1 BOOKING TERMS AND CONDITIONS These Booking Conditions are valid for Zag Sports Tours departing March 1 st, 2011 through January 30 th, What s typically included on your tour What does the typical tour package include? Packages vary by destination and group, but generally include the following: Round-trip airfare from gateway airport Airline taxes, fuel surcharges, etc at the time of deposit Accommodations according to your tour program Some meals; varies by group and noted in your tour program Games, clinics and training as noted in your tour program Community service as determined by the group Sightseeing tours and excursions as noted in your tour program Airport transfers and transportation between destination cities Select entrance fees and tickets as noted in your tour program A tour liaison or manager available 24 hours a day from when you arrive until you depart. Support from partner offices abroad. All non-optional gratuities If we ever fail to provide you with any of your tours inclusions as noted in your Zag Program, we will promptly refund you its value. Items noted as optional excursions Transportation to free-time activities Surcharges due to changes in currency exchange rate Departure fees, which cover airport and airline fees,certain taxes and fuel surcharges (which are subject to changes beyond Zag Sport s control) Airport departure taxes Expenses caused by airline rescheduling, cancellations or delays caused by the airlines, bad weather or events beyond Zag Sport s Travel, interruption, cancellation insurance Customary gratuities (for your tour director, local guide, other staff and coach driver) Passport and visa fees Athletic Trainer Athletic Equipment or Uniforms Porterage Passports and visas Who is responsible for getting travelers passports and visas? Each traveler must obtain a passport and any applicable visas for his or her tour prior to departure. If a traveler is unable to obtain these travel documents, our typical cancellation policy will apply. Please be sure that passports are valid for at least six months after your tour ends. Non- U.S. citizens will need to contact the embassy or consulate of their destination countries to ensure they meet specific entry requirements. Remember to check your itinerary carefully for all countries that you will visit or pass through, including transfers between airports in foreign countries and re-entry into the United States. Visit the U.S. Department of State at travel.state.gov for further information. Insurance Can I purchase insurance through Zag Sports? We strongly advise all participants to purchase comprehensive travel insurance to protect themselves while on tour and prior to tour. This can be done through partner agencies or online. Please inquire within for further details. Flight information Which airlines does Zag Sports use? Zag Sports reserves seats with major airlines, including Aer Lingus, Air Canada, Air France, Air New Zealand, Alitalia, American, British Airways, Continental, Delta, Iberia, KLM, Lufthansa,Northwest, Qantas, South African Airways, SAS, Swiss,United, US Airways, Virgin Atlantic Airways and other domestic and international carriers. Will we have direct flights? We always do our best to provide the most direct route to your destination city. However, due to available flight routings, we cannot guarantee non-stop or direct flights and must balance cost effectiveness and time. Will my group fly together? Depending on seat availability and the size of the plane, we may not be able to accommodate all members of a group on the same flight. Zag Sports is not responsible for airline schedule changes, or mechanical, weather or capacity related flight delays. Will my group sit together on the plane? Depending on your group s size, you may sit together. It really depends on each airline and the structure of the group contract. You will receive your seating assignments when you check in.

