished for each item to minimize the duration of temporary land acquisition. The line route clearance for construction works will be minimize as much as possible. The tree chop down and surface clearance in ROW: apply these measures to maximum limit impacts of tree chop down. At high erosion area in ROW, it is necessary to plan type of trees with appropriate height after chopping down to reserve soil. Bomb and mine disarming: implement before surveying, measuring and constructing to avoid endanging human lives and properties as well as negative impacts to area environment. + In addition, the construction works will be carried out after crops harvested in order to minimize the impacts on crops and aquatic products. RESULTS OF EFFORTS + Pernanent acquisition land that needs to be compensated is 35,649 m 2, in which 8.4% (3,005m 2 ) is residential area, 87.4% (31,144m 2 ) is paddy field, and the remaining (1,500m 2 ) is garden. + 3 houses on the substation site, 10 affected houses in ROW need to be relocated, 59 households have affected farming land and affected crop. + The whole project is located in the province's planning area + There is no impact of the project to ethnic minorities. + The project does not traverse any historical and cultural monuments, temples and pagodas of local residents. LEGAL FRAMEWORK The capital source of this project is remaining budget of "System Efficiency Improvement, Equitization and Renewable" project, credit 3680-VN of World Bank financial resources. The policy applied in RAP of the main project was approved by Vietnam Government and cleared by WB. So, the resettlement principles applied in this project followed the principles in RAP of the main project and obeyed Vietnamese Laws and WB policy on involuntary resettlement (OP 4.12) Related laws, decrees and regulations 1. The Land Law of Vietnam dated November 26th, The Government Decree No 197/2004/ND-CP dated December 03rd, 2004 on compensation for the damage when the State recover land. 3. The Circular No 116/2004/TT-BTC dated December 7th, 2004 of the Ministry of Finance, on the instruction for Decree No 197/2004/ND-CP. 4. The Government Decree No 181/CP dated October 29th, 2004 on the implement for the Land Law. 5. The Government Decree No 188/CP dated November 16th, 2004 on the stipulation of the frame for the price frame of land types. 6. Circular No 05/BXD-DT dated February 9th, 1993 of Ministry of Construction on the classification of house types. I. 7. The Government Decree No.54/1999/ND-CP dated July 08th, 1999 on safety protection of high voltage electrical network and Government Decree No.118/2004/ND-CP dated May IOth 2004 on adjustment of Decree No.54/1999/ ND-CP. 8. The statement No377/2003/TT.LS dated October 23th, 2003 of Long An Department of Finance and Price and Department of Nature Resources for property and policies on site clearance on Long An Head Market at Binh Thanh commune, Thu Thua District. In order to carry out RAP according to OP 4.12 of the World Bank, some law provisions and decrees/circulars of Vietnam that not ensure the compensation according to the replacement price or stipulating the provisions that not apply the compensation right and life recovery for the households who have not got valid documents in owning land will be dispensed from the applying by the Vietnam Government based on the approval RAP policies of the project credit 3680-VN Operational Directive for Involuntary Resettlement of the World Bank (OP 4.12) According to the Guidelines of World Bank in Involuntary Resettlement Policy, Displace persons (DPs) will be ensured improving or maintaining the living standards as before having the project. In order to agree with operational directive of the World Bank (OP 4.12), all of- DPs that are listed will be compensated for lost properties. Only persons who settle at the site affected by the proj ect after the statistical cut-off date are not compensated. Too, in order to agree with operational directive of the WB (OP 4.12), houses, structures, trees will be compensated according to substitution cost and farm produces, short-day crops will be compensated according to market costs Essential elimination In order to implement RAP according to OP 4.12 of the WB, some provisions of the law or regulation of Vietnam that not ensure the compensation according to the replacement price or stipulate the provisions that not apply the compensation right for the affected households that * not have valid documents in owning land will be dispensed from the applying. The provisions will be eliminated including: (i) Damage compensated right - Decree 197/CP Article 6 of Decree 197/CP (people that not be compensated for the loss of land) stipulate "People that is recovered land that having one of conditions stipulated at Article 8 of this decree will be compensated for the lost land; conversely, people that occupied land illegally will not be compensated for ones. In case of needing support, the province people's committee will considered at each specific case. Article 18 of Decree 197/CP (The principle of compensation for lost property), section 2, stipulate "Owner of the properties that locate in illegal land as stipulated at Article 8 of this decree will be considered to support or compensate at each specific case by province people's committee". (ii) The land price for calculating compensation According to the regulation of the Vietnamese Government, the compensation price is calculated based on Decree 188/CP, 197/CP, decision 3143/2003/QD-UB and 843/QD-UB, 377/203/TL.LS of Long An PCC. The unit price for land compensation will be submitted to Power Engineering & Consulting Company No.3 - PECC3 13/39

