Sectin 302 f the Act, which authrizes direct access t the Federal Parent Lcatr Service (FPLS), is belw. Sectin 302. Child Supprt Enfrcement Prgrams fr Indian Tribes. a. Tribal Access t the FPLS. The law amends sectin 453(c)(1) f the Act t add an agent r attrney f an Indian tribe r tribal rganizatin [as defined in subsectins (e) and (l) f sectin 4 f the Indian Self-Determinatin and Educatin Assistance Act (25 U.S.C. 450b)] as an additinal authrized persn that the FPLS may prvide infrmatin fr the purpse f establishing parentage r establishing, setting the amunt f, mdifying, r enfrcing child supprt bligatins. b. Waiver Authrity fr Indian Tribes r Tribal Organizatins Operating Child Supprt Enfrcement Prgrams. The law amends sectin 1115(b) f the Act t prvide that an Indian tribe r tribal rganizatin perating a IV-D prgram shall be cnsidered a state fr purpses f authrity t cnduct an experimental, pilt, r demnstratin prject. The Secretary may waive cmpliance with any requirements r regulatins t the extent and fr the perid the Secretary finds necessary fr an Indian tribe r tribal rganizatin t carry ut such prject. Csts f the prject that wuld nt therwise be included as 2

3 expenditures f a prgram shall, t the extent and fr the perid prescribed by the Secretary, be regarded as expenditures under a tribal plan r plans apprved under such sectin r fr the administratin f such tribal plan r plans as may be apprpriate. A start-up prgram is nt eligible fr this prgram. On Octber 16, 2014, OCSE hsted a Tribal IV-D Directrs call t discuss Sectin 302. During that call, OCSE described FPLS access t the Natinal Directry f New Hires (NDNH), Federal Case Registry (FCR), External lcates, Multistate Financial Institutin Data Match (MSFIDM) and Insurance Match (IM). On January 14, 2015, OCSE sent an message t the Tribal IV-D Directr s listserv t infrm directrs that OCSE was cnducting an analysis f tribal access t key FPLS functins including the NDNH, FCR, External lcates, Department f Defense (DOD) Entitlements, and Emplyer Search, using the federal Child Supprt prtal. OCSE can prvide access t these functins via the internet withut tribal cases being registered n the FCR r debtrs being submitted fr MSFIDM and IM. During cnsultatin OCSE wants t discuss and gather infrmatin abut the implicatins and respnsibilities f FPLS access. Discussin Tpics: What FPLS access means Requirements and design 3