2 Can I earn frequent flier miles? This will vary according to each group and each individual contract. Are there flight restrictions for travelers under 15? Anyone younger than 15 years old traveling apart from the group without an adult companion must pay the airlines Unaccompanied Minor Fee at the airport during check-in. Please contact each airline on the minor s itinerary regarding policies for young travelers. Special Travel Requests Every group contract is a bit different and deviations, upgrades, etc are not guaranteed or always possible. If you feel you may need to deviate from the group, please advise our representatives as soon as is possible. Optional excursions What are optional excursions? Zag Sports offers activities as a supplement to what s already included on your itinerary. Some coaches choose to add optional excursions to all participant accounts. When should I purchase optional excursions? To secure a discounted price, optional excursions need to be purchased 50 days prior to departure. Most optional excursions can be purchased on tour at a slightly higher price (though there are a few that must be purchased prior to departure). Additional details will be sent to participants. Can I get a refund on optional excursions? If Zag Sports has to cancel an optional excursion during a tour (due to low enrollment, for example), you will receive a full refund. To receive a refund for an optional excursion that you simply no longer wish to be enrolled in, you must let us know by 15 days prior to departure. Cancellation will be subject to the specific supplier contracts. Please note that optional excursion prices are subject to change. Rooming Your coach handles final rooming assignments for all travelers. Please ensure that we have all rooming requests 60 days prior to departure. How many athletes are in a room? This will vary by country and destination. Athletes will room in triples or quads with others of the same gender from your entire tour group. Some rooms are similar to US style hotels. These rooms contain two double beds (beds for two people), and two students are expected to share each bed. The rooming and pricing is developed based on maximum occupancy of the hotel rooms as set by the hotel. Anything less than maximum occupancy will require a supplement. How are adults roomed? Adults are placed in twin accommodations (a hotel room with two beds) with another adult of the same gender from your tour group or a specific roommate they may request. They can request a single room at an additional surcharge. What about lost belongings? Zag Sports is not responsible for loss of passports, airline tickets or other documents, or for loss of or damage to luggage or any other passenger belongings. Zag Sports is not responsible for locating lost property, unless the loss is due to Zag Sports negligence. In this case, only shipping costs will be charged to the participant. In rare cases, when Zag Sports must get involved in the physical retrieval and handling of lost property, a non-refundable service fee of $45 plus shipping costs will be charged to the participant. Lost luggage will be donated to charity if it remains unclaimed by one year after departure date. In the case of a lost airline ticket, the participant is solely responsible for meeting the airline s requirements (both logistical and financial) for ticket replacement. Television, Image, and Video Rights: Zag Sports has full television, video and image rights in and to any and all of the programs or events affiliated with the Zag Sports program. Terms and provisions The terms and provisions of these Booking Conditions supersede any other warranties, representations, terms or conditions, unless they are expressly stated within a Booking Conditions Addendum or in a letter signed by an Zag Sports officer. Prices are subject to change. Signing of the contract Contracts and applications are processed on a selection basis. Many tours are invitation only which means we reserve the right to admit or deny desiring participants based on a reasonable standard. Upon agreeing to this contract your commitment becomes a binding contract which is governed by New Jersey and U.S. Law. Responsibilities Zag Sports acts only in the capacity as agent for the owners and contractors providing transportation, hotel, athletic activities or other services. All tour services, tickets, and vouchers are subject to any and all terms and conditions provided by issuer. The acceptance of any service provided as part of the Zag Sports program or of any ticket or voucher, shall be deemed to be acceptance of and consent by the program member to these conditions. All services are subject to the law of the country in which the services are provided. Zag Sports, Inc. cannot be held responsible for events beyond its control, such as acts of God, war(declared or not), terrorist activities, politcal violence, illness/quarantine, currency fluctuations, injuries during itinerary events(however caused) or events caused by persons not controlled by Zag Sports, Inc.(e.g.-employees of airlines, railways, bus companies, hotels, sub-contracted travel agents, tour operators, and other suppliers). Zag Sports, Inc. will not be responsible for