(iii) Compensation principle - Decree 197/CP Article 19 of Decree 197/CP stipulates the compensation solutions for house, structure in different legal situations. In order to ensure meeting the fundamental principles of RAP, waivers of applying Article 19 and Article 20 of Decree 197/CP (in order to allow the households having affected house and structure to be compensated) were approved by Vietnam Government in compensation policies of RAP of the WB's credit project. (iv) Support policy for the people hiring house that is owned by the Government - Decree 197/CP Article 21 of Decree 197/CP stipulate that "DPs are using the houses that be owned by the Government and located in the recovered scope if do not want to continue hiring Government's houses will be entitled to compensation at a rate equal 60% of the cost of the rented house and land". These eliminations are approved by Viet Nam Goverment and WB for main project "System Efficiency Improvement, Equitization and Renewable" credit 3680-VN. Policies applied in this RAP is according to policies of main project DEFINITION AND LIMITATION OF ELIGIBILITY Displace persons (DPs) are all individuals, firms or institution with or without land registration papers who owned, rented or used land, properties and business which are affected by the project: All DPs will be entitled to full compensation for their respective losses as long as they are included in the DP inventory list or can prove that they used the affected items before the cutoff day. The same applies to DPs whose incomes are affected by the project. The cut-off date of this RAP has been fixed at the day of the inventory completion of DMS (30/04/2005) and will be proclaimed by local authorities. Encroachers who settled into the proposed affected areas after the cut-off date will not be considered as DPs therefore having no entitlement to compensation and resettlement. They will be required to demolish their structures and cut the trees or harvest the crops for land clearance to the project. In case necessary, they will be forced to remove out the proposed project area. Nevertheless, they do not have to pay any fine or sanction RESETTLMENT AND COMPENSATION PRINCIPLES These principles obey the Vietnamese laws and World Bank policy on involuntary resettlement. 16 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan - Resettlement and compensation programs must be designed so as to allow the improvement or at least the maintenance DP's living standards as before executing the project. - Both resettlement and land acquisition must be minimized as much as possible. - Resettlement distance must be minimized in case compensation is land-for land type. - Cash compensation for houses/or structures shall be paid at the substitution cost; cash compensation for farm products shall be paid at the market-price. - Resettlement period must be minimized and the cash of compensation should be provided to DPs before the beginning of the construction activities affecting them, no land clearance if the full compensation have not been done yet. - All of DPs having housed and land located in the project area before the cut-off date are entitled receiving compensation for their lost properties and/or income. - Resettlement and compensation plan should be carried out with consultation of DP and approval by local authorities. - Resettlement and compensation plan must provide adequate institutional arrangement to warrant effectively and timely the proper implementation and monitoring. - Financial and technical resources for the resettlement and compensation should be available whenever required. - The living standards and income in the new sites should be maintained or improved more than before having the project. - The regulations in this RAP will be enforceable as an official legal document after be approved by the Government of Vietnam THE VALIDITY OF RIGHT CLAIMING COMPENSATION Legal DPs are all of the affected households and organizations in the list (with or without legal paper of using land) or they can prove owning, hiring or using land and properties relating to land before the cut-off date. In addition, legal DPs are the households and organizations that having affected profession and/or