1 All bookings are made with Wonderment. By booking a trip with Wonderment, Client is deemed to have agreed to these Terms and Conditions (which constitutes the entire agreement between Client and Wonderment) and Client booking will be accepted by Wonderment on this basis. The services to be provided are those referred to in Client booking confirmation invoice. 1. Reservation To confirm a reservation for a Wondement travel programs (known as a Journey ), a nonrefundable deposit of $500 per Client is required. This may be paid on the website with a Visa, MasterCard, Discover, American Express or with a personal check. If payment is made by personal check, this check must clear the bank at least 65 days before the Journey start date. 2. Confirmation After Wonderment receives Client reservation and deposit, Wonderment will confirm Client space in Journey and send a confirmation containing invoice, trip itinerary, any visa/travel permit related documents, general information on destination(s), and additional legal forms for Client to sign and return to Wondement. 3. Payments Sixty (60) days prior to departure, 100% of the remaining balance for the Journey is due by Client. At this time, all travel funds are non-refundable. If a reservation is made within 60 days of the Journey, a full payment is required. If this balance is not paid on or before the required payment due date, Wonderment reserves the right to treat Client booking as cancelled. All deposits and monies received up to this date will not be refunded. Payment of Client deposit represents Client acceptance of the following terms and conditions, as well as all general information listed online at Wonderment shall not be liable and does not assume responsibility for any claims, damages, expenses or other financial loss whether to person or property arising out of any injury, accident, death, cancellation, delay, alteration, or inconvenience resulting from any act of omission, commission or inadvertence of any housing accommodation, carrier, restaurant or other company or person rendering any of the services included in the tour or its pre and post tour arrangements, or caused by weather, sickness, strikes, quarantines or the willful or negligent acts of any other tour members or any cause whatsoever beyond the control of Wonderment. 4. Currency Wonderment sells its Journeys in United States Dollars (USD). 5. Cancellations & Refunds Should Client need to cancel a Journey, Wonderment must be notified in writing. If Client cancels Journey, refunds of the total package price will be subject to the following schedule:

2 All deposits: non-refundable Cancellations over 120 days prior to departure: 100% costs refunded Cancellations prior to departure: 75% trip costs refunded Cancellations days or more prior to departure: 50% trip costs refunded Cancellations 0-60 days prior to departure: 0% trip costs refunded Wonderment will not grant partial refunds for any unused trip arrangements and services, such as voluntarily missed meals, excursions, transport, or etc. after the trip has commenced, or any refunds to Client who do not complete any portion of the Journey for whatever reason. If Client fails to join a Journey, join it after departure, or leave it prior to its completion, no refund will be made. 6. Wonderment Cancellation & Substitutions Wonderment reserves the right to cancel a Journey prior to event due to the minimum customer number not being reached. In such instances, Wonderment will refund all payments received within 30 days after cancellation. Wonderment may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events if it is not viable for Wonderment on to operate the planned Journey. If Wonderment cancels a Journey, Client may choose between applying the amounts paid toward an alternative Journey or receiving a full refund. In circumstances where the cancellation is due to external events outside Wonderment s reasonable control, refunds will be less any unrecoverable costs. Client will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses, or damage (either direct or consequential), or for any loss of time or inconvenience which may result from such cancellation including but not limited to visa, passport, vaccinations, or non-refundable airfare. Wonderment reserves the right to make any necessary changes to Journey or cancel any Journey for unforeseen circumstances that are hazardous or dangerous, or for any other adverse or threatening conditions whether political, military, terrorist or otherwise or if an act or omission of a third party prevents the Journey or an aspect of the Journey from being undertaken in accordance with Client booking or for any other reason considered necessary. In such instances, Wonderment will make all efforts to transfer any payments made to a future Journey. If this is not possible, travel protection may compensate Client depending on the circumstances. If unforeseen circumstances occur, Wonderment will make every effort to select alternative housing accommodations, transportation, and excursions of the same standard, and to keep modifications to a minimum. Wonderment also reserves the right to cancel any Journey due to any government travel warning or advice, or any change in such warning or advice with absolute discretion. Journey are run by Wonderment group leaders. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. If Client fails to comply with a decision made by a group leader, or interfere with the well-being of the group, the group leader may order Client to leave the trip immediately, with no right of refund.