3 lost passports, airline tickets, luggage, or other personal belongings. The participant agrees to hold Zag harmless and indemnify them for any losses, unless Zag Sports is found negligent. Zag Sports, Inc. will assist in all possible ways, but will only be responsible if Zag Sports, Inc. is the negligent party. In most instances Zag Sports, Inc. acts only as an agent for the owners and operators providing transportation, hotels, or other activities and services. Zag Sports, Inc. attempts to provide its participants with all the resources and tools necessary to make the experience financially feasible. Zag Sports, Inc. only acts as an advisor and cannot be held responsible for complaints arising as a result of fundraising. In accepting a Zag Sports, Inc. tour program, participants are subject to conditions of the transportation, hotels, other service providers and laws of the visited country. Pricing Policy The itinerary located in your Zag Program specifically highlights tour inclusion and exclusions. Zag Sports does have the right to change pricing prior to the signing of the commitment contract. Administrators, athletes, and coaches are responsible for understanding the Zag Pricing and Inclusions and Exclusions as they exist at the time of the contract. When does my tour officially start and end? Each tour begins with the take-off from the departure airport, and ends when the flight lands at the return airport. For those making their own flight arrangements, the tour begins upon arrival at the first tour hotel and ends upon departure from the last tour hotel, according to the itinerary. The official length of an Zag Sports tour does not include stay-ahead or stay-behind option periods when participants are not escorted by an tour liaison. Tour/Itinerary Changes Once a participant commits to a Zag Sports, Inc. experience we expect that we will provide you with all items as identified in the itinerary. Often times there are happenings which are out of our control, which force us to exercise our right to make changes accordingly. If changes occur we will make our best effort to substitute experiences of equal value. Changes made in the best interest of the participant and require additional cost will be paid by the participant. The itinerary provided in the Zag Program is just an estimated itinerary and is subject to change until the tour is in process. Cancelling of a Tour Zag Sports, Inc. reserves the right to cancel any tour for events beyond its control, including but not limited to instability in a destination country, acts of God, war (whether declared or undeclared), terrorist activities, incidents of violence, public health issues or quarantine, substantial currency fluctuations, strikes, government restrictions, fire or severe weather conditions which make it impossible or commercially unreasonable in the opinion of Zag Sports to conduct the tour. In the case that a tour is cancelled the participant can; decide to participate in a alternative tour in the current season or the next,adjusting for payment changes, or accept a refund less the costs of cancellation based on supplier contracts, transaction costs, etc. Keep in mind that suppliers have very strict policies for refunds after a certain date. Zag Sports strongly encourages comprehensive travel insurance to protect against unnecessary cancellation. Cancellation for country instability will be based on U.S. State Department travel warnings. In such cases, alternative tour options will be provided, but tour monies will only be refunded according to the cancellation policies of suppliers. Cancellations because of events beyond our control, such as acts of God(ie. weather), war(declared or not), terrorist activities, politcal violence, illness/quarantine are subject to the cancellation policies of supplying airlines, hotels, buses, tour operators, etc. Zag Sports strongly encourages comprehensive travel insurance to protect against unnecessary cancellation. Games, Clinics, Other Athletically Related Activities All games, clinics, or other athletically related activities are amateur in nature. Because of the nature of amateur sports; game times, schedule, etc can change according to the needs of the participating local team or coach. In some instances, because of events out of Zag Sports control, participating teams can cancel their intention to participate. In the unusual instance that this happens, Zag Sports will do all it can to arrange substitute games, clinics, or athletically related activities. Behavior Participants must behave according to local laws and what is deemed reasonable behavior according to the behavior expectations of the participants institutions and Zag Sports. Zag Sports reserves the right to terminate the program of any participant who behaves in a fashion that is below reasonable standards. Participants will be responsible for any additional costs related to their early departure and will not be refunded for any services that they have not received from the time of their termination in the program and the scheduled departure.