business and income by the project due to temporary or endless recovery of land or different properties too COMPENSATION POLICY Compensation for losses of farm products will be provided at the market prices and calculated on productivity average of the last 3 years (according to Circular 145 of Finance Department). Compensation for houses, structures, trees, and other assets will be provided at the substitution cost. Compensation for land losses less than 30% of total land DP holding will be paid at the substitution cost for lost land area and all other losses in cash. Compensation for land losses equal or more than 30%: cash compensation for acquisition area in case of remaining area still have economic value or for whole area in case of remaining area have no economic value. With partly impacted land: remaining area after acquisition with residential area less than stipulated, this area will be reserved following requirement of land owner but have to follow planning. Compensation price will be defined according to tariffs established by the provinces and based on the Decree 87-CP and the Circular 145 of the Ministry of Finance. Due to the time from preparation to project execution can extend so the estimated price could unsuitable to market price or substitution price at the time executing project. Therefore all of prices will be checked again and adjusted if necessary when beginning RAP implementation. Detail survey report will be carried out as soon as begin the project execution by resettlement committee. The price list will be assessed at the executing time by the Independent Monitoring Agency and Department of Finance of Long An province IMPACT CATEGORIES AND ENTITLEMENT POLICY By the nature of the project as described above and based on the surveys on the DPs, the impact categories could be classified as below: Temporary Impacts All of households have lands, crops, trees or structures locating in the corridor of transmission line, surrounding area of tower foundation, in the temporary service roads which are affected only during the construction period. Category 1: The households have trees, crops, which are damaged temporarily by the project during the construction period due to material transport or pulling electric wire Permanent Impact The households have land and properties that will be recovered permanently for the tower foundations, the substation area, and the permanent roads for construction and maintenance of the project. All of households have houses (totally or partially of house area) or structure, or trees located in corridor of transmission line, which need to be removed, demolished, or cut. Category 2: The households have house or structure which are partially dismantled and the dismantled portion will not affect to the safety of the entire house or structure and will be rebuilt in adjacent areas of the same owner. Impact on clearing away for residential areas will be temporary and it can be reused for restricted puraposes. Category 3: The households have house or structure which is partially or totally dismantled (and the dismantled portion more than 25% house area or lower than 25% but unsafe for house structure), still having land for rebuilt. Category 4: The households have house or structure which are partially or totally dismantled, (and the dismantled portion more than 25% house area or lower than 25% but unsafe for house structure), but does not have spare residential land for reconstructing house. Category 5: The households have agricultural land which will be acquired permanently by the project including the construction of tower foundations, substation and permanent roads for manager and maintenance of the project. Category 6: The households have the job or other services are affected by the project. SUBSIDY ALLOWANCES Besides the direct compensation for the losses, DPs also entitled to subsidies/allowances as stipulated in the Decree No.197/CP of GOV. These allowances are as below: Subsidy for house moving (transport allowance) (Article 27, Decree No.197) This allowance is for DPs who are totally impacted on houses and have to be move to new sites or reorganize to the remaining residential areas: i) PAHs which have to move their houses to new places within the Province will be entitled to an allowance of 1,000,000-3,000,000 VND; ii) PAHs have to relocate out of their Provinces will be entitled to transport allowance of 3,000,000-5,000,000VND Relocation Subsidy for Resettlement (Ar'ticle 28, Decree No.197) This subsidy allowance is a food allowance for DPs who are totally impacted on house and therefore have to reconstruct for their new houses. SOCIO-ECONOMIC SURVEY CHAPTER 4 PROJECT IMPACT This section aims at providing basic data on socio-economic of the inhabitant in the project area. The survey information is on income sources, income, socio-economic situation; impact of resettlement on living standard and income. A lot of information was obtained; however, not