3 Client must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited. Certain activities are operated by local tour operators contracted with Wonderment. These operators have been selected for the quality of the services and tours they offer as well as the desirability of the destinations. 7. Journey Inclusions The total cost of Client Journey includes: all accommodations as listed in the itinerary (based on double occupancy); all transportation listed in the itinerary; meals as listed in the itinerary; all park entry fees (unless noted); excursions listed in the itinerary; experienced tour guides; all fitness and yoga classes; taxes and gratuities for hotels, meals, restaurants, and tour guides. 8. Journey Exclusions The total cost of Client Journey excludes: international or internal flights unless specified; meals other than those specified in the itinerary; visa and passport fees; travel insurance unless specified; non-scheduled optional activities and sightseeing, and all personal expenses (such as alcohol and shopping purchases). 9. Client & Health Requirements Client assumes responsibility to select a Journey most appropriate for his/her physical abilities and may be required to obtain a physician's release. Wonderment reserves the right to refuse the application of anyone and/or expel any Client whose conduct is incompatible with the interest and well-being of other Clients. Any costs associated with removal will be borne by the Client. In order for Wonderment to confirm Client travel arrangements, Client must provide all requested details with the final balance of the Journey price. Necessary details vary by Journey but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date, and any pre-existing medical conditions. Failure to provide such information to Wonderment provides the right to treat the Journey as cancelled, and applicable cancellation penalties apply. Client must be in good physical and mental health to participate in a Wonderment Journey. These Journeys take place in isolated or remote areas where access to medical facilities is limited. If medical expenses are incurred as a result of injury or illness, Client will be responsible for the charges. Consult Client travel insurance policy for details on available protection for the medical/travel expenses and evacuation expenses. Wonderment reserves the right to challenge any Client information submitted, ask for further information or clarity on certain points, or reasonably reject or rescind a Client s booking based on the medical information presented. In the event the Client has made a Journey booking with Wonderment and subsequently is unable to complete the required medical form for any reason

4 by the dates specified in the contract, Wonderment reserves the right to treat the booking as cancelled, and applicable cancellation penalties apply. The Client understands the honest completion of the Medical Information and Release Form will assist all concerned in an emergency situation. In the event there is a dispute between Wonderment and the Client in regard to the Client s physical or mental suitability for a Journey, the matter will be referred to a medical professional at the Client s expense. Wonderment must be notified in writing at the time of booking of any medical conditions, pregnancy, physically or mentally challenged conditions or disabilities which may affect fitness to travel. Wonderment shall not be held liable for the Client s failure to notify Wonderment of any such conditions, and the Client assumes all risk for failure to disclose all aforementioned medical conditions. The Client s failure to notify Wonderment of such conditions may result in the client being refused travel, in the case, that results in cancellation, 100% of the cancellation fees are the responsibility of the Client. Some Journeys may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client s responsibility to check prior to booking. Wonderment may refuse to carry pregnant women over 24 weeks or Clients with certain mental or physical conditions. Wonderment is not required to provide any special facilities unless it has been agreed to do so in writing. Wonderment will do its best to meet Clients special requests including dietary, but such requests do not form part of the Terms and Conditions, therefore the Wonderment is not liable for failing to provide these requests. 10. Passport & Visas Client must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which Client will visit during Client trip. Client passport must be valid for 6 months beyond the duration of the trip. It is Client responsibility to ensure that he/she is in possession of the correct visas, permits and certificates for the Journey. Wonderment is not responsible if Client is refused entry to a country because Client lacks the correct passport, visa or other travel documentation. 11. Travel Insurance Travel insurance is compulsory for all Wonderment Clients and purchased at the time of booking. At a minimum, Client travel insurance must provide cover against personal accident, death, medical expenses, emergency repatriation, and evacuation expenses, with a minimum coverage of $200,000. Wondement strongly recommends travel policy to also cover cancellation, curtailment, and loss of luggage and personal effects and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client. Client must provide proof of the travel insurance purchase with listed in-said amount to Wonderment representative at time of final payment for Journey. 12. Acceptance of Risk Client acknowledge that the nature of the Journey is adventurous and participation involves a degree of personal risk. Client will be visiting places where the political, cultural, and geographical attributes presents danger and physical challenges greater than those present in