4 Participant Waiver and Release 1. Upon agreeing to this contract, a deposit noted in your Zag Program will be due according to the dates noted. By signing this agreement you confirm that you agree to the booking terms outlined in this document. Payment can come in the form of a check made to Zag Sports, Inc. or by Credit Card which is subject to a 3% surcharge. Once directed to the credit card services, Zag Sports, Inc is not responsible for any security or other issues as it relates to the credit card service. Part or all of the deposit is non-refundable and is necessary to cover initial processing services at Zag Sports, Inc.. Our payment dates and terms as designated in the Zag Program provided to you by Zag Sports, Inc. and are binding and penalties will be incurred for missed due dates. In the case that the participant is forced to cancel their commitment, refunds will be processed according to the following timeline and conditions. The cancellation policies outlined below take into consideration the costs Zag Sports incurs long before groups ever depart. Notice of cancellation from a Zag Sports tour will only be accepted from the team, participant or his or her legal guardian, his or her coach, or group leader. The date of cancellation will be determined by the date on which Zag Sports receives written notice. Cancellation refunds can only be made to the person whose name appears on the account; monies cannot be transferred to another account. Zag Sports Standard Cancellation Policy(unless specifically noted in the Zag Program as different, at which point the Zag Program is the correct cancellation policy) 120 days or more prior to departure: Full refund less the non-refundable 50usd processing fee. 119 to 99 days prior to departure: Full refund less 300usd deposit and processing fee. 98 days to 60 days prior to departure: Full refund less 300usd deposit and processing fee plus 800usd penalty. 60 days or less prior to departure: No refund. The request to cancel can be sent to: Zag Sports, Inc. 800 Denow Road Suite C #373 Pennington, NJ 0834 All refunds, regardless of when the cancellation takes place, will be made within days of the completion of the tour. Cancellations because of events beyond our control, such as acts of God(ie. weather), war(declared or not), terrorist activities, politcal violence, illness/quarantine are subject to the cancellation policies of supplying airlines, hotels, buses, tour operators, etc. Because of this cancellation insurance is strongly encouraged. 2. I understand that our tour begins with the takeoff from the tour departure airport and ends upon completion of the flight back to the tour airport. 3. I understand that my airline tickets are non-refundable & non-transferable. Group contracts limit the number of deviations, if any. Any itinerary changes made on the part of the participant will incur a change fee and other restrictions according to the participating airline s policies and restrictions. A legal and correct spelling must be submitted in a timely fashion according to the request of Zag Sports, Inc. and must match that of the participant s passport. Name changes will also incur a charge according to the policies of the participating airline. 4. I understand that the air carrier s liability for loss of or damage to baggage or property, or for death or injury to person, is limited by their tariffs, or the Warsaw Convention, or both. 5. I understand it is the responsibility of the participant to verify with an authorized medical professional if medication or vaccinations are required to enter a touring country and it will be the responsibility of the participant to ensure that they have the necessary medical documentation. It is the responsibility of the participant to consult a medical professional or physician to make sure they have vaccinations appropriate for their personal circumstance. Participants are expected to consult a physician or other medical professional to ensure they are in good medical standing and health prior to the trip. 6. I understand it is the responsibility of the participant, their family, and coach to make sure they understand and are caught up on current issues as it relates to the nation they are traveling. I confirm that I have reviewed the state departments website at and its consular information sheets which are updated regularly regarding preparation for your country. 7. I understand that participants will have the option to purchase travel insurance which is available for medical or travel emergencies while traveling. Participants are responsible for investigating the best travel cancellation and medical insurance options for them. 8. I understand that participants are expected to behave in a fashion that is of reasonable standard and reflects well on Zag Sports, Inc., other participants, and their educational institution. Zag Sports has the right to decline or send home individuals who in the opinion of the participants, service provider, coach or educational institution representative, and employees is likely to damage or cause distress to other people or property. In this case, Zag Sports will not be responsible for any expenses incurred as a result of a participant being sent home. 9. I understand that optional activities(site-seeing,adventure,transportation,meals,etc.) will be paid by the participant and Zag Sports, Inc. accepts no responsibility for the these activities or expenses related to them. 10. I understand that participants will be responsible for any damage to property, people, or services while on tour. All costs associated with the damaging activity will be the responsibility of the participant. The participant agrees to hold Zag Sports