all questions were fully responded. Some households could not point out the concrete income source and their revenue. However, with 100% DPs included in the survey, socioeconomic survey on DPs also aims at identifying characteristics of affected areas, assessing the development of population, houses, socio-economic, average income, health care, education, etc... The survey was implemented by Power Investigation and Construction Division - PECC3 in April, Population The substation site is located in an agriculture land having scattered resident with mean population density is 327person/km 2. Household characteristics: - The average number of persons per household is 4.54, a bit higher than that of the whole country (4.97); - Young people (from 0 to 17 years old) present 24.5%; - The productive age group and old people accounts for 74.6% Education Most of DPs are literate. Percent of graduated persons is rather low, mostly is primary level, secondary level and high school. Few people recorded vocational or university level. 23 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan According to Circular 05-BXD/DT dated February 9th, 1993 regarding house classification, houses are divided into 4 classes as below: - 1st class house - 2nd class house - 3rd class house - 4th class house Houses or buildings of 1st and 2nd classes are permanent structures with modem facilities & interior decorations, private toilets & bathroom, separate living room & bedroom. This type of building is usually located in big city or centers and does not appear in the project's area. Buildings of 3rd class are permanent structures with brick wall, reinforced concrete roof, brick floor, conventional facilities & interior decorations. There is no house of this class in the project area. Buildings of 4th class are semi-permanent structures with brick or wooden wall in the rural, tile roof zinc-galvanized iron sheet, brick or cement floor and usually without toilets, the whole project area is belong to this type. ELECTRICITY OF VIETNAM (EVN) AND SPPMB EVN is the project's investor, grants authority to SPPM to plan and carried out all aspects of the project, including RAP implementation. For direct works on the ground, SPPM will be helped and closely coordinated by People's Committees of Long An and related authority agencies. Department of Technology, Science, Environment and Telecommunication, belongs to EVN, is in charge of guiding and accessing the implementation of RAP for the project. In cooperation with PCC, SPPMB will pay for Compensation Unit, provide information and coordinate with relevant government agencies and related agencies of Province/ District as well as between agencies and DPs. PMB will supervise actions of RAP and decisions of Compensation Unit to ensure that the provisions of RAP are respected both in principle and reality. PMB will held and subsidy for these census, inventory and promulgate information; implement internal monitoring and maintain direct relation with representative of communities, affected households and will be the first agency try to solve potential complaints and grievances POWER ENGINEERING & CONSULTANT COMPANY NO.3 (PECC3) PECC3 was assigned to carry out the census, inventory survey and prepare RAP cooperating with SPPMB to organize the public consultation for the project PROVINCIAL PEOPLE'S COMMITTEES (PPC) OF LONG AN + Approving RAP and directly dividing the responsibility to their relevant institutions in RAP implementation. + Approving unit prices of compensation, allowances and establishing appraising committees, compensation committees at all different administrative levels + Approving documents of revoking and transferring land for compensation in the area of province. + Redressing complaints and grievances PROVINCIAL FINANCE AND PRICE DEPARTMENT, CONSTRUCTION DEPARTMENT AND LAND DEPARTMENT Provincial Finance and Price Department is responsible for researching and promulgating compensation price then offers to Provincial People's Committee for approving. At the beginning of the RAP's implementation, Finance and Price Department co-operates with Construction Department, Land Department, Agricultural and Rural Development Department, People's Committee of districts and the independent supervising organization in order to evaluate the applied unit prices in RAP and offer to Provincial People's Committeesfor the adjustment if it is necessary to make sure that the compensation unit costs are at the replacement price at the time of the compensation payment. DISTRICT COMPENSATION COMMITTEES These institutions are mainly responsible for implementing RAP in district area. District compensation committee includes experienced officers in the investigation and gathering information. The District compensation committee is responsible for: + Organizing the survey team to carry out the detail measurement survey (DMS) for affected houses and properties; finalizing DMS and entitlement form for