5 daily lives. Wonderment uses information from government foreign departments in assessing whether the itinerary should operate. It is the Client s responsibility to acquaint himself/herself with all possible relevant travel information and the nature of Journey itinerary. Client acknowledges the decision to travel is made in light of consideration of this information and Client accepts the assumption of personal risks, danger, and challenges associated upon such travel. Client is solely responsible for acquainting himself/herself with customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary. Client is encouraged to locate or make contact for local embassy or consulate in each country visited, prior to Journey. 13. Force Majeure & Special Circumstances Wonderment shall not be liable in any way to the Client for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for Wonderment s failure to commence, perform and/or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by a Force Majeure event. Wonderment shall not be responsible to Client for delay or failure in performance of any the obligations imposed under this agreement provided such failure shall be occasioned by fire, extreme weather, acts of war or terrorism, government or political action, civil commotion, labor disturbances, transportation difficulties, an Act of God, or acts or omissions of a third party or for any other cause whatsoever outside Wonderment s reasonable control. Wonderment will be under no liability whatsoever to Client and may, at its option, by written notice to Client either cancel the Journey or take any other action as specified in section 5 (Cancellations & Refunds). 14. Limitation of Liability Wonderment contracts with a network of tour companies, government agencies, and individuals to assist in the running of our Journey s as agents for these third parties. Wonderment is not responsible for the acts and omissions of these third parties. 15. Optional Activities Optional activities not included in the trip price do not form part of the Journey or this contract. Client accepts that any assistance given by group leader or contracted local tour representative in arranging optional activities does not render Wonderment liable for them. 16. Errors & Omissions Wonderment has made a concerted attempt to verify the accuracy of statements made in Journey documentation including brochure, website or travel documents. Wonderment cannot be held responsible for any error, omission or unintentional misrepresentation that may occur. 17. Claims & Complaints

6 If Client has a complaint about a Journey, the Client must alert Wonderment s group leader right away so that an attempt can be made to rectify the matter. If satisfaction is still not reached through these means, then any further complaint must be put in writing to Wonderment via at info@wondermentltd.com no later than seven days after the final day of the Client s journey. Wonderment will not accept any liability for claims received after this period. Failure to indicate dissatisfaction while on the Journey may bar or reduce the Client s ability to claim compensation from Wonderment. 18. Photos/Videos Permission Wonderment reserves the right and Client agrees to allow Wonderment to take audio, videos, or photographic images of any Journeys and Client and may use any such records for promotional and/or commercial purposes. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed by Wonderment. 19. Severability In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding. 20. Applicable Law The laws of the United States of America govern these Terms and Conditions and any disputes in connection with a Journey or these Terms and Conditions must be initiated in the Supreme Wake County courts of North Carolina. 21. Privacy Policy Any personal information that Wonderment collects about Client may be used for any purpose associated with the operation of a Journey or to send Client marketing material in relation to our events and special offers. The information may be disclosed to our employees, service providers or other suppliers necessary to enable us to operate the Journey. Wonderment will otherwise treat Client details in accordance with our privacy policy and protect personal information. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions can always be found on the website and will be the terms referred to in any dispute.