5 harmless and indemnify them for any losses, unless Zag Sports is found negligent. 11. I understand that we must take care of rooming assignments for the students and other tour participants. Special requests must be submitted 45 days prior to departure. In the case that appropriate rooming assignments have not be provided, Zag Sports reserves the right to do so in their best judgment. 12. I understand that if there is a case while on tour that accommodation or service are not satisfactory it is important to inform your tour leader, coach, Zag representative, or supplier of the service immediately so Zag Sports can make the appropriate adjustments promptly. If you find that the response of the touring leaders or suppliers is not satisfactory you must call Zag Sports, Inc. headquarters using the emergency number supplied to you prior to departure. If the complaint cannot be taken care of on the spot then a written complaint must be submitted within 30 days of the return. We cannot accept any liability for complaints or claims that are not notified according to the above clause. 13. I understand and agree that Zag Sports shall have no liability or responsibility for the participants when I am absent from Zag Sports-supervised activities or for non-zag Sports supervised activities, such as visits to friends or relatives or during stayahead/stay-behind option periods if the stay-ahead/stay-behind period does not include the services of a tour liaison. 14. I understand and agree that Zag Sports reserves the right to refuse or cancel my registration at their sole discretion. Group leaders may also refuse or cancel any participant s registration. In such event, cancellation policies and guidelines as outlined in the Zag Program apply. 15. I agree to abide by all local laws when abroad, including those concerning drugs and alcohol. (Minors must have parents' permission to use alcohol even if the local law would otherwise permit them to.) I understand that if any participant abuses or disobeys such laws, even unintentionally, they waive the right to a refund of any part of the Program Fee, and Zag Sports may send the participant home at my own expense. We also understand that should local authorities be involved, the participant will be subject to the laws of the country we are visiting. 16. I understand and agree that if a participant becomes ill or incapacitated, Zag Sports and suppliers, may take any action they deem necessary for my safety and well-being, including securing medical treatment (at my own expense) and transporting me home. I have advised Zag Sports in writing of all medical conditions, food allergies, or other issues that may have been of critical importance for this experience. 17. I understand and agree that Zag Sports has the right to make changes in tour itineraries and departure dates which are in the best interest of the program. This includes adjusting athletically related activities, meals, sightseeing activities, and other activities up until departure or while on tour; including modifying transportation arrangements, including the use of substitute airlines. In the event of such changes, refunds will be given only in accordance with the provisions of the Booking Conditions supplied herewith. 18. I understand that it is my responsibility to secure the necessary travel documents (passport and visa[s]) unless specifically arranged for the group by Zag Sports. Failure to do so does not constitute grounds for a refund except according to the guidelines as outlined in the Zag Program. 19. I understand that we will be required to pay for any phone calls or incidental personal expenses that we incur at hotels, as well as for any damage we cause to hotel rooms, buses or other property. 20. I understand that this tour has been designed for student athletes, as reflected in the pacing,educational content, accommodations and other aspects of the tour. I also understand that this program consists of intensive athletic training and understand the risks inherent in competing in athletic events. 21. I understand and consent that Zag Sports may use any film likenesses taken of me and any of my comments while on an Zag Sports tour for future publicity and also use my contact information for future Zag Sports promotions in accordance with appropriate NCAA rules and regulations. 22. I understand and agree that this agreement and Zag Sport s Booking Conditions constitute the entire agreement between Zag Sports and me with reference to the subject matter herein, and I do not rely upon any promises, inducements or agreements not herein, including but not limited to any oral statements made to me by any agents or employees of Zag Sports, or by the school or coach. This agreement may be amended or modified only in writing, signed by both parties. The waiver by Zag Sports of any provision of this Agreement shall in no way affect the remaining provisions of this Agreement, and this Agreement shall be interpreted as if such clause or provision were not contained herein. 23. I understand and agree that this agreement shall be governed in all respects, and performance hereunder shall be judged, by the laws of the state of New Jersey. In the event of any claim, dispute or proceeding arising out of my relationship with Zag Sports, or any claim which in contract, tort, or otherwise at law or in equity arises between the Released Parties, whether or not related to this agreement, the parties submit and consent to the exclusive jurisdiction and venue of the courts of the State of New Jersey. 24. I understand that Zag Sports acts only in the capacity as agent for the owners and contractors providing transportation, hotel, athletic activities or other services. All tour services, tickets, and vouchers are subject to any and all terms and conditions provided by issuer. The acceptance of any service provided as part of the Zag Sports program or of any ticket or voucher, shall be deemed to be acceptance of and consent by the program member to these conditions. All services are subject to the law of the country in which the services are provided. We agree to release, indemnify and hold harmless Zag Sports and its affiliates (which term shall include parents, subsidiaries, officers, directors, shareholders, suppliers, agents and employees of Zag Sports as well as Zag Sports itself) and our club, our school, our school board, or other administration and coach/group leader (the Released Parties ) from, and agree not to sue the Released Parties for, any and all claims, demands, actions, lawsuits, settlements,