each DP. + Checking compensation unit prices used in RAP, proposing to adjust the unit prices in conformation with market prices/replacement costs (if it is necessary). + Checking the census results of the project's impacts. + Cooperating with Project Management Board, organizing meetings with DPs, local authorities and popularizing entitlement forms to DPs. + Basing on policies and approved processes of RAP, preparing detailed implementation plans (quarterly, semi annual, annual plans) and together with Project Management Board paying the compensation money to DPs in a timely manner. + Settling complaints and grievances of DPs, resolving any difficulties during the project implementation, and pointing out solutions for the outstanding issues to Provincial Compensation Committees and Developers. + District Compensation Committees will be headed by Vice-Chairman of District. The District Compensation Committee includes representatives of: - Price and Finance Department - Department of Natural Resources and Environment - Department of Construction - Chairman of PC of commune, district that have acquisition land - PMB - District Land Office -DPs 5.6. COMMUNE PEOPLE'S COMMITTEES Commune People's Committees are responsible for: - Supplying information for investigation and statistic works and contributing to census and inventory surveys. - Co-operating with District Compensation Committees to organize public meetings, information dissemination, paying the compensation money and allowance to DPs. - Transferring all feedbacks of DPs to District Compensation Committees, resolving complaints at the communal level and proposing solutions for the outstanding problems (if any). - Supporting local inhabitants to overcome all troubles during the construction period and assisting DPs in repairing of affected houses DISPLACE PERSONS. ESTABLISHMENT OF COMPENSATION AND RESETTLEMENT COMMITTEES As soon as the project is approved, Compensation Committee will be established by the People's Committees of Provinces and Districts SELECT THE INDEPENDENT MONITORING AGENCY AND REVIEW UNIT COSTS APPLIED IN RAP At the early time of RAP implementation, SPPMB will select the qualified institutions for this task. The independent monitoring agency will review the RAP implementation and the unit costs applied in RAP, recommend for modifying if it is necessary COMPENSATIONS AND ALLOWANCES CALCULATION At the beginning of the RAP implementation, RCC includes representatives of Finance and Price Department co-operates with Construction Department, Land Department, Agricultural and Rural Development Department, People's Committee of districts and the independent supervising organization in order to evaluate the applied unit prices in RAP SUBMIT TO PROVINCIAL PEOPLE'S COMMITTEES FOR THE COMPENSATION SCHEDULE AND COSTS' APPROVAL The schedule as well as compensation unit costs, allowances and their adjustment (if it is necessary to make sure that the compensation unit costs are at the replacement prices at the time of the compensation payment) will be submitted to Provincial People's Committees for the approval by the Provincial RCC. DETAILED MEASUREMENT SURVEY (DMS) SPPMB and RCC will carry out final DMS. The final result of DMS and entitlements will be disseminated to DPs by communal authorities. SPPMB and RCC will also clearly inform DPs on the adjustment for compensation unit costs PUBLIC ANNOUNCEMENT Just after the project approval, DPs will be fully informed about the project, their rights and the specific policies of this RAP including eligibility provisions, entitlement policies, types and rates of compensation and allowance, adjusted compensation costs (if any), results of DMS, schedules, complaint and grievance rights and mechanism. Such information will be also delivered to the DPs by PMB via meetings and documents leaved at Commune People's Committees or other places that are informed to each DPs. Resettlement pamphlets will also be disseminated to each DPs DEADLINES OF COMPENSATION AND RESETTLEMENT The compensation money for one-part damaged houses will be paid at least three months before starting the constructive execution. The house repairing allowance will be paid together with the compensation money for the one-part damaged house. The moving allowance will be paid at least six months but in just one time. The compensation money for affected land areas and crops will be paid at least one month before starting constructive execution. Affected land tenure households will be clearly cleaned up the required area at least one month before starting constructive execution. The affected part of resettlement-households will be removed at least one month before starting coiistructive execution. In case of not complying, proper organizations will have rights to remove and the allowance for removing will be withdrawn MONITORING This task will be done by SPPMB and the independent monitoring agency through out the whole period of the RAP implementation SCHEDULE One of provisions of this RAP is that RAP should be done in accordance with proposed basic principles. All RAP activities must be satisfactorily completed before World Bank gives a no objection for award of contract for the projects. Any changes to the RAP after investors' clearance will require review by themselves before commencement of construction. Construction works must be logically followed and not preceded the execution of RAP program. In other words, in case of retards in RAP execution, the delay will be reflected in construction works. COMPENSATION COSTS The costs of compensation for houses, land and trees/crops are calculated based on the unit costs are promulgated by People's Committees of Long An province. - The decision No. 3143/2003/QD-UB dated September 12th, 2003 of Long An's PC on price of land types. - The decision No. 842/QD.UB dated September 13th 2003 of Long An's PC on unit compensation cost for property and policies on site clearance of N 2 nation route. - The statement No377/2003/TTLS dated October 23th, 2003 of Long An Department of Finance and Price and Department of Nature Resources for property and policies on site clearance on Long An Head Market at Binh Thanh commune, Thu Thua District. The price list will be reviewed and adjusted by RCC and approved by Long An PC at the beginning of RAP for ensuring that DP will be compensated at the replacement costs for land, houses, tress and market prices for crops according to this RAP policies Compensation for Land According to Article 9 of Decree 197/CP stipulates that "the compensation costs of revoked land shall be prices of land which depends on purapose of usage at the cut-off day, is promulgated by PCC according to Government's regulation; will not compensate with prices of land which will be changed purapose of usage" Compensation for Houses According to article 19 of Decree 197/CP stipulates that house will be compensated as the new house value. In this RAP, compensation for house is calculated at 100% value of the new one Compensation for Annual Crops According to article 24 of Decree 197/CP guides that compensation for annual crops based on the yields of that crop. After checking the unit costs promulgated by Provincial People's Committees (PPC) with local contractors and with DPs (through the public consultation), consultants see that the unit costs promulgated by PPC are the same as the replacement costs and market prices at the time of RAP preparation. In order to comply the project's resettlement policies, at the time of RAP implementation, the relevant departments under the PPCs and the Independent Monitoring Agency will carry out the survey on the costs for land, houses, trees and for crops in the local area. PURAPOSES Consultation with and participation of local authorities and DPs in the preparation and implementation stage of RAP to get their feedbacks can minimize the contradiction and restrain the possibility of project delay, help PMB designing a RAP program with full aspects to meet needs of DPs, therefore, maximize the social economic profits of the project. PuRAPoses of public consultation and participation for RAP are: + Fully sharing information of project scope and its affections. + Community cooperating in RAP designing program. + Gathering information of the needs as well as DP's against policies and proposed works to adjust in execution phase PERIODS OF PUBLIC CONSULTANT Informing community and referencing consist of two periods: First period: During the process of survey on scale, affected scope of project is shown and got feedback from DPs. Second period: Preliminary RAP report with surveyed and calculated data is shown at Long An PC. In the meetings, consultant agencies already fully announced to related parts on scope of project, resettlement policies, impacts of project to nature resources and socio as well as mitigation methods. Draft report after getting approval of province PC will be presented at office of PC of province and communes. Third period: Report already finished following agreement of Province will be public announce to DPs for reference by PMB and local government. Related information such as: compensation standards, policies, allowances, guideline of procedure of grievances, implementation plan of compensation and resettlement... To guarantee PAHs, their representatives and local authorities knowing the RAP's program clearly, the booklets will be prepared summarily but clearly the related information to widely deliver before the paying execution by PMB. Booklets include some below contents: Part 1: - Description of the target and scope of the project - Execution plan of the project - Affection of the project Part 2: - Description of PAHs' rights and responsibilities - Eligibility, compensation policies and subsidization - RAP Implementing plan - Sequence and procedure of grievance - The resettlement responsible organizations Power Engineering & Consulting Company No.3 - PECC3 35/39