6 judgements, damages, costs and expenses of any nature whatsoever (including attorneys fees) on account of or arising out of any and all personal injury, death, bodily injury, mental anguish, emotional distress, physical, property or other damage that I may suffer from any cause whatsoever related in any way to my participation in any Zag Sports tour. We further agree to release, indemnify and hold harmless the Released Parties from any and all acts of God, war (whether declared or undeclared), terrorist activities, instability in a destination country, incidents of violence, public health issues or quarantine, substantial currency fluctuations, strikes, government restrictions, fire or severe weather conditions which make it impossible or commercially unreasonable in the opinion of Zag Sports to conduct the tour, or the acts or omissions of any other agents over which the Released Parties have no direct or indirect control, including, without limitation, airlines, railways, bus companies, hotels, shipping companies, guides, and sub-contracted agents or tour operators. I understand and have read all of the above, including; the tour program pricing, inclusions and exclusions, the booking conditions and terms and the waiver. I also understand the inherent risks of athletic participation and travel abroad and have considered all risks carefully and agree to the terms here and above. I agree to all financial terms and the related booking and terms noted above and in the Tour Program. Please print, sign, date and mail in this document. 7 MEDICAL RELEASE We the Parents of, give approval for our son/daughter to participate in this international sports program. As parents we give representatives of Zag Sports and its partners the permission to obtain medical attention if the situation requires. I have advised Zag Sports in writing of all medical conditions, allergies, or medications I am on that may have be of critical importance for this experience. Please Sign: Parent/Guardian (if under 18) Date Student-Athlete Date TRAVEL INSURANCE WAIVER This waiver is to confirm that you understand that unforeseen health and related problems can occur before, and while traveling, which may make it necessary for you to cancel your participation on a Zag Sports experience and risk losing tour payments or incurring additional costs while on tour. In addition trips can be cancelled b/c of weather, unrest in the countries, etc. all of which may be covered by cancellation insurance. Please ask about travel insurance provided through Zag Sports. Other insurance is available through the internet. From our years of experience, trip cancellation and trip interruption insurance coverage, has proven worthy in protecting the interests of the player and family. It is also advisable to purchase travel insurance with medical coverage, in the case that there is injury, sickness, or other. I DO NOT intend to purchase travel insurance. I WILL purchase travel insurance. 8 Zag Sports Code of Conduct I realize that while participating in the this cultural sports program I am representing my university, club, or high school, country, my community, my school and my family. I will therefore strive to conduct myself in a manner appropriate to being a good ambassador. I understand and accept the Code of Conduct and Consequences below and pledge myself to honor it. While Traveling with Zag Sports and my team: 1. I will follow all code of conduct and rules implemented by my team, school, and coach. 2. I will cooperate with my tour leader, coaches, and honor rules that he/she set for me and my team. 3. I will dress and act appropriately at all times and be sensitive to the impression I am conveying in a culture other than my own; I will refrain from any tattoo or body piercing while on tour. 4. I will not use alcohol, tobacco or drugs; I will not accept, buy, or transport any of these 5. For my own safety, I agree not to operate any motorized vehicle or be a passenger on any motorcycle. 6. I will behave in a fashion which best represents myself, team, Zag Sports, and all other parties. CONSEQUENCES **Note: The head coach or tour manager may skip a step if deemed necessary.** Step 1 Step 2 Step 3 Discussion between coach, tour manager, and athlete to determine reason of offense and to ensure future respect of rules. Disciplinary action will be discussed and implemented as decided by the coach. If determined necessary by the head coach and tour manager, parents will be called and a warning will be given to student that next offense will result in a trip home at parents expense. Parents will be informed of coach s or tour manager s disciplinary decisions and are expected to pursue the issue upon student s return. If determined necessary by the head coach and tour manager, parents will be called and athlete will be sent home at athlete or parent s expense. Date Student s signature If athletes is under 18. We accept the Code of Conduct and Consequences as a program requirement and agree that violations of it may result in termination of participation in the program. In such case the parents agree to bear the cost of all expenses related to their son s/daughter s return to the USA and forfeit all program monies paid. Date Parent s signature