The object of this meeting is to define the reasonable compensating levels. These plot measurements, detail inventory and data of affected land will be announced to each DPs and commune authorities for checking and these data will be public announced by PMB and RCC. 38 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan CHAPTER 9 COMPLAINTS AND GRIEVANCES Since the entire resettlement and rehabilitation program is being carried out with the participation of the PAHs, it is expected that no grievance issue will be raised. However, to ensure that the PAHs have avenues for redressing their grievances related to any aspect of compensation and resettlement, detailed procedures of redresses of grievances have been established for the project. The objective is to respond to the complaints of the PAHs speedily and in a transparent manner. The mechanism is designed to be easy, transparent and fair. PAH's complaints and grievances will be dealt with according to customary procedures and according to Vietnamese law. PAH's complaints will be treated fairly and must be facilitated with assistance as they plead their cases. In addition, no fee shall be levied on them and in case legal supports are necessary, this shall be given to them free of charge PROCEDURE OF COMPLAINTS AND GRIEVANCES The sequence of complaints and grievances including: 1) Step 1: If there is any aspect of the resettlement and rehabilitation program from a DP, it will be sent to Commune People's Committee. Commune People's Committee will transfer their contents to Project Management Board (PMB) and cooperate with PMB to resolve it through direct negotiation within 15 days from the day received complaints and grievances. 2) Step 2: If DP is not satisfied with the decision in step 1, the complaints shall be brought and solved at related District authorities with the cooperation of PM3B within 15 days from the date of the receipt of the decision in step 1. 3) Step 3: If the step 2 also fails, complaints will be transferred to provincial authorities. Fifteen-day period is limit time of resolving. 4) Finally, if the DP is still dissatisfied with the decision, he/she can appeal to the Provincial/District People's Court (DPC) in accordance with the "Civil Procedure Act" within 15 days of receiving the decision of the PMB without being charged. DPC decision will be a legal basis for compensation LEGAL GUARANTEES FOR COMPLAINTS AND GRIEVANCES In order to make sure that PMB consider PAH's complaints and a fair settlement of litigation cases, negotiations will be observed by PAH's witnesses. 39 Electricity of Vietnam Southern Power Project Management Board Long An 220kV Substation - RAP Resettlement Action Plan CHAPTER 10 MONITORING AND EVALUATION RAP shall be constantly supervised and monitored by SPPMB in cooperation with local People's Committees. The WB OP 4.12 on Involuntary Resettlement recommends that independent activities are carried out. An independent monitoring agency will be entrusted with external monitoring tasks. The interested institutions have to submit their technical and financial proposals to PMB for review and then to WB for its concurrence. The chosen independent monitoring institution shall be contracted by the PMB immediately after RAP approval and shall begin supervision and monitoring activities from the beginning of the implementation phase. Terms of Reference for independent monitoring will be prepared by PMB and then submit to WB for its concurrence INTERNAL MONITORING Internal supervision and monitoring include: a) Monitoring the investigation of population and social economy situation and inventorying the DP's damages, status, occupation and living condition and of DP; b) Monitoring whether the implementation of resettlement and compensation tasks are cared out as provided in this RAP; c) Monitoring the availability and quality of replacement land; d) Monitoring the timely and sufficient deployment of resettlement and compensation funds for this RAP; e) Investigate and fairly assess each case of complaint and grievance; f) Internal monitoring agencies will prepare a quarterly report detailing the progress of RAP implementation. Such a report should be made available to appropriate Government authorities, WB and external monitoring agencies EXTERNAL MONITORING Beside evaluation the quarterly reports produced by internal monitors and conduct the same thing of investigation assigned to internal monitoring, the external monitoring agency will be responsible for following activities: a) Review and evaluate the inventoried results and entitlements determination. Check unit costs of compensation applied in RAP, to see if they are still at replacement costs/market prices at the time of RAP implementation and recommend to PMB for adjusting (if necessary); b) Evaluation of socio-economic impacts of this project on the DPs; Power Engineering & Consulting Company No.3 - PECC3 38/39 -'~~~~
